1.0 BACKGROUND
Skills development for the youths plays an important role in the transition
from school to work. Realising the importance of the linkage, the Government
of Mauritius has formulated the National Skills Development Programme
(NSDP) to train unemployed youth in high demand areas.
The Budget Speech 2016/2017 announced the following measure at section
42: “Government will enlist 4,000 persons under the National Skills
Development Programme for training in technical skills that are in high demand.
This will include training for 1,000 young people in each of the following sectors:
ICT, tourism and hospitality; nursing and paramedics and construction and
other industries. These trainees will be paid a monthly stipend of Rs 5,000.”
Following representation of various stakeholders, the NSDP has been
extended to cover the following sectors:
Manufacturing
Financial services
Logistics
Other sectors
The main objective of this budgetary measure is to train 4,000 unemployed
youth to better match skills with the demand of employers. This measure
comprises 2 components namely training and placement. The support of
enterprises is vital for the successful implementation of the programme.
This ‘Manual of Procedures’ has been developed to provide information and
guidance on the NSDP to relevant stakeholders. It details the roles and
responsibilities of the HRDC, MoEHRTESR, Business Mauritius, Employers,
Industry Associations, Unemployed Youth amongst others. It also includes
the standard processes and procedures.

2.0 GOVERNANCE OF NSDP
The following illustration depicts the governance structure of NSDP.
The Sub-committee(s) may co-opt as members, representatives of industry
associations/institutions as and when required.
The operationalisation of the measure is in close collaboration with Business
Mauritius, Tertiary Education Commission (TEC) and Mauritius
Qualifications Authority (MQA) registered training institutions1 to better
articulate demand and supply of training and placement. The involvement of
the private sector is critical to the success of the programme as it will
contribute towards providing information on skills needs and making
provision for placement. TEC/MQA will ensure quality assurance of the
delivery of courses.
A Technical Committee has been set up with a view to evaluate all
applications.

3.0 THE NATIONAL SKILLS DEVELOPMENT PROGRAMME (NSDP)
The collaborative nature of the programme contributes both towards
empowering unemployed youth through training and placement in areas of
high demand with a view to supply relevant skills to the industry.
The salient objective of the Scheme is to provide industry-relevant training
and placement to unemployed youth to improve their employability. The NSDP
is a joint Government/Private Sector partnership programme managed by a
Steering Committee, co-chaired by the MoEHRTESR and Business Mauritius
(BM) and also comprise the Ministry of Finance and Economic Development
(MoFED), MLIRET, HRDC, TEC, Mauritius Institute of Training and
Development (MITD) and MQA.
The NSDP is supported by the Sub-committee at the level of the HRDC. The
main responsibility of the sub committees is to provide input on the skills in
demand and approve the training programme amongst others.

4.0 OBJECTIVES OF NSDP
The objectives of the NSDP are to:
train unemployed youth to better match skills with the demand of the
industry;
establish linkages between the training systems and the workplace;
provide in demand skilled manpower to the employer; and
provide trainees with the opportunity to experience the environment
of a real workplace.
5.0 BENEFITS OF NSDP
Employers:
Pool of trained manpower based on needs of employers;
Designing training programmes based on their own needs; and
Training cost and stipend paid by the Government.
Unemployed youth:
Benefit from training relevant to the needs of employers;
Help youth enter the labour market with skills and confidence through
job placement; and
Receive a monthly stipend of Rs5,000 plus Rs1,000 monthly for
transport expenses for the duration of the course and placement.
6.0 MAIN COMPONENTS OF NSDP
NSDP is based on two thrusts, namely:
1) Course; and
2) Relevant placement in the
industry.

All courses will have a mandatory placement component during or at the end
of the course. The MLIRET will be responsible for coordinating the placement
component.
6.1. APPLICATION MODES
The following instruments have been developed for the implementation of
NSDP which are categorised as follows:
Mode 1 :Courses offered by MITD and other public training institutions as
approved by the Sub-committee
Mode 2 :Courses emanating from Industry Associations delivered by an
MQA/TEC Registered Training Institution (RTI)
Mode 3 :Courses emanating from an enterprise/employer* delivered by an
MQA/TEC RTI
Mode 4 :Courses existing in the market and delivered by MQA/TEC Training
Institutions (through procurement exercise)
Mode 5 :Courses NOT existing in the market; developed by HRDC (through a
subject expert) and delivered by an MQA/TEC RTI (through procurement
exercise)
*Employer which is duly registered with an Authority.

6.2. COURSES
Youth participating in the NSDP will acquire industry led skills that will
contribute towards addressing skills needs at sectoral level.
The skills needs will be identified and the course structure worked out by the
Sub-committee along with necessary eligibility criteria to facilitate selection
and subsequent enrolment of trainees. The courses will be either delivered by
the MITD or MQA/TEC registered training institutions. Courses should satisfy
the accreditation/approval criteria of TEC/MQA, as applicable.
All courses have to be delivered face-to-face. The courses have to be approved
by MQA/TEC, as applicable, for a batch size and not per participant basis.
6.2.1. COURSES BEING OFFERED BY PUBLIC TRAINING INSTITUTIONS
For courses that will be offered by MITD or other public institutions, the
HRDC will enter into a Project Collaboration Agreement (PCA).
6.2.2. COURSES EMANATING FROM INDUSTRY ASSOCIATION DELIVERED BY MQA/TEC RTIS
An industry association can submit a proposal to run a course by a registered
training institution based on their requirements and approval of the Sub-
committee.

6.2.3. COURSES EMANATING FROM AN ENTERPRISE/EMPLOYER DELIVERED BY MQA/TEC RTI
An enterprise can submit a proposal to run a course by a preferred MQA/TEC
RTI based on its requirements and approval of the Sub-committee. The
following criteria have to be met by the enterprise:
The enterprise has identified skills need and selected unemployed to
meet these need;
The enterprise provides an indication of vacancies that can potentially
be filled through the trainees;
The course should be MQA-approved and the training institution shall
be MQA/TEC registered;

The enterprise shall take on placement all the trainees;
Maximum batch size of 25 participants, generally;
The cost per trainee will not exceed Rs 30,000 in a cohort for a course
between 3-6 months;
The cost per trainee will not exceed Rs 60,000 in a cohort for a course
between 6-12 months;
The enterprise will pay the stipend of Rs6000 to the trainee and claim
for refund from the HRDC, or the HRDC can pay the stipend subject to
the timely submission of attendance in the prescribed format.

6.2.4. COURSES EXISTING IN THE MARKET DELIVERED BY MQA/TEC REGISTERED TRAINING INSTITUTIONS
After approval of the skills need by the Sub-committee, the HRDC will invite
potential training institutions through established procurement procedures,
to bid for the course delivery and placement arrangement in the industry.
6.2.5. COURSES NOT EXISTING IN THE MARKET, DEVELOPED BY HRDC (THROUGH A SUBJECT EXPERT) AND
DELIVERED BY MQA/TEC RTIS
Once the course structure/training requirement is decided by the Sub-
committee, the Sub-committee will select a subject expert to develop the
course material based on the needs of the industry. The expert would be paid
a fixed amount of Rs 10,000 per course developed and submitted to the Sub-
committee. After approval of the course by the Sub-committee, the HRDC will
invite potential training institutions through established procurement
procedures, to bid for the course delivery and placement arrangement in the
industry.

6.3. PLACEMENT IN THE INDUSTRY
Placement is a mandatory component of NSDP which is intended to help
trainees build links with the labour market and gain useful work-related
skills.
The placement for the trainee should be in relation to the training, it could be
either sandwiched during the course or at the end of the course. It is the
responsibility of the applicants to arrange for relevant work placement at the
enterprises. The MLIRET and the HRDC will be responsible to monitor this
component of NSDP. The placement component is intended to provide
trainees with the opportunity to:
Apply the gained knowledge in the real work environment.
Identify, analyse and discuss with experienced practitioners how
theoretical concepts are adapted and applied to suit practical
requirements.
Experience the environment of a real workplace and how needs are
identified and resources are acquired, allocated and used for the
purpose of achieving organisational objectives.
Organise themselves so that they can receive, quickly understand and
carry out instructions to the satisfaction of their employer as a means
of developing towards the completion of more responsible work.
Develop the interpersonal skills required to enable them to work
efficiently as a member of a team trying to achieve organisational goals.
Acquire and develop technical skills associated with the nature of their
work.

7.0 DURATION AND FUNDING OF NSDP
Course and placement

8.0 ELIGIBILITY OF TRAINEES
A person is not eligible to participate in NSDP if s/he is:
a. Employed
b. Diploma/Degree holder
c. Student
d. Currently placed under any Government Skills Development
Schemes (E.g. YEP, ISDP, BTW, DTP, STM and so on)
Unemployed youths who are between 16 and 35 years are eligible to
participate in NSDP.
Given that the cleaning sector did not attract youth as defined for the NSDP, the age
limit has been extended up to 50 years only for this sector.
The programme will target the following:
1) Those who have studied up to Form III to HSC or equivalent; and
2) For the construction sector, unemployed youth below Form III and aged
18 and above and above will also be considered.
Pre-vocational school leavers fulfilling the above criteria are also eligible.
The relevant original documents and certificates, including leaving
certificates, will be verified by the HRDC. For those below 18 years, the
responsible party will sign a consent form for the unemployed youth to
participate in NSDP.

A person is allowed to participate in NSDP only once.
If a person refuses an offer under NSDP for which s/he has applied and
been selected, s/he will not be considered for subsequent NSDP courses
and other Government skills development schemes (E.g. YEP, ISDP,
WBTW, DTP, STM and so on).
Simultaneous participation in Government schemes/programmes (e.g.
NSDP, YEP, ISDP, WBTW, DTP, STM and so on) is not allowed.
After completion of an NSDP training programme, a trainee is not
allowed to participate in other Government skills development schemes
(e.g. NSDP, YEP, ISDP, WBTW, DTP, STM and so on) within the same
enterprise/group of enterprises.
A trainee participating in NSDP is not allowed to swap courses within
NSDP.
9.0 REGISTRATION OF TRAINEES FOR A COURSE UNDER NSDP
Once the courses are approved by the Sub-committee, the HRDC will invite
potential trainees to register for the programme through a dedicated link on
the NSDP website. The potential trainees shall register online at
http://nsdp.hrdc.mu.
10.0 SCREENING AND SELECTION OF TRAINEES
The registrants need to meet the entry requirement of the course and selection
will be made by enterprises/industry association (with the assistance of the
registered training institution as appropriate) on a first come, first served
basis. In certain cases, a registrant may go through an interview/selection
process to gauge their motivation and willingness for particular training
programmes.

The HRDC, with relevant stakeholders, may organise information sessions,
pre-course meetings with training institutions, participating enterprises/
industry associations and selected trainees to improve the efficiency of the
process and simultaneously minimising drop-outs from the programme.
The HRDC will replace drop outs within a time frame as advised by the
respective training institutions.

11.0 RESPONSIBILITIES OF STAKEHOLDERS
11.1. RESPONSIBILITIES OF THE STEERING COMMITTEE
The Steering Committee has been administratively set up by the MoEHRTESR
to oversee and manage the NSDP. The Terms of Reference of the NSDP, inter
alia, include the following:
1) develop policy guidelines for NSDP; and
2) oversee the implementation of NSDP.
11.2. RESPONSIBILITIES OF MOEHRTESR
The MOEHRTESR shall:
1. set up and Co-Chair the Steering Committee;
2. be a member of the Technical Committee to analyse proposals; and
3. be a member of the Sub-Committee.
11.3. RESPONSIBILITIES OF THE SUB-COMMITTEE
A Sub-committee has been set up for the smooth implementation of NSDP.
Their responsibilities are as follows:
1) identify and validate skill needs, requirements, profile of trainees and
number to be trained;
2) work out the TOR of subject expert for the development of course
materials;

3) identify and select subject experts for the development of course
materials;
4) identify main structure of courses including placement;
5) validate the detailed course structure and contents including the
placement component;
6) approve the programme;
7) monitor the implementation of the training and placement; and
8) report its recommendations to the Steering Committee.
11.4. RESPONSIBILITIES OF TECHNICAL COMMITTEE
The Technical Committee shall:
1. evaluate NSDP applications; and
2. make recommendations to the Sub-committee for considerations and
approval.
11.5. RESPONSIBILITIES OF HRDC
The HRDC will be the lead agency for the implementation of the programme,
and will have the following responsibilities:
1. lead the Sub-committee;
2. conduct campaigns for sensitisation w.r.t. NSDP;
3. provide relevant listings of registrants;
4. financially manage the NSDP;
5. fund the programme through the National Training Fund;
-pay a monthly stipend of Rs6,000 to trainees for the duration of
the course and placement;
-in the case of enterprises, the HRDC shall refund the
monthly stipend of Rs6000 to the enterprise for the
duration of the course and placement or directly pay the
trainees subject to the submission of an attestation of
attendance by participating enterprises on the 19th of each
month.

-pay course fees to TEIs or TIs, as approved in steering
committee;
6. undertake procurement procedures to invite quotes from training
institutions as per Terms of Reference approved by the Sub-committee;
evaluate proposals for the selection of training institutions for the
delivery of courses;
7. hold meetings with enterprises, training institutions and industry
associations to discuss on prospective applications;
8. hold meetings with trainees prior to the start of the course;
9. coordinate the implementation of skills development programmes
under NSDP;
10. monitor the implementation of the programme as per guidelines
of the Steering Committee;
11. monitor training and placement;
12. co-ordinate the Sub-committee;
13. contribute in the evaluation of the NSDP;
14. interface with employers/industry associations for skills needs
and support for placement of trainees;
15. provide an insurance to the trainees for the duration of training
and placement;
16. refund a monthly stipend of MUR 6,000 for the duration of the
course and placement, prorated for more than 3 absences per month,
following submission of attendance sheets in due form by Registered
TEIs/TIs and employers (as appropriate);
17. ensure all contracts are signed and records kept; and
18. hold intellectual property right on courses developed at the level
of the Sub-committee by subject experts (Refer to section 11.3)
11.6. RESPONSIBILITIES OF MITD
1. follow up training and placement of trainees as per respective
applications;

2. consolidate attendance sheet (from respective enterprises) and submit
to HRDC by the due date for those following training on a full-time basis
for timely payment of stipend;
3. submit evaluation of training and placement to the HRDC; and
4. pay stipend, as per guidelines, to trainees following courses under
alternative mode (afternoons and week-ends).
11.7. RESPONSIBILITIES OF MLIRET
The Ministry shall:
1. match employers with trainees w.r.t. arrangement for relevant
placement;
2. ensure that a mentor is assigned to the trainee;
3. ensure that the trainer follows up the trainee’s performance during the
placement;
4. ensure the necessary agreements for w.r.t. placement are signed and a
copy submitted to HRDC;
5. monitor placement of trainees;
6. notify the HRDC on non-attendance and drop outs if any;
7. notify the HRDC the exact date of any drop out;
8. update YEP, ISDP, DTP, WBW databases at the Ministry upon
submission of lists of trainees participating in NSDP courses by HRDC
(refer section 8.0); and
9. collect regular feedback to report to the Sub-committee and Steering
committee.
11.8. RESPONSIBILITIES OF TEC AND MQA
The TEC and the MQA shall:
1. provide the appropriate list of RTIs and the respective courses as
approved/accredited;
2. ensure quality assurance of courses;
3. participate in monitoring and evaluation of specific courses;

4. ensure the provision of a fast-track channel upon submission of
complete application for approval of courses, accreditation of
programmes and registration of trainers;
5. validate courses mounted by the Sub-committee; and
6. be a member of the Technical Committee and the Sub-Committee.
11.9. RESPONSIBILITIES OF INDUSTRY ASSOCIATIONS
Industry Associations shall:
1. validate skills needs and the number to be trained;
2. submit proposals to the HRDC with appropriate training institutions for
training of the unemployed youths (Instrument 2);
3. be part of the Sub-committee for their respective industries as required;
4. facilitate placement of trainees in member enterprises;
5. ensure course is delivered and placement is effected as per the proposal;
6. ensure proper monitoring and evaluation by providing to HRDC an
evaluation report on the progress and completion of the programme;
7. enlist the full collaboration of the HRDC in all phases of the programme;
and
8. ensure visibility of the HRDC on the implementation and outcomes of
the programme.
11.10. RESPONSIBILITIES OF REGISTERED TRAINING INSTITUTIONS
Registered Training institutions shall:
1. ensure that the courses are accredited/approved by the TEC/MQA as
appropriate;
2. ensure that the trainees are placed in the industry to acquire relevant
workplace experience as per the approved project;
3. ensure that consolidated attendance sheets (for both placement and
course), with seal/s and authorized signature/s as per format be
submitted to the HRDC for timely payment of stipend;

4. ensure that the duration and main tasks to be effected during
placement as per the application;
5. ensure that requirement of the course/placement is in line with the
regulations of the sector of operation;
E.g. in the case of Construction sector, the course content includes
aspects of the ‘Occupational Safety and Health Act 2005 - Updated as at
2013’, ‘Occupational Safety and Health (Safety of Scaffolds) Regulations
2013 - updated as at 2015 (latest) (shall come into operation on 01 March
2016)’, ‘Occupational Safety and Health (Work at Height) Regulations
2013’, ‘Occupational Safety and Health (Personal Protective Equipment)
Regulations 2012’.
6. ensure that the courses are being run and implemented as approved by
the Sub-committee/MQA/TEC (course and placement) and schedule
(bid document);
7. provide a learner-friendly environment and the required resources as
required by the course;
8. at all times, provide access to HRDC and MLIRET to the different
locations where training and placement would be provided.
9. be responsible for the conduct of the necessary
assessments/examinations as well as the issue of the respective
certificates as per TEC/MQA regulations, as applicable;
10. immediately inform the HRDC of any drop out and the exact date
of the non-attendance;

13. undertake a post-course evaluation with trainees and submit a
report to the HRDC (see template).
11.11. RESPONSIBILITIES OF ENTERPRISES
Under the different modes of applications, enterprises have a number of
responsibilities to fulfil.

The enterprise shall:
1. identify and select trainees (with assistance of the training institution
as appropriate) for placement during/after the course as per the
application;
2. fulfil current regulations in relation to occupational hazard prevention
and inform trainee students thereof (e.g. age criteria of 18 years for
people to work in the construction sector and other health and safety
regulations applicable in Mauritius);
3. assign appropriate mentor/s to trainees during the placement. The
mentor shall assign the tasks to be carried out by the trainees during
their training and shall assist them as and when required. The mentor
shall coordinate jointly with the trainer/training institution the
performance of the activities chosen in the student’s training plan and
shall monitor the progress the trainee’s learning;
4. submit an attestation of the attendance of trainees using the HRDC
Template with the cut-off date of 19th of every month for timely
payment/refund of stipend;
5. release trainees to attend courses at respective TEIs and/or TIs as per
agreed schedule (applicable for placement sandwiched between
courses);
6. provide access and facilitate any monitoring being carried out on site
by the HRDC/MLIRET/members of the Sub-committee;
7. fill the evaluation form as a feedback on the trainee and submit to the
MLIRET after the placement component; and
8. participate in evaluation carried out in relation to this programme
9. assign tasks to trainees related to their possible professional
opportunities aimed at reaching the following purposes:
a) Contribute to the integral training of students, complementing their
theoretical and practical learning.
b) Help trainees learn the work methodology suited to the professional

environment they will potentially work in, comparing and applying
the knowledge they have acquired.
c) Develop technical, methodological, personal and participation skills
among the trainees.
d) Help trainees acquire practical experience that facilitates their
entrance into the job market.
e) Embed life skills training in the curriculum.
11.12. RESPONSIBILITIES OF TRAINEES
The trainees shall:
1. attend any meetings which s/he is being convened by the HRDC,
enterprises and training institutions;
2. satisfy the prerequisites for the course entry requirement and complete
necessary formalities for enrolment;
3. be present and punctual for the course and the workplace for
placement;
4. successfully take all the course assessments and examinations (as
applicable) and satisfy placement requirements at the workplace (e.g.
portfolios, log books, evaluation etc…);
5. abide by the rules and regulations of the training institution and the
enterprise pertaining to discipline, working hours, hierarchy and so on;
6. treat all data and information at the workplace as confidential; and
7. be aware that s/he will not be eligible for subsequent schemes if s/he
drops out without any valid reasons acceptable to the Steering
Committee.
12.0 FEES AND STIPEND
All payments will be effected by the HRDC. The funding structure is as per
the table below:

After approval of the application, the HRDC will effect payment to the training

OFFER OF TRAINEESHIP UNDER NSDP (FOR TRAINEES)
Further to your registration to participate in the National Skills Development
Programme (NSDP), we are pleased to confirm your participation in the
........................................................................................................training,
which will consist of a training and a placement component.
The NSDP will be run under the following terms and conditions which will
also govern your participation in the course:
1. Training. The HRDC, under NSDP, offers you a training in

4. Stipend and Travelling Allowance. (a) Subject to part (b) below, you will
be paid a monthly stipend of Rs 5,000 plus a fixed monthly travelling
allowance of Rs 1,000 during the training and placement.
(b) The stipend and travelling would be paid on pro-rata basis based on
attendance to the training.
(c) You shall provide details of the bank account to which the stipend
and travelling allowance should be paid.

5. Insurance. You will be provided with an insurance cover for the duration
of the course and placement.
6. Attendance. (a) You shall attend the course inclusive of placement as
per the time table set by Training Institution. You shall be present and
punctual for both training and placement.
(b) You shall attend any meeting which is convened by the Training
Institution, the Host Enterprise or the HRDC or any such other
organisation concerned with the NSDP.
(c) You shall fill in the attendance register at the Training Provider and
the Host Enterprise as appropriate.
7. Coursework. You are required to take all the course assessments and
examinations (as applicable) and satisfy placement requirements at the
Host Enterprise (e.g. portfolios, log books, evaluation etc…)
8. Absence. (a) You shall inform both the Host Enterprise and the Training
Institution as soon as possible if you are unable to attend training or
placement on a specific day.
(b) Any non-authorised or unjustified absence of up to 4 consecutive days
for training/placement may be considered as a drop out and a
termination on your part.
(c) Where you need to attend the scheduled exams and other relevant
extra-curricular activities (depending on the schedule of the placement),
you shall produce a copy of any time table or of any scheduled exams
and give one week prior notice to the Training Institution or the Host
Enterprise as applicable.
9. Dress code. You shall dress appropriately for “training” and the
“workplace” as instructed by the Host Enterprise/Training Institution.
10. Safety. (a) You shall fulfil the rules on operation, safety and occupational
hazard prevention of the Host Enterprise/Training Institution.

(b) You shall take reasonable care of your own health, safety and welfare
and that of anyone else who may be affected by your actions or
omissions.
(c) You shall promptly inform the Host Enterprise/Training Institution of
any accident, injury or incident that may occur.
11. Confidentiality. (a) You shall treat all data and information at the Host
Enterprise as confidential and not disclose such information to another
person.
(b) Any publication and/or use of the work carried out during the training
placement shall be carried out upon the expressed authorisation of the
Host Enterprise.
12. Discipline. (a) You shall abide by the rules and regulations of the
Training Institution and the Host Enterprise.
(b) A lack of discipline or any other misconduct committed by you during
the training/placement may lead to the termination of your
training/placement by the Training Institution /Host
Enterprise/industry association/HRDC.
(c) You will not be eligible for any other Government training schemes if
you drop out from the training/placement without any valid reason.
(d) You are not allowed to swap between training courses/placement
within the NSDP.
13. Termination. (a) In the event that you fail to abide by the terms and
conditions of this offer, the HRDC is legally entitled to terminate your
training and/or placement forthwith without any legal formality.
(b) If you terminate the training and/or placement before its end or if you
fail to follow the training and/or placement in accordance with the terms
and conditions laid down in this letter, the HRDC shall cease all
payments under the training agreement.
(c) In case of termination due to "force majeure", i.e. an unforeseeable
exceptional situation or event beyond our or your control and not

attributable to error or negligence on our or your part, you shall receive
for pro-rata payment in respect of satisfactory attendance.
(d) In case the Training Institution or the Host Enterprise ceases its
activities, the training agreement will come to an end and you shall
receive for pro-rata payment in respect of satisfactory attendance
14. Monitoring. You shall collaborate during the monitoring exercises
effected by the Ministry of Labour Industrial Relations, Employment and
Training and agencies such as the Mauritius Qualifications Authority
(MQA)/Tertiary Education Commission (TEC) and the HRDC.
15. Placement not to be considered as employment. During your
placement you shall be a trainee and shall not be a worker under a
contract of employment as defined in the Employment Rights Act.

RECITALS:
WHEREAS;
The HRDC, established under the Human Resource Development Act 2003, was
set up to:
i. Promote human resource development in line with national economic and

ii. Stimulate a culture of training and lifelong learning at the individual,
organisational and national levels for employability and increasing
productivity; and
iii. Provide the necessary human resource thrust for successful transformation
of the economy of the country into a Knowledge Economy.

The purpose and scope of NSDP is described in the Manual of Procedures for NSDP.
NOW THIS AGREEMENT WITNESSES AS FOLLOWS:
1.0 RECITALS
Both Parties agree that the matters referred to in the recitals of this Agreement
are true and correct in every material particular and that the recitals shall form
part of the Agreement.
2.0 TERM
This Agreement shall commence on <date on letter> and, unless terminated
sooner under this Agreement, shall continue in force until completion of the
training and placement.
3.0 FUNDING
3.1. Under this Agreement, HRDC shall provide funding for the implementation
of the NSDP in accordance with paragraph 3.2.
3.2. Funding shall be effected by the HRDC to the training provider according to
the payment structure in the Manual of Procedures for NSDP and submission
of relevant invoices and receipts.
3.3 Parties also agree that the manual may be amended from time to time and
they undertake to ensure compliance with the updated manual.

4.0 ENTERPRISE OBLIGATIONS
The enterprise shall:
I. abide by the approved project proposal which includes the application form
and supporting documents which shall form part of this Agreement;
II. take on placement all the trainees and ensure that his placement is effected
under supervision according to the prescribed requirement for placement
as per the respective course;
III. pay the monthly stipend and travelling allowance of Rs6,000 to the trainee;
IV. ensure that the relevant tools, equipment and other facilities are made
available to him;
V. ensure that he is granted release to attend courses as per agreed schedule
including placement sandwiched during the course;
VI. allow the MoEHRTESR and the HRDC to access to the work premises where
the trainee is on placement;
VII. not benefit from any other financial contributions from other institutions,
other than the HRDC, for the payment of stipend and training costs in
relation to the trainee;
VIII. report to HRDC any difficulty encountered regarding the NSDP.
IX. provide a feedback report on the trainees to the HRDC.
5.0 TRAINING INSTITUTION OBLIGATIONS
The training institution shall:
i. ensure course is delivered and placement is effected as per the project
proposal approved;
ii. ensure proper procurement procedures pertaining to the implementation of
the training and placement;
iii. ensure proper monitoring and evaluation by providing to HRDC an
evaluation report on the progress and completion of the training and
placement;

iv. enlist the full collaboration of the HRDC in all phases of the training and
placement; and
v. ensure visibility of the HRDC on the implementation and outcomes of the
NSDP.
6.0 HRDC OBLIGATIONS
HRDC shall:
(i) provide financial support as per approved project proposal and any
requirements of NSDP and approval of Sub-committee;
(ii) EITHER pay the monthly stipend and travelling allowance of Rs6,000 to
the trainee; and
(iii) OR refund the monthly stipend and travelling allowance of Rs6,000 per
trainee to the enterprise; and
(iv) provide assistance as per requirements of NSDP.
7.0 VISIBILITY OF THE HRDC
7.1. The logo of HRDC, the enterprise and the training institution shall appear
on all marketing/training/communication tools/materials related to this
Agreement.
7.2. HRDC shall be mentioned in all interventions made to the Press/Media by
the enterprise and the training institution on the subject matter of this
Agreement.
7.3. HRDC banners (to be obtained from HRDC) shall be displayed whenever
demonstrations are made throughout.
7.4. A representative of HRDC to be invited to attend working sessions.

8.0 NATURE OF RELATIONSHIP
8.1. The relationship between the Parties hereto shall be only that of
independent entities with rights, liabilities, duties and obligations as set out
in the Agreement.
8.2. Nothing contained in this Agreement shall be deemed or construed to
constitute any Party as a partner, joint venture, employer, employee,
principal, agent, trustee, beneficiary, fiduciary or representative of the
other Party.
8.3. Neither Party has the authority to act for, nor to incur any liability or
obligation on behalf of, any other Party, except as expressly provided in
this Agreement.
9.0 CONFIDENTIALITY
The parties shall abide by data protection laws and shall not disclose any
confidential information to third parties without permission of the appropriate
party.
10.0 FORCE MAJEURE
10.1. Neither party to the present Agreement shall be responsible for any delay
or failure to perform the obligations under the Agreement if the delay or
failure is attributable to force majeure.
10.2. In the event of force majeure which delays performance of the whole or any
part of the present Agreement for more than sixty (60) days, either party
shall have the right, by notice in writing to the other party, to terminate
the Agreement.
10.3. For purposes of this Article, an event of force majeure shall mean an
unforeseen and unavoidable event beyond the reasonable control and
contemplation of the party invoking the existence of such event, and which
impacts directly on the discharge of the obligation under the Agreement.

11.0 TERMINATION
11.2. In addition to any other right, each Party may terminate this Agreement
without cause by giving an appropriate, notice in writing.
11.3. If the other Party has breached any of its obligations under this Agreement
and has failed to rectify that breach within a delay of 14 days, a notice will
be served by the other Party and the other Party shall rectify the breach
within a delay of 1 month, failing which this Agreement may be cancelled
by the HRDC.
12.0 NON-COMPLIANCE
12.1. Subject to paragraph 12.2, the enterprise and the training institution clearly
understand and acknowledge that should they, without any valid reason,
fail to allow a trainee to complete his training or placement, as the case
may be, the HRDC shall be entitled to reduce any funds payable to
them by such proportion as the HRDC will deem appropriate.
12.2. The enterprise and the training institution clearly understand and
acknowledge that failure on their part to comply with this Agreement and
fulfill their obligations under this Agreement may lead to termination of this
Agreement. In case of termination of this Agreement, the enterprise and
the training provider shall reimburse any funds already disbursed by
HRDC.
13.0 DISPUTE RESOLUTION
Any dispute or difference arising out of or relating to this Agreement (a “Dispute”)
shall be dealt with in accordance with this Article.
13.1 In case of dispute or difference arising out of or in relation to this Agreement
or its interpretation, the parties shall use all reasonable endeavours to
resolve the dispute amicably to the mutual satisfaction of the parties.

13.2 No Party may commence any court proceedings, until the procedures set
out in Article 11 have been followed.
14.0 ASSIGNMENT
None of the Parties may, without the written consent of the other Party, assign,
convey, transfer, sub-let or sub-contract any of a Party’s rights or obligations
pursuant to this Agreement
15.0 MODIFICATION AND SEVERABILITY
This Agreement shall not be amended or varied other than by a written instrument
expressed to be either supplemental to or in substitution for the whole or a part
of this Agreement and which instrument shall be signed by each Party or a Party’s
duly authorized agent.
16.0 NOTICES
16.1. Any notice or other communication to be given or made pursuant to the
provisions of this Agreement shall be in writing and signed by the authorized
agent of the Party giving the same. Notices may be served by delivery,

16.2. All such notices and communication shall be effective and be deemed to
have been received in the following circumstances:
i) If delivered, upon delivery;
ii) If sent by email, mail, upon sending/posting; and
iii) If sent by facsimile transmission, upon receipt of the delivery fax report.
17.0 GENERAL
17.1 This Agreement shall be read and construed according to the laws of
Mauritius.
17.2 The failure by a Party to enforce at any time any of the provisions of this
Agreement must not be interpreted as a waiver of such provision.
17.3 Each Party shall execute such agreements, deeds and documents or cause
to be executed or done all such acts and things as will be necessary to
give effect to this Agreement.
17.4 Each Party shall bear its own costs of and incidental to the negotiation of
and the preparation and execution of this Agreement.

D. The National Skills Development Programme, as announced in Budget
Speech 2016-2017, aims to train young people in technical skills that
are in high demand to better match skills, and create more job
opportunities. The sectors concerned are ICT, tourism and hospitality;
nursing and paramedics and construction and other industries.
E. The HRDC is be the lead agency for the implementation of the NSDP
and shall also be responsible for disbursing funds for training and the
stipends (including transport) payable to the youths.
F. The Training Institution is desirous of providing training and in relation
to certain sectors, organise placements of the youths participating in
the NSDP and will submit proposals for approval by the Steering
Committee.
G. The parties intend to enter into this Programme Collaboration
Agreement for the purpose of establishing a framework for collaboration
under the NSDP.
H. A ‘Manual of Procedures’ (attached to this Agreement as Annex 1) has
been developed to provide information and guidance on the NSDP to
relevant stakeholders. It details the roles and responsibilities of the
HRDC, MoEHRTESR, Business Mauritius, Host Enterprises, Industry
Associations, unemployed youth amongst others. It also includes the
standard processes and procedures.
NOW THIS AGREEMENT WITNESSES AS FOLLOWS:
1.0 RECITALS
Both Parties agree that the matters referred to in the recitals of this
Agreement are true and correct in every material particular and that the
recitals shall form part of the Agreement.

SCOPE OF THE PROGRAMME COLLABORATION AGREEMENT
1.1. This Agreement provides for the obligations of the Parties under the
NSDP in relation to be provision of training and placement of trainees
selected by the HRDC pursuant to the approved course.
1.2. The proposal which has to be made by the Training Institution and
the approval by the NSDP Sub-Committee shall form part of this
Agreement.
1.3. The HRDC shall pay the Training Institution for the provision of the
course, as provided under article … of this Agreement.
1.4. The MLIRET shall provide the necessary assistance to the NSDP and
the HRDC as provided for in this Agreement and detailed in the
Manual of Procedures.
2.0 TERM
This Agreement shall commence on <DATE> and, unless terminated sooner
under this Agreement, shall continue in force until completion of the
project.

i. Ensure course is delivered and placement is effected as per the
proposal;

implementation of the programme;
iii. facilitate placement of trainees in member enterprises;
iv. follow up with training institutions on the delivery of training to
ensure training is being delivered as per standard required by the
industry;
v. ensure that the relevant terms of this Agreement is included in the
Agreement with Host Enterprises;
vi. Ensure proper monitoring and evaluation by providing to HRDC an
evaluation report on the progress and completion of the
programme;
vii. Enlist the full collaboration of the HRDC in all phases of the
programme; and
viii. Ensure visibility of the HRDC on the implementation and outcomes
of the programme.
5.0 TRAINING INSTITUTION OBLIGATIONS
Training Institution shall:
I. ensure course is delivered and placement is effected as per the
proposal;
II. ensure proper procurement procedures pertaining to the
implementation of the programme;
III. ensure that the courses are being run and implemented as approved
by the sub-committee/MQA/TEC (course and placement) and
schedule (bid document);

vi. provide a learner-friendly environment and the required resources as
required by the course;
vii. be responsible for the conduct of the necessary assessments and
examinations as well as the award of the respective certificates as
per TEC/MQA regulations, as applicable;
viii. immediately inform the HRDC of any drop out and the exact date of
the non-attendance;
ix. submit a monthly report of attendance, participation and progress;
x. ensure proper monitoring and evaluation by providing to HRDC an
evaluation report on the progress and completion of the programme;
xi. enlist the full collaboration of the HRDC in all phases of the
programme; and
xii. ensure visibility of the HRDC on the implementation and outcomes of
the programme.
6.0 HRDC OBLIGATIONS
6.1. HRDC shall provide financial support as per paragraph 3.2 above
in accordance with the requirements of approved course and
approval of Sub-Committee/Council.
6.2. The HRDC shall also:
(i) enlist trainees for respective skills development programmes;
(ii) hold meetings with beneficiaries prior to the start of the course;
(iii) ensure that the beneficiaries shall be covered by means of an
insurance policy during the training, including the placement;
and
(iv) interface with employers/industry associations for skills needs
and support for placement of trainees.

party, to terminate the Agreement.
c. For purposes of this Article, an event of force majeure shall mean an
unforeseen and unavoidable event beyond the reasonable control and
contemplation of the party invoking the existence of such event, and
which impacts directly on the discharge of the obligation under the
Agreement.
11.0 NON-COMPLIANCE
The industry association and training institution clearly understand and
acknowledge that failure on its part to comply with this Agreement and
fulfill its obligations under this Agreement may lead to termination of this
Agreement.

12.0 TERMINATION
d. In addition to any other right, each Party may terminate this
Agreement without cause by giving an appropriate, notice in writing.
e. If the other Party has breached any of its obligations under this
Agreement and has failed to rectify that breach within a delay of one
14 days, a notice will be served by the other Party and the other party
shall rectify the breach within a delay of 1 month, failing which this
Agreement may be cancelled forthwith by the HRDC.
f. In case of termination of this Agreement, industry association and
training institution shall reimburse any funds already disbursed by
HRDC.
13.0 DISPUTE RESOLUTION
10.1 Any dispute or difference arising out of or relating to this Agreement
(a “Dispute”) shall be dealt with in accordance with this Article.
10.2 In case of dispute or difference arising out of or in relation to this
Agreement or its interpretation, the parties shall use all reasonable
endeavours to resolve the dispute amicably to the mutual satisfaction of
the parties.
10.3 No Party may commence any court proceedings, until the procedures
set out in Article 12 have been followed.
14.0 ASSIGNMENT
None of the Parties may, without the written consent of the other Party,
assign, convey, transfer, sub-let or sub-contract any of a Party’s rights or
obligations pursuant to this Agreement.

15.0 MODIFICATION AND SEVERABILITY
This Agreement shall not be amended or varied other than by a written
instrument expressed to be either supplemental to or in substitution for the
whole or a part of this Agreement and which instrument shall be signed by
each Party or a Party’s duly authorized agent.
16.0 NOTICES
Any notice or other communication to be given or made pursuant to the
provisions of this Agreement shall be in writing and signed by the
authorized agent of the Party giving the same. Notices may be served by

16.1 All such notices and communication shall be effective and be deemed
to have been received in the following circumstances:
i) If delivered, upon delivery;
ii) If sent by email, mail, upon sending/posting; and
iii) If sent by facsimile transmission, upon receipt of the delivery fax report.

17.0 GENERAL
17.1 This Agreement shall be read and construed according to the laws of
Mauritius.
17.2 The failure by a Party to enforce at any time any of the provisions of
this Agreement must not be interpreted as a waiver of such provision.
17.3 Each Party shall execute such agreements, deeds and documents or
cause to be executed or done all such acts and things as will be
necessary to give effect to this Agreement.
17.4 Each Party shall bear its own costs of and incidental to the negotiation
of and the preparation and execution of this Agreement.
17.5 In case of inconsistency between the Manual of Procedures for NSDP
and this Agreement, this Agreement shall prevail.
