Abstract In order to be considered as a potential bidder for the forthcoming Invitation to Tender, the respondent shall be either a single firm or group of firms (hereinafter referred to as “the Firm”) or a group of firms (hereinafter referred to as “the Group of Firms”).The Firm or the Group of Firms shall demonstrate that it meets the applicable qualification criteria by completing this Qualification Questionnaire and by providing the requested documents and references.

1. INFORMATION ABOUT THE FIRM

1.1 Name and Address

Firms interested in participating in the forthcoming Invitation to Tender procedure as a member of a Group of Firms1 shall return a SINGLE questionnaire for the Group of Firms, to be completed by the Lead Firm and signed by each of its members.The number of firms in the Group of Firms shall not exceed two.

2. GENERAL QUALIFICATION CRITERIA

CERN reserves the right not to consider the Firm for the forthcoming Invitation to Tender procedure in the event that: It has replied “yes” to at least one question in § 2.1; It has made a false declaration in the present Qualification Questionnaire; Notwithstanding § Error: Reference source not found, CERN reasonably concludes that the

Firm or Group of Firms will be unable to complete or fulfil its obligations under the contract due to the Firm’s or Group of Firm’s financial situation.

1 The term “Group of Firms” shall mean a consortium, joint venture or any other arrangement between legal entities for the joint submission of a bid and the joint execution of the contract but shall exclude any subcontractors.

Only firms that have replied to the market survey and are qualified on the basis of the following criteria shall be invited to tender: The technical, financial and other qualification criteria defined in this document; CERN’s previous experience with the firm, if any; The number of firms to be selected from each Member State2, as specified in § 2.3 hereunder.

2.2 Subcontracting3

Subcontracting will be permitted for the execution of the contract up to 30% of the value of the contract.However, the following parts of the Supply cannot be subcontracted: Design; Project management; Worksite supervision; Testing and commissioning;

3 The term “subcontract(s)” shall mean any arrangement whereby the Contractor contracts with another legal entity (the subcontractor), except legal entities under its direct control, for the provision of a major part of the Supply (including sub-assemblies and components or any part of the services forming part of the Supply). The term “subcontract(s)” shall include sub-subcontract(s).

Subcontracting is subject to CERN’s prior written approval of each proposed subcontractor. CERN reserves the right to refuse the participation of a subcontractor and to make checks about the proposed subcontractor(s).

2.3 Country of Origin

The term “country of origin” shall mean the country(ies) of manufacture or last major transformation of the Supply (including sub-assemblies and components) by the contractor or its subcontractor(s).The Firm shall be established within one of the CERN Member States. The Supply must originate in the Member States. However, CERN reserves the right not to invite to tender the Firm if: It proposes a Supply originating in an associate member state, or an associate member state in

the pre-stage of accession to membership; and The combined annual financial value of orders, contracts and appointments already committed

for that country: Exceeds the amount of the country’s financial contribution to CERN for the financial year

concerned; or Would exceed the financial contribution if the Firm were awarded the contract.

In addition, with a view to improving the distribution of purchases among its Member States, and in order to decide on the number of potential bidders to be selected from each Member State, CERN shall take into account the Member State’s contribution, its industrial return coefficient and its estimated share of the contract (refer to the Appendix: “Selection and Adjudication Criteria for Supply Contracts”).Please indicate the origin of the Supply in the following table

3. FINANCIAL QUALIFICATION CRITERIA INCLUDING RESOURCES

3.1 Size of the Firm or Group of Firms

3.1.1 Number of Employees

In the case of single Firm: The Firm (with whom the contract will be signed) shall have at least 58 employees in the last three years with:

45 technical employees specialized in industrial refrigeration (IR) systems; Three refrigeration project managers and experts specialized in the design of CO2

refrigeration systems; Four draftsmen specialized in the conception of a refrigeration systems; Three electrician & automation engineers; Three commissioning and start-up engineers specialized in industrial and CO2 applications;

In the case of a Group of Firms:The members of the Group of Firms collectively (with whom the contract will be signed) shall have at least 61 Employees in the last three years with:

3.1.2 Global Annual Turnover

The Firm, or the members of the Group of Firms collectively shall have an average global annual turnover of at least the equivalent of 14’000’000 Swiss francs for the last three years The Lead Firm (in the case of a Group of Firms) shall have a minimal average annual turnover of at least the equivalent of 7’000’000 Swiss francs.

3.2 Proven Production Capacity

The Firm, or the members of the Group of Firms collectively shall be able to demonstrate that it has the management and production capacity to meet the provisional delivery schedule stated in section §4.2 of the Technical Description.

4. TECHNICAL QUALIFICATION CRITERIA

4.1 Competence and Experience

The Firm, or the Group of Firms, shall prove relevant competence and experience by providing the references specified hereunder. The Firm, or the members of the Group of Firms collectively shall have a proven competence and experience in the following areas that are necessary to meet the requirements of the scope, complexity and volume specified in the Technical Description.

Design, supply and installation, test and commissioning of CO2 trans-critical and subcritical technologies;

Design, supply and installation, test and commissioning for industrial low temperature applications below -45 °C and with a minimal cooling capacity of 50 kW;

Design, supply and installation, test and commissioning of large customized skids mounted project for industrial refrigeration systems with contract value of at least the equivalent of 700’000 Swiss francs.

Design, supply and installation, test and commissioning of large built-up project for industrial refrigeration systems with contract value of at least the equivalent 700’000 Swiss francs.

CERN shall be entitled to contact such references in order to verify the potential bidder’s compliance with the above-listed eligibility criteria. In addition, the Firm or the Lead Firm (in the case of a Group of Firms) shall arrange a visit by CERN to any of its references if so requested.If CERN finds that the Firm does not meet these eligibility criteria’s then this may lead to his disqualification.Please use the annexed “Reference forms” and duplicate them as necessary.

4.2 Equipment and facilities

4.2.1 Equipment

The Firm, or the members of the Group of Firms collectively, shall have available at the time of this Market Survey the following equipment: Relevant software/programs during studies;

o AUTOCAD® and PDF® format for P&IDo CATIA® or AUTOCAD® and PDF® format for drawingso CATIA® or AUTOCAD® Revit and PDF® format for 3D modelso EPLAN® and PDF® format for electrical schemes;

Adequate testing equipment for two simultaneous commissioning & start-ups, such as, but not limited to vacuum pumps, laser alignment tool.

4.2.2 Facilities

4.3 Maintenance

The Firm, or the members of the Group of Firms collectively shall be able to assure preventive maintenance on the CERN site at a regular interval per year based on Original Equipment Manufacturer (OEM) recommendations and mandatory EN standards in force (either by themselves or by a entrusted subcontractor).

4.5 Schedule

The Firm, or the Group of Firms collectively shall be able to comply with the provisional delivery, installation and commissioning schedule stated in section §4.2 of the Technical Description.Is this criterion fulfilled?

4.6 Quality Assurance

4.6.1 Certification

The Firm, or the Lead Firm (in the case of a Group of Firms) shall have ISO 9001:2015 and ISO 14001:2015 certification in the field of design, supply and installation of refrigeration systems, or be able to demonstrate compliance with certification or shall be willing to establish an equivalent quality assurance procedure.Is this criterion fulfilled?
