12.1.2 NAMING OF THE NEW MUSEUM BUILDING

PURPOSE

For the Council to approve the name endorsed by the Museum Advisory Committee for the new museum building.

BACKGROUND

The development of the Museum site presents opportunities including selecting a name for the new community facility. The new facility replaces an old shed that once housed the education kitchen and butcher’s cart. Over the years, it has been referred to as “The Shed”, “The Education Centre” and “The Domestic Life Building”. As there are four buildings within the Museum precinct, it is beneficial to have a clear name for each building to distinguish them from one another.

A Museum Advisory Committee meeting was held on Tuesday, 10 August 2021 to discuss a name for the new museum building.

DISCUSSION

A report presented to the Museum Advisory Committee offered six suggestions of a name for the new facility. These names were researched and proposed by the Town’s Museum staff, based on the following:

1. the strength of their attachment to Claremont,

2. their involvement in the Claremont community, and

3. the individual’s involvement in the Museum.

The suggested names were attached to the word ‘gallery’, to represent the fact that it will be used to display works and collections.

Names suggested were:

1. Atkinson Gallery

2. Bodney Gallery

3. Hasluck Gallery

4. Henneker Gallery

5. Strauss Gallery

6. Tocock Gallery

After much discussion, the Museum Advisory Committee unanimously agreed not to name the building after an individual, but instead to give the building a name which reflects the location. By doing so, it also allows for the possibility of a prefix sponsor name in years to come. Additionally, the name reflecting the location will not date, as opposed to an individual who may no longer be recognised by future generations. The location name, Freshwater Gallery encompasses the riverside location as well as the past name of the Claremont Museum, being Freshwater Bay Museum. In discussing suggestions for the building’s name it became evident that the Town does not have a policy for naming rights and sponsorship. The Museum Advisory Committee recommends that a policy is developed to standardise this procedure.

PURPOSE

For Council to consider and adopt amendments to the Terms of Reference for the following Committees:

1. Claremont Museum Advisory Committee;

2. Lake Claremont Advisory Committee;

3. Foreshore Advisory Committee; and

4. Audit and Risk Management Committee.

BACKGROUND

Council has established Committees under section 5.8 of the Local Government Act 1995 (Act):

A local government may establish* committees of 3 or more persons to assist the council

and to exercise the powers and discharge the duties of the local government that can be

delegated to committees.

* Absolute majority required.

Section 2.1 of the Town of Claremont Meeting Procedures Local Law 2018 requires Council to endorse the Terms of Reference of a Committee upon its establishment.

Each of the abovementioned Committee’s Terms of Reference were adopted by Council on 17 October 2017. The Terms of Reference were last reviewed at the Ordinary Council Meeting on 15 October 2019, however, they remained largely unchanged from the 2017 versions.

The Terms of Reference can be amended by Council as required. It is encouraged that each Committee’s Terms of Reference are reviewed on a regular basis, ideally once every two years.

There are two Committees of Council whose Terms of Reference are not included in this report as set out below:

Claremont Town Centre Advisory Committee

The Claremont Town Centre Advisory Committee’s next meeting is on 28 September 2021. The Terms of Reference will be presented to the Committee for review at this meeting and will thereafter be presented to Council for adoption. This will likely occur when Committee nominations are presented to Council.

Complaints Committee

The Complaints Committee was established and its Terms of Reference were adopted at the Ordinary Council Meeting on 18 May 2021. Accordingly, no review of the Terms of Reference is required at this stage.

DISCUSSION

The following amendments have been applied globally to each Committee’s Terms of Reference:

1. Amendments to formatting –

• Colour scheme and fonts updated to reflect the Town’s current branding;

• Numbering removed from headings and numbering of terms simplified;

• Town logo updated to Council’s crest; and

• Document control box inserted for improved version control. Removed double ups with legislation.

2. The documents have been simplified to ensure items that are dealt with in the legislation are not duplicated within the Terms of Reference such as voting and agenda requirements.

3. The criteria for community representatives has been updated for the Advisory Committees to allow for a reduced number of community representatives in the event limited nominations are received as has occurred in previous years.

4. Removal of the provision which stated that additional Committee Meetings may be convened by resolution of Council. Council approval is not required to convene a meeting. The Terms of Reference all now specify that meetings will be called by the Chairperson in consultation with the Chief Executive Officer.

5. The Terms of Reference all provide that Committee’s will meet at least quarterly.

6. The responsibilities section of the Terms of Reference has in most cases been removed or amended as no Committee has delegated powers from Council. The objectives section now more accurately reflects the functions of Committees.

Below is a detailed summary of changes made to each Committee’s Terms of Reference.

Claremont Museum Advisory Committee

At its meeting on 10 August 2021, the Claremont Museum Advisory Committee were presented with proposed amendments to the Terms of Reference for review as shown at Attachment 1.

Key changes made to the Terms of Reference are as follows:

• ‘Freshwater Bay Museum’ has been changed to ‘Claremont Museum’ (as per Council’s decision at the Ordinary Council Meeting on 20 October 2020).

• The current Terms of Reference states that the Advisory Committee will be comprised of two Council Members and five community representatives. The Terms of Reference now provides that the Committee will be comprised of two Council Members and three to five community representatives including at least:

1. One representative from the Friends of the Museum community group; and

2. One Town of Claremont resident.

Following the Committee’s meeting on 10 August 2021 the Terms of Reference has been slightly amended as shown with tracked changes at Attachment 2 and in final version at Attachment 3. The additional amendments have been highlighted yellow for reference in Attachment 2.

Lake Claremont Advisory Committee

At its meeting on 12 August 2021, the Lake Claremont Advisory Committee were presented with a revised Terms of Reference for review as shown at Attachment 4 with tracked changes. The final version is shown at Attachment 5.

Key changes proposed to the Terms of Reference are as follows:

• A provision has been inserted to detail the types of updates and reports that are generally presented to the Committee at each meeting being:

1. A progress report from Town staff providing an update to the Committee on the items, tasks and activities that have been completed from the Lake Claremont Operational Plan for the preceding period;

2. An update from the City of Nedlands Council Member regarding City of Nedlands projects which are of interest to the Committee; and

3. An update from the Friends of Lake Claremont Committee Representative regarding the organisation’s activities and projects.

City of Nedlands

At the Committee Meeting, Committee Members moved an amendment to the Terms of Reference as detailed below:

That the words ‘and Deputy’ be inserted after the words ‘Nedlands Council Member’ at point 4b of the amended Lake Claremont Advisory Committee Terms of Reference.

Currently, a second Council Member from the City of Nedlands attends most Committee Meetings together with the City of Nedlands Committee Member.

The intention of this amendment is to provide for the additional representative from the City of Nedlands to attend Committee Meetings without assigning them voting rights.

Section 5.11A of the Act states that a local government may appoint a person to be a deputy member of a committee and that ‘a deputy member of a committee may perform the functions of the member when the member is unable to do so by reason of illness, absence or other cause’.

Council has not resolved to appoint a deputy member to the Lake Claremont Advisory Committee and would need to do this before a Deputy could be appointed.

Further, appointing a Deputy, would afford them voting rights at a Committee meeting when acting in the capacity of Deputy (when the Member is not in attendance).

It is not recommended the amendment be adopted. Rather, the recommended approach is that the Chairperson of the Committee extends an invitation to the additional representative from the City of Nedlands to attend Committee meetings pursuant to point 13 of the Terms of Reference.

Point 13 of the Terms of Reference states that meetings of the Advisory Committee are generally closed to the public and that public attendance is permitted only through invitation or prior approval by the Committee.

Foreshore Advisory Committee

At its meeting on 25 August 2021, the Foreshore Advisory Committee were presented with a revised Terms of Reference for review as shown at Attachment 6 with tracked changes. The final version is shown at Attachment 7.

Key changes made to the Terms of Reference are as follows:

• The current Terms of Reference refers to the Foreshore as both the Swan River and Freshwater Bay Foreshore. All references have been updated to Claremont Foreshore to encapsulate all aspects of the Foreshore relevant to the Committee including parkland, habitat zones, parking and overarching management.

• A provision has been inserted that Town staff will report to the Committee at each meeting to provide updates on items relevant to the Foreshore, as is the current practice.

Audit and Risk Management Committee

Amendments to the Audit and Risk Management Committee’s Terms of Reference were adopted by Council at the Ordinary Council Meeting on 15 June 2021.

A further amendment to the Terms of Reference is proposed in accordance with the global amendments detailed above.

The revised version of the Audit and Risk Management Committee’s Terms of Reference is shown at Attachment 8 with tracked changes and Attachment 9 as final.

URGENCY

It is recommended that Council review each Committee’s Terms of Reference on a regular basis, ideally once every two years. The last review of the Terms of Reference occurred at the Ordinary Council Meeting on 15 October 2019.

That Council adopt each of the Terms of Reference for the following Committees:

a. Claremont Museum Advisory Committee as shown in Attachment 3;

b. Lake Claremont Advisory Committee as shown in Attachment 5;

c. Foreshore Advisory Committee as shown in Attachment 7;

d. Audit and Risk Management Committee as shown in Attachment 9.

With the consent of the mover and seconder, the wording of the motion was altered to read as follows:

That Council adopt each of the Terms of Reference for the following Committees:

a. Claremont Museum Advisory Committee as shown in Attachment 3;

b. Lake Claremont Advisory Committee as shown in Attachment 5 subject to the addition of the following provision:

An additional City of Nedlands Council Member will be appointed as a Deputy Member of the Committee. The Deputy Member may perform the functions of the City of Nedlands Council Member when the member is unable to do so by reason of illness, absence or other cause;

c. Foreshore Advisory Committee as shown in Attachment 7;

d. Audit and Risk Management Committee as shown in Attachment 9.

14 ANNOUNCEMENTS BY THE PRESIDING PERSON

Cr Kelly shared that he attended the WALGA State Council meeting held in Broome.

Cr Goetze and Cr Main shared they attended the judging of the Art Award and Exhibtion. They advised they also attended the opening of the Art Award and Exhibition together with Cr Telford, Mayor Barker, Cr Suann, Cr Browne and Cr Haynes.

Cr Goetze shared she participated in a WALGA Zone Meeting, SHINE Community Services Board Meeting and Public Transport Authority Art Selection Panel for the Claremont Train Station.

Cr Telford, Cr Main and Cr Goetze shared they attended the WALGA Social Media Presentation hosted by the Town which was attended by Elected Members from the Shire of Peppermint Grove, Town of Mosman Park and Town of Cottesloe.
