MINUTES OF THE MISSISSIPPI ENVIRONMENTAL

QUALITY PERMIT BOARD

HELD IN JACKSON, MISSISSIPPI, ON TUESDAY, MAY 12, 2015

The Mississippi Environmental Quality Permit Board held a meeting in the

Commission Hearing Room of the Department of Environmental Quality, located at 515

East Amite Street, on May 12, 2015. Leslie Royals called the meeting to order at 9:00

a.m. with the following members and designated representatives present:

Roy Furrh Senior Attorney for MDEQ, was present as General Counsel. On

motion by Mike Bograd and seconded by Jan Boyd, the minutes of the April 14, 2015,

meeting were approved.

REPORT OF STAFF PERMIT ACTIONS/CERTIFICATIONS

Staff reported to the Permit Board that staff had taken action on various permits

since the April 14, 2015, Permit Board Meeting pursuant to the regulations delegating

this authority to the Executive Director and the Executive Director’s delegation of this

authority to the staff in accord with those regulations. The Permit Board voted to note

and record in its minutes the reports of permit actions/certifications by staff since the

April 14, 2015, Permit Board Meeting. [Kay Whittington abstained from voting on all

Land and Water Resources permits and Mike Bograd abstained on all of the Office of

Geology permits.]

Joe McGee Construction Co., Inc., P11-017 Madison County

Joe McGee Construction Co., Inc. requested that P11-017 be rescinded as no

mining activities have taken place at this site nor will there be any mining at this

site.

Surface Mining Permit Transfer:

On motion by Jim Lipe and seconded by Jan Boyd, the Permit Board voted

to approve the following surface mining permit transfer: (Mike Bograd abstained)

E. I du Pont de Nemours & Company-Delisle Plant P04-036 Harrison County

E. I. du Pont de Nemours and Company-Delisle Plant requests that P04-036 be

transferred to the Chemours Company FC, LLC. The E. I. du Pont de Nemours and

Company-Delisle requests that their bond be returned. The new permit number will

be P04-036T.

Red Hills Mine MS-002 Bond Release:

On motion by David Snodgrass and seconded by Jim Lipe, the Permit Board

voted to approve the requested partial bond release of 21 acres for a road and right

of way. This portion of the road will be returned to Choctaw County. This is the

first coal mine bond release under the state coal mining law. (Mike Bograd

abstained)

THE PERMIT BOARD CONSIDERED THE FOLLOWING OFFICE OF

POLLUTION CONTROL MATTERS:

Agriculture Branch

C and T Farm, AFO General Permit #MSG201809, Lamar County, Mississippi

and Coverage under the Large Construction Storm Water General Permit

(Coverage #MSR106876):

Tracy Tomkins of the Environmental Permits Division advised the Board that

C and T Farm applied for coverage under the State of Mississippi AFO General

Permit and for coverage under the State of Mississippi Large Construction Storm

Water General Permit for operation of a proposed poultry farm in Lamar County,

Mississippi. MDEQ received two letters stating concerns with potential odors,

runoff, and other possible contaminants from the proposed site. MDEQ conducted

two pre-permitting site inspections, one on March 12, 2015, and the other on May 1,

2015. MDEQ’s inspectors verified that the proposed facility complied with the siting

criteria and that the proposed facility also complied with all technical requirements.

Ms. Tomkins advised the Board that staff recommended issuance of the coverages to

C and T Farm. No one spoke in opposition to issuance of the coverages.

On motion by Jan Boyd and seconded by Jim Lipe, the Permit Board voted to

accept the staff’s recommendation to issue both permits.

Solid Waste Management & Mining

Leflore County Board of Supervisors, Leflore County Municipal Solid Waste

Landfill, Renewal of Wastewater Pretreatment Permit #MSP091115, Renewal of

NPDES Storm Water Permit #MSS050237, Reissuance of Title V Air Permit

#1560-00073 and Renewal of Solid Waste Permit #SW05420010430:

Sandra Taylor of the Environmental Permits Division advised the Permit

Board that the Leflore County Board of Supervisors applied for renewal of four

permits for a Municipal Solid Waste Landfill located in Leflore County, Mississippi.

MDEQ held a public hearing to receive public comments regarding the draft permits

on April 9, 2015, at the Leflore County Civic Center. MDEQ received comments

primarily regarding outreach to the community. MDEQ’s Environmental Compliance

and Enforcement Division inspected the landfill and found there were no violations.

MDEQ staff determined that all of Leflore County’s permit renewal applications were

complete and complied with all regulations. Staff recommended reissuance of the

permits.

On motion by Jan Boyd and seconded by David Snodgrass, the Permit Board

voted to accept the staff’s recommendation to issue all four permits.

Kemper County Landfill Company, LLC, A subsidiary of Waste Pro of

Mississippi, Inc., Reissuance of NPDES Storm Water Permit #MSS049468 and

Reissuance of Pretreatment Permit #MSP091085:

Charity Rockingham of the Environmental Permits Division advised the

Permit Board that the Kemper County Landfill Company applied for reissuance of

two permits. MDEQ held a public hearing to receive public comments regarding the

draft permits on April 16, 2015. Staff determined that the permit renewal

applications were complete and complied with the solid waste laws and regulations.

Staff recommended reissuance of the permit.

On motion by Dennis Riecke and seconded by Jan Boyd, the Permit Board

voted to approve the staff’s recommendation to issue both permits.

CONFIRMATION OF THE NEXT PERMIT BOARD MEETING

Leslie Royals confirmed the next meeting to be June 9, 2015.

OTHER BUSINESS

Roy Furrh stated that there will be an evidentiary hearing during the July 14,

2015, Permit Board meeting regarding the Drying Facility Assets Holdings, LLC

facility in Picayune, MS which involves transfer of permits and issuance of a Clean

Water Act Section 401 Water Quality Certification.
