TBI Waiver History

Session Law 2009-451, SECTION 10.72A.(a)

The Department of Health and Human Services, Division of Medical Assistance, in conjunction with the Division of Mental Health, Developmental Disabilities, and Substance Abuse Services, shall report on the feasibility and efficacy of applying for Medicaid waivers from the Centers for Medicare and Medicaid Services. The report shall recommend whether the following waivers should be pursued and the reasons therefore:– ….(3) A 1915(c) waiver to permit individuals who sustain

traumatic brain injury after age 22 to access home and community-based Medicaid services. The report and recommendation shall include the estimated cost to implement the waiver.

• Brain Injury Advisory Committee – consumers, families, advocates, providers

• DMA/DMHDDAS submitted report to General Assembly on 12/1/2010– Brain Injury Advisory Committee reviewed report

• Unanimous support to pursue 1915 (c) wavier for individuals with TBI

TBI Waiver Purpose• Community alternative for individuals with TBI who reside

in nursing facilities or• Individuals with TBI in community who are at risk for

placement in a nursing facility• Reintegrate & maintain individual in the community• Receive targeted TBI services and supports
