INTRODUCTION

The National Emergency Medal was established for the purpose of according recognition within the Australian honours system for the unique contribution and significant commitment of those persons who have provided service in response to a nationally-significant emergency.

The Medal was introduced into the Australian honours system by Letters Patent approved on 23 October 2011. To date, five events were declared as nationally-significant for the purposes of the Medal:

• the bushfires that happened in the State of Victoria in February 2009;

• the floods that happened in the State of Queensland during December 2010 and January 2011, and Cyclone Yasi;

• Tropical Cyclone Debbie 2017; and

• the floods that happened in North Queensland in January and February 2019.

As an operational service medal, it may be awarded for either:

• sustained service - to persons who meet the criteria established by the National Emergency Medal Committee for each individual nationally-declared emergency and have given a minimum duration of service in specified times and places within Australia; or

• significant service - to persons who the National Emergency Medal Committee considers contributed in direct response, assisted with the protection of lives and property and performed extraordinarily.

The National Emergency Medal Regulations 2011 state that the award of a National Emergency Medal shall be made by the Governor-General on the recommendation of the National Emergency Medal Committee in the case of significant service, and the Australian Honours and Awards Secretariat for sustained service.

Anyone can nominate another person for their service during a declared emergency, and the awards are not exclusively for Australian citizens.

There is no timeframe for the submission of nominations.

PART 1 PRELIMINARY

NAME OF REGULATIONS

1 These regulations are the National Emergency Medal Regulations 2011.

DEFINITIONS

2 In these Regulations: 'clasp' means a device that denotes the nationally-significant emergency for which the Medal was awarded. 'Committee' means the National Emergency Medal Committee established under regulation 9. 'Medal' means the National Emergency Medal awarded under regulation 4. 'Medal for significant service' means the National Emergency Medal awarded under subregulation 4 (2). 'Medal for sustained service' means the National Emergency Medal awarded under subregulation 4 (1). 'Minister' means the Minister responsible for the administration of the Australian system of honours and awards. 'nationally-significant emergency' has the meaning given by regulation 3. 'Register of Awards' means the Register of Awards maintaned by the Secretariat under regulation 13. 'Secretariat' means the Australian Honours and Awards Sercretariat. 'service' includes paid and unpaid service. 'significant service' means service that the Committee decides is significant under subregulation 10 (6). 'sustained service', for a nationally-significant emergency, means the type and duration of service advised by the Committee under paragraphs 10 (4) (e) and (f).

PART 2 AWARD OF MEDAL

NATIONALLY-SIGNIFICANT EMERGENCY

3 (1) For these Regulations, each of the following emergencies is a nationally- significant emergency: (a) the bushfires that happened in the State of Victoria in February 2009; (b) the floods that happened in the State of Queensland during December 2010 and January 2011; (c) Cyclone Yasi; (d) an emergency declared to be a nationally-significant emergency under subregulation (2).

(2) The Governor-General may, on the recommendation of the Minister, declare another emergency to be a nationally-significant emergency for the purpose of these Regulations.

(3) The Minister must not make a recommendation under subregulation (2) unless:

(a) the emergency happened in Australia; and (b) the emergency happened during the previous 3 years; and (c) the Minister has received advice from the Committee about whether the emergency should be declared a nationally-significant emergency.

(4) A declaration under subregulation (2) must state the following in relation to the nationally-significant emergency: (a) the name by which the nationally-significant emergency is to be known for the purpose of these Regulations; (b) the geographical area in Australia where the emergency happened; (c) the day on which the emergency began; (d) the duration of the emergency; (e) the minimum duration and type of service required to qualify for the award of the Medal for sustained service.

AWARD OF MEDAL

4 (1) The Governor-General may, on the recommendation of the Secretariat, award to a person who has given sustained service during a nationally- significant emergency the Medal and a clasp denoting the nationally- significant emergency.

(2) The Governor-General may, on the recommendation of the Committee, award to a person who has given significant service during a nationally-significant emergency the Medal and a clasp denoting the nationally-significant emergency.

(3) If a person: (a) has been awarded the Medal and a clasp under these Regulations; and (b) has given sustained service or significant service during another nationally-significant emergency; the Governor-General may award to the person the Medal in the form of a clasp denoting the nationally-significant emergency.

CANCELLATION OF AWARD

5 (1) The Governor-General may, on the recommendation of the Minister, cancel an award of the Medal or a clasp.

(2) If the Governor-General cancels an award of the Medal: (a) the Secretariat must note the cancellation in the Register of Awards; and (b) the person must return the Medal to the Secretariat.

(3) If the Governor-General cancels an award of a clasp: (a) the Secretariat must note the cancellation in the Register of Awards; and (b) the persons must return the clasp to the Secretariat.

REINSTATEMENT OF AWARD

6 (1) The Governor-General may, on the recommendation of the Minister, reinstate an award of the Medal, or of a clasp, that has been cancelled.

(2) If the Governor-General reinstates an award, the Secretariat must: (a) note the reinstatement in the Register of Awards; and (b) return the Medal or clasp.

PART 3 THE MEDAL AND CLASP

DESIGN OF THE MEDAL AND CLASP

7 The design of the Medal, or of a clasp, is the design determined by the Governor-General.

WEARING OF THE MEDAL AND CLASP

8 The manner in which, and occasions on which, the Medal, or a clasp, may be worn are as determined by the Governor-General.

PART 4 NATIONAL EMERGENCY MEDAL COMMITTEE

ESTABLISHMENT OF NATIONAL EMERGENCY MEDAL COMMITTEE

9 The National Emergency Medal Committee is established by this regulation.

FUNCTIONS OF THE COMMITTEE

10 (1) This regulation sets out the Committee's functions.

(2) A fuction of the Commiitee, for an emergency mentioned in paragraph 3 (1) (a), (b) or (c), is to advise the Governor-General of the matters mentioned in paragraphs (4) (a) to (f).

(3) A function of the Committe is to advise the Minister whether an emergency

should be declared a nationally-significant emergency, after considering the following matters:

(a) whether the emergency had a serious impact on the population and region where the emergency happened; (b) whether the emergency caused a large number of casualties; (c) whether the emergency displaced a large number of people; (d) whether the emergency caused significant destruction of, or disruption to, critical infrastructure, including infrastructure used to supply electricity, water, gas and fuel; (e) whether the emergency required interstate or international assistance.

(4) If the Committee advises the Minister that an emergency should be delcared a nationally-significant emergency or the Minister advises the Committee that he or she will recommend to the Governor-General that an emergency should be declared a nationally-significant emergency, a fuction of the Committee is to advise the Minister of the following: (a) the name of the clasp for the nationally-significant emergency; (b) the geogrphical area where the emergency happened; (c) the day on which the emergency began; (d) the duration of the emergency; (e) the type of service that a person is required to have undertaken to qualify for the award of the Medal for sustained service; (f) the minimum duration of service that a person is required to have completed to qualify for the award of the Medal for sustained service.

(5) A function of the Commitee is to advise the Secretariat as to whether the service requirements for the award of the Medal for sustained service may be waived for a person who: (a) died during the nationally-significant emergency; or (b) was evacuated during the nationally-significant emergency due to injury or illness.

(6) A function of the Committee is to decide whether a person has given significant service during a nationally-significant emergency, after considering the following matters: (a) whether the person's service was part of the response efforts to the nationally-significant emergency; (b) whether the person's service assisted with protecting lives and property; (c) whether the person's service was extraordinary.

(7) A function of the Committee is to make recommendations to the Governor- General for the award of the Medal for significant service.

CONSTITUTION OF THE COMMITTEE AND APPOINTMENT OF MEMBERS

11 (1) The Committee is to consist of the following perons: (a) 2 members appointed by the Minister as Commonwealth representatives; (b) 3 members appointed by the Governor-General, on the recommendation of the Minister, as community representatives.

(2) In making a recommendation to the Governor-General under paragraph (1) (b), the Minister must have regard to the desirability of ensuring that the membership of the Committee is broadly representative of the Australian community.

(3) A member mentioned in paragraph (1) (b) may be appointed for a period not exceeding 3 years but is eligible for re-appointment.

(4) The Governor-General must appoint from the members mentioned in paragraph (1) (b): (a) a Chair of the Committee; and (b) a person to act as Chair of the Committee in the event the person appointed as Chair of the Committee is absent or unable to perform the duties of the position.

PART 5 AUSTRALIAN HONOURS AND AWARDS SECRETARIAT

FUNCTIONS OF THE AUSTRALIAN HONOURS AND AWARDS SECRETARIAT

12 (1) This regulation sets out the Secretariat's functions in relation to the Medal.

(2) A function of the Secretariat is to identify organisations involved in responding to a nationally-significant emergency and to advise those organisations of the application and nomination processes.

(3) A fuction of the Secretariat is to: (a) recieve applications for the award of the Medal; and (b) if an application is for the award of the Medal for sustained service - verify information provided in or with the application.

(4) A fuction of the Secretariat is to make recommendations to the Governor- General for the award of the Medal for sustained service.

(5) A function of the Secretariat is to assist the Committee in the performance of its functions.

(6) A function of the Secretariat is to maintain a Register of Awards in accordance with regulation 13.

REGISTER OF AWARDS

13 (1) The Secretariat must: (a) enter in the Register of Awards the names of each person to whom the Medal or a clasp has been awarded under these Regulations; and (b) keep such other records relating to the award of the Medal as the Governor-General directs.

(2) The Secretariat may: (a) correct an error in an entry in the Register of Awards or another record kept under this regulation; and (b) annotate an entry in the Register of Awards in accordance with regulation 5 or 6; and (c) annotate an entry in another record kept under this regulation.

2 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

AUTHORITY

3 This instrument is made under subregulation 3(2) of the National Emergency Medal Regulations 2011 set out in the Schedule to the Letters Patent dated 23 October 2011 that instituted the National Emergency Medal.

DEFINITIONS

4 Note: A number of expressions used in this instrument are defined in the Regulations, including the following: (a) Medal for sustained service; (b) nationally significant emergency; (c) service. (1) In this instrument: declared emergency means the emergency declared in section 5. eligible service means service of a type mentioned in section 9. Regulations means the National Emergency Medal Regulations 2011 set out in the Schedule to the Letters Patent dated 23 October 2011 that instituted the National Emergency Medal. (2) Unless the contrary intention appears, expressions used in this instrument have the same meaning as in the Regulations.

DECLARED EMERGENCY

5 For the purposes of subregulation 3(2) of the Regulations, the emergency of Tropical Cyclone Debbie 2017 is declared to be a nationally significant emergency for the purposes of the Regulations.

NAME OF DECLARED EMERGENCY

6 For the purposes of paragraph 3(4)(a) of the Regulations, the name by which the declared emergency is to be known for the purposes of the Regulations is “Tropical Cyclone Debbie 2017”.

GEOGRAPHICAL AREA OF DECLARED EMERGENCY

7 (1) For the purposes of paragraph 3(4)(b) of the Regulations, the geographical area in Australia where the declared emergency happened is the area that consists of the local government areas, as at 25 March 2017, covered by subsections (2) and (3).

New South Wales (2) This subsection covers the following local government areas in the State of New South Wales: (a) Ballina; (b) Byron; (c) Clarence Valley; (d) Kyogle; (e) Lismore; (f) Richmond Valley; (g) Tenterfield; (h) Tweed.

Queensland (3) This subsection covers the following local government areas in the State of Queensland: (a) Banana; (b) Brisbane; (c) Bundaberg; (d) Burdekin; (e) Central Highlands; (f) Charters Towers; (g) Fraser Coast; (h) Gladstone; (i) Gold Coast City; (j) Goondiwindi; (k) Gympie; (l) Hinchinbrook; (m) Ipswich; (n) Isaac; (o) Livingstone; (p) Lockyer Valley; (q) Logan; (r) Mackay; (s) Maranoa; (t) Moreton Bay; (u) Noosa; (v) North Burnett; (w) Palm Island; (x) Redland; (y) Rockhampton; (z) Scenic Rim; (za) Somerset; (zb) South Burnett;

DURATION OF DECLARED EMERGECY

8 (1) For the purposes of paragraph 3(4)(c) of the Regulations, the declared emergency began on 25 March 2017. (2) For the purposes of paragraph 3(4)(d) of the Regulations, the duration of the declared emergency was the period beginning on 25 March 2017 and ending on 10 April 2017.

ELIGIBLE SERVICE DURING THE DECLARED EMERGENCY

9 For the purposes of paragraph 3(4)(e) of the Regulations, the type of service in relation to the declared emergency that is required to qualify for the award of the Medal for sustained service is service by a person: (a) in the protection of lives and property; or (b) in the service of interests that are not their own; in direct response to the declared emergency (including support that enables or facilitates the emergency response).

MINIMUM DURATION OF ELIGIBLE SERVICE DURING DECLARED EMERGENCY

10 For the purposes of paragraph 3(4)(e) of the Regulations, the minimum duration of eligible service required to qualify for the award of the Medal for sustained service is 5 days during the period mentioned in subsection 8(2) of this instrument.

AUTHORITY

3 This instrument is made under subregulation 3(2) of the National Emergency Medal Regulations 2011 set out in the Schedule to the Letters Patent dated 23 October 2011 that instituted the National Emergency Medal.

DEFINITIONS

4 Note: A number of expressions used in this instrument are defined in the Regulations, including the following: (a) Medal for sustained service; (b) nationally significant emergency; (c) service. (1) In this instrument: declared emergency means the emergency declared in section 5. eligible service means service of a type mentioned in section 9. Regulations means the National Emergency Medal Regulations 2011 set out in the Schedule to the Letters Patent dated 23 October 2011 that instituted the National Emergency Medal. (2) Unless the contrary intention appears, expressions used in this instrument have the same meaning as in the Regulations.

DECLARED EMERGENCY

5 For the purposes of subregulation 3(2) of the Regulations, the floods that happened in North Queensland in January and February 2019 are an emergency that is declared to be a nationallysignificant emergency for the purposes of the Regulations.

NAME OF DECLARED EMERGENCY

6 For the purposes of paragraph 3(4)(a) of the Regulations, the name by which the declared emergency is to be known for the purposes of the Regulations is the “North Queensland Floods 2019”.

GEOGRAPHICAL AREA OF DECLARED EMERGENCY

7 For the purposes of paragraph 3(4)(b) of the Regulations, the geographical area in Australia where the declared emergency happened is the area that consists of the following local government areas, as at 25 January 2019, in the State of Queensland: (a) Aurukun; (b) Barcoo; (c) Boulia; (d) Burdekin; (e) Burke; (f) Cairns; (g) Carpentaria; (h) Cassowary Coast; (i) Charters Towers; (j) Cloncurry; (k) Cook; (l) Croydon; (m) Diamantina; (n) Douglas; (o) Etheridge; (p) Flinders; (q) Hinchinbrook; (r) Hope Vale; (s) Kowanyama River; (t) Lockhart River; (u) Longreach; (v) Mackay; (w) Mapoon; (x) Mareeba; (y) McKinlay; (z) Mornington; (za) Mount Isa; (zb) Napranum; (zc) Northern Peninsula; (zd) Palm Island; (ze) Pormpuraaw; (zf) Richmond; (zg) Torres; (zh) Torres Strait Island; (zi) Townsville; (zj) Whitsunday; (zk) Winton; (zl) Wujal Wujal; (zm) Yarrabah.

DURATION OF DECLARED EMERGECY

8 (1) For the purposes of paragraph 3(4)(c) of the Regulations, the declared emergency began on 25 January 2019.

(2) For the purposes of paragraph 3(4)(d) of the Regulations, the duration of the declared emergency was the period beginning on 25 January 2019 and ending on 14 February 2019.

ELIGIBLE SERVICE DURING THE DECLARED EMERGENCY

9 For the purposes of paragraph 3(4)(e) of the Regulations, the type of service in relation to the declared emergency that is required to qualify for the award of the Medal for sustained service is service by a person: (a) in the protection of lives and property; or (b) in the service of interests that are not their own; in direct response to the declared emergency (including support that enables or facilitates the emergency response).

MINIMUM DURATION OF ELIGIBLE SERVICE DURING DECLARED EMERGENCY

10 For the purposes of paragraph 3(4)(e) of the Regulations, the minimum duration of eligible service required to qualify for the award of the Medal for sustained service is 5 days during the period mentioned in subsection 8(2) of this instrument.

i, sir peter cosgrove, Governor-General of the Commonwealth of Australia, having the approval of Her Majesty The Queen to the design of the National Emergency Medal, and acting in pursuance of regulations 7 and 8 of the Regulations Governing the Award of the National Emergency Medal hereby determine as follows: 4 July 2014

NATIONAL EMERGENCY MEDAL

DESIGN

1 The National Emergency Medal is circular, 38 millimetres in diameter, and finished in nickel-silver. The Medal is suspended from a 32 millimetre wide riband by means of a fixed nickel-silver suspender bar featuring the Commonwealth Coat of Arms. The central image is a stylised representation of Australia’s national floral emblem, the wattle, and complements the design of the companion medal, the Humanitarian Overseas Service Medal. The image around the central image is of flowering wattle, representing the accomplishments and sacrifices made by Australians in the service of others in times of crisis. The back of the Medal repeats the ring of flowering wattle and includes the words 'FOR SERVICE TO OTHERS IN A NATIONAL EMERGENCY' and space to engrave the name of the recipient.

MINIATURE

2 The miniature of the National Emergency Medal is a half-size replica of the Medal suspended from a miniature ribbon 16 millimetres wide.

RIBBON

3 The National Emergency Medal is suspended from a ribbon, 32 millimetres wide, by means of a narrow nickel-silver suspender bar. The colours of the ribbon are gold and eucalyptus green. Gold symbolises the Australian sun, optimism and hope. Eucalyptus green complements the symbolism of the medal design. The seven gold coloured bands represent Australia's six states, with the seventh representing the territories. The ribbon, in order left to right, 6 millimetre band of eucalyptus green, 20 millimetre band of metallic gold and eucalyptus green stripes (7 x gold stripes 2 millimetres wide and eucalyptus stripes 1 millimetre wide) and 6 millimetre band of eucalyptus green.

RIBBON BAR

4 The ribbon bar of the National Emergency Medal consists of a strip of full-size ribbon, 32 millimetres wide and 10 millimetres deep, with no emblem.

CLASP

5 The award of the clasp to the National Emergency Medal is recorded by a bar 37 millimetres wide and 6 millimetres deep and worn on the riband 10 millimetres from the ribbon slot. Any further clasps are worn an additional 10 millimetres above the preceding clasp, unless four or more clasps in which case they are to be spaced evenly.

WEARING

6 The National Emergency Medal shall be worn on the left breast on all occasions when full-size orders, decorations and medals are worn. The miniature Medal is worn on all occasions when miniatures of orders, decorations and medals are worn. The ribbon bar may be worn with all forms of dress at the discretion of the holder. However, it should not be worn at the same time as full-size or miniature medals.

ORDER OF WEAR

7 The National Emergency Medal is worn in accordance with The Order of Wearing Australian Honour and Awards and is placed immediately after the Humanitarian Overseas Service Medal as approved by The Sovereign.
