8 Thereupon, the following proceedings were had:
9 MR. GAINSBURG: I had provided -- Barry
10 Gainsburg.
11 I was formerly representing Bio-Tech
12 Medical Software in this case. I'm no longer
13 working for Bio-Tech Medical Software.
14 I had provided them a stipulation for
15 substitution of counsel. They didn't sign --
16 The other side didn't sign it. I got a notice
17 of appearance on Monday. I would just like to
18 be off of the case.
19 THE COURT: I think, technically, you are,
20 but if it makes you happy.
21 MR. GAINSBURG: I thank you, sir.
22 MR. GOTTI: Yes, Your Honor.
23 Ronnie Gotti for the Shiner Law Group, now
24 representing Bio-Tech Medical Software, for the
25 plaintiff.

1 We just wanted to -- We didn't sign --
2 agree to a stipulation because we wanted to
3 preserve record evidence of what amounts to be
4 behavior of unethical conduct. For example,
5 prior counsel, Mr. Gainsburg, has filed a
6 complaint against Bio-Tech.
7 THE COURT: This is a substitution. You
8 wanted to withdraw.
9 MR. GAINSBURG: I'll do a new order.
10 MR. GOTTI: Has filed a complaint against
11 Bio-Tech Medical Software before even being
12 withdrawn as --
13 THE COURT: Perhaps; perhaps that's all
14 true. It doesn't matter. The case is
15 dismissed. He's just getting off. He's off.
16 This case was dismissed on April 21st.
17 MR. GAINSBURG: Can I go out and get an
18 order?
19 THE COURT: Yes.
20 MR. GAINSBURG: Thank you so much, Your
21 Honor.
22 MR. GOTTI: I think we are going to
23 reinstate the case.
24 THE COURT: Okay. But it may not be
25 reassigned to me.

1 MR. GOTTI: It's just that --
2 That's acceptable, Your Honor.
3 THE COURT: It might be.
4 MR. GOTTI: It's just that there was a
5 strain between Bio-Tech and --
6 THE COURT: Wonderful.
7 MR. GOTTI: -- Mr. Gainsburg. So --
8 MR. GAINSBURG: I'll prepare that order.
9 Thank you, Your Honor.
10 MR. GOTTI: Thank you.
