In 2014: 110 bills introduced in 36 states. Experts expect this number to double in the 2015 legislative session◦ 28 have passed into law
Eighteen state boards are tasked by statute with writing their state’s student data management policy or have oversight authority for the agency that is writing the policy.
Thirteen state boards are members of their state’s data management team.
Seven state boards are required by statute to ensure FERPA compliance.
Fifty-five bills introduced in 2014 would give state boards some authority in regulating student data privacy.

Louisiana: Created a task force to validate data storage, security, and sharing practices at the district and state levels.
Alabama: Passed a policy to ensure that all state education data is collected, managed, and used in secure ways.
West Virginia: Passed a resolution requiring transparency about data collection, governance, and parent complaint procedures.
Utah: Passed a resolution calling on the legislature to pass laws to protect student data.

Publishing a comprehensive issue brief about student data privacy due out this summer that will include a “model resolution” that state boards can adapt to pass in their state

Work with the state boards authorized to pass and implement privacy policies to make sure student data is adequately protected
Work with the state boards who can pass binding rules to create and implement sufficient privacy policies in states where no legislation or inadequate legislation was passed
Hold regional meetings for state boards to attend on educational data privacy
