2. This Act shall apply to Muini!UJd Tanzania.

3 . In this Act, unless lh~ context requires otherwise­'"Agency" means the Tanzan ia Disaster Management

Agency estab lished under section 4; ~authorised person~ mellfls any person authorised to

"hazard" means a dangerous phenomenon, substance, human activity or <:onciilion that may cause loss of I ife., injury or olher health ;m""cis, properly damage, loss of livelihood and ~rvicc. social and economic disruption or cnvironment;!\ damage;

"M inisler" means Minister responsible for disaster management:

"mitigation" mcans measures aimed at roollcing the risk, imp!l~l or "lTeets of a diS3ster;

"National Disaster Management Plan" means a plan which defines act inns 10 be taken in dealing with a disaster, risk reduction and management;

"natural disaster" means a disaster arising from Ihe interaction of natural pheT\{lmcna without the help or plan by man, and include, such occurrences as earthquakes. hurricanes, floods. droughts, fi res or epidemics:

"Platfonn" means th~ National Oisaster Management Platform established under this Act.

"Regional Committee" means the Regional Disaster "Ianag~ment Committee established under this Act;

"Village Comminee" means the Village Disaskr Management Conunittee established under Ihis Act;

"vulnerability'· means the degree to which the population is likely to be impacted or damag~<1 by a disaster:

··Ward Cummittee" means a Ward Disaster Management Committee cstablish~d under this Act.

(5) The provisions of the Schedule 10 this ACI shall have cffcct in respect to pn:x;cedings of the Counci l and other mattcrs relating 10 il.

PART II! ADMINIST RA TION O r THE AGENCY

[}i=<>f Gmcr.il 9.-( I) There shaH be a Dire<.:tor General ofthe Agency who shall be appointed by the P=idCflt from amongst qualified public servants .

(2) The Director General sh~ ll serve for a term of !i1"C years and shall be eligible for reappointment.

(3) The Director General shall be the Cllicf fOl<ecutivc and Accounting Officer of the Agency and shall be responsible to the Counci l.

10.-( I) The Director General may, during emergence situation and after consultation wilh Chainnall of me Council. issue directives or orc.lers which are neces:;ary to address the situation.

(2) The Direclor General shall , upon the consulmtion with Chairman-

(a) infonn the Minister on Ihe emergency measures laken in order 10 address \h" situation; and

(b) tause 10 be con~cned an emergency meet ing or tile CouncHIO deliberate on the situalion.

JI. -{l) The Agency may, with the approval orlhe relevant authorities, establish a number of direcIOnl.h:S. units as may be necessary for the proper discharge of duties oflh" AS.::nc)'.

(2) The Agency may, with thc approval of the Council and in accordance with the Public Servicc Act, appoiot or employ such number of officers and nther stan' as may be nccessary for the proper and efficient discharge of its functions under this Act

12.-{ 1 ) The Director·General shall establish and maintain directory and invcntory for life suppan and critical infrastructure for dis;aster management operations.

(2) Without prejudice to the provisions of subsection (I) and section 10(2) ofthc Regional Administrlltion Act, the Regional Commillee shall , in addition to the members of th~ Regional Secretariat, inclutle the following members appointed by the Regional Admin istrative Sc<:rctary-

(a) a Regional Disas ter Manag~mcm Coordin31or,

(b) a representative from B regiona l umbrella of non·governmentalorganizations;

(el two representatives from thc private sector from within the Region:

(d) 8 regiona l representat ive for Tanzania Re-d Cross Society ami othcr humanitarian Md volun1a1")' organizations:

(e) three representatives of religious organizations: and

(3) Notwithstanding the provisions of subsect ion (2), the Regional Committee may, cO-{lplany person who is nol a member orthe Committee to alten<.i the ddibcrmions orthe Committee.

(e) coordinate district plans on the prevention of disasters and their mitigation submitted by the District Committee.
