MUNICIPALITY OF ANCHORAGE ANCHORAGE PARKS & RECREATION Memorandum PRC 08-53 DATE: August 7, 2008 TO: Parks & Recreation Commission FROM: Tom Korosei, Park Planner SUBJECT: Transfer of Unnamed Park Land (Carr-Gottstein Donation) Background An unnamed park parcel (Tract A, Southport Subdivision Area E [MOA parcel 019-161-33]) was conveyed to the Municipality in 2005 by Carr-Gottstein Properties as part of a group of parcels donated for public park purposes. It was later discovered that the parcel was intended, as noted on the subdivision plat, to be held in common by the Southport Master Homeowners Association. The Municipality formally dedicated these parcels as park land in 2006 with AO No. 2006-96. However, dedication of Tract A, Southport Subdivision Area E was made subject to addressing the ownership issue and amending the plat to remove the plat note. Despite efforts of Carr-Gottstein Properties to resolve this with the home owners association for the benefit of the Municipality, the Southport Master Homeowners Association wishes to retain the parcel. Consequently Carr-Gottstein Properties requests the property be relinquished by the Municipality, requiring the Assembly to adopt an ordinance to transfer Tract A, Southport Subdivision Area E to the Southport Master Homeowners Association. The subject property is 18,657 sq. ft. (.43 ac.) in area, and has not been developed or planned for development by Parks and Recreation. Parks and Recreation is not aware of any particular public park use identified by the community for this parcel, nor is the parcel identified in the Anchorage Bowl Park, Natural Resource, and Recreation Facility Plan to meet specific park needs. Copies of the plat (Plat No. 97-79) and AO No. 2006-96 are attached for reference. The Parks and Recreation Department understands that the property is subject to a number of easements and intragovernmental permits for utilities, trails, and other public purposes, and that these rights would be retained for public benefit upon reconveyance of the subject property. Staff Recommendation Parks and Recreation staff recommends that the Parks and Recreation Commission concur with the proposal to reconvey the subject parcel to the Southport Master Homeowners Association, and that the Commission adopt a resolution such as the following: NOW THEREFORE, BE IT RESOLVED that the Parks and Recreation Commission concurs with the intent to reconvey the subject unnamed parcel of park land in accordance with the approved Southport development and subdivision plat. The Parks and Recreation Commission recommends that public interest be retained as necessary and appropriate, including for public access, drainage, and utilities.
