SALE NOTICE OF IMMOVABLE PROPETY MORTGAGED TO THE BANK ISSUED IN TERMS OF RULE 8(6) OF THE SECURITY INTEREST (ENFORCEMENT) RULES, 2002

TENDER CUM AUCTION NOTICE

Whereas G M Oils Pvt. Ltd, Old No: 52, New No: 113, Ankur Plaza, III floor, GN Chetty Road, T.Nagar, Chennai and the guarantors (1) Mr. M.Mathairasan, S/o Manickam, (2) Mr. M.Gopinath, both residing at 16/1799, I Block, II Street, AnnaNagar West, Chennai-40 and also at 16, Ammaiyapillai Nagar, Vayalur Road, Trichy- 17 (3) Dr. D.Vivakar, S/o Dorai Viswabaji, (4) Mrs. P.Subbulakshmi, W/o Dorai Viswabaji and (5) Mrs. K.Karpagam, W/o D.Vivakar all 3-5 residing at No:43, Beski Nagar, Near Vekkaliamman Koil, Woriyur, Trichy- 620003 now owe to the The South Indian Bank Ltd., Nungambakkam Branch (herein after referred as “the bank”) a sum of .2,66,17,516.65 (Rupees Two crores sixty six lakhs seventeen thousand five hundred sixteen paise sixty five only) as on 30.06.2011 along with further interest from 01.07.2011 and expenses incurred/to be incurred in SARFAESI proceedings.

WHEREAS Demand Notice dated 19.01.2010 was issued to all borrower/guarantors under section 13(2) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 and whereas you have failed to repay the amount within the stipulated time and whereas the Authorised Officer has taken symbolic possession of the immovable properties, more fully described in the schedule hereunder under Section 13(4) of the Act read with Rule 8 of the Security Interest (Enforcement) Rules, on 11.05.2010, notice is hereby given that the said property will be sold in tender cum public auction on the date and place mentioned herein below subject to the following Terms and Conditions.

DATE AND TIME OF AUCTION

1)The proposed bidders/tenderers shall read and understand the terms and conditions mentioned in the detailed Tender cum bid document published by the Bank and also visit the scheduled property and satisfy as to its area, boundaries etc. The extent of the properties shown in the proclamation is as per the respective title deed by which the mortgagor derives title. The Authorised Officer and the Bank will not be responsible for any variation in the extent due to any reason. The Bank shall not entertain any dispute regarding the Auction or the scheduled property after participating in Tender/Auction. The intending tenderers/bidders can inspect the property from outside on any date on or before 06.09.2011 after taking prior permission from the Branch Manager, Chennai Nungambakkam Branch (Ph- 044-2827 0884).

2)Property will not be sold below the reserve price fixed for it.3)The intending tenderers should submit their tender in a separate sealed cover along with the EMD of

`.20,00,000/- (Rupees Twenty lakhs only) by way of DD drawn in favour of “Authorised Officer, The South Indian Bank Limited, Chennai Regional Office” Payable at Chennai. Such tender shall be in the prescribed form purchased from the Bank and is to be submitted in the above cited office on or before 11.00 A.M. on 07.09.2011. The sealed cover should be super scribed by “Tender for the purchase of property at Trichy- A/c G M Oils Pvt Ltd.” Tenders with conditions will not be accepted. (The tender cover should contain only the tender and the demand draft for the earnest money should be kept separate. The prescribed tender form can be obtained from the undersigned or from the Chennai Nungambakkam Branch of the Bank.) Tender not in the prescribed form and tenders quoting below the reserve price will be summarily rejected.

4)Only those who submit the tender before the stipulated time and quoted at or above the reserve price will be allowed to participate in the auction at 11.30 AM on 07.09.2011.

5)The sealed tenders will be opened by the Authorised Officer, in the presence of available/attending tenderers at 11.30 AM on 07.09.2011.

6)After opening the tenders, the tenderers present will be given an opportunity, at the discretion of the Authorised Officer, to have inter-se bidding among them to enhance the offer price. The tenderers not present at the stipulated time of auction and not participating in the auction, will not be given an opportunity to enhance his offer price. For the sake of quick and convenient auction, the bid amount shall be the multiples of Rs.100000/-(Rupees One lakh only) or such amounts as decided by the Authorised Officer. In case any/all of the tenderer/s is/are not attending the auction or not bidding in the auction, the sale will be confirmed in the name of tenderer who gave the highest quotation or to the highest bidder, as the case may be. The EMD shall be liable for forfeiture without prior notice, if the successful bidder/tenderer fails to adhere to the terms of the sale, time and commit any default in any manner. The successful bidder/tenderer should pay 25% of the bid amount (less EMD) immediately on sale being knocked down in his/ her favour and the balance money in full within15 days from the date of auction, failing which the entire deposit made by him/her till then shall be forfeited without any notice and the property concerned will be re-sold.

7)At present, only symbolic possession is with the Bank. The immovable property will be sold on AS IS WHERE IS CONDITION and the successful bidder/tenderer will have to meet all the expenses relating to stamping, registration, any statutory dues like property tax etc and other necessary expenses. The sale certificate will be issued only in the name of successful bidder/tenderer and the sale is subject to the confirmation by the Bank.

8)The Authorised Officer has obtained EC regarding the property till 11.07.2011. Two attachments by DRT-II, Chennai for ̀ .16,70,104/- and ̀ . 16,62,195/- are seen in the EC. All the attachments are seen subsequent to the date of mortgage by deposit of title deeds (30.12.2008) in favour of the bank. The IAs filed by the Bank for raising 3 attachment orders in OA 36, 37 and 38/2009 is pending with DRT-II, Chennai, and the operation of order dtd. 02.11.10 of DRT-II, Chennai for impleading the bank in the IAs for attachment is now being stayed by the Hon'ble DRAT, Chennai in M.A Nos: 637, 638 and 639 of 2010. However, vide order dtd. 27.01.2011 of DRT-II, Chennai in SIA Sr.310/2011 in SA 5/11 it was held that the South Indian Bank Ltd. has prior charge over the schedule property. There are no encumbrance over the property to the knowledge of the Bank other than those mentioned herein

9)The Authorised Officer has the absolute right to accept or reject a bid or postpone/cancel the sale and to prescribe procedures for the conduct of auction.

11)This may be treated as notice to the borrower and guarantors informing them that the property will be sold if the entire amount due to the Bank as cited above and other costs and charges is not remitted on or before the

date fixed for auction/sale.12)If the sale is postponed/ adjourned for any reason, no fresh publication will be given. However the new date

of sale will be notified on the Notice board of the Regional Office, Chennai of the Bank.
