GENERAL GUIDELINES

1. BSNL EW-6, Form BSNL EW 8, Schedules, special conditions / specifications and

drawings will be issued to intending tenderers only. The Standard Form will not be issued along with the Tender Documents but the same shall form part of the agreement to be drawn and signed by the both parties after acceptance of tender. The standard Forms shall be available in downloadable manner from website http://www.tenders.bsnl.co.in All blanks are confined to Notice Inviting Tender (BSNL EW-6) and Schedules A to F. Authority approving the Notice Inviting Tenders (NIT) shall fill up all the blanks in BSNL EW-6, and in Schedules B & F before issue of Tender Papers.

2. The intending tenderers shall quote their rates in Schedule A only.

3. The proforma for registers and Schedules are only for information and guidance. These

are not to be filled in the Standard Form. The Schedules with all blanks, duly filled, shall be separately issued to all intending tenderers for filling and returning the same in the manner prescribed. The Schedules can also be downloaded from website http://www.tender.bsnl.co.in.

2) (a) Printed forms of tenders consisting of the detailed plans, complete specifications, the schedule of quantities of the various classes of works to be done and the set of conditions to be complied and with by the persons whose tender may be accepted, can be purchased, at the Divisional Office between the hours of 11:00 hrs and 16:00 hours every day except on Sundays and public holidays on payment of Rs. 1135/- (Not Refundable) in cash / Demand draft.

(b) The site for the work is available / or site for the works shall be made available in parts. (c) The tender forms can also be downloaded from the web site. (d) Before tendering, the contractor shall inspect site and fully acquaint himself about the

condition with regard to accessibility of site and site nature and the extend of grounds, working conditions, including stocking of materials, installation of T & P etc., and conditions affecting accommodation and movement of labour etc., required for satisfactory execution of contract. No claim whatsoever on such account shall be entertained by BSNL in any circumstances.

3) Tenders which should always be placed in sealed covers with the name of work written on the

Block, Patna -800001 up to 15.00 hours on and will be opened by him in his office on the same day at 15:30 hours. 4) The time allowed for carrying out the work will be 03 months from the date of issue of LOI for

Part A & B and 48 Months for Part C (after 12 months from date of Completion of work) 5) Issue of tender form will be stopped four days before the date fixed for opening of tenders.

Tenders will be sold on working days; no tender will be sold after 1600 hours.

6) (a) Earnest Money amounting to Rs. 58,120/- in the form of demand draft / FDR / BG/ CDR of nationalized / scheduled bank guaranteed by the Reserved Bank of India, drawn in favor of Accounts Officer (Cash), O/o PGMTD, BSNL, Patna, must accompany each tender and each tender should be in two sealed covers, one cover containing the EMD in proper form (if tender document issued by Division Office) and other cover containing tender, super-scribed as ― Tender for the work: ―SITC of 5 x 7 TR Microprocessor controlled High Precision capacity package AC units for MSC Exchange Patliputra under GM-NOW(CM) Patna.( PART- A: Supply, PART-B: Installation, Testing & Commissioning, PART-C: Annual Maintenance Contract.)

The Validity period of EMD is 120 days, from the date of opening of tender. In case of down loaded tender, each tender should be in two sealed covers, first containing credentials for meeting the eligibility condition along with the cost of tenders and EMD in proper form, second cover containing tender documents. The credentials shall be self attested and certified by any BSNL / MTNL Executive or Gazetted Officer of GOI. If not certified by BSNL Executive then original documents shall be produced at the time of tender opening. After verification of contents of this envelop then second envelope containing the bid document shall be opened. (b) The EMD of all the unsuccessful tenders shall be released on issue of award letter to the successful tenderer. This shall be done within one week of award letter. (c) Exemption from payment of earnest money and security deposit by any other unit/ department shall not hold good for BSNL.

7) (a) The contractor should submit & confirm Chartered Accountant Certificate in respect of turnover / Audited balance sheet & other registration certificate with attested copies (self-attested & counter attested by any BSNL / MTNL Executive or Gazetted Officer of GOI) as applicable along with the application on printed letter head for purchase of tender.

(b) The contractor shall submit and confirm his Permanent Account Number (PAN) issued by the Income-tax department.

(c) The tenderer should submit the valid WCT,Sales tax/VAT as well as EPF, ESI registration certificate.

8) i) Performance Guarantee For PART A & B (Supply & ITC Portion):- The contractor is required to furnish performance guarantee for an amount equal to 5% of the contract value of part A&B in the form of Bank Guarantee/CDR/FDR/DD (of Nationalized /Scheduled Bank in a standard format) within two weeks from the date of issue of award letter. This period can be further extended by the Engineer-in-Charge up to maximum period of two weeks on return request of contractor. The validity period of performance security in the form of performance Bank Guarantee shall be one year from the date of stipulated completion of work. For Part C: Firm has to submit Performance guarantee before 15 days of expiry of warranty period (i.e. 12 months from date of completion of work) for 10 % of the 48 Months‘ contract value of Part “C” in the form of Bank Guarantee/CDR/ FDR/DD (of Nationalized /Scheduled Bank in a standard format). The validity period of performance security in the form of

performance Bank Guarantee shall be four years from the date of completion of work. PG & SD for Part - A & B shall be released only after receipt of PG for Part-C.

ii) Security Deposit : For PART A & B (Supply & ITC Portion) - In addition to the performance guarantee stated above, a sum @ 5% of the gross amount of the bill shall be deducted from each running bill of the contractor till the sum be deducted with the sum already deposited as earnest money, will amount to security deposit of 5% of the tender value of the work.

9) The acceptance of tender will rest with the Chief Engineer (E), who does not bind himself to accept the lowest tender or any other tender and reserve to himself the authority to reject lowest or all the tenders received without assigning any reason. All tenders in whom any of the prescribed conditions are not fulfilled or incomplete in any respect are liable to be rejected. Tenders with any condition including that of conditional rebate shall be rejected forthwith summarily.

10) Canvassing in connection with tender is strictly prohibited and the tenders submitted by the contractors who resort to canvassing will be liable for rejection.

11) The BSNL reserves itself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rates quoted.

12) (i) The tenderer should give a certificate that none of his/her relative is employed in BSNL units. In case of proprietorship firm, certificate will be given by the proprietor and for partnership firm certificate will be given by all the Directors of the company.

(ii) Near relatives of all BSNL employees either directly recruited or on deputation are prohibited from participation in tenders and execution of works in the different units of BSNL. The near relatives for this purpose are defined as:

(a) Members of a Hindu Undivided family. (b) They are husband & wife. (c) The one is related to the other in the manner as father, mother, son(s), and son‘s wife

(daughter-in-law), daughter(s) and daughter‘s husband (Son-in-law), brother(s) and brother‘s wife, sister(s) and sister‘s husband (Brother-in-law). (iii) The company or firm or any other person is not permitted to tender for works in BSNL unit

in which his near relative(s) is (are), posted. The unit is defined as SSA /Circle/Chief Engineer/Chief Architect/Corporate office for non-executive employees and all SSA in a circle including Circle office/Chief Engineer/Chief Architect/Corporate office for executive employees (including those called as Gazetted officers as present). The tenderer should give a certificate that none of his /her such near relative is working in the units as defined above where he is going to apply for tender /work, for proprietorship, partnership firms and limited company certificate shall be given by the authorized signatory of the firm. At breach of the conditions by the company or firm or any other person, the tender /work will be cancelled and earnest money/performance guarantee will be forfeited at any stage whenever it is so noticed. BSNL will not pay any damages to the company or firm or the concerned person. The company or firm or the person will also be debarred for further participation in the concerned unit.

13) No employee in BSNL/Government of India is allowed to work as a contractor for a period of two years of his retirement from service without the prior permission. The Contract is liable to be cancelled if either the contractor or any of his employees is found at any time to be such a person who had not obtained the permission as aforesaid before submission of tender and engagement in the contractor‘s service.

14) The tender for works shall not be witnessed by the contractor who himself /themselves has /have tendered or who may and has/have tender for the same work. Failure to observe this condition would rendered tenders of the contractors tendering as witnessing the tender is/are liable for summarily rejection.

15) It will be obligatory on the part of the tenderer to sign each page of the schedule of work and the tender documents for all the component parts and after the work is awarded he will have to enter into a separate agreement for each component with the officer concerned.

16) Any tender not submitted in proper manner or if it contains too may corrections, overwriting of absurd rates, and absurd amount will be liable to be rejected and the BSNL will be at liberty to take such action as it may deem fit without any reference to the tenderer.

17) The tenders for the work shall remain open for acceptance for a period of 90 days from the date of opening of tenders.

If any tenderer withdraws his tender before the said period or makes any modification in the terms and conditions of the tender which is not acceptable to the BSNL shall, without prejudice or to any other right of remedy be at liberty to forfeit 50% ( Fifty percent only) of the said earnest money absolutely. Further tenderer shall not be allowed to participate in the tendering process of the work.

18) Extension of validity: In case, where the letter of award of work cannot be placed within the validity of the period of the tender, the BSNL can request all tenderers to extend the validity of their respective tenders and the earnest money deposit by a reasonable period. In such cases, extension of validity of earnest money deposit by 30 days beyond the extended validity date of tender should also be asked for. While BSNL can make the request of extension, the tenderer is free to either extend the validity or refuse the request to extend the validity.

19) Unsealed tenders will be summarily rejected. 20) The contractor should read the tender documents carefully before submitting the tender. 21) Agreement shall be drawn with the successful tenderer on prescribed form. Tenderer shall

quote his rates as per various terms and conditions of the said form, which will form part of agreement.

22) The tenderer shall furnish a declaration to this effect ( In case downloaded tender) that no addition /deletion/correction have been made in the tender document submitted and is identical to the tender document appearing in website. Every page of downloaded tender shall be signed by the tenderer with stamp (Seal) of his firm /organization.

23) This Notice Inviting Tender shall form part of the contract document. The successful tenderer/contractor on acceptance of his tender by the Accepting authority, shall, within 15 days from the stipulated date of start of the work, sign the contract consisting of:- a) The Notice Inviting Tender all the documents including additional conditions specifications

and drawings if any forming the tender as issued at the time invitation of tender and acceptance thereof together with any correspondence leading thereto.

b) Standard form, BSNL EW-8.

24) Eligibility Criteria: - 1.1. Average annual turnover during the last 3 years, ending 31st March of the previous financial year, should be at least 30% of the estimated cost put to tender.

AND 1.2. BSNL CO (Electrical) approved Package AC Manufacturer.

OR 1.3. The dealer authorized by BSNL CO (Electrical) approved Package AC Manufacturers. The letter of Authorization in Original from manufacturer will have to be produced by the dealers.

OR 1.4. Experience of having successfully completed similar works in Central Government / State Government / Central Autonomous Body / Central Public sector undertaking during last 7 years ending last day of month previous to the one in which applications are invited should be either of the following :- Three similar successfully completed works costing not less than the amount equal to 40% of the estimated cost put to tender with Central / Package AC Plant with equipment Module not less than 80% of individual capacity of the Central / Package AC Plant proposed in the NIT.

OR Two similar successfully completed works costing not less than the amount equal to 60% of the estimated cost put to tender with Central / Package AC Plant with equipment Module not less than 80% of individual capacity of the Central / Package AC Plant proposed in the NIT.

OR One similar successfully completed work costing not less than the amount equal to 80% of the estimated cost put to tender with Central / Package AC Plant with equipment Module not less than 80% of individual capacity of the Central / Package AC Plant proposed in the NIT. Note: Only BSNL Corporate Office (EW) approved make HPAC units shall be provided. Apart from the approved makes available on website www.electrical.bsnl.co.in, any other make approved by BSNL CO (EW) till the last date of opening of tender shall also be accepted.

Documentary proof of satisfying above conditions and valid Chartered Accountant certificate towards deposit of income tax, valid Bihar Sales Tax / VAT, registration for execution of works contract tax , Service Tax Registration, valid EPF Registration & ESI Registration to be furnished along with application; Agency should also submit the attested copy of PAN card.

Validity of tender shall be for 90 days from the date of opening of tender. The tenders of contractors who do not deposit earnest money in the prescribed manner (in separate cover) are liable to be rejected and will not be opened. NOTE: Tender document can also be downloaded from the website - http://www.tender.bsnl.co.in >>> Tenders >>> Current Tenders >>> Electrical Wing >>> PATNA Division. The firm who quotes on the tender issued by the BSNL/ downloaded from web-site shall strictly follow the following procedure:- 25. The tenderer shall submit the tenders in two sealed covers marked as 1st and 2nd with name of work. In case bidders, not mentioning name of work on both the envelopes, bids shall be disqualified. Both the envelopes should be separate and they should not be enclosed in a common 3rd cover.

a. If the tenderer quotes on the tender issued by the BSNL: (i) 1st cover shall contain Earnest Money Deposit in the prescribed form. (ii) 2nd envelope shall contain duly filled tender document. The first envelope shall be opened first. The second envelope shall not be opened at

all in case:- (i) EMD is not in proper form.

If during the process of tender finalization, if it is detected that the tenderer has submitted tender documents after making any change /additions/deletions in the tender documents issued by the department, the offer shall summarily rejected and the EMD deposited by the tenderer shall be forfeited in addition to any other action as per prevalent rules.

b. If the tenderer quotes on the tender downloaded from the website: (i) 1st cover shall contain tender application, tender cost in prescribed form, the attested

credentials of the firm fulfilling eligibility criteria and the Earnest Money Deposit in the prescribed form. EMD and tender cost should be separate. The credentials shall be self attested and counter attested by any executive of BSNL/MTNL or Gazetted officer of GOI as applicable along with the application on printed letter head for purchase of tender. If not counter attested then original documents shall be produced at the time of tender opening.

(ii) 2nd envelope shall contain duly filled tender document. The tenderer shall submit only the downloaded original computer print out of the document from Web site. The photo copy shall not be accepted. The first envelope shall be opened first. The second envelope shall not be opened at all in case:-

i) Tender fee is not submitted in proper form. ii) EMD is not in proper form. iii) Firm fails to fulfill eligibility criteria on the basis of document submitted in the

first envelope. If during the process of tender finalization, if it is detected that the tenderer has submitted tender documents after making any change /additions/deletions in the tender documents downloaded from the website, the offer shall summarily rejected and the EMD deposited by the tenderer shall be forfeited in addition to any other action as per prevalent rules.

2. If any difference / discrepancies found between the tender form issued by the Division

office and the NIT, the contents in NIT issued from C.E. (E)‘s office will be final & binding.

NOTE: In case the tenderer is not able to download the tender document from the web site (www.tenders.bsnl.co.in) due to server/payment gateway problem etc. then the tenderer should immediately contact the EE(E) BSNL, Electrical Division, Patna on his mobile no 9471005874 and send a communication by E-mail indicating the problem along with the print of the computer screen indicating the error(error report) and his E-mail ID at least two days before opening of tender document. Then the EE (E) will E-mail the tender document at the E-mail ID of prospective tenderer after examining the request /complaint. This E-mailed tender document can be downloaded by the tenderer and shall now be treated as same as internet downloaded tender document. The cost of the tender document shall be deposited in the First cover along with EMD & credential etc. failing which the second cover containing tender document shall not be opened. (d) Before tendering, the contractor shall inspect the site and fully acquaint himself about the condition with regard to accessibility of site and site nature and the extend of grounds, working condition, including stocking of materials, installation of T&P etc., and conditions affecting accommodation and movement of labour etc., required for the satisfactory execution of the contract. No claim whatsoever on such account shall be entertained by the BSNL in any circumstances. 03. SUBMISSION OF TENDERS : 3.1 The bidder shall submit the tender in two sealed envelopes marked as

envelope 1st and 2nd. The 1st envelope should contain the Earnest Money in the form of DD/CDR/BG and all other credentials. The 2nd envelope should contain the Techno-commercial Bid (Tender document). In case the 1st envelope is not annexed or Earnest Money & other credentials is not in proper form, then the 2nd cover containing tender documents will not be opened and the offer will be rejected.

3.2 The envelope-1st ( EMD & Credentials) shall contain the following: 3.2.1 Necessary Earnest money Deposit (EMD) may be submitted in the form of

CDR / FDR / DD / BG of a scheduled Bank or Nationalized Bank /State Bank guaranteed by Reserve Bank of India drawn in favour of A.O, O/o the PGMTD, BSNL, Patna ( BG should be submitted as per MODEL FORM OF BID SECURITY FORM). The Bank Guarantee shall be valid for a period of 120 days from date of opening of tender.

3.2.2 Cost of tender documents/ proof of payment of cost of tender document. 3.2.3 Chartered Accountant Certificate for turnover.

3.2.4 Copy of PAN card issued by Income Tax department.

3.2.10 The credentials shall be self attested as well as certified by any BSNL Executive. If the credentials are not certified by BSNL Executive, then original documents shall be produced at the time of tenders opening.

BSNL 3.3 The envelope-2nd shall contain the following :-

3.3.1 Techno-commercial Bid (Tender document) duly filled up.

3.3.2 The second cover ( Envelop 2nd) containing the Techno- commercial Bid ( tender

document) shall be opened only if the conditions regarding eligibility, tender cost , EMD etc is furnished fully as per the NIT.

3.4. The time allowed for carrying out the work will be three Months from the date of L.O.I.

3.5. Issue of tender form will be stopped two days before the date fixed for opening of tenders. Tenders will be sold on working days; no tenders will be sold after 1600 hours.

3.6 a) Earnest Money amounting to Rs.58,120.00 in the form of demand draft/ FDR/ BG/

CDR of a nationalized/scheduled bank guaranteed by the Reserve Bank of India, drawn in favors of Accounts Officer (Cash), O/o the PGMTD, BSNL, Patna must accompany each tender. The Validity period of EMD is 120 days (validity period of tender + 30 days), from the date of opening of tender.

b) The EMD of all the unsuccessful tenderers shall be released on issue of award letter to the successful tenderer. This shall be done within one week of award letter.

c) Exemption from payment of earnest money and security deposit by any other unit/ department shall not hold good for BSNL.

4. TENDER OPENING:-

Tenders, which should always be placed in sealed envelope, in the manner detailed at Para no. 3.0 above, will be received and opened on the due dates in BSNL, Electrical division, Patna up to 15:00 Hrs & 15:30 Hrs. respectively by Executive Engineer (E) or his authorized representative in his office. 4.1 Envelope-1st containing the EMD & Credentials shall be opened on the due date. 4.2 Envelope-2nd containing the credentials, Techno-commercial bid etc shall be

opened on the same date. 4.3 After the opening of Envelope-1st & 2nd, Techno-commercial bid shall be evaluated

by BSNL. 4.4 Deviation, objectionable stipulations and discrepancies, if any, shall be brought to

the notice of eligible bidders by BSNL for clarification, giving a minimum 7 days notice.

4.5 All communication with the bidders shall be in writing. FAX / E-Mail shall be covered under this category and considered as adequate means of communication.

4.6 If a holiday is declared on the tender opening day, the tenders will be opened on the next working day.

5 i) Performance Guarantee: The contractor is required to furnish performance guarantee

for an amount equal to 5% of the contract value of SH-I and SH-II only in the form of bank guarantee / CDR/FDR/DD (of a nationalized / Scheduled Bank in a standard format) within two weeks from the date of issue of award letter. This period can be further extended by the Engineer-in-charge upto a maximum period of 2 weeks on written request of Contractor. The validity period of the performance security in the form of performance bank guarantee shall be one year from the date of actual completion of work .For maintenance contract the firm is required to furnish performance guarantee of 5% of contract value of SH-III only before start of AMC .Validity of this PG will be up to actual completion of maintenance period.

ii) Security deposit: In addition to performance guarantee stated above, a sum @ 10% of

the gross amount of the bill shall be deducted from each running bill of the contractor till the sum be deducted with the sum already deposited as earnest money, will amount to security deposit of 5% of the contract value of the work of SH-I and SH-II only. This security deposit will be released after completion of warranty period .For maintenance contract in addition to PG stated above, a sum@10% of the gross amount of the bill of maintenance work shall be deducted from each running bill of that contractor till the sum to be deducted will amount to 5%of contract value of work of SH-III. This security deposit will be released after actual completion of maintenance period.

6 The acceptance of a tender will rest with the Chief Engineer (E), BSNL Electrical Bihar Zone,

Patna, who does not bind himself to accept the lowest tender or any other tender and reserves to himself the Authority to reject lowest or all the tenders received without assigning any reason. All tenders in which any of the prescribed conditions are not fulfilled or incomplete in any respect are liable to be rejected. Tenders with any condition including that of conditional rebates shall be rejected forthwith summarily.

7 Canvassing in connection with tender is strictly prohibited and the tenders submitted by the contractors who resort to canvassing will be liable for rejection.

8 The BSNL reserves itself the right of accepting the whole or any part of the tender and the

tenderer shall be bound to perform the same at the rates quoted.

9 i) The tenderer should give a certificate that none of his/her relative is employed in BSNL units In case of proprietorship firm, certificate will be given by the proprietor and for partnership firm certificate will be given by all the Directors of the company.

ii) Near relatives of all BSNL employees either directly recruited or on deputation are prohibited from participation in tenders and execution of works in the different units of BSNL. The near relatives for this purpose are defined as:

a) Members of a Hindu Undivided family. b) They are husband and wife. c) The one is related to the other in the manner as father, mother, son(s) & son's wife

(daughter-in-law), Daughter(s) & daughter's husband(son-in-law), brother(s) & brother's wife, sister(s) & sister's husband(brother -in-law).

iii) The company or firm or any other person is not permitted to tender for works in BSNL Unit in which his near relative(s) is (are) posted. The unit is defined as SSA/Circle/Chief Engineer/Chief Archt./Corporate office for non executive employees and all SSA in a circle including circle office/Chief Eng./Chief Archt./Corporate office for executive employees (including those called as Gazetted officers at present). The tenderer should give a certificate that none of his/her such near relative is working in the units as defined above where he is going to apply for tender/work, for proprietorship, parternership firms and limited company certificate shall be given by the authorized signatory of the firm. Any breach of these conditions by the company or firm or any other person, the tender/work will be cancelled and earnest money/performance guarantee will be forfeited at any stage whenever it is so noticed. BSNL will not pay any damages to the company or firm or the concerned person. The company or firm or the person will also be debarred for further participation in the concerned unit. The format of the certificate to be given is—

10 No employee in BSNL/ Govt. of India is allowed to work as a contractor for a period of two years of his retirement from service without the prior permission. The contract is liable to be cancelled if either the contractor or any of his employees is found at any time to be such a person who had not obtained the permission as aforesaid before submission of tender and engagement in the contractors‘ service.

11 The tender for the works shall not be witnessed by the contractor who himself/themselves has/ have tendered or who may and has/have tender for the same work. Failure to observe this condition would render tenders of the contractors tendering as witnessing the tender is/are liable for summarily rejection.

12 It will be obligatory on the part of the tenderer to sign each page of the Schedule of work and

the tender documents for all the component parts and after the work is awarded he will have to enter into a separate agreement for each component with the officer concerned.

13 Any tender not submitted in proper manner or if it contains too many corrections, over writings

of absurd rates, and absurd amount will be liable to be rejected and the BSNL will be at liberty to take such action as it may deem fit without any reference to the tenderer.

14 The tenders for the work shall remain open for acceptance for a period of 90 days from the

date of opening of the tenders. If any tenderer withdraws his tender before the said period or makes any modification in the terms and conditions of the tender which is not acceptable to the BSNL shall, without prejudice to any other right of remedy be at liberty to forfeit 50% (fifty percent only) of the said earnest money absolutely.

15 Extension of validity: In case, where the letter of award of work cannot be placed within the

validity period of the tender, the BSNL can request all tenderers to extend the validity of their respective tenders and the Earnest Money deposit by a reasonable period. In such cases, extension of validity of Earnest Money deposit by 30 days beyond the extended validity date of tender should also be asked for. While BSNL can make the request for extension, the tenderer is free to either extend the validity or refuse the request to extend the validity.

16 Unsealed tenders will be summarily rejected.

17 The contractor should read the tender documents carefully before submitting the tender.

18 Agreement shall be drawn with the successful tenderer on prescribed form. Tenderer shall quote his rates as per various terms and conditions of the said form, which will form part of the agreement.

19 The tenderer shall furnish a declaration to this effect (incase downloaded tender) that no

addition/deletion/correction have been made in the tender document submitted and is identical to the tender document appearing on website as per ANNEXURE-A. Every page of downloaded tender shall be signed by the tenderer with stamp (seal) of his firm /organization.

20. This Notice Inviting Tender shall form part of the Contract document. The successful tenderer/contractor on acceptance of his tender by the Accepting authority, shall, within 15 days from the stipulated date of start of the work, sign the contract consisting of :-

a) The Notice Inviting Tender, all the documents including additional conditions, specifications and drawings, if any forming the tender as issued at the time of invitation of tender and acceptance thereof together with any correspondence leading thereto.

b) Standard Tender Form BSNL EW-8 as available on the web site www.bsnl.co.in.

BNL c) EPF Provisions :

The agency has to comply with the provision of EPF and miscellaneous provisions Act - 1952 and employees Provident Fund scheme-1952 as amended up to date in respect of labours / employees engaged by them for this work. Any consequences arising due to non-complying of provisions as specified above shall be of the sole responsibility of the firm only.

21 Eligibility Conditions: FOR HVAC AND PACKAGE ( HIGH SENSIBLE / PRECISION) AC

UNITS :

The Contractors satisfying the following conditions:

1.1. Average annual turnover during the last 3 years, ending 31st March of the previous financial year, should be at least 30% of the estimated cost put to tender.

The firm shall read carefully the following conditions and shall quote accordingly confirming all the points in their offer.

A) GENERAL TERMS AND CONDITIONS;_ 1. SUBMISSION AND OPENING OF TENDERS:-

i. The tender shall be submitted as prescribed in clause 6 of BSNL EW 6. ii. The tenderer are advised not to deviate from the technical specifications / items,

commercial terms and conditions of NIT.

2. EVALUATION OF TENDERS:- The evaluation and comparison of responsive bids shall be done on the basis of Net cost to BSNL. Net cost to BSNL= [(Quoted amt. for Part-A + Part-B + Part-C) - (Cenvatable amount i.e. Excise Duty + Service Tax for Part-A + Part-B + Part-C)]. If Cenvatable amount break up is not given then same shall be treated as zero & evaluation shall be done accordingly.

3. Operation of Individual agreements shall be governed as follows: i) The agreement (Separate for A. Supply Portion, B. Installation, Testing & Commissioning Portion and C. Comprehensive Maintenance) shall be framed in the O/o EE (Elect.), Patna.

ii) For A] Supply Portion , B] Installation, Testing & Commissioning Portion and C ] COMPREHENSIVE MAINTENANCE Portion:- Individual award Letter for the work shall be issued by EE (Elect.), Patna to the firm and will made separate agreement for ―Supply‖, ―Installation Testing Commissioning‖ and ―comprehensive maintenance. iii] a) Date of start of A. Supply Portion, and B. Installation, Testing & Commissioning Portion agreements shall be the date of issue of award letter and time allowed to carry out the work shall be counted thereafter as per terms of this NIT.

b) Date of start of COMPREHENSIVE MAINTENANCE portion agreement will be after one year of successful initial acceptance testing and time allowed to carry out the work shall be counted thereafter as per terms of this NIT. iv] Individual agreement shall be operated independently without co-relation with the other individual agreements for the purpose of payment, deduction/release of Security Deposit, extension of time, closing of contract etc. as per terms and conditions of individual agreement. If the firm fails to commence any work, the PG of the individual work shall be forfeited. v] S. D. and other deposits as per terms and conditions of individual agreement shall be kept with the concern EE (E) and refunded / adjusted as per relevant clause of individual agreement. 4. CO-ORDINATION AT SITE:- At the site of work more than one agency may be working full cooperation shall be extended to other agencies during progress of work. Further, work shall be carried out in such a way so that it may not cause abnormal noise and hindrance to the officers of the department engaged in erection as well to the normal routine work. 6. PACKING, FORWARDING AND STORAGE AT SITE:- Before dispatch to site, the equipment / component / materials shall be properly packed so as to afford protection against transit damages and damages against storage in open areas either at transporter's premises or at work site. When storage in open area is inevitable proper waterproof covering shall be provided to protect damages on account of rainwater etc. However, damaged items shall be replaced as per the direction of Engineer-in-Charge. All the stores and materials required for satisfactory completion of the work shall be arranged at work site by the contractor from his own sources. However, safe custody of the material stored at site will be the responsibility of the contractor. 7. TRAINING OF BSNL PERSONNEL:- The contractor shall arrange to impart the training to the BSNL Personnel on the following aspects prior to provisional takeover of the plant:

a) Operation of plant b) Gas charging and pumping down of the system. c) Adjustments of settings for microprocessor controls and protective devices. d) Preventive maintenance.

8. INSPECTION AT CONTRACTOR‟S PREMISES:- The BSNL's authorized representative shall have full powers to inspect drawings of any portion of the work or examine the materials and workmanship of the plant at the contractor's work or at any other place from where the material or equipment is obtained. Acceptance of any material or equipment shall in no way, relieve the contractor of his responsibility for meeting the requirement of the specifications but shall have to be replaced free of cost by contractor in case equipment of work is found defective or of inferior quality. 9. GUARANTEE AND DEFECT LIABILITY: - The guarantee shall be valid for twelve (12) months after Commissioning of the system and initial acceptance testing thereof by BSNL Inspection Circle Team. The contractor shall guarantee that system shall be free from any defect due to the defective material and / or bad workmanship and also the equipments shall work satisfactorily with performance and efficiencies not less than the guaranteed values. The firm shall visit quarterly during guarantee period and ensure the healthiness of system. a) Any part found defective during this period shall be replaced free of cost by the contractor. The

service of the contractor's personnel if required during this period shall be made available free of cost to the department.

b) The contractor shall depute his representative within 36 hours of notification of the defect by

the department. c) A joint report shall be prepared by the representative of department and firm regarding nature

of defects and remedial action required. Time schedule for such action shall be also finalized. d) In case the contractor fails to depute his representative within 36 hours of notification of the

defect or fails to cause remedial measure within reasonable time as decided during joint inspection, the department may proceed to do so at the contractor‘s risk and expenses and without prejudice to any other right.

10. MISCELLANEOUS a) The workers engaged by firm should maintain proper discipline and good behavior with occupants. The firm shall not depute such workers at the site, whose behavior is found improper. Executive Engineer‘s decision shall be final. b) The agency will provide the workers with necessary Tools & Plant, Testing and safety equipments. c) Agency has to observe all the labour rules and regulations in force and indemnify BSNL against any claims whatsoever, either from this clause or any other clause in the contract. d) Firm shall issue ID card to their workforce whenever they enter premises for bonafide work. Nobody shall be allowed entry without work and nobody will be allowed overnight stay without work. The workers should wear proper uniform with detachable badge indicating the name of person & firm. 11. BYE-LAWS INDEMNITY AGAINST LIABILITIES a) The contractor shall comply with all bye-laws and regulations of local and statutory authorities having jurisdiction over the works and shall be responsible for payment of all fees and other

charges and giving/receiving all necessary notices and keep the Engineer-in-Charge informed about the notices issued and received. b) The contractor shall indemnify BSNL against all claims in respect of patent rights, design, trade mark or name of other protected rights in respect of any plant, machine, work or materials used for or in connection with the works or temporary works and from and against all claims, demands, proceedings, costs, charges and expenses whatsoever in respect of or in relation thereon. The contractor shall defend all actions arising from such claims and shall him-self pay all royalties. c) License fees, damages, cost and charges of all and every sort that may be legally incurred in respect thereof shall be borne by the contractor. d) All liabilities / penal recoveries on matters arising out of tax/excise/levies such as incorrect deductions, discrepancies in the filling up returns, revised assessments by the concerned authorities etc. shall be borne by the contractor. e) It is contractor's liability to follow all safety procedures in accordance with relevant I.S. amended up to date during execution of work at site. 12. COMPENSATION FOR DEFAULTS a) Any damage to the installation(s)/building due to the carelessness on the part of firm‘s staff shall be the responsibility of firm and shall be replaced/rectified without any extra cost. b) Any accident or damage will be the responsibility of agency and the Department will not entertain any claim, compensation, penalty etc on this account or on account of non-observance of any other requirement of law relevant to his work. c) All breakdown calls / complaints have to be attended by the firm with utmost promptness. If the agency fails to rectify any fault within reasonable time, the department reserves the right to carry out the work at the risk and cost of the agency. In case the fault is of emergency nature, which may affect the normal functioning of the services and the firm fails to take immediate necessary action the work shall be carried out at the risk and cost of the firm without giving any notice. The decision of the EE (E) shall be final. 13. REJECTION OF DEFECTIVE UNITS a) If the completed plant or any portion thereof, before it is taken over, be found defective or fails

to fulfill the intent of the specifications, the contractor shall on receipt of a written notice from the Engineer-in-Charge, forthwith make good the defective plant.

b) If the contractor fail to rectify the defects and or make good the defective plant within a

stipulated time mentioned in the written notice or replace the plant at no extra cost, BSNL may make good, reject and or replace at the risk and expanses of the contractor, the whole or any portion of the plant which is defective or fails to fulfill the requirements of the contract.

c) All the equipments shall be tested as per tender specifications. Where test results indicate

capacity less than specified in the equipment schedule, the contractor shall pay to the BSNL prorata compensation against each item. No compensation shall be payable, if the short fall is 3% or less.

14. Display Board;-

One display board should be provided in the Package AC plant room showing all details of the Package AC units plant i.e no of units, capacity of each unit, date of installation, date of commissioning (Date of Pre A/T and Date of final A/T), type & quanitity of refrigerant charged and HP/LP cut off etc.)

B. COMMERCIAL CONDITIONS OF CONTRACT

1. a. The bidder shall give the total composite price inclusive of all Central & state‘s levies and taxes i.e. Sales-tax, purchase tax, turnover tax, Service tax works contract tax etc. or any other taxes or duties etc. except octroi / L.B.T. etc. However the evaluation and comparison of shall be done on the basis of Net cost to BSNL. Net cost to BSNL=[(Quoted amt. i.e. total cost offered inclusive of duties and all taxes such as sales tax, service tax packing, forwarding ,freight and insurance charges etc. for Part-A + Part-B + Part-C) - (Cenvatable amount i.e. Excise Duty + Service Tax for Part-A + Part-B + Part-C)]. If Cenvatable amount break up is not given then same shall be treated as zero & evaluation shall be done accordingly. b. The total composite price shall comprise of unit price and all other components of price need to be individually indicated quoted against the goods/material/service, it proposes to supply under the contract in the following manner:- i) The Basic Unit Price (Ex-Factory Price) of the goods /services/ materials, Excise Duty, Sales Tax, Freight, Forwarding, Packing, service tax, insurance and any other levies /charges already paid or payable by the contractor/ supplier shall be quoted separately. ii) The liability to pay all taxes, levies, etc shall be of contractor and BSNL will not entertain any claim whatsoever in this respect. c. No concessional form except Sales Tax form ‗C‘ for the items as specified in the schedule of works and meant for use in BSNL shall be provided by BSNL. Form ‗C‘ shall be provided by the BSNL only on the specific request of the contractor.‖ • The unit wise cost / break up is necessary for the purposes of information and verification of composite price so quoted by the contractor/supplier. • The contractor/supplier shall submit to BSNL documents /proof of payment of all taxes / levies along with exemption certificate if any, to avail CENVAT benefits by BSNL • However the evaluation and comparison of respective bids shall be done on the basis of net cost to BSNL on the total cost offered inclusive of duties and taxes (but –excluding CENVAT-able duties and taxes) sales tax, packing, forwarding, freight and insurance charges etc. 2. The contractor shall, keep necessary books of account and other documents for the purpose of this condition as may be necessary and shall allow inspection of the same by a duly authorised representative of BSNL and further shall furnish such other information/ document as engineer-in-charge may require. 3. The Contractor shall, within a period of 30 days of imposition of any further tax or levy in pursuant to the constitution of (forty sixth amendment) act 1982 give a written notice thereof to the Engineer-in-charge that the same is given pursuant to this condition, together with all necessary information relating thereto. 4. TAX DEDUCTED AT SOURCE: - BSNL shall deduct work contract tax, income tax and other statutory deductions from payments due to the firm as per rules of the State/Central Government. The Accounts Officer of the concerned Division shall issue certificates for such deductions to the firm. The rates offered by the firm shall be inclusive of VAT as applicable in the state. The BSNL shall deduct TDS (e.g. work contract tax, income tax and other statutory deductions) from payments due to the firm as per rules of the State / Central Government. Certificate for such deductions shall be issued to the firm by the Accounts officers of the concern division. 5. PAYMENT TERM: - A. SUPPLY ITEMS [ITEM NO-1] - No advance payment will be made. The payment terms for all items shall be governed as under. Stipulations like levy of interest if payment is not made in specified time are not acceptable to the BSNL.

a) For supply of items 95% of the price shall be paid on receipt of goods at site by the consignee. For claiming this payment the following documents are to be supplied to the paying authority:-

i. Excise gate pass / Invoice or equivalent document favoring BSNL shall be supplied by the supplier.

ii. Delivery challan. iii. Consignee receipt. iv. Proof of payment of octroi / L.B.T. / entry tax, if any

NOTE: 100% Payment (in place of 95 %) may be made on delivery , provided that an additional bank guaranty for an amount equivalent to 5 % of the value of supplies valid for a minimum period of one year is furnished by the supplier along with an undertaking that the shortages / damages are intimated to the supplier in writing shall be made good.

b) The balance 5 % payment shall be released after satisfactory commissioning of equipment or 6

months from the date of supply of the equipment whichever is earlier. c) In cases where shortages / damages are intimated to the supplier in writing, the balance

payment shall be released only after the cases are settled in accordance with the provision of the P.O.

d) No payment will be made for goods rejected at the site on testing. Payment, if made for such items shall be recovered from subsequent bills or other bills.

e) No concessional form will be issued by BSNL.

B. ITC & MISC. ITEMS – 70% of prorata of approved price breakup of contract on successful physical installation, trial run and successful initial Acceptance Testing of AC system. 30% of prorata of approved price breakup of contract on successful Final performance cum Seasonal Test of AC system. C. COMPREHENSIVE MAINTENANCE ITEMS - The payment shall be made quarterly. 6. FORFEITURE OF EMD – a] If any tenderer withdraws his tender before the expiry of the validity period or before the issue of letter of acceptance whichever is earlier or makes any modifications in the terms and conditions of the tender which are not acceptable to the department, then the BSNL shall without prejudice to any other right or remedy, be at liberty to forfeit 50% of earnest money absolutely.

b] If contractor fails to furnish the prescribed performance guaranty within the prescribed period the amount of EMD with reference to estimated amount will be forfeited without any notice. c] If only a part of work as shown in the tender is awarded and the contractor does not commence the work , the amount of EMD with reference to estimated amount will be forfeited. e] In case of forfeiture of EMD as prescribed in a to c above, the tenderer shall not be allowed to participate in the retendering process of the work.

7. COMPLIANCE OF EPF ACT: The firm has to fulfill / compliance of the provisions of EPF & Misc. Provisions Act 1952 & Employees‘ Provident Fund Scheme 1952.The each claim bill of contractors must accompany the 1) List showing the details of laborers / employees engaged. 2) Duration of their engagement. 3) The amount of wages paid to such laborers / employees for the duration in question. 4) Amount of EPF contributions (both employers and employee‘s contribution) for the duration of engagement in question paid to the EPF authorities. 5) Copies of authenticated documents of payments of such

contribution to EPF authorities and 6) A declaration from the contractors regarding compliance of the conditions of EPF Act, 1952. 8. SERVICE TAX : Invoice indicating the quantum of Service tax paid on Installation, Testing, Commissioning Portion and Comprehensive Maintenance Portion. Invoice should indicate the name of the consignee with relevant Service tax registration no. as intimated by Executive Engineer (E) concerned The Rates quoted by the contractor shall be inclusive of his service tax liability as service provider in works contracts as per the service tax rules applicable as on date. At present, the service tax is to be norm in the ratio of 50:50 by the service provider (contractor) & by the service receiver (BSNL) in respect of work contacts. The Contractor, as a service provider, shall be fully responsible for the payment of his service tax liability to the service tax department & BSNL will not be responsible for any default on the part of the contractor. BSNL as service receiver shall directly pay its liability to service tax department & no reimbursement shall be made to the contractor. Any further amendment notified by the government in service tax rules during the currency of agreement shall also be applicable without any separate notice. NOTE: No additional condition whatsoever will be accepted for turnover tax/sales tax on works contract. In case of additional conditions for the payment of such taxes by the contractor the tender may be liable to be summarily rejected by the accepting authority. No conditional offer shall be entertained and rejected. (Standing order No.258) C) SUPPLY PORTION AGREEMENT (PART-A) - 1. VARIATION IN EXCISE DUTY:- In case of any statutory variation in regard to excise duty only in respect of AC Package Units, within the stipulated date of completion of individual agreement, the same shall be paid or recovered as per the actual against valid documentary proof. However, beyond this period dept. will take advantage of any reduction in excise duty but will not pay extra on account of increase in excise duty. 2. OCTROI / L.B.T.: - The rate quoted by the firm shall be exclusive of octroi / L.B.T.only for Package units. For other materials octroi / L.B.T. shall be inclusive. No octroi / L.B.T. exemption certificate shall be issued. The octroi / L.B.T.actually paid only for Package units shall be refunded as per actual on production of valid documentary proof / original receipt and other concerned original documents of the octroi / L.B.T. levying authority specifying the materials. 3. STORES AND SAFETY: - Before dispatch to site, the equipment / component / materials shall be properly packed so as to afford protection against transit damages and damages against storage in open areas either at transporter's premises or at work site. Special care shall be taken in respect of sensitive items like heat transfer surface of cooling coils, air-cooled condenser etc. When storage in open area is inevitable proper waterproof covering shall be provided to protect damages on account of rainwater etc. However, damaged items shall be replaced as per the direction of Engineer-in-Charge. 4. DATE OF COMPLETION: - The work shall be deemed to have been completed after the fulfillment of the following: a) Physical completion of installation of A.C system including balancing of air and water circuits (wherever applicable) and successful trial run of the A.C system by the contractor for a period of 7 days subject to a minimum of 120 hours of running during that period in the presence of representative of the Engineer-in-Charge. b) Successful completion of the initial acceptance testing as per the BSNL standards in the presence of representative of Engineer-in-Charge and Inspection Circle of BSNL.

5. GUARANTEE AND DEFECT LIABILITY: - The guarantee shall be valid for a period of 12 months after initial acceptance test. However, the microprocessor shall be having a warranty period for three years. The contractor shall guarantee that all equipments shall be free from any defect due to the defective materials and bad workmanship and that the equipment shall work satisfactorily and that the performance and efficiencies of the equipments shall be not less than the guaranteed values. Any part(s) found defective during the guarantee period shall be replaced or made good by the contractor without any charge whatsoever. The services of the contractor's personnel, if requisition during this period for such work, shall be made available free of any cost to the dept. a) The contractor shall depute his representative within 36 hours of notification of the defect by the department. b) A joint report shall be prepared by the representative of department and firm regarding nature of defects and remedial action required. Time schedule for such action shall be also finalized. c) In case the contractor fails to depute his representative within 36 hours of notification of the defect or fails to cause remedial measure within reasonable time as decided during joint inspection, the department may proceed to do so at the contractor‘s risk and expenses and without prejudice to any other right. d) Agency shall provide Quarterly free servicing up to guarantee period. If the firm fails to carry out the same, the department may proceed to do so at the contractor‘s risk and expenses and without prejudice to any other right. D) ITC Potion of AGREEMENT:- 1. DRAWINGS TO BE SUBMITTED FOR APPROVAL The contractor shall get the following drawings approved before the start of the work: a) A dimensional drawing giving complete details of the erection of the equipment in plant room

(including condensers, refrigerant piping and details of foundations). While deciding layout future expansion, if any, has to be taken into consideration.

b) Electric wiring diagrams for all Electrical equipments including controls showing cable sizes and equipment capacities.

2. TESTING AT SITE: - a) TRIAL RUN After installation is complete physically and all adjustments as listed above are carried out, the plant shall be subjected to trial run. The trial run is to be conducted for a period or 7 days subject to minimum running of 120 hours in the presence of representative of the BSNL. During this test performance of all the equipments and control systems shall be checked. Inside conditions shall also be recorded on this trial run. A record of this test shall be submitted to the Engineer-in-Charge who shall arrange for initial acceptance testing thereafter. b) INITIAL ACCEPTANCE TESTING After completion of trial run the plant shall be subjected to initial acceptance testing as per standards of the BSNL. This testing shall be conducted jointly by the representative or the Engineer-in-Charge, Inspection circle and user. A list of all defects and discrepancies shall be prepared during the test, which shall be rectified by the agency within a period of 15 days. c) FINAL PERFORMANCE CUM SEASONAL TEST. This test shall be conducted jointly by the representative of the Engineer-in-Charge, and Inspection Circle of BSNL and user as per standards of the BSNL. The test shall be conducted between 1st April to 30th September.

d) The BSNL shall have the right to operate all equipments if in operating conditions, whether or not such equipment, have been accepted as complete and satisfactory. Repairs and alternations shall be made at such times as directed by Engineer-in-Charge.

e) In special circumstances the BSNL may have to use the plant to air condition some areas even before the completion of whole work. The firm shall co-operate fully under such circumstances.

f) Wherever relaxations are required, these should be obtained from the Superintending Engineer (Electrical) well before the final performance cum seasonal test.

g) All test equipments, the operating personnel, oil and refrigerant required for testing shall be supplied by the contractor.

3. OPERATION: - The contractor will provide staff for operation up to initial acceptance

testing (Initial AT) clearance. No extra payment for this operation will be reimbursed to firm by the BSNL except under exceptional circumstances. Staff will work under the supervision of the BSNL officers for proper operation.

4. DATE OF COMPLETION : - The work shall be deemed to have been completed after the

fulfillment of the following: a) Physical completion of installation of A.C system including balancing of air and water

circuits (wherever applicable) and successful trial run of the A.C system by the contractor for a period of 7 days subject to a minimum of 120 hours of running during that period in the presence of representative of the Engineer-in-Charge.

b) Successful completion of the initial acceptance testing as per the BSNL standards in the presence of representative of Engineer-in-Charge and Inspection Circle of BSNL.

5. COMPLETION DRAWINGS : - (I) Following drawings shall be submitted by the contractor after physical completion of the

work but before the proposed date of initial acceptance testing.

(a) Plant installation drawing giving complete details of the entire equipment including foundations.

(b) Electrical drawings showing cable sizes, equipment capacity, control components and control wiring.

(c) Schematic control drawings giving detailed sequence or operation and notes to explain the operation or the control circuit.

(d) Piping drawings showing all pipe sizes, valves and fittings. (II) One set of service manuals of air conditioning plant including salient features of the plant. 6. PAYMENT TERM: - No advance payment will be made. The payment terms for all items

shall be governed as under. Stipulations like levy of interest if payment is not made in specified time are not acceptable to the BSNL. i) 70% of prorata of approved price breakup of contract on successful physical installation,

trial run and successful initial Acceptance Testing of AC system. ii) 30% of prorata of approved price breakup of contract on successful Final performance

cum Seasonal Test of AC system. COMPREHENSIVE AMC PORTION AGREEMENT For details refer relevant Section, Specifications etc. at the end.

1.0 In modification of the existing procedure of Deposit of Earnest Money with each Tender in the shape of Cash/Demand Draft/Pay Order, it has been decided by the Telecom Commission to provide for an option to the Contractor(s) for depositing Bank Guarantee along with the Tenders for Air-conditioning, Diesel Engine Alternator, Lifts and Sub-station works wherever the amount of EMD is more than Rs.20, 000/- 2.0 The Bank Guarantee shall be from a Scheduled Bank or from a Nationalized Bank/State Bank guaranteed by Reserve Bank of India. 3.0 The Bank Guarantee shall remain in force for 30 days after the period for which the tenders are valid. 4.0 The value of the Bank Guarantee to be deposited along with each Tender shall be at the rates of Earnest Money prescribed by the Government from time to time. Note (for Part A, B, C): - 1) Rates quoted shall be inclusive of all taxes & duties. For determining L-1 Cenvatable credit items i.e. Excise duty & Service tax shall not be considered. SPECIFICATIONS FOR 7/14 TR CAPACITY HIGH PRECISION AIR

CONDITIONERS (HPACs) 1.0 SCOPE :

1.1 These specifications describe the specific requirements of microprocessor

based High Precision Air conditioners (HPACs). The HPAC unit shall consist of indoor and outdoor unit.

1.2 The indoor unit shall be floor mounted type comprising of hermetic

sealed scroll compressor(s), filter section, controller, electrical power system , multi-rows deep copper cooling coil with aluminium fins,

dehumidification cycle, modular panel cabinet construction, cabinet insulation, statically & dynamically balanced blower section, humidifier,

refrigeration controls etc. The unit shall be suitable for Top/Bottom

discharge.

1.3 The outdoor unit shall comprise of air-cooled condenser with fans.

1.4 These specifications set out the basis of design of self contained HPACs to meet the environmental needs of telecom equipments.

1.5 The firms will have to supply such units, approved from BSNLCO.

2.0 DESIGN :

back panels suitably treated for weather protection, corrosion and shall be powder coated.

3.2 Coil and blower sections shall be insulated internally for both acoustics and

thermal purposes. The insulation material shall be polyurethane foam of thickness not less than 15 mm complying to the class-B according to DIN

4102 with self extinguishing and sound absorbing properties.

4.0 COMPRESSOR :

4.1 The compressor(s) shall be of scroll hermetic sealed type of COPELAND–

ZR108C/DANFOSS make having independent refrigerant circuit.

4.2 Compressor(s) shall be suitable for R22/R407C/R410A refrigerants.

4.3 Compressor(s) shall be suitable for operation on 3-phase, 415± 10% volts, 50 Hz, AC supply.

4.4 The compressors shall be located in such a way that removal of one

compressor shall not affect the operation of the other compressor.

4.5 Compressors shall be mounted on vibration isolation pads or any other mounting approved by manufacturer.

4.6 The compressor(s) shall be provided with built in overload protection.

4.7 The Compressor(s) shall be fitted with electrically operated oil heaters. The heaters shall be “ON” when compressor is in “OFF” position and vice-versa.

It shall be possible to disconnect power supply to the heater during extended periods of shut down.

5.0 EVAPORATOR SECTION :

5.1 The Evaporator Coil shall be provided separately for each refrigerant

circuit.

5.2 Evaporator coil shall be constructed out of copper tubes not less than 0.28 mm thickness with expanded aluminium fins to give a good mechanical bond

for maximum heat transfer. The number of fins shall not be less than 12 fins per inch. Fins thickness shall not be less than 0.1 mm and provided with

hydrophilic treatment.

5.3 Face area of coil shall be selected corresponding to air velocity not exceeding

2.5 m/sec.

5.4 The condensate drain tray shall be of stainless steel of thickness not less

than 1.2mm shall be provided to cover full projected area of cooling coil to collect all the condensed water. The PVC threaded water pipe shall be

provided to drain the condensed water.

5.5 The Blower fans shall be statically and dynamically balanced.

5.6 Backward curved fan directly driven by electronically Commutated (EC) motor with integrated electronics suitable for operation on 3-phase AC

supply. The fan speed shall be controlled by sensing return air temperature/pressure/controller logic for energy saving.

5.7 Energy efficient motors of EBMPAPST/ROSSENBERG/ZEIHLABEGG make

shall be used.

5.8 Infrared /Immersed electrode humidifier shall be provided.

6.0 REFRIGERANT PIPING :

6.1 Separate piping shall be provided for each refrigerant circuit.

6.2 Each refrigerant circuit shall be suitable for operation on R22/R-407C/R

410A and shall consist of the following items:- i) Electronic Expansion Valve (EEV) controlled by the microprocessor with

special software to enable the adjustment of flow of refrigerant fluid through the evaporator. At the same time, it should not allow liquid flood

back into compressor. ii) Removable liquid line filter drier with hand shut off valves.

iii) Liquid Line sight Glass with Moisture indicator.

iv) Charging valves. v) Liquid receiver with safety plug.

6.3 Serviceable/removable components for easy removal & assembling.

6.4 The piping shall be carried with refrigerant quality copper tubes of thickness

not less than 18 SWG (1.2mm). The proper bending tool shall be used for bending of the pipes. Heavy gauge radius fittings shall be provided

wherever, bending of pipes is not feasible.

7.0 ELECTRICAL SYSTEM :

The electrical system shall confirm to relevant I.S. standard. The panel shall be accessible from front. The main incomer MCCB of suitable rating and

having a rupturing capacity of not less than 25 kA shall be provided along with

Single Phasing Preventer (SPP), Electronic overload protection, phase loss and reverse phase sequence and sensing negative sequence current to meet the

total power requirements.

7.1 The load shall be distributed equally on 3-phase, 4-wire supply.

7.2 All control wires shall be provided with not less than 1.5 sq. mm. Multi-

strand copper conductor. The control wiring shall be properly colour coded and shall be numbered/ ferruled at their point of termination to facilitate

servicing/identification.

7.3 The power and control wiring shall be provided in separate casing capping/conduit.

7.4 Heaters shall be provided with insulators, with safety thermostats,

humidistats and contactors of suitable ratings.

7.5 Isolator of suitable rating having rupturing capacity of not less than 10 kA

shall be provided for each equipment/ motor/ heater etc. However, the isolation arrangement for condenser fan motor shall be achieved through

suitable rating MCB mounted on condenser unit.

7.6 Contactor of suitable rating shall be provided with over load protection for motors and compressors.

7.7 The laminated power and control wiring diagram shall be provided on HPAC

unit.

8.0 AIR COOLED CONDENSER :

8.1 Separate condenser unit shall be provided for each refrigerant circuit.

8.2 A heat rejecting coil block shall be constructed out of copper tubes not less

than 0.28 mm thickness with expanded aluminium fins to give a good mechanical bond for maximum heat transfer. The number of fins shall not be

less than 12 fins per inch.

8.3 Fins thickness shall not be less than 0.1 mm and shall be provided with epoxy /suitable weather proof coating.

8.4 A minimum of two numbers axial flow fan directly driven by variable speed

drive shall be provided for each condenser unit.

8.5 The condenser unit shall suitably design for noise level ≤ 75 dB at a distance of 1 meter away from outdoor unit.

8.6 The Condenser unit shall be suitable for round-the-clock operation.

8.7 The body of the condenser unit shall be made out of 16 SWG (1.6 mm) corrosion resistant G.I. Sheet. The entire assembly shall be supported by

epoxy coated frame.

9.0 CONTROLS :

9.1 High pressure trip – Manual reset (for each compressor)

The unit shall trip in the event of for three consecutive LP trip.

10.0 SAFETY INTERLOCKS :

10.1 The compressor shall start with condenser fan in “ON" condition only. However, the compressor may run without condenser fan in operation.

10.2 Provision shall also be made to operate the evaporator fan without operation

of condenser and compressor.

11.0 CONTROLLER :

11.1 SCOPE :

Each unit shall have individual controller as per the manufacturer’s design

to maintain the desired temperature and humidity. The controller shall be intelligent type with microprocessor capable of communicating with other units

in same room and control the desired condition with group action. The controller shall operate the units in Master-Slave configuration; however, each

controller shall act as Master, if required, in emergency situations.

The controller shall be provided with a backlit LCD/LED screen and control keys for user inputs mounted in an ergonomic, aesthetically pleasing housing.

The controls shall be menu driven. The display & housing shall be viewable

while the unit panels are open or closed.

The controller shall fully compliant with EEC directives for electromagnetic compatibility possessing following broad features:

i) Operates and monitors so that the temperature and humidity in the

conditioned area are kept at 23 +3 0C & 40 + 20% RH respectively. However, the parameters shall be site settable.

ii) The controller shall be password protected for preventing un-authorized access.

iii) The display shall be organized into following three main sections:

humidity etc. are saved at regular intervals.

iii) Numeric/Graphic Data View : The numeric/ graphic records shall be available for supply air temperature,

return air temperature, return air humidity and outdoor ambient temperature.

iv) Unit View - Status Overview : Numeric or Graphical unit view summary displays shall include temperature,

humidity, active functions and any alarms of the units.

v) Total Run Hours : Menu shall display accumulative component operating hours for Unit and

compressors.

11.3 SERVICE MENU:

The service menu shall be defined as follows: -

i) Set Points :

The controller shall allow programming of the following conditions:

a) Temperature Set Point - 18-29ºC

b) Adjustable Temperature Hysteresis - 0.5-5ºC c) Humidity Set Point - 20-80% RH

The controller may be set within these ranges, however, the unit may not

be able to control to extreme combinations of temperature and humidity.

The controller shall include the following settable features: a) Unit identification number.

b) Startup delay, cold start delay and Fan run on timers c) Remote shutdown & general alarm management

d) Compressor sequencing. e) Return temperature control.

ii) Repair/Service Mode : Control input and output values and status shall be displayed to aid in

unit diagnostics and troubleshooting. Control inputs shall indicate on or off at the front display and shall be able to turn on or off from the front display

without using jumpers or a service terminal. Each control output shall be indicated by an LED on a circuit board.

11.4 ADVANCED MENU:

Factory Settings:

Configuration settings shall be factory-set based on the pre-defined component operation.

11.5 The Controller shall also have following features :

i) Allow adjustment of temperature, humidity set points, range of control,

alarm set points etc.

ii) Arrow/control buttons for navigation and value adjustment.

iii) Status indicators like Power, Cool, humidity etc.

iv) The controller shall be provided with power backup unit to operate during mains

power failure.

v) Programming of unit shall be based on :

(a) Equal run hours per 24 hours in a day and

(b) Turn on next unit in case the designated unit is unhealthy.

11.6 GROUP OPERATION: The optimum number of units shall be made operational in order to maintain

the necessary temperature and humidity in the conditioned area. All units can work as a single system and shall communicate with each other to maintain desired values in the conditioned area.

11.7 CASCADING EFFECTS:

If the values exceeds beyond the set points, the standby units will operate to

maintain the desired condition and after maintaining the set points, unit will return back to standby mode. In case, the standby unit(s) are not in a position

to maintain the set values, all the units shall operate collectively to maintain the desired condition.

The Controller shall have the feature of grouping/ zoning of units, if required.

11.8 SYSTEM AUTO RESTART:

The controller shall have auto restart facility to start unit sequentially after

restoration of power supply with suitable programmable time delay to minimize

total inrush current.

11.9 PREDICTIVE HUMIDITY CONTROL :

The controller shall calculate the moisture content in the room and prevents

unnecessary humidification and dehumidification cycles by responding to changes in dew point temperature.

11.10 ALARM MANAGEMENT :

11.13 The log data shall be downloadable printable in sequence of date & time. The

necessary provision shall be available to connect the laptop /flash drive through TCP/IP protocols, wherever IBMS is not available.

Section-III

ELECTRICAL WORK

1. Scope

This section sets out the basic requirement for switchboards, electrical power wiring to individual motors and other equipments, control circuit wiring and earthing etc.

1. General

1. Unless otherwise specified particularly the entire equipment shall be suitable for operation

on 415 volts/240 volts, 50Hz earthed neutral, 3/single-phase alternating current system as may be required.

2. All components, accessories, raw materials and finished parts used in manufacture and

assembly of switch boards, power and control circuit wiring and earthing system shall comply with the relevant Indian Standards amended up to date. Where Indian Standards do not exist British Standards shall apply.

3. The entire work shall comply with Indian Electricity rules and C.P.W.D general

specifications for electrical work. Particular care shall be taken to ensure compliance to I. E. rules 41, 45, 51 and 61.

4. When cables pass through pipes, wooden bushes shall be provided at both the ends. When

cables are required to pass through floors or walls, pipe inserts shall be provided and openings sealed in approved manner.

2. Control Wiring

1. Control circuit wiring shall be carried out with 250 volts grade PVC insulated armored multi

core copper conductor cables. 2. Control cables shall be of adequate cross sections to restrict the voltage drop but each

conductor shall be not less than 1.5 sq. mm. 3. Runs of control wires within the switchboard shall be neatly bunched and suitably supported

/ clamped. Means shall be provided for easy identification of the control wires by means of labeled ferrules.

4. The control wiring shall correspond to the circuit / sequence of operations and inter locks as

required for satisfactory performance of the plant.

4. Earthing

1. In accordance with Rule 61 of IE Rules, metallic frame of all medium voltage equipments / supporting frames, shall in all cases be connected to 2 separate and distinct earths. The size of such earth wires shall be not less than 4-mm dia. GI wire.

PART C

GENERAL CONDITIONS

COMPREHENSIVE AMC PORTION AGREEMENT

1. Scope of Maintenance :

a. The maintenance of HPAC units as included in the schedule of work is to be carried out on comprehensive basis. No material / spares will be supplied by BSNL. The firm has to adhere to maintenance schedule attached with this document.

b. The firm has to repair / replace defective parts / spares at no extra cost. The faulty compressor will be replaced from the original manufacturers / authorized dealer and documentary proof for the same will be given.

c. The contractor shall depute his service representative – (I) within 4 to 6 Hours in case 50% or more PAC units trip or goes faulty (emergency condition), (II) within 24 hours in case 1/2 units trip or goes faulty (in normal working condition), of notification of breakdown calls made by the department / BSNL.

d. In case the contractor fails to depute his representative within (I) 4 to 6 hours (emergency condition) or (II) 24 hours of notification of the defect or fails to cause remedial measure within reasonable time as decided during joint inspection, the department may proceed to do so at the contractor‘s risk and expenses and without prejudice to any other right.

e. The AMC period shall be started immediately after the expiry of warrantee period & will be treated as taken over for comprehensive contract from the next calendar date. The units being in warrantee period, there will not be any kind of defect list etc during handing over.

f. After the completion of maintenance contract, the Agency will hand over the installation in a healthy and free from defects condition.

2. METHODOLOGY

a. Before starting the work the agency has to supply the details as per Annexure I. A complaint book as per Annexure-II shall be kept at sub-division office by the firm and the firm shall update the same by submission of service reports. Necessary complaints will be registered by JTO (E) / SDE (E) concerned and entries will be made by him according to the service reports with due verification.

b. At the start of each quarter, the firm in consultation with SDE (E) concerned shall prepare a

tentative program for preventive maintenance to be carried out during the period by listing name of stations and date on which he may carry out the maintenance.

c. The firm shall depute only those persons who are trained in handling the unit to the

satisfaction of maintenance in charge. 3. COMMERCIAL

a. The tenderer must obtain himself at his own expenses, all the information necessary for the purpose of tendering, Inspect the site and acquaint himself with all the local conditions, means of access to work and nature of work etc. No claim shall be entertained on this account.

b. Payments shall be made on quarterly basis. It is mandatory to attach Annexure III & IV (Containing details of periodical maintenance done) with the bill. This certificate has to be signed by the S.D.E. (E).

4. SERVICE TAX: - Refer conditions mentioned earlier. 5. COMPENSATION FOR DEFAULTS

a. Any damage to the installation(s)/building due to the carelessness on the part of firm‘s staff shall be the responsibility of firm and shall be replaced/rectified without any extra cost.

b. Any accident or damage will be the responsibility of agency and the Department will not

entertain any claim, compensation, penalty etc on this account or on account of non-observance of any other requirement of law relevant to his work.

c. All breakdown calls / complaints have to be attended by the firm with utmost promptness. If

the agency fails to rectify any fault within reasonable time, the department reserves the right to carry out the work at the risk and cost of the agency. In case the fault is of emergency nature, which may affect the normal functioning of the services, and the firm fails to take immediate necessary action, the work shall be carried out at the risk and cost of the firm without giving any notice. The decision of the EE (E) shall be final.

d. Compensation for delay in removal of defects:

defects (replacement/ repair) by the Superintending Engineer (E).

6. CURRENCY OF CONTRACT

a. The currency of contract shall be 48 months (4 years).

b. The Department reserves the right to terminate the contract by giving show cause notice of one-month duration at any time during the currency of the contract.

c. The Department reserves the right to extend the contract for a maximum period of 12

months (6 months at a time) at the same rates & conditions without consent of the firm.

7. MISCELLANEOUS

a. The workers engaged by firm should maintain proper discipline and good behavior with occupants. The firm shall not depute such workers at the site, whose behavior is found improper. Executive Engineer‘s decision shall be final.

b. The agency will provide the workers with necessary Tools & Plant, Testing and safety equipments.

c. Agency has to observe all the labour rules and regulations in force and indemnify BSNL against any claims whatsoever, either from this clause or any other clause in the contract.

d. Firm shall issue ID card to their workforce whenever they enter premises for bonafide work. Nobody shall be allowed entry without work and nobody will be allowed overnight stay without work. The workers should wear proper uniform with detachable badge indicating the name of person & firm.

e. Dismantled materials shall be returned to the BSNL except those items for which the replacement is supplied by the agency.

f. The contractor has to keep all the units, neat and clean to avoid any accident and / or fire hazards.

g. Firm should have round the clock contact telephone number. In case of Emergency, contractor and authorized engineer supervisor shall be available at site on short notice from engineer-in-charge and make all efforts to make the situation normal at the earliest.

h. Firm is responsible to keep workable spares and consumables for due performance of the contract. For critical spare parts, firm shall have arrangement with dealers for prompt supply.

i. Any material used/replaced by the Firm for the work shall have same specification. Alternate Make shall be allowed, only after prior approval of the Engineer in charge.

8. MAINTENANCE SCHEDULE TO BE FOLLOWED

QUARTERLY

1. Checking and tightening of electrical connections. 2. Check compressor mounts for any undue vibrations or cracks, replace mounts, if

necessary. 3. Checks air leakage around the A/C unit and rectify. 4. Cleaning of cooling and condensing coil with air pressure (including chemical cleaning, if

required). 5. Clean internal parts of A/C units. 6. Open fan section cover. Check belts for wear & tear. Replace, if necessary. Check bearings

& alignment of belt drive and take corrective action. 7. Check operating pressures of compressors. Take corrective action for deviations. 8. Checking of Micro controller settings 9. Checking of sequential operational settings of programmer. 10. Checking all safety controls like overload, HP/LP cutouts & thermostats. Take corrective
