OPINION ON HB 307 “JUST
CAUSE FOR POLICE CHIEFS”
Effective August 29, 2013 the Missouri Police
Chiefs Association proposed, supported and
obtained passage of HB 307. This bill provides
specific employment process relating to police
chiefs. Based on several misinterpretations of the
bill, Representative Kenny Wilson (Former Chief of
Smithville PD) sought an Attorney General’s
opinion on some of the misinterpretations that
had come to light.

SENATE PASSES SB 613
SECOND AMENDMENT
PRESERVATION ACT –
February 20, 2014
This act lists various declarations of the Missouri
General Assembly regarding the United States
Constitution and the scope of the federal
government's authority. In addition, the act
declares that federal supremacy does not apply to
federal laws that restrict or prohibit the
manufacture, ownership, and use of firearms,
firearm accessories, or ammunition within the
state because such laws exceed the scope of the
federal government's authority. Laws necessary
for the regulation of the land and the United
States Armed Forces are excluded from the types
of federal firearms laws that exceed federal
authority. This act also declares that the General
Assembly strongly promotes responsible gun
ownership and condemns unlawful transfers of
firearms and the use of a firearm in criminal or
unlawful activity.

During the January 2014 MPCA Board Meeting, the
board approved an agreement that will provide
unlimited POST certified training on-line through

MPCA’s new virtual training academy. Training
courses range from generational differences in the
workplace to Col. Dave Grossman’s “The
Bulletproof Mind for Law Enforcement”.
Information and registration for this new service
to MPCA members and member agencies will be
coming out in March 2014. The annual cost per
officer for unlimited hours of POST approved
training will be $99.
MPCA LAUNCHES NEW BUYERS GUIDE
The MPCA had requests from members for a
directory of law enforcement service providers in
one place to make assess and contact easier.
Therefore, the MPCA has launched its new
business directory which can be access on the
MPCA web site www.mopca.com home page by
clicking on the MPCA Buyer Guide tab.

QUARTERLY REMINDER
Pursuant to section 590.070, RSMo, you are
required to notify the POST Program when you
have commissioned or terminated a peace officer
or reserve peace officer. This notification must be
made within thirty days.
Please review your POST Roster by going to our
website at www.dps.mo.gov/roster and entering
your agency ORI. If you find that changes need
to be made, you can submit those changes
electronically by going to the POST Forms section
of our website at www.dps.mo.gov/post.

MPCA WORKS WITH
ORGANIZATIONS
TO ESTABLISH ORDINANCES
RELATING TO COLLECTIVE
BARGAINING & POSTS
CURRENT AGREEMENTS ON
WEB SITE
At the request of MPCA members, the MPCA will
begin working on model ordinances along with
other organizations that have interest in
establishing model ordinances relating to
collective bargaining, training, and negotiations.
An initial meeting has been held to begin the
process. The time line is to get the project
reviewed, finalized, and rolled out by May of 2014.
The MPCA is also posting agreements finalized
regarding collective bargaining structures on the
MPCA web site located at www.mopca.com. Note,
there are not very many at this time. It is highly
recommended to review your current policies now
as this trend continues. MPCA will be assisting
with sample general orders by May of 2014 as
well.
COLLECTIVE BARGAINING
RULING IN CIRCUIT COURT OF
JACKSON COUNTY
In the case of West Central Missouri Regional
Lodge #50 of the Fraternal Order of Police et al.,
vs. The City of Grandview (Case No. 1116-CV-
34004; summary judgment was granted in favor
of Plaintiffs). Based on recent discussions, the

city is expected to appeal the judgment.

TASER SENDS NOTICE TO
LAW ENFORCEMENT AGENCIES
USING KARBON ARMS LLC
MPID/MPID-C DEVICES
On January 10, 2014 the U.S. District Court for
the District of Delaware entered a Final Judgment
and Permanent Injunction against Karbon Arms,
LLC in the patent infringement cited TASER
Internatinal, Inc. v. Karbon Arms, LLC / U.S.
District Court District of Delaware, Case No. 2011-
426-RGA.
The letter from TASER has gone to law
enforcement agencies that purchased Karbon
Arms MPID and MPID-C devises as a notice
regarding the Permanent Injunction and the
infringement of the MPID and MPID-C product
upon three of TASER’s patents.

SUPPORT FOR ADAM WALSH
ACT IMPLEMENTATION
The U.S. Department of Justice (DOJ), Office of
Justice Programs (OJP), Office of Sex Offender
Sentencing, Monitoring, Apprehending,
Registering and Tracking (SMART) is pleased to
announce that it is seeking applications for
funding under the SMART Office FY 2014 Support
for Adam Walsh Act Implementation Grant

VOLUNTEER PROGRAM
ASSESSMENT (VPA)
The Organizational Science graduate program at
the University of North Carolina at Charlotte
(UNCC) has reached out to IACP through one of
its State VIPS advocates to recruiting law
enforcement volunteer programs interested in
undergoing a comprehensive volunteer program
evaluation. This assessment, offered FREE OF
CHARGE, provides a unique opportunity for you to
look at your program through your volunteers’
eyes: how they feel about training, supervision,
satisfaction, recognition… all the program
elements that affect how well your program
operates. The only qualification is that you have at
least 30 active volunteers.

EYEWITNESS IDENTIFICATION PROCEDURES
As currently drafted, this proposed legislation
would require law enforcement agencies to
implement written protocols on procedures
relating to eyewitness identification.

PROMOTION OF BEST
PRACTICES AND AN
ALTERNATIVE APPROACH
While we cannot support the current draft, we are
continually looking for ways to improve the
criminal justice system. That’s why Missouri’s
prosecutors have launched a Best Practices
Initiative to study and promote ways to improve
the efficiency and protect the integrity of the
criminal justice system. By working together with
Missouri’s prosecutors, law enforcement
community and victims’ advocates, we can all help
ensure that every citizen in Missouri receives the
highest level of prosecution services possible.

Lambert International Airport Police Chiefs Paul
Mason is stepping down. Mason on Wednesday,
told his staff that he was retiring as of April 1,
2014.
