We remind all in-state dealers to be licensed and we also remind out-of-state manufacturers that while you don’t need to be licensed you should make sure that the businesses/dealers who are selling your product in Montana are licensed. Information on the law: Application forms are posted on the MMH&RVsite at: www.mtmhrv.org The annual license period for a manufactured home dealer is from October 1 through September 30. A first time applicant must submit the following documents. -Application form -Plate order and fees form -Proof of Zoning -Inspection -Dealer Surety Bond * The bond must be in the amount of $50,000.00 * Must indicate the license type of Manufactured Home * Must show an expiration date of September 30 * Must be renewed annually To renew a Manufactured Home Dealer License: Dealers must submit either a new bond or continuation certificate prior to September 30 each year to renew. If bond is not submitted the selling privileges of dealer will be suspended on October 1 each year. OnSeptember27,thePresidentsignedintolawlegis-lation(H.R.5297)thatprovides$30billionincapitaltocommunitybankstoexpandsmallbusinesslending.Thebillestablishesa$30billionlendingfunding,administeredbytheTreasuryDepartment,toprovidecommunitybankswithcapital.Thebillisdesignedtomakeiteasierforsmallbusinesses to access capital.

Eligiblesmallbusinesslendingactivityincludesloansmadetobusinesseswithannualrevenuesofnomorethan$50million.Eligibleloansincludecommercialorindustrialloans;owner-occupiednonfarm,nonresidentialrealestateloans;loanstofinanceagriculturalproduction;andloanssecured by farmland.

ThelegislationextendsthroughFY2013theSmallBusinessAdministration’s(SBA)DealerFloorPlanFinanc-ingPilot(DFP)program,whichprovidesa60-75percentguaranteeoncreditlinesofbetween$500,000and$5mil-lionforthefinancingofinventory,includingmanufacturedhomesandRVs.program Overview:

treasury unveils Sample ReSpa-tila combined disclosure

TherecentlyenactedDodd-FrankWallStreetReformandConsumerProtectionAct(H.R.4173;P.L.111-517)containsaprovisionrequiringthenewlyestablishedBureauofConsumerFinanceProtection(CFPB)todevelopacom-binedTILAandRESPAdisclosureform.Thelawrequiresa proposed disclosure be published with one year of the CFPB’sdesignatedtransferdateofJuly21,2011.

Latelastmonth,theTreasuryDepartmentreleasedasampleformthatcouldpotentiallyserveasareplacementtotheexistingTILAandRESPAdisclosures.TheTreasuryDepartment has been careful to note that the sample form is not being formally proposed by any federal agency and was developedindiscussionsbetweenstafffromtheFederalReserveandtheDepartmentofHousingandUrbanDevel-opment(HUD)andthatitservesonlyasadiscussiondraftand a consumer testing piece.

DuringMHI’sAnnualMeetingheldSeptember26-28inDenver,Colorado,aspecialtaskforcefocusedonanalyzingandminimizingtheimpactimplementationoftheDodd-FrankbillandformationoftheCFPBwillhaveonthemanufactured housing industry was established.

TaskforcemembersandMHIstaffareintheprocessofreviewingandprioritizingprovisionsimpactingmanufac-tured housing throughout the Dodd-Frank measure and will bemeetinginmid-Novembertooutlineproposedlegisla-tiveandregulatoryremedies.

ginnie mae announces pooling guidelines for FHa title i program

MHIispleasedthatearlierthisweek,GinnieMaereleased its pooling guidelines for loans insured under the newFHATitleIprogram.TheissuanceofthesepoolingguidelinescompletestheimplementationoftheFHATitleIprogrampassedaspartoftheHousingandEconomicRecoveryAct(HERA)in2008.

TheissuanceoftheseguidelineswillnowalsoprovideFHATitleIlendersandGinnieMaeapprovedIssuerstheabilitytosecuritizemanufacturedFHATitleIloans.

EffectivewithissuancesonorafterOctober1,2010,is-suers may pool manufactured home loans insured under the FHATitleIprogramelectronicallythroughGinnieNET.

Afewkeyhighlightsinclude:

•Thesecuritiesratemustbeatleast3.25percentlowerthanthelowestfacerateontheloans,butnotmorethan4.75percentlowerthanthehighestfacerateofthesecurity.

•TheguaranteefeeforMHMBSremainsat30bps,andeachpoolmustcontainatleasteightloans.Theminimumpoolbalance,atorigination,willincreaseto$1million.

•TheprogramisretroactiveforanyFHAloansorigi-natedsinceJune1,2009.

However,MHIhasheldseveralmeetingswithGin-nieMaeandFHAseniorstaffregardingourrequestforchangestotheeligibilitystandards,inotherwords,whatrequirementsdolendershavetomeetjusttoparticipateintheGinnieMaeprogram.WhileMHIsupportsstronglythepremise that the program must be protected from future lossesandthatlendersmusthaveadequatenewworthrequirements,MHIbelievesthatsomeconsiderationscan be made to responsibly ease the burden of lenders to participateasaGinnieMaeIssuer.PleasenotethatalendercanbeanFHAlenderandoriginateloansinsuredbyFHA,andyetnotbeaGinnieMaeapprovedIssuer.AccordingtoGinnieMae,theyhavereceivedmultipleapplicationsfromlenderstobeapprovedIssuers.

TheInternationalEnergyConservationCodeCouncil(IECC),atameetinglastweekinCharlotte,NorthCaro-lina,votedtoadoptanewnationalmodelenergycodethatboostsnewhomeandcommercialenergyefficiencyby30%,andwilllikelyimpacttheDepartmentofEnergy’s(DOE)effortstoestablishcomparablestandardsformanu-factured housing.

TheDOEiscurrentlydraftingthestandards,andplanstopublishaproposedruleearlynextyear.TheSystemsBuildingResearchAlliance’sExecutiveDirector,EmanuelLevy,ataDOEmeetinglastweek,confirmedthatindeed,theDOEwillusethenew2012IECCcodeasmodelfornewmanufacturedhousingstandards.UndertheEnergyIndependenceandSecurityAct(EISA)of2007,theDOEmust establish energy standards for manufactured homes thatarebasedonthemostrecentversionoftheIECCCode,andmustalsoconsiderthecosteffectivenessofthestan-dards for manufactured homebuyers.

BothinmeetingswithDOEofficials,andinourwrittencomments,MHIhaswarnedoftheimpactofnewenergystandards on the ability of many homebuyers to afford the increasedhomecostsofthenewstandards,particularlysince loan underwriting and appraisal standards do not considertheincreasedcostsofenergyconservationfeaturesinnewhomes.AtitsLegislativeMeetinginApril,MHI’s

BoardofDirectorsvotedtosupportamendingEISAtoclarifythattheDOE,insettingnewstandardsformanufac-turedhomes,considerthelowesttotalcoststothepurchas-er,includingfinancinganddownpayments.

TheactionlastweekbytheIECCwonthesupportofofficialsfromtheU.S.ConferenceofMayors,TheNation-alAssociationofStateEnergyOfficials,andabroad-basedEnergyEfficientCodesCoalition.

Themodelenergycodegovernsresidentialandcom-mercialbuildingconstruction,additions,andrenovationsin47statesandtheDistrictofColumbiawherelocalbuild-ing codes are based on these national model standards. FHFAwasestablishedin2008throughtheHousingandEconomicRecoveryAct(HERA),whichplacedFannieMaeandFreddieMacintoconservatorship.FHFAhasoversightandregulatoryauthorityoverFannieMae,Fred-dieMacandtheFederalHomeLoanBanks.AsofJune2008,thecombineddebtandobligationsoftheseGSEstotaled$6.6trillion.TheGSEsalsopurchaseorguarantee84percentofnewmortgages.

MHIheldaconferencecallwith31memberstateas-sociationexecutivesonTuesday,November9.Duringthecall,MHIprovidedasummaryofelectionresultsandanticipated changes on Congressional committees impact-ingtheindustry.StateassociationexecutivesinturnsharedinformationonrelationshipstheyhavewithnewlyelectedMembers and their potential for being industry allies in Washington,DC.

MHIupdatedstatemembersonMHI’s2011prioritiesanddecisionsmadeatMHI’sAnnualMeetinginDenverrelated to those priorities. Participants were informed of theupcomingmeetingofMHI’staskforceappointedtoanalyzetheimpactoftheDodd/FrankWallStreetReformandConsumerProtectionActontheindustry.MHIwillworktoresolveissuesidentifiedbythetaskforceduringlegislativecorrectionstothelawand/orduringtheregula-tory process.

Discussion was also held on the recent meeting of the ManufacturedHousingConsensusCommittee(MHCC).Many states are facing budget constraints in running their SAAprogramsandthiswasalsodiscussed.MHIandthestateassociationexecutivesholdregularcallstodiscussnationalissuesandhelpcoordinateaunifiedmessageandstrategy.

wHY SO manY RV adS dOn’t wORkManytimes,peoplewritingRVadsforgetsellingisa

matterofone-to-one.Thebasicsofsellingareonepersonsellingtoanother.ButmanydealershipsandRVadagen-ciesaregettinglost.Ifthere’sonemistakedealersmake,it’sthe“30,000footprint.”

The30,000footprinttrystoselltoeveryone,butendsup selling to no one. Don’t talk to the entire market. Imag-ine you’re talking to one person.

More money is wasted by agencies and dealers talking to a group of people instead of talking to a single person. It’sasimplefact:toresonatewithaconsumer,theyneedtofeelyou’retalkingtothem.Thatoneindividualneedstobelieveyou’retheanswertotheirwantsandneeds.Youradsmustmaintainaonetooneperspective.Ifyourmessagehasthe30,000footprintperspective,you’renotgetting the most for your money.

Atypical30,000footmessagesoundslikealistingoffactsandfeatures.Thereisnosellingofthebenefits.Benefitsarewhatmotivatecustomerstotakeaction.YourRVadmustmaketheirlifemorefulfilling,morefun,lessstressful,orsimplybetter.

Whenyouwriteyournextad,seeifitpassestheone-to-one test.

Closing a customer on a product is earned through a process. It requires one to put forth effort to gain an under-standing of what the customer deems is important and is ultimatelytryingtoachieve.Then,usingone’sknowledgeandskillstoinfluencethecustomerinunderstandingyourproductisbesttofittheirneeds.Thisiscreatingvaluethatistiedtotheirwantsandneeds.Thesalesperson’seffec-tivenessatachievingthisthroughthesalesprocessshowsintheabilitytonegotiateafairprofitforyourproduct.

Withallthatbeingsaid,ittrulyisnothingmorethanarepetitiveapproachthatisadaptedtoahandfulofstallsorobjections.Thestallsorobjectionsareanindicatorthat,fromthecustomer’spointofview,somethinghasnotbeenvalidatedorjustified.Onceonelearnshowtoaddressthesestallsorovercometheobjections,heorshecanmoveontothe negotiation.

Thetwoleadingareasinsalesthatseemtosuffermostarenegotiatingandclosing.Forsomereason,thesetwoareasroutinelyevademostsalespeopleintheirquesttobecomeexcellent,butalsoinjustachievingproficiencyinthissignificantpartofthesale.Likeanyotherprofessionthesearelearnedskills.Formany,theseskillshavecomefromtheexperienceoftrialanderror.Fortunately,into-day’s world so much focus has been put on negotiating and closing,thereisawealthofinformationtohelpimproveyour skills in this area.

Thereseemstobecommoncausesforlackofimprove-mentinone’snegotiatingandclosingskills.ThefollowingisalistofthetopfivereasonsineachIhavediscoveredinmy years of working with salespeople.

MMH&RV Already Preparing for 2011 Legislative Session

The Montana Legislative Session will begin on January 3, 2011 and your state association will be an active participant in working on bills that impact both the manufactured housing and RV industries. Throughout the session we will be sending members periodic updates of happenings at the State Capitol and on occasion we will ask you to please contact your legislator to help support or oppose a specific bill. We will also be posting up to date legislative information on the MMH&RV Web-site throughout the 90 day session that concludes the last week in April. To date Montana Legislators have requested over 700 bills and we anticipate that number will grow to 2,000 by the start of the session. We are already flagging bills that could impact members and below is a list of 35 bills that we have placed our bill tracking list so far. Look for more information as the session approaches and if you have questions then please call Stuart at the association office at, 406-442-2164.
