2) Eligibility Criteria:1. BSNL Electrical wing Enlisted contractors of in class IV (E) or above subject to there
financial limit.2. The firm should have EPF registration3. The firm should have valid Electrical License to work in Uttrakhand state.4. In all cases firm should also have round-the-clock contact Telephone number (s).
The contractor shall submit and confirm: Documentary proof of satisfying eligibility conditions and valid Income tax clearance
certificate or Chartered Accountant certificate for turn over with attested copies as applicable along with application on their printed letter heads.
3) The tender document can be had from this office on payment of Rs 500 + GST @18% in cash (non refundable). The tender document can also be downloaded from
the website www.tender.bsnl.co.in. The cost of such tender document shall be submitted in the shape of demand draft / pay order drawn in favour of Accounts Officer (Cash), O/o The GMTD, BSNL, Almora payable at Almora . The tenderer shall submit the downloaded original computer printout of the document from website. The photocopy shall not be accepted. If during the process of tender finalization, it is detected the tenderer has submitted tender documents after making any changes/additions/deletions in the tender documents downloaded from the web site, the offer shall be summarily rejected and the EMD deposited by tenderer shall be forfeited in addition to any other action as per prevalent rules.
5) Procedure for submission of tenders: 1. The tender shall be submitted in two covers. The documents to be enclosed in each cover are
detailed below. Both the covers shall be sealed separately by the seal of the tenderer.2. The tenderer shall enclose the followings in sealed envelope ONE:

a) EMD @ 2% of the estimated cost in the shape of Demand Draft / Pay Order / CDR / FDR / Bank Guarantee of a scheduled bank or Nationalized Bank / State Bank Guaranteed by Reserve Bank of India drawn in favour of Accounts Officer (Cash), O/o The GMTD, BSNL, Almora payable at Almora.
b) Cost of tender document including GST in the shape of Demand Draft / Pay Order if the document is downloaded from the website.
c) Documentary proof of fulfilling the eligibility criterion as per NIT, if the same is downloaded from the website.
3. The bid of tenderer who do not comply as above shall not be opened.4. The Tenderer shall enclose the following in sealed envelope TWO:
Price bid along with complete set of documents issued by the BSNL/downloaded from the website. The rates and amounts should be filled in the schedule of work attached thereto. NOTICE INVITING TENDER(As per tendering procedure in BSNL revised up to date)
Tenders in the prescribed form are hereby invited on behalf of BSNL for the work of –: Shifting of 20 KVA DG set from USO BTS Tumri to TE Shiling & 40 KVA EA set from Shiling to TE Lohaghat with Overhauling of the DG set.
Estimated cost : Rs 1,49,480.00
01. (a) Printed forms of tenders consisting of the detailed plans, complete specifications, the schedule of quantities of the various classes of works to be done and the set of conditions of contract to be complied with by the persons whose tender may be accepted, can be purchased at the Divisional office between the hours of 1100 hrs and 1600 hrs. Every day except on Sundays and public holidays on payments of Rs. 500 + GST @18% in cash.
(b) The site for the work is available/ or the site for the works shall remain available in parts. (c) The tender forms can also be down loaded from the Web site. (d) Before tendering, the contractor shall inspect the site and fully acquaint himself about
the condition with regard to accessibility of site and site nature and the extend of grounds, working condition including stocking of materials , installation of T&P etc and conditions affecting accommodation and movement of labour etc required for the satisfactory execution of the contract .No claim whatever on such account shall be entertained by the BSNL in any circumstances.
02. Tenders which should always be placed in sealed covers with the name of the work written on the envelope will be received by the Executive Engineer(E), BSNL Electrical Division, Haldwani up to 5000 hrs on 25.07.2017 and will be opened by him in his office on the same day at 1530 hrs.
03. The time allowed for carrying out the work will be 1 (Two months) from 10 th day after the date of written order to commence the work.
04. Issue of tender form will be stopped two days before the date 25.07.2017 fixed for opening of tenders. Tenders will be sold on working days, no tenders will be sold after 1600 hrs.

a) Earnest money amounting to Rs 2,990.00 in the form of Demand draft / FDR/BG/CDR of a Nationalished / Scheduled Bank granted by the Reserve Bank of India drawn in favour of Accounts Officer (Cash), O/o The GMTD, BSNL, Almora payable at Almora must accompany each tender and each tender should be in two sealed covers, one cover containing the EMD in proper form and other cover containing tender, super scribed as “ Tender for the work of : Shifting of 20 KVA DG set from USO BTS Tumri to TE Shiling & 40 KVA EA set from Shiling to TE Lohaghat with Overhauling of the DG set.” And addressed to Executive Engineer (E), BSNL Electrical Division, Haldwani. The validity period of EMD is 120 days, from the date of opening of tender.
In case of e-tendering, each tender should be in two sealed covers first containing credentials for meeting the Eligibility conditions along with the cost of tenders and EMD in proper form, second cover containing tender documents. The credential shall be self attested and certified by any BSNL Executive, If not Certified by BSNL Executive then original documents shall be produced at the time of tender opening. After verification of the contents of this envelope then second envelope containing the bid document shall be opened.
b) The EMD of all the unsuccessful tenderers shall be released on issue of award letter to the successful tenderer. This shall be done within one week of award letter.c) Exemption from payment of earnest money and security deposit by any other unit /department shall not hold good for BSNL
07. a) The contractor should submit and confirm Chartered Accountant Certificate in respect of turnover and other registration certificate (Enlistment in BSNL, Electrical License, GST) with attested copies (self attested and counter attested by any executive of BSNL/MTNL or Gazetted officer of G.O.I ) as applicable along with the application on printed letter head for purchase of tender.
b) The contractor shall submit and confirm his permanent account number (PAN) issued by the income Tax Department.
c)The tenderer should submit the valid WCT/ GST /VAT registration certificate.
08 i) Performance guarantee : The contractor is required to furnish performance guarantee for an amount equal to 5% of the contract value in the form of bank guarantee/CDR/FDR/DD (of nationalized /scheduled bank in a standard format) within two weeks from the date of issue of award letter. This period can be further extended by the Engineer –in-charge up to a maximum period of 2 weeks on written request of contractor. The validity period of the performance security in the form of performance bank guarantee shall be one year from the date of actual completion of work.
ii) Security deposit : In addition of performance guarantee stated above , a sum @ 10% of the gross amount of the bill shall be deducted from each running bill of the contractor till the sum be deducted with the sum already deposited as earnest money, will amount to security deposit of 5% of the Tendered value of the work.
09. The acceptance of a tender will rest with the Competent authority who does not bind himself to accept the lowest tender or any other tender and reserves to himself the Authority to reject lowest or all the tenders received without assigning any reason. All tenders in which any of the prescribed conditions are not fulfilled or incomplete in any respect are liable to be rejected. Tenders with any condition including that of conditional rebates shall be rejected forthwith summarily.
10. Canvassing in connection with tender is strictly prohibited and the tenders submitted by the contractors who resort to canvassing will be liable for rejection.
11. The BSNL reserves itself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rates quoted.

12. i) The tenderer should give a certificate that none of his/her relative is employed in BSNL units. In case of proprietorship firm, certificate will be given by the proprietor and for partnership firm certificate will be given by all the directors of the company.
ii) Near relatives of all BSNL employees either directly recruited or on deputation are prohibited from participation in tenders and execution of works in the different units of BSNL. The near relatives for this purpose are defined as:a) Members of a Hindu Undivided family.b) They are husband and wife.c) The one is related to the other in the manner as father, mother, son(s) & son’s wife (daughter-in-law) , daughter(s) & daughter’s husband ( son in law) , brother(s) & brother’s wife, sister(s) & sister’s husband (brother in law).
iii) The company or firm or any other persons is not permitted to tender for the work in BSNL unit in which his near relative(s) is (are) posted The unit is defined as SSA/ circle/ Chief Engineer/ Chief Archt. / corporate office for non-executive employees and all SSA in a Circle including Circle office / Chief Engineer / Chief Architect / Corporate Office for Executive Employees (including those called as Gazetted officers at present). The tenderer should give a certificate that none of his /her such near relative is working in the units as defined above where he is going to apply for tender/ work, for proprietorship, partnership firms and limited company certificate shall be given by the authorized signatory of the firm. Any breach of these conditions by the company or firm or any other person, the tender / work will be cancelled and earnest money / performance guarantee will be forfeited at any stage whenever it is so noticed. BSNL will not pay any damages to the company or the firm or the concerned person. The company or firm or the person will also be debarred for further participation in the concerned unit.

13. No employee in BSNL/ Govt. of India is allowed to work as a contractor for a period of two years of his retirement from service without any prior permission. The contract is liable to be cancelled if either the contractor or any of his employees is found at any time to be such a person who had not obtained the permission as aforesaid before submission of tender and engagement in the contractors service.
14. The tender for the works shall not be witnessed by the contractor who himself/ themselves has/ have tendered or who may and has/ have tender for the same work. Failure to observed this condition would render tenders of the contractors tendering as witnessing to tender is/ are liable for summarily rejection.
15. It will be obligatory on the part of the tenderer to sign each page of the schedule of work and the tender documents for all the component parts and after the work is awarded he will have to enter into separate agreement for each component with the officer concerned.
16. Any tender not submitted in proper manner or if it contains, to many corrections, over writing of absurd rates and absurd amount will be liable to rejected and the BSNL will be at liberty to take such action as it may deem fit without any reference to the tender.
17. The tenders for the work shall remain open for acceptance for a period of 90 days from the date of opening of the tenders.

If any tenderer withdraws his tender before the said period or makes any modification in the terms and conditions of the tender which is not acceptable to the BSNL shall, without prejudice to any other right of remedy be liberty to forfeit 50% ( fifty percent only) of the said earnest money absolutely.
18. Extension of validity: In case, where the letter of award of work cannot be placed within the validity period of the tender, BSNL can request all tenderers to extend the validity of their respective tenders and the earnest money deposit by a reasonable period. In such cases, extension of validity of Earnest Money deposit by 30 days beyond the extended validity date of tender should also be asked for. While BSNL can make the request for extension, the tenderers is free to either extend the validity or refuse the request to extend the validity.

19. Unseald tender will be summarily rejected.
20. The contractor should read the tender documents carefully before submitting the tender.
21. Agreement shall be drawn with the successful tenderer on prescribe form. Tenderer should quote their
rate as per the various terms and conditions of the said form, which will be part of the agreement.
22. The tenderer shall furnish a declaration to this effect( in case downloaded tender) that no addition/
deletion/correction have been made in the tender document submitted and is identical to the tender
with stamp (Seal) of his firm/ organization.
23. The notice inviting tender shall form part of the contract document. The successful tenderer/ contractor on acceptance tender by the accepting authority, shall, within 15 days from the stipulated date of start of work, sign the contract consisting of:-
a) The notice inviting tender, all the documents including additional conditions, specifications and drawing , if any forming the as issued at the time of invitation of tender and acceptance thereof together with any correspondence leading thereto.
b) Standard form.

1. I/We have read and examined the notice inviting tender, schedule, Specifications applicable, Drawings & Designs, General Rules and Directions, Conditions of Contract clauses of contract, Special conditions, Schedule of Rate & other documents and Rules referred to in the conditions of contract and all other contents in the tender document for the work.
2. I/We hereby tender for the execution of the work specified for B.S.N.L. within the time specified in Schedule as applicable.
3. I / We agree to keep the tender open for Ninety (90) days from the due date of submissions thereof and not to make any modifications in its terms and conditions.
4. A sum of Rs. 2,990.00 is hereby forwarded in the form of DD/Pay Order/FDR/CDR / BG of a Scheduled Bank by Reserve Bank of India as earnest money. If I/We, fail to commence the work specified, I/We agree that BSNL or his successors in office shall without prejudice to any other right or remedy, be at liberty to forfeit the said earnest money absolutely, and the same may at the option of the competent authority on behalf of BSNL be recovered without prejudice to any other right or remedy available in law out of the deposit in so far as the same may extend in terms of the said bond and in the event of the deficiency out of any other money due to me/us under this contract or otherwise.
5. Should this tender be accepted, I / we agree to execute all the works referred to in the tender documents upon the terms and conditions contained or referred to therein and to carry out such deviations as may be ordered upto maximum of percentage mentioned in clause 12.3 of

the tender form and those in excess of that limit at rates to be determined in accordance with provisions contained in clause 12.2.
6. I/we agree to furnish to BSNL Deposit at call receipt / FDR/Bank Guarantee of a nationalized bank / scheduled bank for an amount equal to 5% of the contract value in a standard format within two weeks from the date of issue of award letter. I / We agree to keep the performance bank guarantee valid for one year from the date of actual completion of work.
7. We hereby declare that I/We shall treat the tender documents drawings and other records connected with the work as secret/confidential documents and shall not communicate information derived therefrom to any person other than to whom I/We am/are authorized to communicate the same or use the information in any manner prejudicial to the safety or interest of BSNL.

GENERAL RULES AND DIRECTIONS1. All works proposed for execution by contractor will be notified in a form of invitation to tender
displayed on Notice Board in select BSNL offices and signed by the officer inviting tender or by publication in News papers/internet (designated web page) as the case may be.
2. This form will state the work to be carried out, as well as the date of submitting and opening tenders and the time allowed for carrying out the work; also the amount of earnest money to be deposited with the tender, and the amount of performance guarantee to be deposited by the successful tenderer(s). Copies of the specifications, designs and drawings and any other documents required in connection with the work signed for the purpose of identification by the Officer inviting tender shall also be open for inspection by the contractor at the office of Officer inviting tender during office hours.
3. In the event of the tender being submitted by a firm it must be signed by the authorized signatory.
4. Receipts for payments made on account of work when executed by a firm, must also be signed by authorized signatory.
5. Any person who submits a tender shall fill up the usual printed form stating at what rate he is willing to undertake each item of the work. Tenders, which propose any alteration in the work specified in the said form of invitation to tender, or in the time allowed for carrying out the work, or which contain any other condition of any sort, including conditional rebates will be summarily rejected. However, tenders with unconditional rebate will be acceptable. No single tender shall include more than one work, but contractors who wish to tender for two or more works shall submit separate tender for each. Tenders shall have the name and number of the works to which they refer written on the envelopes. The rates(s) must be quoted in decimal coinage. Amounts must be quoted in full rupees by ignoring fifty paise and considering more than fifty paisa as rupee one.
6. The Officer inviting tender or his duly authorized assistant will open tenders in the presence of any intending contractors who may be present at the time, and will enter the amounts of the several tenders in a Comparative Statement in a suitable form. In the event of a tender being accepted a receipt for the earnest money forwarded therewith shall thereupon be given to the contractor who shall thereupon for the purpose of identification sign copies of the specifications and other documents mentioned in Rule 1. In the event of a tender being rejected, the earnest money forwarded with such unaccepted tender shall thereupon be returned to the contractor remitting the same without any interest.
7. The officer inviting tenders shall have the right of rejecting all or any of the tenders, and, will not be bound to accept the lowest or any other tender.
8. The receipt of an accountant or clerk for any money paid by the contractor will not be considered as any acknowledgement of payment to the Officer inviting tender and the contractors shall be responsible for seeing that he procures a receipt signed by the concerned Accounts Officer.B S N L EW
9. The memorandum of work tendered for and the schedule of materials to be supplied by BSNL shall be filled and completed in the office of the Officer inviting tender before the tender form is issued. If a form is issued to an intending tenderer without having been so filled in and incomplete, he shall request the officer to have this done before he completes and delivers his tender.
10. The tenderer shall sign a declaration under the officials Secret Act, 1923 for maintaining secrecy of the tender documents drawings or other records connected with the work given to them. The unsuccessful tenderers shall return all the drawings given to them.
11. Rates quoted by the Contractor in the tender both in figures and words shall be accurately filled-in so that there is no discrepancy in the rates written in figures & words. However, if a discrepancy is found the rates which correspond with the amount worked out by the contractor shall unless otherwise proved be taken as correct. If the amount of an item is not worked out by

the contractor or it does not correspond with the rates written in either in figures or words then the rates quoted by the contractor in words shall be taken as correct. Where the rates quoted by the contractor in figures and in words tally but the amount is not worked out correctly, the rates quoted by the contractor will unless otherwise proved be taken as correct and not the amount.
12. Performance Guarantee: The contractor is required to furnish performance guarantee for an amount equal to 5% of the contract value in the form of bank guarantee / CDR/FDR/DD (of a nationalized / Scheduled Bank in a standard format) within two weeks from the date of issue of award letter. The validity period of the performance security in the form of performance bank guarantee shall be one year from the date of actual completion of work.
Security deposit: In addition to performance guarantee stated above, a sum @ 10% of the gross amount of the bill shall be deducted from each running bill of the contractor till the sum be deducted with the sum already deposited as earnest money, will amount to security deposit of 5% of the Tendered value of the work.
13. All rates shall be quoted on the tender form. The amount for each item should be worked out and requisite totals given. Special care should be taken to write the rates in figures as well as in words and the amount in figures only, in such a way that interpolation is not possible. The total amount should be written both in figures and words. In case of figures, the word ‘Rs.’ Should be written before the figure of rupees and word ‘P’ after the decimal figures, e.g. ‘Rs.2.15 P’ and in case of words, the word, ‘ Rupees’ should precede and the word ‘Paise’ should be written at the end. Unless therate is in whole rupees and followed by the word ‘only’ it should invariably be upto two decimal places. While quoting the rate in schedule of quantities, the word’ ‘only’ should be written closely following the amount and it should not be written in the next line.
14A The bidder shall give the total composite price inclusive of all Central & state’s levies and taxes i.e Sales-tax, purchase tax, turnover tax, GST, works contract tax etc. or any other taxes or duties like octroi, local area development tax on materials/labour etc. However the evaluation and comparison of respective bids shall be done on the basis of net cost to BSNL on the prices of the goods offered inclusive of duties and taxes (but –excluding CENVAT-able duties and taxes) sales ,tax, packing, forwarding ,freight and insurance charges as per existing BSNL policies.
14.B The total composite price shall comprise of unit price and all other components of priceneed to be individually indicated quoted against the goods/material/service, it proposes to supply under the contract in the following manner:-B S N L EWi) The Basic Unit Price (Ex-Factory Price) of the goods /services/ materials Excise Duty, GST, Freight, Forwarding ,Packing , insurance and any other levies /charges already paid or payable by the contractor/ supplier shall be quoted separately .
ii) The liability to pay all taxes, levies, etc shall be of contractor and BSNL will not entertain any claim whatsoever in this respect.
14C No concessional form except GST form ‘C’ for the items as specified in the schedule of works and meant for use in BSNL, shall be provided by BSNL. Form ‘ C’ shall be provided by the BSNL only on the specific request of the contractor.”
For the purpose of evaluation of financial Bid, composite price inclusive of all taxes and levies will be considered .
The unit wise cost /break up is necessary for the purposes of information and verification of composite price so quoted by the contractor/supplier.
The contractor supplier shall submit to BSNL documents /proof of payment of al taxes /levies alongwith exemption certificate if any ,to avail CENVAT benefits by BSNL
However the evaluation and comparison of respective bids shall be done on the basis of net cost to BSNL on the prices of the goods offered inclusive of duties and taxes (but –excluding CENVAT-able duties and taxes) sales ,tax, packing, forwarding, freight and insurance charges as per existing BSNL policies.
15.A- However, pursuant to the constitution (forty-sixth amendment) act, 1982, if any further tax or levy is imposed by statute, after the last date of receipt of tenders, and the contractors thereupon

necessarily and properly pays such taxes/ levies, the contractor shall be reimbursed the amount so paid, provided such payment, if any, is not in the opinion of Superintending engineer (whose decision shall be final and binding) be attributable to delay in execution of work within the control of contractor.
15. B- In case of statutory variation in regard to excise duty, only in respect of package AC units, EA set and Lifts within the stipulated date of completion of individual agreement, the same shall be paid or recovered as per the actual against documentary proof. However, beyond this period BSNL will take advantage of any duty reduction but will not pay extra on account of duty increase. Price adjustment provision on account of change in excise duty shall not apply in respect of equipment/components ofequipment/materials, other than package AC units, EA set and lifts.
15.C -The contractor shall, keep necessary books of account and other documents for the purpose of this condition as may be necessary and shall allow inspection of the same by a duly authorized representative of BSNL and further shall furnish such other information/ document as engineer-in-charge may require.
16. The Contractor shall, within a period of 30 days of imposition if any further tax or levy in pursuant to the constitution of (forty sixth amendment) act 1982 give a written notice thereof to the Engineer-in-charge that the same is given pursuant to this condition, together with all necessary information relating thereto.
17. BSNL shall deduct work contract tax, income tax and other statutory deductions from payments due to the firm as per rules of the State/Central Government. The Accounts Officer of the concerned Division shall issue certificates for such deductions to the firm.
18. The tender for the work shall not be witnessed by a contractor or contractors who himself/ themselves has/have tendered or who may and has/have tendered for the same work. Failure to observe this condition would render, tenders of the contractors tendering, as well as witnessing the tender, liable to summary rejection.
B S N L EW19. Other agencies will also simultaneously execute the works like horticulture, external services,
installation of telephone exchange equipment and other building works for the same project alongwith this work in particular. The contractor shall afford necessary facilities for the same. No claim in the matter shall be entertained.
20. Some restrictions may be imposed by the security staff etc. On the working and/or movement of labour, material etc., The contractor shall be bound to follow all such restrictions /instructions and nothing extra shall be payable on this account.
21. The contractor shall comply with the provisions of the Apprentices Act 1961, and the rules and orders issued there under from time to time. If he fails to do so, his failure will be a breach of the contract and the Engineer-in-charge may in his discretion without prejudice to any other right or remedy available in law cancel the contract. The contractor shall also be liable for any pecuniary liability arising on account of any violation by him of the provisions of the said Act.
22. No engineer of gazette rank or executive of BSNL employed in engineering or administrative duties in an engineering department of the government of India/BSNL is allowed to work as a contractor for a period of two years of his retirement from government service without the previous permission of government of India / BSNL. This contract is liable to be cancelled if either the contractor or any of his employee is found at any time to be such a person who had not obtained the permission of the government of India as aforesaid, before submission of the tender or engagement in the contractor’s service as the case may be.
23. Near relatives of all BSNL employees either directly recruited or on deputation are prohibited from participation in tenders and execution of works in the different units of BSNL. The near relatives for this purpose are defined as:a) Members of a Hindu Undivided family.b) They are husband and wife.

c) The one is related to the other in the manner as father, mother, son(s) & son’s wife (daughter-in- law) , daughter(s) & daughter’s husband ( son in law) , brother(s) & brother’s wife, sister(s) & sister’s husband (brother in law).
24. The company or firm or any other persons is not permitted to tender for the work in BSNL unit in which his near relative(s) is (are) posted The unit is defined as SSA/ circle/ Chief Engineer/ Chief Archt. / corporate office for non-executive employees and all SSA in a Circle including Circle office / Chief Engineer / Chief Architect / Corporate Office for Executive Employees (including those called as Gazetted officers at present). The tenderer should give a certificate that none of his /her such near relative is working in the units as defined above where he is going to apply for tender/ work, for proprietorship, partnership firms and limited company certificate shall be given by the authorized signatory of the firm. Any breach of these conditions by the company or firm or any other person, the tender / work will be cancelled and earnest money / performance guarantee will be forfeited at any stage whenever it is so noticed. SPECIAL CONDITIONS OF CONTRACT
The firm shall read carefully the following conditions and shall quote accordingly.
1. INCREASE/ DECREASE OF TENDER QUANTITY:-
a) BSNL will have the right to increase or decrease up to 25% of the contract value depending upon the requirement of goods and services specified in the schedule of items without any change in the unit price or other terms and conditions at the time of award of contract.
b) In exceptional situation where the requirement is of an emergent nature and it is necessary to ensure continued supplies from the existing venders, the purchaser reserves the right to place repeat order up to 50% of the quantities of goods and services contained in the running tender/contract within a period of twelve months from date of award of work at the same rate or a rate negotiated (downwardly) with the existing venders considering the reasonability of rates based on prevailing market conditions and the impact of reduction in duties and taxes etc.
2. CURRENCY OF CONTRACT
The contract shall be valid for issue of LOI for Six Months from the date of its acceptance and same can be extended for a further period of Two months without consent of the contractor and for further next Two months subject to the written consent of the contractor.
3. OPERATION OF CONTRACT:
(i) It is a consolidated NIT for a number of works to be executed at different sites in Uttarakhand under BSNL Electrical Division Haldwani.
(ii) The master agreement shall be signed between the Firm and the Executive Engineer (Elect), BSNL, Electrical Division Haldwani.
(iii) Based on the master agreement, individual Letter of Intent (LOI) along with schedule of work shall be issued by O/o EE(E) for work at individual sites.
(iv) For each work, a separate Award letter shall be issued by the SDE(E) concerned and a formal work contract agreement will be made between the SDE(E) and the contractor on the basis of sample agreement and schedule of works supplied. The period of completion for each work shall be Two months reckoned from 10th day from the date of issue of award letter by EE(E).
(v) The individual agreement so executed in (iv) above containing all the terms and conditions of master agreement shall be treated as an independent agreement and any action if required to be taken shall be taken as per this individual contract.
(vi) No work shall be under taken without issue of proper L.O.I. from the competent authority and completion of agreement formalities as per (v) above.
4. RATES, TAXES, DUTIES & WORKS CONTRACT TAX:-4.1 The rates quoted shall be composite price inclusive of all Central & states levies and
taxes like GST, Purchase Tax. Turnover Tax, Works Contract tax etc. and any other taxes or duties like Octroi, local area development tax on material and labour etc.
4.2 The liability to pay all taxes, levies etc. shall be of contractor and BSNL will not entertain any claim whatsoever in this respect.
4.3 No concessional forms shall be issued by BSNL. 4.4 BSNL shall deduct statutory taxes and duties like income tax, work contract tax etc. from
payments due to the firm as per rules of the central/ State Government. The certificate for such deductions shall be issued to the firm by the Accounts Officer of the concerned Division.
6.0 Variation in Excise Duty: 6.1 In case of statutory variation in regard to excise duty, within the stipulated date of completion of
individual agreement, the same shall be paid or recovered as per the actual against documentary proof.
6.2 Tendered rates will be inclusive of taxes and levies payable under the respective statutes. However, pursuant to the constitution (Forty six Amendment ) Act, 1982, if any further tax or

levy is imposed by state after the date of receipt of tenders and the contractor(s) thereupon necessarily and properly pays taxes or levies the contractor(s) shall be reimbursed the amount so paid, provided such payment, if any, is not in opinion of SE (whose decision shall be final and binding) attributable to delay in execution of work within the control of the contractor(s).
6.3 The contractor(s) shall keep necessary books of accounts and other documents for the purpose of this condition as may be necessary and shall allow inspection of the same by a duly authorized representative of BSNL and shall furnish such other information /documents as the Engineer – in charge nay require.
6.4 The contractor(s) shall within a period of 30 days of imposition of any further tax or levy pursuant to the constitution (Forty six amendments) Act 1982 give a written notice thereof, to the Engineer-in – charge that the same is given pursuant to this condition together with all necessary information relating thereto.
6.5 No additional condition whatsoever will be accepted for turnover tax / GST on works contract. In case of additional conditions for the payment of such claims by the contractor, the tender will not be considered by the accepting authority.
7.0 EPF Registration7.1 The contractor shall comply / fulfill the provision of the EPF & Misc. Provisions Act – 1952 &
Employees Provident Fund Scheme – 1952 as amended upto date in respect of labourers/ Employees engaged by them for performing this work. Any consequences arising due to non-complying of the provisions as specified above shall be the sole responsibility of the Firm only.
7.2 If any tenderer doesn’t have EPF Registration, the tenderer shall though be allowed to participate in the bid process but they will have to get the EPF Registration done.
8. ESCALATION / CLAUSE 10 CC:- No claim under clause 10 CC shall be entertained under this contract.
9. EARNEST MONEY:-[A] (a) Firm has option to deposit Earnest Money in form of Bank Guarantee in department’s
approved format and manner (Annexure-I).The BG shall be from a schedule bank or a Nationalized Bank/ State Bank guaranteed by Reserve Bank of India, in enclosed Performa for the prescribed value mentioned in the NIT.The Bank guarantee shall be valid for 120 days and shall remain in force for 30 days after the period for which the tenders are valid. (validity of the BG should be 90+30 = 120 days as the tender validity period is 90 days)
1. For Uttrakhand, the B.G. shall be furnished duly stamped at the rate of Rs. 5/- for every 1000 or part
there of as per Indian stamps act 1899. 2. The B.G. shall be got extended if required. The successful bidder after award of rate
contract will extend the B.G. upto Two months beyond the currency of rate contract. (d) If the B.G. is executed in other state than that of place of work and stamp duty is less at the place of execution of B.G., then it will required to be stamped with the higher amount.(e) If the stamp duty in the state where B.G. is executed is higher than the place of work no further stamp duty is required.
[B] RELEASE OF EARNEST MONEY:a) The Earnest Money Deposited shall be released after receipt of the Performance
Guarantee for all works awarded against Rate Contract in case of successful tenderer.
b) The Earnest Money Deposited shall be released in case of un - successful tenderer within one week of issue of award letter to successful tenderer.
c) The earnest money deposit will be refunded in full after the issue of letter of intent in full including deviation and deduction of security deposit for entire quantity.

d) In case the work is not started in full or parts ( including deviation) by the contractor(s), the EMD will be forfeited for the proportionate quantity of work.e) In case the contract is awarded to more than one agency, the EMD will be adjusted
for the part contract awarded. The proportionate EMD for the contract not awarded, will be refunded on demand.
10. PERFORMANCE GUARANTEEThe contractor is required to furnish performance guarantee for an amount equal to 5% of the contract value in the form of bank guarantee (of a Nationalized/Schedule Bank in a standard format as per annexure II) /CDR/FDR/DD within 2 weeks from the date of issue of award letter for individual work. In the event of failure on the part of successful tenderer to furnish the performance guarantee, the EMD will be forfeited and contract shall be cancelled .The validity period of the performance security in the form of performance bank guarantee shall be one year from the date of actual completion of that individual work.
11. SECURITY DEPOSIT:In addition to performance guarantee stated above, a sum @ 10% of the gross amount of the bill shall be deducted from each running bill of the contractor till the sum will amount to security deposit of 5% of the awarded value of the individual work.
12. PAYMENTS TERMS Payment to the contractors during progress of work is regulated for all the items as below:(a) Upto 60% of the price shall be paid on receipt of goods at site and after satisfactory
physical inspection. (b) Balance payment shall be released after completion of work and submission of
satisfactory testing and completion report, rectification of deficiencies and handing over the installation.
13. STORES AND SAFETY:
The contractor from his own sources shall arrange all the stores and materials required for the satisfactory completion of the work at work site. Safe custody of the material stored at site will be the responsibility of the contractor till the completion/ handing over of the works.
14. COORDINATION AT SITE:At the site of work more than one agency may be working. Full cooperation shall be extended to other agencies during progress of work. Further, work shall be carried out in such a way so that it may not cause abnormal noise and hindrance to the Officers of the Department engaged in installation as well to normal routine work.
15. CERTIFICATES AND DRAWINGS:The firm shall submit following test certificates on supply of the materials at site.
i) Test certificates for the fire extinguisher. ii) Scheme diagram of wiring, cable laying and position of earthings iii) Earth resistance value of earthings iv) The firm will supply complete details of inventory (make, model, Serial No.
length/dimension & quantity etc.) of each item along with detail of accessories, position of items/earthings in drawing.
v) Five sets of completion drawings.
16 DATE OF COMPLETION:Date of successful commissioning of all items of work shall be taken as completion of work.

18. OTHER CONDITIONS: i) The layout of the work will be given by the Engineer-in charge or his duly authorized
representative at site of works.ii) The work will be done as per current BSNL Specification.iii) Inter connection between bus bar and switch of capacity 100 Amps. & above will be
done with solid copper conductor with PVC Insulation. iv) Any damage done to the building during the execution will have to be made good to
the entire satisfaction of Engineer-in-charge.vi) Earthing should be done in the presence of Engineer-in-charge.
19. GUARANTEE & DEFECTS LIABILITY PERIOD:(a) The guarantee shall be valid for Twelve months after successful performance testing.
The contractor shall guarantee that all the equipment shall be free from any defect due to the defective materials and/ or bad workmanship and also the equipment shall work satisfactorily with performance and efficiencies not less than the guaranteed values.
(b) Any parts found defective during the guarantee period shall be replaced free of cost by the contractor. The services of the contractors personnel, if required during this period shall be made available free of cost to the BSNL.
( c) The contractor shall depute his representative to the site within 36 (thirty six) hours of notification of defects by the department.
(d) The representative of department and firm shall prepare a joint report regarding the nature of defect and remedial action required. Time schedule for such action shall be also finalized.
20. PARTICIPATION OF NEAR RELATIVES OF THE BSNL EMPLOYEES:It has been decided that the near relatives of BSNL Employees either directly recruited or on deputation are prohibited from participation in tenders and execution of works in the different units of BSNL. The detailed guidelines in this regard are given in the following paragraphs :-
i) The near relatives for this purpose are defined as:a) Members of a Hindu undivided family. b) They are Husband and wife.c) The one is related to the other in the manner as father, mother, son(s) & son’s wife
(daughter-in-law). Daughter (s) & daughter’s husband (son-in-law). Brother (s) & brother’s wife sister (s) & sister’s husband (brother-in-law).
ii) As per Government of India’s CCS Conduct rule 4, no Government servant shall in the discharge of his official duties deal with any matter or sanction any contract to any company or for any other person if any member of his family is employed in that company or firm or under that person or if he or any member of his family is interested in such matter or contact to his official superior. This clause is applicable to all BSNL employees and in view to this as soon as any BSNL employee becomes aware of the above aspect, he must intimate this to the prescribed authority. For non executive employees this authority is SSA Head/Circle Head/Chief Engineer Chief Archt./ Corporate office under whom he is posted. For executive employees (at present some of them are called as Gazetted officers) the prescribed authority for this purpose is Circle Head/Chief Engineer/Chief Archt. Corporate office under whom he is posted.
iii) (a) The company or firm or any other person is not permitted to tender for works in BSNL Units in which his near relative(s) is (are) posted. The unit is defined as SSA/Circle/Chief Engineer /Chief Archt. /Corporate office for non executive employees and all SSA in a circle including circle office /Chief Engineer /Chief Architect /Corporate office for executive employees (those called as Gazatted officers at present). Therefore, it has been decided by the competent authority that a clause must be added in the tender and other related documents that the tenderer should give a certificate that none of his /her such near relative is working in the units as defined above where he is going to apply for tender/work. In case of proprietorship firm certificate will be given by all the partners and in case of limited company by all the Directors of the company. Any breach of these conditions by the company or firm or any other person, the tender/work will be cancelled and earnest money/security deposit will be forfeited at any stage whenever it is so noticed. The department will not pay any damages to the company or firm or the

concerned person. The company or firm or the person will also be debarred for further participation in the concerned unit.
(b) In respect of case where the tender notice /work related orders have been issued and are waiting for submission the concerned unit should issue corrigendum for inclusion of above clause. However, where tender/work related documents have been opened and are waiting for finalization the certificate may be taken from the company or firm or any other concerned person giving details of the relatives employed in the jurisdiction of the tender. The company or firm or the person concerned will not be debarred in this case but his work will be kept under proper watch to avoid any further complaint. Further, the relative will not be involved in the decision making and execution of the work.
(c) Where the tenders or the work are already in operation (or awarded ) the tenderer may be requested to give details of relatives employed in the jurisdiction of the tender and such cases the tenderer will be allowed to continue the work but special watch may have to be kept about his performance to avoid any complaint. The concerned relative will not be involved in execution and settlement of claims of the contractor.

GENERAL SPECIFICATION
1. The work shall be done as per current departmental specification.2. The work shall be supervised by a qualified overseer.3. Unapproved materials, if brought to site of work shall be removed immediately at his cost & risk.4. Any damage done to the building by the contractor during the execution of work shall have to be made good at his cost and risk. If he does not do it himself with in a variable time as determines by the Ex. Engineer (E) then the same will be got done at his cost departmentally after giving notice to him.5. The firm shall quote strictly as per NIT conditions.6. Any deviation from NIT conditions will make the tender liable for rejection.7. The rate shall be inclusive of all taxes, duties i/c excise, central or state GST, octroi charge, loading, freight and unloading at site but excluding GST which will be paid extra on the proof of deposite of the same.8. No. concessional form shall be issued by the department.9. The parts required for the repairing should be purchased by the authorized dealer /service dealer of manufacturer and the complete repairing should be done within Two months time after starting the work.

ADDITIONAL SPECIFICATIONS FOR THE WORK OF (E.I & FANS)-I
1. The work shall be done as per current CPWD specifications for electrical works as amended from time to time and Indian Electricity Rules as amended upto date.
2. The work shall be supervised by a qualified Engineer.
3. The layout of the work will be given by the Engineer-in-charge to the duly authorized representative at the site of work.
4. The following wiring shall be done on separate circuits.
Power plug wiring. Light and fan point wiring. Emergency light and fan point wiring. Telephone wiring Circuit wiring.
The Number of power plug points shall not exceed two per circuit in any of the cases.
5. The earthing sets shall be provided in the presence of the Engineer-in-charge or his authorized representative.
6. The contractor will have to be give the following tests at his cost in the presence of E – in – C or his authorized representative and intimate test results before final bills are paid. Nothing extra will be paid to him on this account.
Earth Test. Polarity Test. Insulation Test. Earth continuity Test of the recessed conduit pipes.
7. Any damage done to the building by the contractor during the execution of work shall have to be made good without any extra cost. If he does not made good himself within a reasonable time determined by the Executive Engineer (E) then the same will be get done at his risk and cost departmentally after giving notice to him.
8. The outlet boxes / I.C. boxes for switches and piece of conduits etc. for different categories of conduits runs catering for different type of electric wiring as mentioned in clause (4) above shall be painted inside with different colours each signifying the different categories mentioning so as to avoid mixing of various circuits and their wiring and nothing extra will be paid for this account.
9. All the time of laying conduit pipe in the slab and in recess the contractor will keep fish wire of 14 SWG (G.I.) throughout conduit pipe and will have to take special care so that the conduit do not pass through air conditioning ducts, grills, columns, beams etc. If any such necessity is foreseen special written permission of EE (E) will be obtained before such work is carried out. Successful tenderer should recess the conduit in the walls before they are plastered and in collaboration with building progress of work. Any damage thus done will have to be made good at the cost of the contractor. The conduit pipes should be mechanically and electrically continuous.
10. The runs of various circuits wiring at various places shall be kept minimum by taking the runs on walls where crossing columns is not necessary. This has to be decided before the casting of slab so that unnecessary lengths of conduits are not laid therein.

11. All the I. C. distribution board, sub main boards and their complete fittings shall be sign written clearly indicating the number of distribution board, the exact load of it is serving and the number of circuits contained in the distribution box.
12. Underground cables both of 11 KV and 1.1 KV grade should be subjected to pressure/insulation tests before and after laying the same in the ducts and in case of unsatisfactory tests, the cost of all repairs and replacements and all extra work removal and relaying will have to be made good by the contractor at his own cost and risk.
13. The MDB / LT Panels, drawings shall be got approved from the Engineer-in-charge before fabrication. The same shall also be offered for inspection to E-in-C before supply at site.
14. Termination of all connections of main Boards/Sub main board sub distribution boards will be done by crimping and nothing extra will be payable on this account.
15. Interconnection between busbar & switches i/c & above 100 AMP Sub – main boards will be done with solid copper conductor with PVC sleeve.
16. For the conduit already laid recovery shall be effected on the basis of DSR-94 rates plus abatement of corresponding item of this tender on linear basis.
17. The Department shall not supply any tools and plants unless otherwise specified.
18. The contractor must see the proposed site for the work and study the specifications and conditions to tender carefully before tendering. No claim of any sort shall be entertained on account of site condition or ignorance of specifications and conditions.
19. All the materials to be used on the work shall be ISI Marked and if ISI marked is not manufactured the confirmation to ISS shall be used. The same shall be approved by the Engineer-in-charge before use. All rejected materials are to be removed from the site of work immediately at contractor’s own cost.
20. The work is to carry out according to the drawings issued, kept in the office of the Engineer-in-charge who reserves the right to change the layout as and when required according to changed site conditions at any stage. The wiring and conduit routes are to be marked at site first and got approved by the Engineer-in-charge for commencement of actual work. No extra payment shall be made on this account.
21. The Electrical works shall be carried out in close liaison with the civil work in such a way that at no stage the electrical works lacks behind the civil works.
22. The contractor has to make his own arrangement for stores watch and ward arrangement for material brought by him and also the material issued by the Department at the site of work to contractor and nothing extra will be paid on this account.
23. The contractor shall have to arrange for insulation, earthing and other tests governing specifications as amended upto date in the presence of the representative of the Engineer-in-charge as and when required by him and submit the test report before the work can be considered as completed. Otherwise recovery at the rate of 2.5% of tendered amount with a ceiling of Rs. 2500/- shall be deducted from his final bill. However the decision of the Superintending Engineer (E) in this connection shall be final and binding. Insulation test report shall be separately given for each main/sub switch.

24. CI/MS junction boxes / conduit boxes are to be provided with aluminium / phenolic. Laminated sheet cover as approved by the Engineer-In-Charge and nothing extra shall be paid on this account.
25. The contractor to get approval for layout drawing arrangement of the switch boards before fabrication and installation in the work. The earthing of all the metal parts (as per Indian Electricity Rules) has to be made with suitable lugs and. No. extra payment shall be on made this account.
26. All connections-inter-connections on the main board and distribution boards made out of angle iron shall be done with a suitable size of cable drawn in solid conduit and termination with appropriate size of lugs/thimbles.
27. Bricks for protection of underground cable, locally manufactured of 2nd class quality shall be accepted if used.
28. All cable work shall get checked by the Engineer-In-Charge before refilling of trench is done. No pit work is to be left upon. If due to unavoidable circumstances this is to be left open, the contractor shall make adequate arrangement during right to avoid any accident.
29. No. Compensation shall be payable to the contractor for any damage caused by rain, fire, wind, storm, flood or otherwise and no claim on this account shall be entertained.
30. The contractor shall drain out rainwater collected during execution of work from the excavated portion at his own cost. Nothing extra will be payable on this account, however the contractor shall be entitled for extension of time under clause No. 5 of the Agreement.
31. The tenderer shall see the approach conditions of the site. In case of any approach from main road is required at site of existing approach to be improved for cartage of material by the tenderer, the same shall be provided and maintained by the successful tenderer at his own cost and nothing shall be paid extra on this account.
32. The contractor shall maintain in good condition all work executed till the completion of work allotted to him.
33. For reasons such natural calamity if any damage takes he should make good of all such damages.
34. The contractor has to lay the conduit in slab as well as in walls within three days from the intimation to avoid hindrance in execution of civil work failing which the same shall be got done in that portion, at the risk and cost of contractor.
35. The Electrical work is to be carried out in close Co-ordination and according to the progress or civil work. No claims for any delay in civil work shall be entertained.
36. No sharp edges of conduit shall be left unrounded.
37. The threaded portion of MS/GI boxes shall be at least 1.6mm thick.
38. The PVC insulation of Busbars shall be at least 1mm thick.
39. All MDB’s should be complete cubical and dust & vermin proof.

1. ADDITIONAL SPECIFICATION-II 1. All wiring and earthing shall confirm to IS Rules and regulations amended upto date.
2. The supplier shall have to submit drawings for approval before starting the installations.
3. The suppliers have to obtain approval from concerned fire brigade authorities.
4. All minor bldg. works, if any shall be done by the supplier and if any damage to the bldg/instrument is caused during the execution of work, that should also be made good at this cost and risk.
5. Within Two months of the date of the order the contractor shall submit lay out drawings in triplicate indicating the position and size of holes if required in the wall and floors these holes of course should be finalised after approval by Engineer-in-charge.
6. All building works such as construction of foundation for the equipments, chases in the wall for conduits etc. if required shall be including in the tender.
7. Contractor shall be responsible for removal of debris and waste materials arising out of the work done by him from the site.
8. Prior approval of the Engineer in charge shall be obtained by the successful tenderer before commencement of the installation of the system in all respects and the decision of Engineer in charge shall be final and binding. The installation of detectors etc. in equipment room should be carried out only with the permission of officer in charge.
9. The electrical load requirements for the equipment installed shall be indicated and the necessary electrical test report shall also be furnished when the work is completed. All electrical wiring shall confirm the latest ISI specification and IEE regulations. Earthing arrangements for the electrical panel shall be provided by the contractor.
10.Necessary technical literature (6 complete sets) pertaining to the system along with maintenance and operating instructions for the smooth operation of the system shall be supplied with the tender.
11.Four copies of the equipment layout, smoke detectors having and other drawing relating to the system installed shall be supplied before of the system.
12.The installation will be tested in the entire satisfaction of the Engineer in charge and whose decision will be final in all respect.
13.During the installation period of the above system the successful tenderer shall impart training to P&T personnel in the maintenance of the system.
14. Supplier shall give guarantee of at least 12 months from the date of completion of work against any material/manufacturing defects and shall include free normal maintenance for a period of 12 months in their offer which consist of periodical instructions, adjustment and changing the system as required.
15.All necessary spares required in two years normal maintenance and set of tools shall be provided including operating and maintenance manual and special instruction if any for repair and maintenance.
