NarcoticsCrimePenaltiesNarcoticsdealers’punishmentaccordingtoSaudilaw:SaudilawofNarcoticscontrolisenactedpursuanttotheRoyalOrderNo.4/B/966anddated10/07/1407H.thatincludesthedecisionoftheSeniorJuristCommissionNo.138dated20/06/1407H.andtheministerialresolutionNo.11for1374H.NarcoticsControllawdifferentiatesbetweennarcoticssmugglers,anddealers,anduserasfollows:Narcoticssmuggler:Theseverestpunishment,forthosewhoareinvolvedinsmugglingnarcoticsandbringingnarcoticsinthekingdomisdeath.Apersonwhoimportsnarcoticsfromabroadisconsideredanarcoticssmugglerandalsothepersonwhoreceivesnarcoticsanddistributesthemtothenarcoticsdealers.Dealer:Thenarcoticslawdifferentiatesbetweenthepersonwhodealsinnarcoticsforthefirsttimeandthepersonwhoisconvictedpreviously.Forthefirsttimeoffender,punishmentisimprisonment,lashingorfinancialfineorall.Fortherepeatoffenders,punishmentisincreasedandtheinvolvedpersonmaybesentencedtodeath.NarcoticsUser:Narcoticsuserisjailedfortwoyearsandpunishedaccordingtothejudge’sdecision.Iftheoffenderisaforeigner,hewillbedeportedfromtheKingdom.Anarcoticsuserwhoenrollsinthetreatmentisnotquestioned,butadmittedintoaspecialisedhospital.SaudilawinaccordancewiththeUnitedNationrecommendationstreatsnarcoticsaddictsaspatientswhoneedtreatment.SpecialTreatmentforstudentssuspectedtobenarcoticsaddicts:Thelawexcludesstudentsfrompunishmentandlimitedtodiscipliningandmonitoringthem;theirguardianmustcommittoeducateandguidethemtomakesurethattheyarereformed.Tobenefitfromthisexclusionfrompunishment,thefollowingconditionsmustbetrue:*Theageofthestudentmustnotexceed20years.*Studentmustbededicatedforschooling.*Heshouldneitherbeanarcoticsdealernorasmuggler.*Theoffendermustnotbeconnectedanyothercrimesapartfromusingnarcotic/drugs.*Notconvictedbeforeforsmuggling,dealingorusingnarcoticsoranyothercriminalactivities.*Offenceshouldnotbeassociatedwithotherethicalcrimes.*Crimeshouldnotbeassociatedwithanytrafficaccidentsresultingindeathorinjuries.*Studentmustnotbeaprofessionaldriver.*Thestudenthasnotresistedarrest.Thetermofjailforstudentneverexceedsthreemonthsor50lashes.
