Dear Mr. Hlava:

This application, deemed to be incomplete, is hereby denied and is being returned to you. You seem to indicate in your cover letter that the proposed well will be dedicated to the W/2 (equivalent) of Irregular Section 30, Township 31 North, Range 9 West, NMPM, San Juan County, New Mexico, which comprises 208.20 acres; however, the NMOCD Form C-102 for this well shows that a non-standard 299.10-acre coal gas spacing unit comprising the W/2 equivalent of Irregular Section 31 and the SW/4 equivalent of Irregular Section 31 is to be dedicated to this well. Moreover, your application does not reference an existing order that authorized this 299.10-acre nonstandard unit, nor do you even acknowledge the fact that in either case the two units are non-standard pursuant to Rules 4 and 5 of the special rules governing the Basin-Fruitland Coal (Gas) Pool, as promulgated by Division Order No. R-8768, as amended.

BP America Production Company respectfully requests an administrative approval for a non-standard well location for the Riddle C LS well No. 5 to be drilled at a location of 2110' FSL and 925' FWL of Section 30, T31N-R09W. The non-standard location is necessitated by topographical conditions, steep terrain and existing pipelines - and would insure the conservation of surface and subsurface resources in the area. This location was staked non-standard for the Basin Fruitland Coal formation in order to best fit the existing steep terrain and maintain footage away from the edge of the cliff to avoid any adverse impact.

The location is on an existing pad of a once permitted Fruitland Coal well named Riddle Gas Com C #1 API* 30-045-28614.

To aid in your review attached is a C-102 and a 9 Section well Location plat, indicating the proposed well location and the existing Fruitland Coal wells in the BP operated 299.10 acre unit in the W/2. Also attached is a topographical map.

Amoco proposes to d r i l l the well to further develop the Fruitland Coal reservoir. The well w i l l be d r i l l e d to the surface casing point using native mud. The well w i l l then be d r i l l e d to the intermediate casing point wit a non-dispersed mud system. The attached modified 12" 3000 psi blowout preventer w i l l be used. Amoco w i l l attempt to complete the Fruitland coal by d r i l l i n g the i n t e r v a l with water and a i r . A service unit w i l l probably be used to d r i l l into the coals using the attached modified 6" 3000 psi BOP. I f commercial productivity i s established, then the well w i l l be completed as an open hole.

CONTINGENCY OPERATIONAL PLAN

In the event the well does not y i e l d commercial volumes of gas from the open hole completion, the water f i l l e d hole w i l l be mudded-up and weighted-up as necessary (9-ll///gal.) for hole s t a b i l i t y and well control. The well w i l l then be deepened approximately 200' into the Pictured C l i f f s formation to provide necessary footage for a cased and cemented completion technique. The Fruitland coals w i l l then be perforated and fracture stimulated. The Pictured C l i f f s formation w i l l be isolated with cement.

EVALUATION

Re: Administrative application dated September 6, 2005 (administrative application reference No. pMESO-529359477) for an unorthodox Basin-Fruitland coal gas well location for BP America Production Company's proposed Riddle "C" LS Well No. 5 to be drilled 2110 feet from the South line and 925feet from the West line (Lot 14/Unit K) of Irregular Section SO, Township 31 North, Range 9 West, NMPM, Basin-Fruitland Coal (Gas) Pool (71629), San Juan County, New Mexico.

Dear Mr. Hlava:

This application, deemed to be incomplete, is hereby denied and is being returned to you. You seem to indicate in your cover letter that the proposed well will be dedicated to the W/2 (equivalent) of Irregular Section 30, Township 31 North, Range 9 West, NMPM, San Juan County, New Mexico, which comprises 208.20 acres; however, the NMOCD Form C-102 for this well shows that a non-standard 299.10-acre coal gas spacing unit comprising the W/2 equivalent of Irregular Section 31 and the SW/4 equivalent of Irregular Section 31 is to be dedicated to this well. Moreover, your application does not reference an existing order that authorized this 299.10-acre nonstandard unit, nor do you even acknowledge the fact that in either case the two units are non-standard pursuant to Rules 4 and 5 of the special rules governing the Basin-Fruitland Coal (Gas) Pool, as promulgated by Division Order No. R-8768, as amended.
