MOTION FOR LEAVE TO PROCEED IN THE UNITED STATES SUPREME COURTIN FORMA PAUPERIS

COMES NOW the Petitioner, Lawrence T. Tyler , Pro Se, pursuant to rule 39 hereby ask leave to

file the accompanying petition for writ of certiorari without prepayment of cost proceed in this Court in

forma pauperis. I was previously granted leave to proceed in forma pauperis in the following courts :

L U. S. District Court for the Southern District Of Texas, Houston Division;

(See Accompanying Appendix I, Docket Entry # 35.)

2, U. S. Court Of Appeals For The Fifth Circuit;

(See Accompanying Appendix I, Docket Entry # 77)

I was represented by counsel appointed under the Criminal Justice Act, 18 U.S.C. Section 3006A (b)

and (c), on appeal to the United States Court of Appeals for the Fifth Circuit. I was also represented by

appointed Counsel in the District Court, and this Court. My declaration in support of this Motion is

attached hereto.

I am unable to pay the Court's ($300) three hundred dollars Docket Fee, Filing Fees, and other fees, or

post bond for them because I am imprisoned/detained and lost my earning potential for such fees. I,

Lawrence T. Tyler, declare that I am the Petitioner in above-entitled proceding. In support of this

motion to proceed in forma pauperis, without being required to prepay fees, costs or give security

therefor, I state that because of my poverty I am unable to prepay the cost of said proceeding or to give

security therefor. My declaration is attached. Also attached is my Prisoner-Trust-Account-

Report/Detainee-Trust-Account-Report for the past (6) six months and my consent to collection of fees

from my Prisoner/Detainee Trust Account. I am an indigent Inmate/Detainee.

CONSENT TO COLLECTION OF FEES FROM DETAINEE'S TRUST ACCOUNT

I, Lawrence T. Tyler, Petitioner, hereby consent to have the appropriate prison/detention officials withhold from my prison/detainee's trust account and pay to the Clerk, Supreme Court Of The United States an initial payment of 20% of the greater of:

(a) the average monthly deposits to my account for the six-month period immediately preceeding the filing of my Petition For Writ Of Certiorari; or

(b) the average monthly balance in my account for the six-month period immediately preceding the filing of my Petition For Writ Of Certiorari.

I further consent to have the appropriate prison officials collect from my account on a continuing basis each month, an amount equal to 20% of each month's income. Each time the amount in the account reaches $10. The Trust Officer must forward the interim payment to the Clerk's Office.
