City of Rockville Leaf Collection

The final leaf collection for New Mark Commons will be the week of December 7th through December 11th.

Residents should rake leaves into the gutter or immediately adjacent to the pavement if no curb or gutter exists. Leaves can be raked out no earlier than one week prior to the scheduled collection week. This avoids the accumulation of leaves near and on the streets, which can lead to fire hazards or grass being damaged if left too long.

Limbs, rocks and other heavy objects must be removed, and leaves should not be placed in plastic bags. Residents who prefer to bag their leaves may place the leaves in biodegradable kraft paper bags and place them at the curb for collection on their regular weekly yard waste collection day. If City Leaf Collection Crews are unable to complete an area during their collection week, crews will continue working on the unfinished portion on the following Saturday.

Community Forum:

Judy Rudolph was present to discuss several concerns she has with the community. She would like the Board to review two Architectural Control Committee (ACC) approvals granted to the owners of 802 and 804 NME concerning repairs and replacement decks on the rear of these residences. She believes the decks are not compatible to the design of the original balconies and colors are not appropriate. There is a large, white box truck parked in the clubhouse parking lot. Is it permitted? It should be parked in a space that is less noticeable. The brown taxi cab should be parked perpendicular in a parking space, not taking up two spaces as it is now. The piece of equipment under the blue tarp in the parking lot needs to be removed. A problem in the 800 block townhouse parking lot is that one resident has 8 to 10 automobiles which monopolizes non-assigned parking spaces. She would like to see the Property Maintenance committee reactivated. Joe Jordan mentioned he shared Judy’s concerns and had several items he would like to mention. He would like to see the newsletter frequency return to 10 issues a year. Trash is still a concern. Residents place large items or piles of trash out and do not call the City for a special pick up. The minutes of the Board meeting need to be posted to the website in a timelier manner.

Mincy Neil mentioned she was encouraged by the number of young families she saw at the pool this summer. She said the adult pool party held this summer was a great event. She suggested we have events that appeal to younger residents and residents with kids.

Dues: Jim informed the Board that 7 residents were not current with their HOA dues.

Pool update: Pool winterization is underway. We will be adding additional chemicals to prevent algae and excessive staining of the pool white plaster coat.

168 NME: NMC received notice from Montgomery County Department of Finance that the tax sale foreclosure of the property resulted in a surplus balance of funds. Our attorney completed a Claim Form for NMC seeking reimbursement for past due HOA dues and legal fees totaling $5,979.88.

Board of Director’s Open House: From the Board members who responded to the doodle.com scheduling application, October 17th was selected the date for the Open House.

Third quarter financial review: Due to the length of the meeting, the financial review was re-scheduled for the November 5th Board meeting.

Clubhouse parking lot: The Board saw photos that Dorie Mangan had taken of the vehicles that have been using the clubhouse parking lot. The Board unanimously decided the large, white bus be prohibited from using the NMC Clubhouse parking lot. The yellow 24’ box truck had been removed from the CH parking by meeting time. The Board requested that the taxi cab owner be instructed to park in a parking space instead of occupying two parking spaces.

Jim requested our attorney review a proposed contract with Milestone Towing & Transport for impound towing. This contract will allow NMC to remove vehicles from community-owned property that are in violation of our parking rules and regulations. Towing will be a last resort after we have followed the process outlined in our Parking Rules and Regulations.

Jordan’s backyard: Jim gave the Board a letter from the Jordan’s attorney, Lynn Parker Perry of LPP Law. Jim told the Board he had also forwarded a copy to the Association’s attorney, Brian Bichy. ohn Daroff prepared a revised License Agreement between the Association and the Jordan’s for the Board’s review. He mentioned that since the Jordan’s had retained legal counsel, it would be appropriate for our attorney to reply to the LPP Law letter with any offer from the Board. Jim will forward the most recent license agreement to Brian Bichy for review and arrange a meeting with Brian to discuss the Board’s reply to LPP Law.

On October 8, 2015 there was a conference call with our attorney, Brian Bichy. On the call from New Mark Commons were John Hansman, Jeff Miller, Magnus Turesson, and Jim Denny. Based on the conversation in the meeting, Brian Bichy prepared a draft of a reply on October 9, 2015 and sent it to

the Board for their review. The final letter was approved by the Board on October 15m 2015 and sent to LPP Law.

John Hansman —late fee analysis: The Board affirmed that we continue to bill a late fee for delinquent HOA dues.

Sustainable Energy Systems (SES) proposal: We received a proposal for $69,126.75 from SES for the design and installation of a 21.95 kW solar photovoltaic (PV) system for the NMC Clubhouse roof. After discussion, the Board decided we would not pursue a PV system at this time. The community is anticipating a lake dredging project and it would be prudent to save funds for that effort. The Board can revisit a PV system in the future

Stolburg Landscaping LLC—proposals: The Board approved four proposals from Stolburg Landscaping for additional maintenance, drainage and concrete repair in the community totaling $7,550.

Over the years many things have changed in our community, including what it takes to continue to achieve that vibrancy, which is why the Board of Directors has looked at our committees and decided that they needed to be restructured and revitalized. At our November meeting, we voted to consolidate some committees and create new ones. A board member will sit on each committee as the board liaison.

Rockville Police Station Offers a Safe Haven for Online Transactions

You’re looking to sell that old coffee table on Craigslist, but you’re reluctant to invite a stranger into your home to complete the sale. Look no further than the Rockville City Police Department station, which offers its parking lot as a safe place for buyers and sellers to complete a transaction arranged on Craigslist or other online service.

The parking lot of the station, at 2 W. Montgomery Avenue, is well-lit, under constant video surveillance, and open to the public for transactions 24 hours a day, seven days a week. The RCPD offers these recommendations for buying or selling items via an online service:

• Ask questions before going to buy an item. If the seller can’t answer questions, there is a strong possibility they may not actually have the item and could be looking to commit a crime.

• Consider not buying from sellers who only list an email address. This could be a sign that the seller has something to hide. Request a telephone number and be cautious if they refuse.

• Meet in a public place, like a police station. Criminals seek easy targets and do not want witnesses.

• Do not go alone. Ask a friend to accompany you.

• Never go to a second location. If you arrive at a prearranged meeting place and are asked to go somewhere else, refuse.

• Trust your instincts. If a deal sounds too good to be true, it more than likely is.

• Stay in communication. Let your spouse, friends, family or coworkers know where you are going, who you are meeting, and when you will be back.

• Be on guard and be smart. Don’t wear expensive or “flashy” clothing. Doing so can invite criminal activity.

• Report suspicious activity. Call Rockville police at 240-314-8900.

New Website Offers ‘Open Data’ For All

Rockville Earns Praise as Model for Use and Presentation of GIS Technology

A new City of Rockville website that allows anyone to discover, examine, and download geographic information systems (GIS) data for analysis and mapping is getting the attention of leaders in the open data movement.

Rockville launched its new GIS Open Data Portal on August 12, joining many other government organizations, such as the State of Maryland and the District of Columbia, in using open data technology.

Two days after the launch, Bern Szukalski, chief technology advocate and product strategist for GIS software vendor Esri, tweeted: “New Rockville #opendata site. I like the clean look and branding … All orgs should be doing this!”

The new site replaces an older GIS data download Web page. It takes less effort to maintain and offers users a richer experience for interacting with geographic data such as the city’s boundary, zoning and planning areas, Historic Building Catalog, and bicycle routes. City staff and members of the public can use the data for analysis and map production.

The open data movement encourages organizations to increase transparency by making data available for free to anyone for use, reuse, and distribute without copyright and other restrictions. In recent years, Rockville has participated in a trend toward a growing number of web maps and applications by offering many web maps for public use. Rockville’s open data portal site can help contractors, developers, and utility companies create more useful maps. It is also useful to government agencies in, near, or close to Rockville, to community members seeking to learn more about the city and to students engaged in geographic data projects. Esri makes the GIS Open Data Portal site available at no extra cost to software licensees, including Rockville.

Trash Talk, etc. Did you know that…Two of the most frequent complaints and frustrations that we hear about from New Mark Commons residents relate to trash and dog waste. These problems impact everyone’s quality of life and property values.

In case you aren’t aware of them, both the New Mark Commons Covenants and City of Rockville laws and regulations establish standards that apply to these matters. Most importantly, adhering to these rules and guidelines is the neighborly thing to do.

From the New Mark Commons Covenants (http://www.rocknet.org/Community/NewMark/pdfs/Decl%20of%20Covenants.pdf):

Article X. Section 3. E. (e) Trash and garbage containers shall not be permitted to remain in public view except on days of trash collection. This means that in single family homes, trash and recycling bins should be stored in garages or on the side or rear of the home. In townhouses, trash bins must be stored within the fenced trash enclosures. We realize that this has become more difficult with the introduction of the larger bins, but it is still possible and is necessary to ensure the overall neat appearance of the neighborhood.

City of Rockville Refuse website: http://www.rockvillemd.gov/index.aspx?nid=1114. Bulk refuse that is too big to fit in the cart (furniture, rugs, mattresses, etc.) is collected by appointment. Each home is provided with six special bulk refuse collections each year. Your cart must be removed within 24 hours of collection.

To schedule a special collection or for other concerns about refuse and recycling, call 240-314-8568. It is the NMC resident’s responsibility to make these arrangements; trash should not be placed out for collection until the day of the special pickup.

City of Rockville Animal Control Ordinance Section 3-22. Removal of pet solid waste. Proper disposal of pet solid waste is necessary to protect public health, safety, and welfare. The owner of any animal shall immediately remove any pet solid waste deposited by his/her animal on public walks, recreation areas, public streets, or private property other than the premises of the owner of the animal. The owner shall properly dispose of their pet’s solid waste in a waste receptacle or other suitable refuse collector. When walking their pet off their property, pet owners are required to have in their possession a viable means by which to pick up and remove their pet’s solid waste. Failure to adhere to this ordinance can result in fines from the City. According to this brochure, fines can be up to $1000. http://www.rockvillemd.gov/DocumentCenter/View/543.

2016 Proposed BudgetThe proposed budget for 2016 appears on the following pages along with our income, expenses and reserve fund expenditures as of October 31, 2015. Please feel free to speak or write Jim or a Board member about the attached figures. You are invited to attend the December 3rd Board meeting to discuss any concerns or make any suggestions you may have.

The following are some general notes about the budget. Our budget usually does not change dramatically from year to year. Our governing documents set forth the maximum amount we can raise our Association dues.

In recent years, the dues increases have been held within or under the annual Consumer Price Increase (CPI). Our Covenants state the increases in dues have to be within the annual increase in the CPI on a cumulative basis since January 1, 1968. The percentage of increase in the Consumer Price Increase (CPI) for the Washington/Baltimore metropolitan area for the period of September 2014 to September 2015 was 0.5%. After discussion, the Board unanimously agreed to increase the dues for 2016 by zero point one point (0.5%). The increase is within the cumulative dues total as of 2015. The zero point five percent (0.5%) increase is equal to $4 to $5 increase per household for the year.

The New Mark Commons Homes Association does not pay property tax on community owned real estate. However, we receive a Real Property Consolidated Tax bill from Montgomery County for the City of Rockville’s Stormwater Management fee. We also receive a bill from the Montgomery County Commission on Common Ownership Communities (CCOC). The Association includes these fees on your dues invoice.

Storm Water Management Utility (SWM) fee is a charge for service assessed by the City for all property owners, including homeowners, businesses, houses’ of worship, governments and schools. New Mark Commons has twenty three

(23) parcels that incurred a SWM fee. Seventeen parcels are identified as common area parcels and their fee will be billed to all three hundred and eighty four residences. Six parcels identified as townhouse parking lots. The fee for these parcels will be billed to the one hundred and ninety eight townhouse residences. You will see a separate line item on your January dues invoice for the SWM fee. The Stormwater Management fee increased 8.4% for the City’s fiscal year 2016 budget.

The City of Rockville adopted Montgomery County, Section 10B-3, which required all common ownership communities in Rockville to register with the County’s Commission of Common Ownership Communities (CCOC). There is a fee associated with registering with the CCOC. The fee for the City’s fiscal year 2016 was three dollars ($3) per residence per year. You will see a separate line item on your January dues invoice for the CCOC fee.

Taxes: The IRS ruled in the early 70’s that New Mark is a for-profit corporation. We have to pay corporate income taxes. We are taxed on the interest earned each year by our reserve fund. We cannot be sure of the exact amount of taxes we will pay until our accountant completes our annual tax returns in the first quarter of the next year.

Insurance: The Association’s insurance coverage consist of a commercial general liability policy, a worker compensation policy, a commercial umbrella policy, an Officers and Directors liability policy and a crime policy.

Pool Management: This figure includes management services of Community Pool Services Inc. for 2015. We terminated our contract with Community Pool Services (CPS) effective December 17, 2015. We will solicit bids from other pool management companies for 2016.

Revenues: In 2015 our non-resident pool memberships generated $20,700 in revenue. The non-resident memberships help us offset the largest line item in our budget, the pool.

Notes for 2016 Budget

Income

1. 36 non-resident memberships at $575 each.

2. City of Rockville Storm Water Management (SWM) fee on all the common areas in the community. The fee is billed to all homes in the community. The fee for the second 2016 dues invoice is an 8.4% percent increase over the first 2016 invoice.

3. Montgomery County Common Ownership Community (CCOC) fee levied when the City of Rockville opted into this County program. The fee for the county’s fiscal year 2016 is $3 per residence.

Expenses

1. Salary at Board discretion.

2. Bonus at Board discretion.

3. Storm Water Management (SWM) fee. New Mark Commons has 23 parcels of common area that are assessed a SWM fee. This amount reflects an 8.4% increase over the City’s fiscal year 2016 rate.

4. Insurance reflects a 5% increase over 2015.

5. Third year of 3 year contract with Community Pool Service. We will be soliciting bids from other pool management companies this winter.

6. Annual lake maintenance contract.

7. Common area grounds maintenance represents the largest increase in the 2016 budget. We have a proposal from Stolburg Landscaping that reflects a switch from traditional lawn care products to organic based products.
