REVIEW OF DEVELOPMENT PERMIT APPLICATION

The Town has received a Development Permit Application for a Home Occupation Class 2 to providenatural health coaching services at 4610 47 Street. This application is classified as a Home OccupationClass 2 because clients will visit the home and is therefore a 'discretionary' use. The approving authorityfor this application is the Municipal Planning Commission (MPC).

The applicant proposes to have up to 3 clients per day by appointment only. Hours of operation will befrom 9 a.m. - 8 p.m. Monday - Sunday. The applicant advises that parking for clients will be on thestreet. This parcel is in the area that requires Zone A parking passes to allow on street parking. Eachresident is allowed 2 parking passes, one for the resident and one for visitors. The applicant will needto get the parking pass returned from each client to use for the next client.

Eleven (1 1) area landowners were circulated with regards to this application. At the time of thiswriting, no objections or concerns were received from area property owners.

Planning & Development staff are of the opinion that this home occupation would not unduly affect theuse and enjoyment of the neighbouring parcels of land and, therefore, support approval of thisapplication.

REVIEW OF DEVELOPMENT PERMIT APPLICATION

The Town has received a Development Permit Application for a relaxation of the permitted fence heightof 1 metre in the front yard to allow a 1 .82 metre fence at 5437 54 Street. This relaxation is beyond thescope of the Development Officer; therefore, the application is before the Municipal PlanningCommission for decision.

The Land Use Bylaw #01-23 (LUB) states: The Municipal Planning Commission may grant a varianceto reduce the requirements of any use of the Land Use Bylaw and that use will be deemed to comptywith this bylaw, and

Section 2.2 - Development Not Requiring a Development Permit:the erection or construction of gates, fences, walls or other means of enclosure /ess fhan 1 m (3.3 ft.)in height infrontyards andless than 2 m (6.56ft.) in otheryards, andthe maintenance, improvementand other alterations of any gafes, fences, or walls or other means of enclosure provided that suchdevelopment complies with all applicable provisions of Schedule B.

The parcel is addressed off 54 Street, therefore the front yard faces 54 Street. When the dwelling wasconstructed in 1999 it was approved with the front entrance facing west on 55 Avenue. Taking this intoaccount, the portion of the yard facing 54 Street is considered the side yard. The applicants have alarge dog and they would like it to be able to play freely within the fenced yard. The dog is a large breedand would easily jump a fence 1 metre in height.

Four (4) area landowners were circulated with regards to this application. No objections or concernswere received from area property owners.

Planning & Development staff are of the opinion that this relaxation for the 1.82 metre (6') fence wouldnot unduly affect the use and enjoyment of the neighbouring parcels of land and, therefore, supportapproval of this application.

RECOMMENDATION: That the Municipal Planning Gommission approve Development Permitapplication 20-070 as presented, subject to the conditions listed in the attached draftDevelopment Permit.
