MORGAN’S POINT RESORT AMENDMENT ACT 2016

WHEREAS it is expedient to amend the Morgan’s Point Resort Act 2014;

Be it enacted by The Queen’s Most Excellent Majesty, by and with the advice andconsent of the Senate and the House of Assembly of Bermuda, and by the authority of thesame, as follows:

CitationThis Act, which amends the Morgan’s Point Resort Act 2014 (“the principal Act”),

may be cited as the Morgan’s Point Resort Amendment Act 2016.

Amends section 2Section 2 of the principal Act is amended—

in the definition of “Developer”, by after “2010” inserting “, and includesany local company that is a subsidiary of the Developer and has beengranted consent under section 4A of the Companies Act 1981 to hold land”;

in the definition of “Development”, by deleting “Drawing No.5510/046/426h” and substituting “Drawing No. 5510/046/452h”;

in the definition of “freehold land”, by deleting “34.9 hectares (86.2 acres),shown in Drawing No. 5510/046/426b” and substituting “35.03 hectares(86.57 acres), shown in Drawing No. 5510/046/452b”;

in the definition of “freehold seafront land”, by deleting “6.1 hectares (15.2acres), shown in Drawing No. 5510/046/426b” and substituting “6.27hectares (15.49 acres), shown in Drawing No. 5510/046/452b”;

in the definition of “leasehold land”, by deleting “39.2 hectares (96.9 acres),shown in Drawing No. 5510/046/426b” and substituting “39.24 hectares(96.96 acres), shown in Drawing No. 5510/046/452b”;

in the definition of “leasehold seafront land”, by deleting “Drawing No.5510/046/426b” and substituting “Drawing No. 5510/046/452b”;

in the definition of “marina”, by deleting “12.3 hectares (30.4 acres), thatmay be developed as marina, shown in Drawing No. 5510/046/426b” andsubstituting “12.29 hectares (30.38 acres), that may be developed asmarina, shown in Drawing No. 5510/046/452b”; and

in the definition of “Property”, by deleting “92.6 hectares (229 acres) shownhatched in red in Schedule 2 (Drawing No. 5510/046/426a), theboundaries of which are more accurately shown on the definitive boundaryplan of the Property (Sheet Number 4030/001/18)” and substituting“92.90 hectares (229.56 acres) shown hatched in red in Schedule 2(Drawing No. 5510/046/452a), the boundaries of which are moreaccurately shown on the definitive boundary plan of the Property (SheetNumber 4030/001/20)”.

Amends section 6Section 6(1)(c) of the principal Act is amended by deleting “Drawing No.

5510/046/426b” and substituting “Drawing No. 5510/046/452b”.

Amends section 8Section 8(1) of the principal Act is amended by deleting “freehold land, including

the freehold seafront land, into the 37 lots” and substituting “Property into the 44 lots”.

Repeals and replaces Schedules 2, 3, 4 and 5The principal Act is amended by repealing Schedules 2, 3, 4 and 5 thereto and

substituting—
