Legal argument is made regarding the lack of criminal culpability of such child soldier "recruits" for conflict-related international crimes and the inapplicability of currently recommended judicial and non-judicial accountability mechanisms in such cases. The book challenges various anthroplogical accounts of child soldiers' alleged "tactical agency" to resist committing atrocity as members of armed groups or forces committing mass atrocity and/or genocide. Also provided are original interpretations of relevant international law including an interpretation of the Rome Statute age-based exclusion from prosecution of persons who were under 18 at the time of perpetrating the crime as substantive law setting an international standard for the humane treatment of child soldiers.362.7/355

The author is inspired by Omar Khadr's case, a young soldier who has been detained since he was at the age of 15, Novembre 2002, in Guantanamo Bay and tried for alleged war crimes. The author goes through controversial issues such as childhood being a social construct and children being rational moral agents, the diffusion of combatant's responsibility for war crimes and the moral justification of punishment. Focusing on non state armed groups, it is possible to move away from the traditional statist approach to sources, which denies armed groups any role in law creation, without moving to the extreme position of giving such groups complete control over their obligations or equal lawmaking powers with states. To this end, the author suggest various mechanisms (unilateral declarations, hybrid treaties, and possibly quasi-custom) for giving armed groups an opportunity to recognize existing obligations or undertake new ones, while reducing the risk of placing them on par with states or downgrading international humanitarian protections. La protección de las PDI, implica en última instancia garantizar que puedan reanudar una vida normal mediante el logro de una solución duradera. Sin embargo aunque ha habido avances normativos y conceptuales en el proceso de búsqueda de soluciones duraderas, el que haya por los menos 40 países con personas en situación de desplazamiento prolongado significa que las PDI siguen marginadas en los procesos de construcción de la paz. Se plantea que hay dificultades conceptuales que explican la escasa atencíon que se ha dado a este problema.

In the past, the laws of war allowed an army to attack enemy civilians as a reciprocal measure to an attack on its own civilians. Modern humanitarian law has attempted to outlaw such measures of reciprocity. The question is posed as to whether the attempt to outlaw such reciprocity has in fact contributed to the protection of civilians or perhaps has encouraged irregular forces to attack civilians.
