Minutes of the Open sessions of the North Carolina Medical Board Meeting held July 15-17, 2009. The July 15-19, 2009, meeting of the North Carolina Medical Board was held at the Board's Office, 1203 Front Street, Raleigh, NC 27609. The meeting was called to order at 8:00 a.m., Wednesday, July 15, 2009, by George L. Saunders, III, MD, President. Board members in attendance were: Janelle A. Rhyne, MD, Past President; Donald E. Jablonski, DO, President-Elect; Janice E. Huff, MD, Secretary/Treasurer; Ms. Pamela Blizzard; Thomas R. Hill, MD; Ms. Thelma Lennon; John B. Lewis, Jr., LLB; Peggy R. Robinson, PA-C; William A. Walker, MD; Paul S. Camnitz, MD and William W. Foster, MD. Also attending were R. David Henderson, Executive Director and Thom Mansfield, Board Attorney.

Presidential Remarks

Dr. Saunders commenced the meeting by reading from the State Government Ethics Act, “Ethics Awareness and Conflict of Interest Reminder.” No conflicts were reported. Dr. Saunders asked if there would be any absences at the September Board Meeting. Dr. Huff responded that she would not be able to attend that meeting. Dr. Saunders reported to the Board that a new committee on Diversity in the Workforce has been put in place. Dr. Huff and Ms. Lennon were appointed to this committee. Executive Director’s Announcements Mr. Henderson reminded all the Board Members that they would be participating in an Ethics Training session on Thursday afternoon. Mr. Curt Ellis, Director of Investigations, gave a presentation to the Board on the Certified Medical Board Investigator (CMBI) program. This is a rigorous program available to medical board investigators and is jointly sponsored by AIM and the FSMB. All of the NCMB investigators have completed this program.

Minute Approval Motion: A motion passed that the May 20, 2009 Board Minutes and the June 16, 2009 Emergency Board Minutes are approved as presented. ATTORNEY'S REPORT A motion passed to close the session pursuant to Section 143-318.11(a) of the North Carolina General Statutes to prevent the disclosure of information that is confidential pursuant to Sections 90-8, 90-14, 90-16, 90-21.22 of the North Carolina General Statutes and not considered a public record within the meaning of Chapter 132 of the General Statutes and/or to preserve attorney/client privilege.

The following definitions apply to this Subchapter: (1) “Board" means the North Carolina Medical Board. (2) “Examination" means the Physician Assistant National Certifying Examination. (3) “Family member” means a spouse, parent, grandparent, child, grandchild, sibling,

aunt, uncle or first cousin, or persons to the same degree by marriage. (4) "Physician Assistant" means a person licensed by the Board under the provisions

of G.S. 90-9.3. (5) "Physician Assistant License" means approval for the physician assistant to

perform medical acts, tasks, or functions under North Carolina law. (6) “Physician Assistant Educational Program” is the educational program set out in

G.S. 90-9.3(a) (1). (7) "License Renewal" means paying the annual fee and providing the information

requested by the Board as outlined in this Subchapter. (8) "Supervising" means overseeing the activities of, and accepting the responsibility

for, the medical services rendered by a physician assistant. (9) "Supervisory Arrangement" is the written statement that describes the medical

acts, tasks and functions delegated to the physician assistant by the primary supervising physician appropriate to the physician assistant's education, qualification, training, skill and competence.

(10) "Supervising Physician" means a physician who is licensed by the Board and who is not prohibited by the Board from supervising physician assistants. The physician may serve as a primary supervising physician or as a back-up supervising physician. (a) "Primary Supervising Physician" is the physician who accepts full

responsibility for the physician assistant's medical activities and professional conduct at all times, whether the physician personally is providing supervision or the supervision is being provided by a Back-up Supervising Physician. The Primary Supervising Physician shall assure the Board that the physician assistant is qualified by education, training and competence to perform all medical acts required of the physician assistant and is responsible for the physician assistant's performance in the particular field or fields in which the physician assistant is expected to perform medical acts.

(b) "Back-up Supervising Physician" means the physician who is responsible for supervision of the physician assistant's activities in the absence of the Primary Supervising Physician and while actively supervising the physician assistant.

(11) "Volunteer practice" means performance of medical acts, tasks, or functions without expectation of any form of payment or compensation.

21 NCAC 32S .0202 QUALIFICATIONS AND REQUIREMENTS FOR LICENSE

(a) Except as otherwise provided in this subchapter, an individual must obtain a license from the Board before practicing as a physician assistant. The Board may grant a physician assistant license to an applicant who:

(1) submits a completed application to the Board; (2) meets the requirements set forth in G.S. 90-9.3 and has not committed any of the

acts listed in 90-14; (3) submits to the Board proof that the applicant has completed an accredited

Physician Assistant Educational Program; if a physician assistant was licensed in North Carolina after June 1, 1994, he/she must also show successful completion of the Physician Assistant National Certifying Examination;

(4) pays to the Board a non-refundable fee of $200 plus the cost of a criminal background check. There is no fee to apply for a physician assistant limited volunteer license;

(5) submits National Practitioner Data Bank (NPDB) and Healthcare Integrity and Protection Data Bank (HIPDB) reports. These reports must be requested by the Applicant and submitted to the Board within 60 days of the request.

(6) submits a Board Action Data Bank Inquiry from the Federation of State Medical Boards (FSMB), This report must be requested by the Applicant and submitted to the Board within 60 days of the request.

(7) submits to the Board two complete original fingerprint record cards, on fingerprint record cards supplied by the Board;

(8) submits to the Board a signed consent form allowing a search of local, state, and national files to disclose any criminal record;

(9) discloses whether he/she has ever been suspended from, placed on academic probation, expelled or required to resign from any school, including a PA educational program;

(10) attests that he/she has no license, certificate, or registration as a physician assistant currently under discipline, revocation, suspension or probation or any other adverse action resulting from a health care licensing board;

(11) certifies that he or she is mentally and physically able to safely practice as a physician assistant and is of good moral character;

(12) provides the Board with three original recommendation forms dated within 6 months of the application. These recommendations shall come from persons under whom the applicant has worked or trained who are familiar with the applicant’s academic competence or clinical skills. At least one reference form must be from a physician and two reference forms must be from peers under whom the applicant has worked or trained. References must be able to evaluate the applicant’s academic competence, clinical skills and character as a physician assistant. References cannot be from any family member or in the case of new graduate applicants, references cannot be from fellow students of the applicant’s Educational Program

(13) if two years or more have passed since graduation from a Physician Assistant Educational Program, documents that he/she has successfully completed at least 100 hours of continuing medical education (CME) during the preceding two years, at least 40 hours of which must be American Academy of Physician Assistants Category I CME; and

(14) supplies any other information the Board deems necessary to evaluate the applicant's qualifications.

(b) An applicant may be required to appear in person for an interview with the Board. 21 NCAC 32S .0203 MANDATORY NOTIFICATION OF INTENT TO PRACTICE (a) Prior to the performance of any medical acts, tasks, or functions under the supervision of a primary supervising physician, a physician assistant shall submit notification of such intent using the Board’s Intent to Practice form located on the Board’s website. The notification of intent to practice shall include:

(1) the name, practice addresses, and telephone number of the physician assistant; and

(2) the name, practice addresses, and telephone number of the primary supervising physician(s).

(b) The physician assistant shall not commence practice until he/she receives acknowledgment from the Board that the Board has received and processed the Intent to Practice Form. By checking the Board’s website, the physician assistant can confirm that the primary supervising physician has been added to the physician assistant’s personal information page on the Board’s website. (c) The physician assistant shall notify the Board of any changes to the information required in Paragraph (a) of this Rule within 15 days of the occurrence. 21 NCAC 32S .0204 ANNUAL RENEWAL

(a) A physician assistant shall renew his/her license each year no later than 30 days after his/her birthday by:

(1) completing the Board's renewal form; and (2) submitting a nonrefundable fee of $120.00, except that a physician assistant who renews not later than 30 days after his/her birthday shall pay an annual renewal fee of $100.00;

(b) If a physician assistant fails to renew his/her license, the Board shall send a certified notice, return receipt requested . If the physician assistant does not renew his/her license within 30 days of the date of the mailing of that notice, his/her license automatically becomes inactive. 21 NCAC 32S .0205 INACTIVE LICENSE STATUS By notifying the board in writing, a physician assistant may elect to place his/ her license on inactive status. A physician assistant with an inactive license shall not practice as a physician assistant. A physician assistant who engages in practice while his/ her license is inactive is practicing without a license and is subject to discipline by the Board as well as criminal penalties. 21 NCAC 32S.0206 LICENSE REACTIVATION (a) A physician assistant may apply to reactivate his/her license if: (1) he/she had a license in North Carolina; (2) the license was placed on inactive status within the past calendar year; and

(3) the licensee did not become inactive as a result of disciplinary action or to avoid disciplinary action.

(b) A physician assistant requesting reactivation shall: (1) complete the board’s reactivation application;

(2) pay to the board a nonrefundable fee of $120, plus the cost of a criminal background check; (3) submit to the board two completed original fingerprint record cards, on fingerprint record cards provided by the Board; (4) submit to the board a completed signed and dated original Authority for Release of Information Form allowing a search of local, state, and national files to disclose any criminal record; (5) submit National Practitioner Data Bank (NPDB) and Healthcare Integrity and Protection Data Bank (HIPDB) reports, dated within 60 days of their submission to the board; (6) submit a board action data bank inquiry from the Federation of State Medical Boards (FSMB), dated within 60 days of its submission to the board; (7) provide documentation to the board verifying completion of 100 hours of continuing medical education during the preceding two years; and (8) supply any other information the board deems necessary to evaluate the applicant's qualifications.

(c) An applicant may be required to appear in person for an interview. 21 NCAC 32S. 0207 LICENSE REINSTATEMENT (a) A physician assistant may apply to reinstate his/her license if the license has been inactive for more than one calendar year, or if the inactive status resulted from disciplinary action or was taken to avoid disciplinary action. (b) A physician assistant requesting reinstatement shall satisfy all the requirements set forth in 21 NCAC 32S .0202. (c) An applicant may be required to appear in person for an interview with the Board. 21 NCAC 32S .0208 LIMITED VOLUNTEER LICENSE (a) A physician assistant who holds a regular license may convert that license to a limited volunteer license by notifying the Board in writing. A physician assistant practicing under a

limited volunteer license shall practice with no expectation of payment or compensation whatsoever for any medical services rendered. A physician assistant holding a limited volunteer license may not accept any compensation, either directly or indirectly, whether monetary, in-kind, or otherwise, for the provision of medical services. (b) A physician assistant with an inactive license who wishes to return to practice on a volunteer basis must first reinstate or reactivate his/her license, whichever applies, by complying with 21 NCAC 32S.0206 or 21 NCAC 32S.0207. Once reinstated or reactivated, a physician assistant may convert that license to a limited volunteer license pursuant to paragraph (a) of this rule without paying an additional fee. (c) There is an annual renewal fee of $25. 21 NCAC 32S .0209 NON APPLICABILITY This Subchapter does not apply to:

(1) a student enrolled in a Physician Assistant Educational Program accredited by the Commission on Accreditation of Allied Health Education Programs or its successor organizations;

(2) a physician assistant employed by the federal government while performing duties incident to that employment; or

(3) an agent or employee of a physician who performs delegated tasks in the office of a physician but who is not rendering services as a physician assistant and identifying him/herself as a physician assistant.

21 NCAC 32S .0210 IDENTIFICATION REQUIREMENTS A physician assistant shall keep proof of current licensure and renewal available for inspection at the primary place of practice and shall, when engaged in professional activities, wear a name tag consistent with G.S. 90-640. 21 NCAC 32S .0211 AGENCY Physician assistants are the agents of their supervising physicians in the performance of all medical practice-related activities, including the ordering of diagnostic, therapeutic and other medical services. 21 NCAC 32S .0212 PRESCRIPTIVE AUTHORITY A physician assistant may prescribe, order, procure, dispense and administer drugs and medical devices subject to the following conditions:

(1) the physician assistant complies with all state and federal laws regarding prescribing including G.S. 90-18.1(b);

(2) each supervising physician and physician assistant incorporates within their written supervisory arrangements, as defined in rule .0201(8) of this Subchapter, instructions for prescribing, ordering, and administering drugs and medical devices and a policy for periodic review by the physician of these instructions and policy;

(3) In order to compound and dispense drugs, the physician assistant complies with G.S. 90-18.1(c);

(4) in order to prescribe controlled substances, (a) the physician assistant must have a valid Drug Enforcement

Administration (DEA) registration and prescribe in accordance with DEA rules;

(b) All prescriptions for substances falling within schedules II, IIN, III, and IIIN, as defined in the federal Controlled Substances Act, shall not exceed a legitimate 30 day supply;

(c) the supervising physician must possess the same schedule(s) of controlled substances as the physician assistant's DEA registration.

(5) each prescription issued by the physician assistant contains , in addition to other information required by law, the following:

(a) the physician assistant's name, practice address and telephone number; (b) the physician assistant's license number and, if applicable, the physician

assistant's DEA number for controlled substances prescriptions; and (c) the responsible supervising physician's (primary or back-up) name and

telephone number; (6) the physician assistant documents prescriptions in writing on the patient's record,

including the medication name and dosage, amount prescribed, directions for use, and number of refills; and

(7) a physician assistant who requests, receives, and dispenses medication samples to patients complies with all applicable state and federal regulations.

21 NCAC 32S .0213 SUPERVISION OF PHYSICIAN ASSISTANTS (a) A physician assistant may perform medical acts, tasks, or functions only under the supervision of a physician. Supervision shall be continuous but, except as otherwise provided in the rules of this Subchapter, shall not be construed as requiring the physical presence of the supervising physician at the time and place that the services are rendered. (b) Each team of physician(s) and physician assistant(s) shall ensure that the physician assistant's scope of practice is identified; that delegation of medical tasks is appropriate to the skills of the supervising physician(s) as well as the physician assistant's level of competence; that the relationship of, and access to, each supervising physician is defined; and that a process for evaluation of the physician assistant's performance is established. (c) Each supervising physician and physician assistant shall sign a statement, as defined in Rule .0201(8) of this Subchapter, that describes the supervisory arrangements in all settings. Written prescribing instructions are required for each approved site. This statement shall be kept on file at all practice sites, and must be available upon request by the Board. (d) A primary supervising physician and a physician assistant in a new practice arrangement shall meet monthly for the first six months to discuss practice relevant clinical issues and quality improvement measures. Thereafter, the primary supervising physician and the physician assistant shall meet at least once every six months. A written record of these meetings shall be signed and dated by both the supervising physician and the physician assistant, and shall be available for inspection upon request by the Board agent. The written record shall include a description of the relevant clinical issues discussed and the quality improvement measures taken. 21 NCAC 32 S.0214 SUPERVISING PHYSICIAN A physician wishing to serve as a primary supervising physician must exercise supervision of the physician assistant in accordance with rules adopted by the Board. The physician shall retain professional responsibility for the care rendered by the physician assistant within the scope of the supervisory arrangement. 21 NCAC 32S .0215 RESPONSIBILITIES OF PRIMARY SUPERVISING PHYSICIANS IN REGARD TO BACK-UP SUPERVISING PHYSICIANS (a) The primary supervising physician shall ensure that a supervising physician, either primary or back-up, is readily accessible for the physician assistant to consult whenever the physician assistant is performing medical acts, tasks, or functions. (b) A back-up supervising physician must be licensed to practice medicine by the Board, not prohibited by the Board from supervising a physician assistant, and approved by the primary supervising physician as a person willing and qualified to assume responsibility for the care rendered by the physician assistant in the absence of the primary supervising physician. An ongoing list of all approved back-up supervising physicians, signed and dated by each back-up supervising physician, the primary supervising physician, and the physician assistant, must be retained as part of the Supervisory Arrangement. 21 NCAC 32S .0216 CONTINUING MEDICAL EDUCATION

A physician assistant must complete at least 100 hours of continuing medical education (CME) every two years, at least 40 hours of which must be American Academy of Physician Assistants Category I CME. CME documentation must be available for inspection by the board or its agent upon request. The two year period shall run from the physician assistant’s birthday, beginning in the year 1999, or the first birthday following initial licensure, whichever occurs later. 21 NCAC 32S .0217 VIOLATIONS The Board may take disciplinary action against a supervising physician or a physician assistant, pursuant to G.S.§ 90-14. It is unprofessional or dishonorable conduct for a physician assistant to violate the rules of this Subchapter, or to represent him/herself as a physician. 21 NCAC 32S .0218 TITLE AND PRACTICE PROTECTION (a) Any person not licensed by the Board violates G.S. 90-18.1 if he or she:

(1) falsely identifies him/herself as a physician assistant; (2) uses any combination or abbreviation of the term "physician assistant" to

indicate or imply that he or she is a physician assistant; or (3) acts as a physician assistant without being licensed by the Board.

(b) An unlicensed physician may not use the title of "physician assistant" or practice as a physician assistant unless he/she fulfills the requirements of this Subchapter. 21 NCAC 32S .0219 PRACTICE DURING A DISASTER A physician assistant licensed in this State or in any other state may perform acts, tasks, or functions as a physician assistant under the supervision of a physician licensed to practice medicine in North Carolina during a disaster within a county in which a state of disaster has been declared or counties contiguous to a county in which a state of disaster has been declared (in accordance with G.S.166A-6). A team of physician(s) and physician assistant(s) practicing pursuant to this Rule is not required to maintain on-site documentation describing supervisory arrangements and instructions for prescriptive authority as otherwise required by 21 NCAC 32S .0212. Celentano, CPA (Comptroller). Financial Statements Mr. Celentano, CPA, presented the May 2009 compiled financial statements. May is the seventh month of fiscal year 2009. Mr. Celentano also reviewed the Board’s current cash position as of May 31, 2009. Dr. Jablonski made a motion to accept the financial statements as reported. Enhanced Licensee Information (“ELI”) Update: Pursuant to G.S. 90-5.2 and 5.3, the

Board is required to collect and publish certain information regarding physicians and physician assistants. Mr. Gupta and Jean Fisher-Brinkley, Director of Public Affairs, updated the Committee regarding staff efforts thus far to collect and publish this information. Mr. Gupta will provide a further update during the September Board Meeting.

Staff Diversity: Ms. Dawn LaSure, Director of Human Resources discussed with the Committee management’s commitment and efforts to create a more diverse workplace. Delegation of Investigative Orders: The Medical Practice Act authorizes the Board to “require a physician licensed by it to submit to a mental or physical examination by physicians designated by the Board…G.S. 90-14(a) (5).” This is accomplished by an “Order for Examination” that requires a licensee to obtain a physical, neuropsychiatric, or substance abuse assessment when needed. The Committee discussed a proposal to delegate this authority to the President or his/her designee and the Chair of the Disciplinary or Review Committee upon recommendation of the Senior Staff Review Committee (this proposal would not apply to an order for a professional competence assessment). Dr. Jablonski made a motion to accept this proposal, Dr. Huff seconded the motion and the motion was approved unanimously. NCMB Advisory Committee: The Committee discussed the possibility of forming an Advisory Committee to provide input to the Board regarding its licensing, investigative and disciplinary processes. The Committee agreed unanimously on the formation of an Advisory Committee and will continue to work with staff on the structure of this committee. Informal Interviews/Orders for Assessment: The Committee discussed a policy whereby those the Board believes should undergo a professional assessment (e.g., CPEP or PACE) would be given the opportunity, if requested, to meet with members of the Board (informal interview) to learn the basis for the Board’s decision. The Committee believes this will give the licensee a better understanding of the Board’s decision and have an opportunity for input. Dr. Rhyne made a motion to adopt this policy, Dr. Huff seconded the motion and the motion was approved unanimously. Request for Rule–Making: On June 30, 2009, The NCMB received a petition for rulemaking pursuant to G.S. 150B-20 in which the petitioners ask the NCMB to adopt a rule that would require all non-physicians who use the designation “Doctor” or “Dr.” to wear an ID badge that would specify the type of license held by the individual and verbally disclose the information to patients. Dr. Rhyne made a motion to disseminate copies of the petition to all interested parties, solicit feedback and report any/all feedback to the Committee at the September meeting. Dr. Huff seconded the motion and the motion was approved unanimously.

Nomination of New Officers: A motion was made to nominate the following officers for 2009-2010: Dr. Janice Huff as President-Elect, and Dr. William Walker as Secretary/Treasurer. Mr. John Lewis and Dr. Tom Hill are nominated as members at large of the Executive Committee.

5/2008 – It was pointed out that not all physician extenders work in the same circumstances. Many physician extenders are at-will employees; others work in practice environments in which they are the owner and/or the sole practitioner. The statement should cover both extremes. It was suggested that the layout of the statement could be similar to the Physician Supervision position statement, which lists circumstances to be considered on a case by case basis. Additionally, it was stated that continuity of care for patients must be the ultimate concern.

DEPARTURES FROM OR CLOSINGS OF MEDICAL PRACTICES

Departures from or closings of medical practices are trying times. If mishandled, they can significantly disrupt continuity of care and endanger patients.

Provide Continuity of Care Practitioners continue to have obligations toward their patients during and after the departure from or closing of a medical practice. Practitioners may not abandon a patient or abruptly withdraw from the care of a patient. Patients should therefore be given reasonable advance notice (at least 30 days) to allow other medical care to be secured. Good continuity of care includes preserving and providing appropriate access to medical records.* Also, good continuity of care may often include making appropriate referrals. The practitioner(s) and other parties that may be involved should ensure that the requirements for continuity of care are effectively addressed. It is the position of the North Carolina Medical Board that during such times practitioners and other parties that may be involved in such processes must consider how their actions affect patients. In particular, practitioners and other parties that may be involved have the following obligations.

Permit Patient Choice

It is the patient's decision from whom to receive care. Therefore, it is the responsibility of all practitioners and other parties that may be involved to ensure that:

• Patients are notified in a timely fashion of changes in the practice and given the opportunity to seek other medical care, sufficiently far in advance (at least 30 days) to allow other medical care to be secured, which is often done by newspaper advertisement and by letters to patients currently under care;

• Patients clearly understand that they have a choice of health care providers; • Patients are told how to reach any practitioner(s) remaining in practice, and when

specifically requested, are told how to contact departing practitioners; and • Patients are told how to obtain copies of or transfer their medical records.

No practitioner, group of practitioners, or other parties involved should interfere with the fulfillment of these obligations, nor should practitioners put themselves in a position where they cannot be assured these obligations can be met.

Written Policies

The Board recommends that practitioners and practices prepare written policies regarding the secure storage, transfer and retrieval of patient medical records. Practitioners and practices should notify patients of these policies. At a minimum, the Board recommends that such written policies specify:

• A procedure and timeline that describes how the practitioner or practice will notify each patient when appropriate about (1) a pending practice closure or practitioner departure, (2) how medical records are to be accessed, and (3) how future notices of the location of the practice’s medical records will be provided;

• How long medical records will be retained; • The procedure by which the practitioner or practice will dispose of

unclaimed medical records after a specified period of time; • How the practitioner or practice shall timely respond to requests from

patients for copies of their medical records or to access to their medical records;

• In the event of the practitioner’s death or incapacity, how the deceased practitioner’s executor, administrator, personal representative or survivor will notify patients of the location of their medical records and how patients can access those records; and

• The procedure by which the deceased or incapacitated practitioner’s executor, administrator, personal representative or survivor will dispose of unclaimed medical records after a specified period of time.

The Board further expects that its licensees comply with any applicable state and/or federal law or regulation pertaining to a patient’s protected healthcare information. __________________________________________ * NOTE: The Board’s Position Statement on the Retention of Medical Records applies, even when practices close permanently due to the retirement or death of the practitioner. (a) No physician shall advertise or otherwise hold himself or herself out to the public as being

“Board Certified” without proof of current certification by a specialty board approved by (1) the

American Board of Medical Specialties; (2) the Bureau of Osteopathic Specialists of American

Osteopathic Association; (3) the Royal College of Physicians and Surgeons of Canada; (4) a

board or association with an Accreditation Council for Graduate Medical Education approved

postgraduate training program that provides complete training in that specialty or subspecialty;

or (5) a board or association with equivalent requirements approved by the North Carolina

Medical Board.

(b) Any physicians advertising or otherwise holding himself or herself out to the public as “Board

Certified” as contemplated in paragraph (a) shall disclose in the advertisement the specialty

board by which the physician was certified.

(c) Physicians shall not list their names under a specific specialty in advertisements, including

but not limited to, classified telephone directories and other directories unless: (1) they are

board certified as defined in paragraph (a); or (2) they have successfully completed a training

program in the advertised specialty that is accredited by the Accreditation Council for Graduate

Medical Education or approved by the Council on Postdoctoral Training of the American

Osteopathic Association.

Capital punishment

In North Carolina Dept. Correction v. North Carolina Medical Board, the North Carolina Supreme Court ruled that while the North Carolina Medical Board does “retain disciplinary power over a licensed medical doctor who participates in an execution,” the Board “may not discipline or threaten discipline against its licensees solely for participating in the execution alone.” Consistent with the Supreme Court’s ruling, the Board will not take any disciplinary action against a physician for participation in an execution.

The North Carolina Medical Board does, however, takes continue to take the position that physician participation in capital punishment is a departure from the ethics of the medical profession within the meaning of N.C. Gen.Stat. 90-14(a)(6).The North Carolina Medical Board adopts and endorses cites the provisions of AMA Code of Medical Ethics Opinion 2.06 (printed below) as an accurate statement of the professional ethics of physician participation in executions. except to the extent that it is inconsistent with North Carolina state law.

The Board recognizes that N.C. Gen.Stat. 15-190 requires the presence of “the surgeon or physician of the penitentiary” during the execution of condemned inmates. Therefore, the Board will not discipline licensees for merely being “present” during an execution in conformity with N.C. Gen.Stat. 15-190. However, any physician who engages in any verbal or physical activity, beyond the requirement of N.C. Gen.Stat. 15-190, that facilitates the execution may be subject to disciplinary action by this Board.

Relevant Provisions of AMA Code of Medical Ethics Opinion 2.06 An individual’s opinion on capital punishment is the personal moral decision of the individual. A physician, as a member of a profession dedicated to preserving life when there is hope of doing so, should not be a participant in a legally authorized execution. Physician participation in execution is defined generally as actions which would fall into one or more of the following categories: (1) an action which would directly cause the death of the condemned; (2) an action which would assist, supervise or contribute to the ability of another individual to directly cause the death of the condemned; (3) an action which could automatically cause an execution to be carried out on a condemned prisoner.

Physician participation in an execution includes, but is not limited to, the following actions: prescribing or administering tranquilizers and other psychotropic agents and medications that are part of the execution procedure; monitoring vital signs on site or remotely (including monitoring electrocardiograms); attending or observing an execution as a physician; and rendering of technical advice regarding execution.

In the case where the method of execution is lethal injection, the following actions by the physician would also constitute physician participation in execution: selecting injection sites; starting intravenous lines as a port for a lethal injection device; prescribing, preparing, administering, or supervising injection drugs or their doses or types; inspecting, testing, or maintaining lethal injection devices; and consulting with or supervising lethal injection personnel.

The following actions do not constitute physician participation in execution: (1) testifying as to medical history and diagnoses or mental state as they relate to competence to stand trial, testifying as to relevant medical evidence during trial, testifying as to medical aspects of aggravating or mitigating circumstances during the penalty phase of a capital case, or testifying as to medical diagnoses as they relate to the legal assessment of competence for execution; (2) certifying death, provided that the condemned has been declared dead by another person; (3) witnessing an execution in a totally nonprofessional capacity; (4) witnessing an execution at the specific voluntary request of the condemned person, provided that the physician observes the execution in a nonprofessional capacity; and (5) relieving the acute suffering of a condemned person while awaiting execution, including providing tranquilizers at the specific voluntary request of the condemned person to help relieve pain or anxiety in anticipation of the execution.

TELEMEDICINE

Issue: The Board to consider recent adoptions of telemedicine policies and statements by the Federation, Blue Cross Blue Shield and the AMA. 5/2009 COMMITTEE DISCUSSION: Dr. Rhyne reported that the Federation recently adopted a statement regarding telemedicine. It was also reported that BCBS would be implementing a new e-medicine policy. 5/2009 BOARD ACTION: Todd to use information from AMA, Federation, Medical Society and BCBS, to begin working on a comprehensive policy. This policy should include the telepsychiatry issue the Committee addressed last year.

7/2009 COMMITTEE DISCUSSION: Dr. Rhyne reported that the AMA recently passed a policy regarding telemedicine and that Blue Cross Blue Shield may have also taken a position regarding this issue. 7/2009 COMMITTEE RECOMMENDATION: Todd is to continue to research this issue. Question regarding self treatment

Issue: Is it in violation of the Board’s position statement for a physician to order a cbc or lipid panel on him- or herself?

7/2009 COMMITTEE DISCUSSION: The Committee discussed several different scenarios where this might be done, such as convenience, when a physician’s doctor requests that blood work be done and the physician (patient) has the blood drawn at their own practice for convenience. It was the consensus of the Committee that ordering blood work is not a good idea and could lead to self-treatment. The Committee also agreed that the current position statement is sufficient and that each hospital should develop its own guidelines. 7/2009 COMMITTEE RECOMMENDATION: Respond that in the Board’s opinion, such ordering of tests on one’s self is a bad idea and is discouraged. Refer to the Board’s current position statement.

3. Each CME Audit letter that is mailed will have a CME sheet attached for the licensee to use to record their self reported Category 2 hours. For Category 1 hours they will send back copies of their Category 1 certificates.

4. The licensee will have 30 days from the date of the letter to return their information. 5. Each CME Audit response will need to be date stamped and reviewed. Category 2

hours will be reviewed by Operations staff. Category 1 hours will be reviewed by the Medical Director.

6. If a response is not received within 30 days, a certified letter will be mailed to the

licensee. If a licensee does not respond to the certified letter, a copy of the original CME Audit letter and the certified letter receipt will be sent to Investigations.

II. The Committee reviewed several different disruptive physician policies and decided to pass this over to the Policy Committee for recommendation of a disruptive physician position statement.

III. Dr. Rhyne updated the Committee on the FSMB Advisory Groups charged with Assuring the Continued Competence of Licensed Physicians. A discussion followed.

Charge: Issue an opinion to the FSMB Board of Directors concerning the FSMB’s Maintenance of Licensure initiative and more specifically, whether the framework proposed in the report of Special Committee on Maintenance of Licensure for use by state medical boards in assuring the continued competence of licensed physicians is feasible, reasonable, consistent with the guiding principles adopted by FSMB;s House of Delegates in May 2008 and suitable for use by state medical boards in assuring the continued competence of licensed physicians.

In carrying out this charge, the Advisory Group should include in its consideration and, where appropriate, provide input regarding:

1. Review of the FSMB’s work on MOL, to include public policies, reports, documents and any active engagement of state medical boards, the public, physicians and other stakeholders in discussions about MOL and the solicitation of their input in the evolution and development of related policy recommendations.

2. Review of the available research and published literature concerning the evidence for the need for initiating an MOL program and the effects of such a program as well as other quality improvement methodologies on physician practice and quality care outcomes.

3. Review of further analyses of any outstanding issues that surfaced as a result of the MOL impact analysis report and state medical board and other stakeholders’ feedback to this report.

4. In collaboration with the appropriate stakeholders, review and/or develop recommendations for how MOL, maintenance of certification and other continuous improvement activities could be aligned to support state medical boards in achieving a regulatory system that assures the public of a physician’s competence while minimizing duplication and burden on the physician community

5. Review of any pilot projects supported/funded by the FSMB in collaboration with appropriate stakeholders centering on issues relevant to the MOL discussions

Pre-approved PLOCs Summary: A presentation was made to the board by an applicant at the May meeting with regard to his plans to practice tele-neurology. Board action was to issue a license with a letter of concern outlining the Board’s concerns associated with practicing tele-neurology. Board Action: Send applicants approved for license, who are planning to practice tele-neurology, the letter developed by Dr. Sheppa. Add this category to the “pre-approved PLOC” list developed by the SSRC. 2. Practicing without license Summary: Staff requests feedback/guidance on how to proceed when a physician’s license is made inactive due to an error on their part or their staff’s. Possible sanctions for practicing medicine without a license are a PLOC, a PUBLOC or a reprimand.

Board Action: Add the following criteria to approved list of pre-approved PLOCs:

• Licenses that are inactive up to 90 days - reinstate retroactively with a PLOC • Cases beyond 90 days are handled via PUBLOC and other disciplinary vehicles

depending upon each situation and being guided by the length of inactive status and circumstances that led to the situation.

3. Rewrite of Physician Regulatory Rules Summary: Nancy Hemphill will attend the open session portion of this meeting to discuss the proposed regulatory rules for license. A draft will be e-mailed to Board members prior to the Board meeting. A copy of the proposed rules can be found under the heading “Licensing Rules”. Board Action: Accept proposed rules with recommended change to include language suggested by Dr. Huff that reference forms must be from physicians that have observed the applicant’s clinical practice within the past 3 years and to list the examinations acceptable to the Board instead of referencing the statute.

Per Dr. Kanof’s e-mail of 06/22/09: “The Bill to create a rehab program for impaired EMTs passed the House and we fully expect, since no tax dollars are asked for, that it will pass the Senate and will be administered by the Nursing Board.” Board Action: Accept as information. AA Supervision Summary: Summary: As of January 1, 2010; by Board rulemaking; AA's may be supervised as 4 AAs to 1 physician. The current statute allows only 2 AAs per anesthesiologist. The statute also talks about changes to that supervision ratio, on January 1, 2010- but only by rule making.

BOARD ACTION: Move forward with rule change that will state that a supervising anesthesiologist may supervise up to four AAs. Also strike out wording regarding student AAs. 21 NCAC 32W .0109 SUPERVISION OF ANESTHESIOLOGIST ASSISTANTS (a) The Primary Supervising Anesthesiologist shall ensure that the Anesthesiologist Assistant's scope of practice is identified; that delegation of anesthesia services is appropriate to the level of competence of the Anesthesiologist Assistant; that the relationship of, and access to, each Supervising Anesthesiologist is defined; and that a process for evaluation of the Anesthesiologist Assistant's performance is established. (b) The Supervision Agreement defined in Rule .0101(10) of this Subchapter must be signed by the Primary Supervising Anesthesiologist(s) and Anesthesiologist Assistant and shall be made available upon request by the Board or its agents. A list of all Supervising Anesthesiologists, signed and dated by each Supervising Anesthesiologist, the Primary Supervising Anesthesiologist, and the Anesthesiologist Assistant, must be retained as part of the Supervision Agreement and shall be made available upon request by the Board or its representatives. (c) A Supervising Anesthesiologist, who need not be the Primary Supervising Anesthesiologist, shall supervise the Anesthesiologist Assistant and ensure that all anesthesia services delegated to the Anesthesiologist Assistant are consistent with the Anesthesiologist Assistant's Supervision Agreement. (d) A Supervising Anesthesiologist may supervise no more than two up to four Anesthesiologist Assistants or Student Anesthesiologist Assistants at one time. The limitation on the number of Anesthesiologist Assistants or Student Anesthesiologist Assistants that an anesthesiologist may supervise does not affect the number of other qualified anesthesia providers an anesthesiologist may concurrently supervise. (e) Entries by an Anesthesiologist Assistant into patient charts of inpatients (hospital, long term care institutions) must comply with the rules and regulations of the institution. In general, the group expressed a preference for using North Carolinians (local talent, employment, ease of arrangements, etc.) but expressed concern about how to evaluate whether such courses make a difference. Discussion Go with Dr. Akwari and Mr. Kertesz for single day courses. Ask Mr. Kertesz to contact AHEC, get them to do the event planning so that NCMB is not involved in that. Thank PACE and Case Western and continue to refer licensees to their longer programs.

Have at least one clinician on NCMB, plus one MD on NCMB staff, attend each course initially, at the Board’s expense. If Board mandates attendance, ask for feedback from participants, both for their self assessment and evaluation of class. Note also that existence of local, reasonably priced courses will also lower the bar for referral by Board to classes. Inform Senior Staff about existence of classes. Once Board feels confident with quality of classes, use Board means to publicize: letter from Dr. Saunders to various groups (NCHA, NCMS, medical group managers, risk managers, medical schools) to “nourish” the classes and boost voluntary attendance. Notices could also be placed in the Forum and on the website. Academic paper: need data, statistics as to the classes, what difference they make. Dr. Huff suggested Warren Newton; others mentioned SHEPS Center; ask Mr. Kertesz. NCMB should be a catalyst rather than the researcher. Board Action: the NCMB affirmed the decision of the work group and asked them to proceed.
