The meeting of the Approval Committee of Noida SEZ was held on 30/07/2013

at 11:30 AM in the Conference Hall of NSEZ, Noida. The meeting was chaired by Shri

Jayant Misra, Development Commissioner, Noida SEZ. Following members were

present:

3 Shri A.K. Gupta, Dy. Commissioner, Customs, Air Cargo Export

5 Shri S.N. Paswan, Manager, DIC, G.B. Nagar.

Besides, Shri Prakash Chand, Asstt. Development Commissioner, NSEZ, Sh.

Ram Baboo, Asstt. Development Commissioner, NSEZ, Shri K. Bhattacharjee,

Appraiser, Customs, NSEZ and Shri Praveen Kumar, AEE, U.P.P.C.B. Noida also

attended the meeting.

GIST OF THE MEETING:

Ratification of Minutes of last meeting of the Approval Committee:

The Approval Committee ratified the minutes of the last meeting held on 07/06/2013.

Decisions on Proposals:

1. Application of M/s Metco International for setting up a unit in NSEZ for

Manufacturing/processing of Tinplate, TFS, CR, GP - Coils, Sheets, Strips.

The Committee discussed the proposal at length but did not found the same to be

financially viable. The Committee decided not to approve the project in its present

form.

2. Application of M/s Parisian Parfum Pvt. Ltd. for setting up a unit in NSEZ for

EAU DE PARFUM, EAU DE PERFUME, EAU DE TOILETTE, Spray Perfume,

Body Spray, Spray Mist, Perfume Gift Set, Cosmetics, Body products, Roll

on, Perfumed Roll on, Deodorant, Cologne, EAU DE COLOGNE, After Shave,

Deo Spray.

The Committee deliberated on various aspects of the proposal in detail and did not

agree to the proposal.

3. Application of MIs Ansh Ventures Pvt. Ltd. for setting up a unit in NSEZ for

E-Commerce Serivces.

The Committee deferred the proposal with the directions to the applicant to rectify

the shortcomings observed in the application and also clarify the project financing

as the company has been incurring losses as per balance sheet.

4. Application of MIs Okaya Infocom Pvt. Ltd. for setting up a unit in NSEZ for

Computer Software Development liT Enabled Services.

The Committee discussed the proposal and approved the same.

5. Application of MIs AC Impex for setting up a unit in NSEZ for (1)

Manufacturing of plain & studded gold, diamond, silver & platinum jewellery

& gold coins, articles of gold, gold components, mountings, findings. (2)

Repair I Remaking of Old gold I silver I platinum (plain & studded) jewellery.

The Committee considered and approved the proposal restricting the authorised

operations to "manufacturing of plain & studded gold, diamond, silver & platinum

jewellery" only.

6. Application of MIs Deepak Enterprises for setting up a unit in NSEZ for

Trading in Hospital goods, Medical goods, Medicines.

The Committee considered the proposal and decided to defer the same with the

directions to the applicant to furnish a detailed list of proposed items to be traded.

7. Application of MIs AVS Jewellers for setting up a unit in NSEZ for

manufacturing of Hand madel Machine made Goldl SilverI Platinum Jewellery

(plain/Studded with precious, semi-preciousl Synthetic stones, pearls &

diamonds. Gold & Silver Articles.

operations to "manufacturing of Hand made/Machine made Gold/ Silver/Platinum

Jewellery (plain/Studded with precious, semi-precious/ Synthetic stones, pearls &

diamonds".

11. Proposal of MIs KnitPro International for amendment in LOA

12. Proposal of MIs Global Dent Aids Pvt. Ltd. for Inclusion of additional items of

manufacture in LOA & Monitoring of performance.

8. Application of MIs Integrated Wireless Solutions Pvt. Ltd. for setting up a

unit in NSEZ for Manufacturing I Assembling of Compact RAN BTS (Radio

Access Network, Base Transmission Station) with I without IBS2 and

accessories.

The Committee deferred the proposal with the directions to the applicant company

to furnish fund flow statement, clarify regarding clause 5.1, submit exhibit A, modify

agreement giving its duration, and change the foreign exchange balance sheet

taking into account outflow of foreign exchange against foreign technology

agreement.

9. Application of MIs Albion InfoTel Ltd. for setting up a unit in NSEZ for

Computer Software Services, Research & Development.

The Committee considered and approved the proposal.

10. Proposal of MIs Synapse Communications Pvt. Ltd. for transfer of LOAlall

rightslownership to MIs Synapselndia Outsourcing Pvt. Ltd.

The Committee discussed the proposal and approved the same as change of

entrepreneur in terms of rule 19(2) of SEZ Rules, 2006 inter alia subject to

submission of an undertaking by the incoming entrepreneur regarding taking over

the assets and liabilities of the existing unit and execution of fresh bond cum legal

undertaking.

The Committee discussed the proposal and approved addition of 'parts thereof' in

already approved authorised operations relating to manufacturing.

The Committee considered and approved inclusion of Plastic holders (in place of

New Plastic Holders approved earlier), Tooth picks, Brush sticks, Plastic holder

with brush, Interdental brush, Plastic mouth morrors, Metal mouth mirrors, Dental

picks & scalier, PVC Pouch, Polythene bags, All type of product made of plastic

(like plastic tray, different type of plastic handles, plastic clips, plastic cases, plastic

syringe etc) subject to condition that all these items will be soley for oral care.

The Committee also monitored the performance of the unit as per APRs for the

period from 2007-08 to 2011-12 and noted achievement of positive NFE by the unit

as on 31/03/2012 ..

13. Proposal of MIs La Moda Eleganza for amendment in LOA & monitoring of

performance.

The Committee considered & approved the proposal of the unit for inclusion of

'manufacturing of shoe uppers and embroidery for export' in LOA.

The Committee also monitored the performance of the unit as per APRs for the

period from 2007-08 to 2011-12 and noted achievement of positive NFE by the unit

as on 31/03/2012.

14. Proposal of MIs SIMS Recycling Solutions India Pvt. Ltd. for LOA Renewal.

The Committee deliberated on the proposal and decided to renew the LOA of the

unit for another five years i.e. up to 30/04/2018 within the unit's existing capacity

and with the condition that no import of used goods for recycling would be allowed.

The Committee also monitored the performance of the unit as per APRs submitted

up to 2011-12 and noted achievement of positive NFE by the unit as on

31/03/2012.

The Committee further directed the unit to submit Board Resolution along with

details of appointment of Mr. Anand Narasimhan as MD of company and submit

CA certified APR for 2012-13 at the earliest.

15. Proposal for review of LOAIProject of MIs Legendary Swords Private Ltd.

The Committee reviewed the LOA dt. 28/09/2012 and after taking into account the

failure on the part of the unit to take any steps to implement the project and

considering alleged misdeclarations made by the Export Oriented Unit (EOU) of

the promoters for availaing export benefits under different export promotion

schemes & show cause notice issued by DC, Noida SEZ to the EOU, the

Committee decided to cancel the LOA dt. 28/09/2012 granted to MIs Legendary

Swords Private Ltd.

16. Approval of default services

The Committee noted that after issuance of Notification No. 12/2013-Service Taxdated 01/07/2013 by the Ministry of Finance, office of DC, NSEZ has beenreceiving proposals from various NSEZ units for fresh approval of those serviceswhich were approved by the Approval Committee in terms of provisions oferstwhile Notification No.17/2011-Service Tax dated 01.03.2011 and NotficationNo. 40/2012-ST dt. 20/06/2012.

The Committee approved the list of default services, as annexed, under theNotification No. 12/2013-Service Tax dated 01/07/2013. For additional services,units may apply for approval separately.

Decision of additional agenda items:

1. Proposal of MIs Kundan Rice Mills Ltd. for amendment in LOA by including

manufacturing of plain jewellery.

The Committee considered the proposal of the unit and approved inclusion of

"manufacturing of plain jewellery of gold/silver/platinum' in the LOA subject to

adherence to the prescribed value addition by the unit.

The meeting ended with a vote of thanks to the Chair.
