REQUISITES

Five requisite elements of a NVNB claim

1. That a 'measure' has been applied by a party subsequent to the entry

into force of the relevant trade agreement;

2. That a 'benefit' was reasonably expected by the other party as being

negotiated in return for some textual agreement;

3. That as a result of the application of the measure that benefit has

been 'nullified or impaired.'

The core idea of NVC is to improve competitiveness that

can be legitimately expected from a tariff concession and to

encourage contracting parties to make tariff concessions. The

opinions about this system differ a lot some people consider it

as a legal fantasy and useless and dangerous construction

NVC & IP• In May 2003, the TRIPS Council chairperson listed four

possibilities for a recommendation:

• (1) banning non-violation complaints in TRIPS completely,

• (2) allowing the complaints to be handled under the WTO’s

dispute settlement rules as applies to goods and services

cases,

• (3) allowing non-violation complaints but subject to special

“modalities” (i.e. ways of dealing with them), and

• (4) extending the moratorium

MORATORIUM

Hence the moratorium has been extended several times, from one Ministerial Conference to the next. The TRIPS Council agreed to recommend extending the present period until the next conference .

In 2015 90 developing and least-developed countries led by Peru

formally presented their proposal at the TRIPS Council, calling

for a permanent moratorium for applying NVCs to disputes under

the agreement.
