Criminal Advocacy & Defective Representation Robert S. Shiels

Members of the legal profession may not want to discuss defective representation but with the increasing possibilities of it affecting them it is hugely important that they do. Robert Shiels takes on the task of reinforcing the principles of the case of Anderson v HM Advocate in 1996, prior to which there were no grounds for appeal due to defective representation.

• Contains a full analysis of Anderson v HM Advocate – the in-depth insight you need

• Provides extensive reference to relevant case law – all in this single volume

• Particular emphasis is put on comparative material from other jurisdictions – providing the full global picture

• Prepares solicitors of all experience levels to prevent appeals – saving time and reputation

Offensive Weapons Robert S. Shiels

In recent years there has been substantial policy change in the way offensive weapons are licensed and legislated against in Scotland. The ‘grave social ill’ of knife crime has quite rightly become a matter of severe public concern. Where in the past the full emphasis of the law was placed upon prosecution of criminal acts related to the carrying of such a weapon, the boundaries of criminal law have now moved on and attempts are being made, under amendments to the Civic Government (Scotland) Act 1995, to regulate the sources of knives. With knife dealers licenses now required, the issue is as much civic as criminal, meaning that this text is essential to not only solicitors, Advocates and criminal courts, but also local government and law enforcement regulating such licensed premises.

• Covers all the key legislation relating to offensive weapons

• Links together both the criminal offence and civic licensing aspects of the fight against offensive weapons

• Encompasses a wide range of reported cases deciding the law

Prisons, Prisoners and Parole

2nd Edition

Douglas Thomson • How do people get into prison?

• What happens when they are inside, and on release?

• How might a prisoner be granted parole?

• What avenues are open for prisoner complaints?

Douglas Thomson answers these questions with specific reference to relevant legislation and case law, ensuring you have the trusted, daily guidance you need.

This essential new edition shines a light on these concerns and provides guidance through them for solicitors and counsel, social workers and those with an interest in criminology and penology; and of course the parole board themselves. You can have the answers you need, with detailed explanation from an expert author.

Licensing (Scotland) Act 2005

The Licensing (Scotland) Act 2005 completely overhauled Scottish Licensing law, sweeping away the Licensing (Scotland) Act 1976 and necessitating a completely new edition of his essential text. Since then there have been substantial and intricate changes effected by the Criminal Justice and Licensing (Scotland) Act 2010 and the Alcohol etc (Scotland) Act 2010.

In this third edition, Jack Cummins again sets out the text of the 2005 Act, incorporating amendments, together with key regulations to which constant reference will be required. This new edition also takes into account a stream of cases from the sheriff court and Court of Session since the previous edition.
