MINI Full MaintenancePrograms - 2005 Models

Full Maintenance Programs are a benefitdesigned to help reduce the cost of scheduledand unscheduled maintenance.

MINI Cooper and MINI Cooper S passengercars purchased from any Authorized MINIDealer in the United States are covered by FullMaintenance for 36 months or 36,000 miles,whichever occurs first. Coverage begins on thedate of first retail sale or the date the vehicle isfirst placed in service as a demonstrator orcompany vehicle, whichever is earlier.

Any authorized MINI Dealer in the UnitedStates will perform the scheduled or additionalmaintenance services on your vehicle at noexpense to you. The maintenance scheduleintervals are based on normal driving condi-tions and operation. Should you requestmore frequent maintenance service, thecost of these services will not be covered bythe Maintenance Program.

Coverage

Full Maintenance covers all factory recom-mended maintenance, as determined by theservice interval indicator. Additional items thatneed replacement due to normal wear andtear, and that are not covered by the originalMINI New Passenger Car Limited Warranty -such as brake pads, brake rotors, and wiperblades - are included, provided wear and tearexceeds MINI specifications. Any adjustmentsrequired due to normal operating conditionsare also included. See pages 6-9 of thisstatement for additional information.

Maintenance Intervals

Time intervals should be followed using themaintenance interval as indicated by the MINIService Interval Indicator on the check controlpanel in the dashboard.

This MINI Service and Warranty InformationStatement should be presented to your MINIDealer when maintenance is required. Your

MINI Dealer will stamp this book documentingthe services or maintenance performed.

Exclusions from coverage

– Items reimbursable under your MINI NewPassenger Car Limited Warranty.

– Gasoline and gasoline additive.– Windshield washer additive (except when in

conjunction with scheduled maintenance).– Tires, wheel alignment, tire balance and

rotation.– Wear and tear of soft trim items, such as:

seats, carpets, moldings, headliner, doorpanels and all chrome trim.

– Damage detected when performing the rustperforation inspection.

– Damage which results from negligence,improper operation of the vehicle, wear andtear or deterioration due to driving habits orconditions, improper repair, environmentalinfluences, flood, accident or fire damage,road salt corrosion, alteration, installation ofnon-MINI accessories, or use of improper,poor quality or contaminated fuel.

– Altered or unreadable Vehicle IdentificationNumber (VIN) or odometer irregularities orvehicles where the true mileage cannot bedetermined.

– Maintenance or repair after the vehicle isdeemed a total loss.

– Maintenance or repairs performed by otherthan an Authorized MINI Dealer within theUnited States.

– Vehicles used in competitive events.– Oil changes performed outside the recom-

mended maintenance intervals as indicatedby the Service Interval Indicator.

Upgrades

Note: For those vehicles covered by FullMaintenance for 36 months/36,000 miles,MINI offers the possibility to upgrade to FullMaintenance for 48 months/50,000 miles.This upgrade can be purchased throughyour authorized MINI Dealer during the first36 months or 36,000 miles of ownership,whichever occurs first. Maintenance System

The MINI Maintenance System has beendevised with the following objectives: tomaximize vehicle safety, reliability, andresale value by minimizing breakdownsresulting from wear, and minimizing cost andinconvenience by computing maintenanceintervals based upon the specific manner inwhich each individual vehicle is driven.

Maintenance intervals on motor vehicleshave conventionally been specified basedupon accumulated mileage. However, thetype of driving conditions has a majorinfluence on routine maintenance require-ments; distance traveled is only one of thesignificant factors. A vehicle driven for50,000 miles of short trips in the city withnumerous cold starts, prolonged periods ofidling, stop-and-go driving, and high enginespeeds during acceleration requires morefrequent maintenance intervals than avehicle driven for 50,000 miles for longdistances at low engine speeds primarily atoperating temperature.

MINI’s service interval indicator whichcomputes the actual optimum maintenancerequirements is based not only upon theaccumulated mileage, but takes into accountimportant factors such as engine coolanttemperatures, high or low engine speeds,short or long trip driving, and number ofvehicle starts. The maintenance interval maytherefore be maximized with considerablesavings to owners of vehicles subjected tolight duty.

The service interval indicator consists of amileage reading, and the inscriptions “OILSERVICE” and “INSPECTION”.

Whenever the ignition is switched on, thedisplay shows the next scheduled type ofservice and the remaining distance until theservice should be performed. The distance isbased on your driving style.

If the maintenance interval has beenexceeded, a “—” symbol reminds you of theurgent need for servicing. In the interests ofroad safety and reliability, you should avoiddriving your MINI when the “—” symbol isshowing, and have the essential mainte-nance work performed without delay.

After each maintenance is performed theservice indicator is reset in order to computethe next service interval.

If the service interval indicator displays anillogical reading, or if there is no display,consult an authorized MINI Dealer.

If the speedometer, tachometer or coolanttemperature gauge should develop a fault,the service interval indicator will probablycease to operate correctly as well, since itdepends on correct speed, distance andtemperature readings. The fault must belocated and rectified by an authorized MINIDealer.

A detailed list of all maintenance operationsincluded in each of the elements of the MINIMaintenance System is found on pages 5-14. These elements are as follows:

Quality Certification I will be performed byyour selling dealer and certified on thefollowing page.

The performance of certain subsequentmaintenance elements, as required by theMINI New Passenger Car Limited Warranty,will be specified at intervals computed by theMINI service interval indicator as follows:

– Oil Service: Engine oil changed with theengine at operating temperature. Note:change oil at least once per year. Your MINIis factory-equipped with a newly-developedsynthetic engine oil. At the time of theprinting of this booklet MINI High-Perfor-mance Synthetic 5W-30 Oil (Part Number 0751 0 143 829) and Mobil 1 5W-30 and 5W-40 oils are strongly recommended andapproved by the MINI Division of BMW ofNorth America, LLC for the Cooper andCooper S models. The MINI Division isevaluating various synthetic oils for inclu-sion in our list of recommended motor oils.

For the most current list of synthetic oils,please contact your authorized MINI Dealer,or call the MINI Division at 1-866-ASK-MINI(275-6464).

It is recommended to check engine oil levelwhenever fuel is added to the vehicle.

If you need to add oil between oil changesand are unable to obtain MINI High Perfor-mance Synthetic Oil, Mobil 1 or anotherspecial oil on the list, use a synthetic oil withan API rating of SJ or higher.

– Inspection I: Major vehicle maintenance asspecified in the following pages underInspection I.

– Inspection II: Additional major vehiclemaintenance as specified in the followingpages under Inspection II.

The following maintenance elements must beperformed at the mileage/time stated (time

intervals begin from the vehicle’s productiondate):

– Brake Fluid Service: Change brake fluidevery two years.

– Engine Coolant Service: Change coolantevery four years.

– Oxygen Sensor Service: The oxygen sensordeteriorates strictly on a mileage basis andmust therefore be replaced every 100,000miles to maximize vehicle fuel economy andminimize exhaust pollution. The replace-ment of the oxygen sensor is required underthe terms of the applicable MINI emissionsystem warranties.

– Spark Plug Service: Replace spark plugsevery 100,000 miles. Your MINI is equippedwith platinum-tipped spark plugs. Theseallow a longer service life than conventionalspark plugs.

For your convenience, you may also wish tohave your MINI Dealer perform any neces-sary operations to fulfill any state inspectionrequirements in your area concurrent withthe maintenance elements specified aboveduring other repairs.

Make sure that confirmation of maintenancework is always entered in this Service andWarranty Information Statement. You may needthis for any warranty claims that becomenecessary, and later on as evidence that yourcar has been given the correct and regularmaintenance that justifies its resale or trade-invalue.

The most modern technological advancesnot only have been applied to the designand production of your vehicle, but also tocomputing of the optimum maintenanceinterval for your type of operations anddriving style. Your MINI Dealer has made asubstantial investment in unique MINIspecial service tools to enable its MINIfactory trained service technicians toperform quality repairs on your MINI inminimal time. Your MINI Dealer looks forwardto serving your every service need and tohelp maximize your satisfaction with yourMINI, its longevity, and resale value.

Unscheduled Maintenance

Only use fuels advertised to have adequatedetergency and low alcohol content. Use offuels with insufficient detergent and/orexcess alcohol can cause driveabilityproblems that necessitate cleaning intakevalves and fuel injection valves, and, whenapplicable, adjusting the engine idle. Wesuggest having this work performed by yourauthorized MINI Dealer, perhaps whileregular maintenance is performed. Your MINIDealer can also recommend a gasolineadditive that will provide sufficient deter-gency. While this recommended un-scheduled maintenance is not required inorder to maintain the emission warranty,cleaning of intake valves or, when appli-cable, fuel injection valves, or adjustment ofengine idle, necessitated by use of in-appropriate fuel, is not covered by warrantybecause no defect in material or workman-ship or component failure is involved.

Special Note

Maintenance items and schedules statedherein reflect the combined recommenda-tions for all model 2005 MINIs, and aresubject to change. The most current mainte-nance recommendations are available fromyour authorized MINI Dealer.

If your car is driven only for short distancesof less than 10 miles over a prolongedperiod of time, without an occasional drive athighway speeds, the engine’s chargingsystem will not maintain the battery. Insuffi-cient use of the vehicle could result in short-term starting problems and in the long-termcould damage the battery.

In case the car is not operated for more thanfour weeks it is advisable to:

a) consider using a proper trickle charger,following the charger manufacturer’sinstructions, to maintain the battery’s stateof charge; or

b) consult your MINI Dealer regardingbattery removal. Once removed, thebattery must be charged and stored in acool, dry place where it can be protectedfrom freezing. If the battery will be storedfor over 3 months, it must be rechargedevery 3 months, or else it will becomedamaged and useless.

Please consult with your MINI Dealer forfurther guidance and information.

Corrosion Protection

Extensive corrosion protection measuresnow make it possible to offer a twelve-yearunlimited mileage anti-corrosion warrantyagainst rust perforation on your vehicleprovided that the vehicle is maintained inaccordance with the provisions of the MININew Passenger Car Limited Warranty asoutlined in the Warranty Section of thisStatement (page 30).

The major degree of corrosion protection isdue to the electrophoretic dip paintingprocess which cathodically deposits paintparticles on all body parts, attracting paintparticles into the minutest cavities or seams.Body parts are designed to provide optimumcorrosion protection.

During manufacture, exterior body partsreceive an additional corrosion protectioncoat. Hood, trunk, doors and other bodyparts with metal folds are coated with PVCand sealed from the outside.

All floor panels receive a resilient coating ofPVC for maximum protection againstdamage due to stones, etc.

Corrosion protection materials tested overmany years are applied to the surfaces ofcavities and to the entire underside of thevehicle during and after assembly.

Requirements for maintaining the twelve-year unlimited mileage anti-corrosionwarranty are outlined in the WarrantySection of this Statement (page 32).

Restoring corrosion protection

Please take care that anti-corrosion materialis replaced when your car is repaired afterbody or chassis damage.

MINI will not accept any liability for anyparts and accessories not approved bythe MINI Division of BMW NA.

Underbody maintenance

The underbody has to be cleaned at leastonce a year, in spring, with plain water inorder to remove mud, chemical sedimentsand other deposits. If those materials arenot removed, corrosion (rust) will occur.

Your MINI Dealer will do this anti-corrosionservice for you.

WARNING

Do not apply additional undercoating orrust-proofing on or near the exhaust mani-fold, exhaust pipes, catalytic converter orheat shields. During driving, the substanceused for undercoating could overheat andcause a fire.

During a specific period (usually the earlierof 12 months or 12,000 miles, though thisperiod varies by state), some states requireus or our authorized MINI Dealer, to repair ina reasonable number of attempts, any defector condition which substantially impairs theuse, value, or safety of a new vehicle sold,leased or registered in that state.

A “reasonable number of attempts” isgenerally defined as: (i) two or more at-tempts to repair the same defect (the numberof attempts may vary by state); or (ii) that thesame defect has caused the vehicle to beout of service by reason of repair for morethan 30 days (this period may vary by state),except for delays created by conditionsbeyond our control.

If we are unable to correct a defect orcondition covered by these statutes in areasonable number of attempts, we may beobligated either to replace the vehicle orreimburse the owner/lessee in an amountequal to the purchase price or leasepayments paid by the owner/lessee, less theamount directly attributable to use of thevehicle by the owner/lessee.

Owner’s Eligibility

You are covered if your vehicle is:

– A new MINI passenger car, distributed bythe MINI Division of BMW NA, andpurchased at an authorized MINI Dealer,OR;

– A new, U.S. version, MINI passenger carpurchased under the Diplomatic or MilitarySales programs, operated in any of the 50states, Canada and Puerto Rico.

Coverage is provided for the vehicle itself,regardless of the driver. Protection isconcurrent with the MINI New PassengerCar Limited Warranty.

Getting Started

A temporary Roadside Assistance Identifica-tion Card can be found inside of your vehicleportfolio. It contains the 24-hour toll-freenumber for Roadside Assistance.

For your convenience a decal, showing thesame information as the ID card, has beenaffixed in the trunk compartment.

In a few weeks you will receive a permanentMINI Roadside Assistance ID card by mail.The original in-service date and the vehicleidentification number (VIN) are embossedon the card.

This card should be carried by the driver ofyour MINI passenger car.

Calling For Assistance

The toll-free MINI Roadside Assistancenumber is answered by a MINI RoadsideAssistance service representative. In orderfor you to receive quick and reliable ser-vices, it is essential that you providedetailed and accurate information to theservice representative.

Be prepared to give:

1. Your name and address.

2. Your complete Vehicle IdentificationNumber (found on your vehicle registra-tion or your permanent MINI RoadsideAssistance ID card).

3. Model description of your vehicle.

4. Date of purchase.

5. License plate number of your vehicle.

6. Vehicle location (including nearbycrossroads/intersections, highway mile markers,street numbers, landmarks, etc.).

7. Location you are calling from (includinga telephone number where you can bereached). If you are calling from a publicphone wait there for the return call. Donot leave this location without informingthe Roadside Assistance servicerepresentative.

8. A description of your vehicle’s problem.Specific and accurate information willenable the Roadside Assistance servicerepresentative to provide the properhelp.

Dispatch Service

A service provider will be dispatched to thesite of your disabled vehicle.

On-Site Assistance

On-site service for vehicle disablementssuch as flat tires, dead batteries, and out offuel conditions is provided by MINI RoadsideAssistance.

The cost for parts and fuel, when used on-site, are the responsibility of the owner/driver. The MINI New Passenger Car LimitedWarranty does not cover any of the aboveon-site services.

Lock-Out

Please contact MINI Roadside Assistancefor lockout situations. MINI RoadsideAssistance will attempt to reunite the ownerwith a spare key by calling someone atcustomer’s residence or by sending ataxicab to pick you up. (Cost of taxi is notreimbursable.) Be sure the vehicle is in asafe location in the above situations. As alast resort, we will have your MINI towed todealership. The MINI dealership can assistwith key replacement. Towing services willbe provided up to a maximum of $100.00per incident. The cost for replacement keys isthe responsibility of the owner/driver.

Towing Service

In the event of a mechanical breakdownnormally covered under the MINI NewPassenger Car Limited Warranty, yourvehicle will be transported (at no cost) to the

Services nearest authorized MINI Dealer. Your vehicleis also covered in the event of an accident orcollision.

If a breakdown occurs after normal businesshours, your vehicle will be transported to asecure location and transported to thenearest authorized MINI Dealer on the nextbusiness day.

If you request that the vehicle be taken to alocation other than the nearest authorizedMINI Dealer, any additional expense will beyour responsibility.

Towing requests for vehicles disabledbecause of casualty, fire, act of God, acts ofwar (declared or undeclared), or violation oflaw (federal, state or local) are accepted atthe expense of the owner/driver.

If it is necessary for you to have your vehicletowed through your own arrangements, youmust contact MINI Roadside Assistancefor prior authorization and instructions onclaim procedures. All claims must besubmitted within sixty (60) days of thedisablement or occurrence, accompanied bythe original receipts. Claims received afterthat time period may not be honored and aresubject to the full discretion of MINI Road-side Assistance. If MINI Roadside Assis-tance is not contacted for "prior" authoriza-tion, the maximum coverage for towingsituations is $50.00.

Sign-and-Drive

In most instances, services provided underthe MINI Roadside Assistance Program donot require immediate payment.

Usually, you will be able to sign a receipt, sothe provider of the service can bereimbursed directly by MINI RoadsideAssistance.

Parts, materials, and fuel should be paid forby you directly to the provider of theservices.

Trip Interruption Benefits

Trip interruption benefits are provided formechanical breakdowns as follows:

– Breakdowns that are warranty related,and;

– Must occur in excess of 100 miles from thedriver’s residence, and;

– Repairs cannot be completed duringnormal business hours on the same day ofbreakdown.

Reimbursements will be made for meals,lodging, car rentals, and alternate transpor-tation to bring the driver and the MINIpassenger car together after the vehicle hasbeen repaired by an authorized MINI Dealer.Original receipts and a copy of the vehiclerepair order must accompany all reimburse-ment requests.

Trip interruption coverage is limited to$750.00 per incident, to a maximum of fivedays per incident.

Always contact MINI Roadside Assistancefor trip interruption benefits. They will assistin making all the necessary arrangements.

Exclusions

Specifically excluded from coverage are:

– Fines, taxes, or impound towing feescaused by a violation of local or state law.

– Expenses related to hazardous weatherconditions (removal from snow, ice, etc.).

– Expenses for the removal of snow tires,and mounting or removal of snow chains.

Warrantor

The MINI Division of BMW NA warrants 2005U.S. specification vehicles distributed by theMINI Division against defects in materials orworkmanship to the first retail purchaser, andeach subsequent purchaser.

Warranty Period

The warranty period is 48 months or 50,000miles, whichever occurs first.

Warranty Begins

This warranty begins on the date of firstretail sale, or the date the vehicle is firstplaced in service as a demonstrator orcompany vehicle, whichever is earlier.

Warranty Coverage

To obtain service under this warranty, thevehicle must be brought, upon discovery of adefect in material or workmanship, to theworkshop of any authorized MINI Dealer,during normal business hours. The MINIDealer will, without charge for parts or labor,either repair or replace the defective part(s)using new or authorized remanufacturedparts. The decision to repair or replace saidpart(s) is solely the prerogative of the MINIDivision. Parts for which replacements aremade become the property of the MINIDivision.

In all cases, a reasonable time must beallowed for warranty repairs to be completedafter the vehicle is received by the autho-rized MINI Dealer.

Safety Belt Warranty - Kansas

Safety belts are covered under the MINI NewPassenger Car Limited Warranty for defectsin material or workmanship for a period of 10

years, unlimited mileage from the date ofpurchase. In order to be eligible for thiscoverage, the vehicle must be a new vehicleretailed in the State of Kansas and the repairmust be performed by an authorized MINIDealer in Kansas.

Towing/Other Owner Benefits

A 24-hour Roadside Assistance Program isavailable to every MINI owner during theMINI New Passenger Car Limited Warrantyperiod.

Other Items

Wheel alignment, balancing and wiperblade inserts are covered up to 2,000 miles.

Items which are subject to wear and tear ordeterioration due to driving habits orconditions, such as brake pads/linings,brake discs, clutch disc, pressure plate,filters, upholstery, trim and chrome items,paint finish, drive belts, glass, and similaritems, are specifically limited to defects inmaterial or workmanship.

This warranty does not apply to thefollowing:

Damage which results from negligence,improper operation of the vehicle, improperrepair, lack of or improper maintenance,environmental influences, flood, accident orfire damage, road salt corrosion, or use ofimproper or contaminated fuel.

Maintenance services and parts whenreplaced during maintenance such as sparkplugs, lubricants, fluids, engine tuneupparts, replacement of filters, coolant, andrefrigerant.

Failure to maintain the vehicle properly inaccordance with the instructions in theOwner’s Manual or the Service section ofthis Statement, that results in the failure ofany part of the vehicle.

Modification of the vehicle or installation ofany performance accessories or compo-nents attached to the vehicle which altersthe original engineering and/or operatingspecifications or which result in damage tothe other original components, electricalinterference, electrical short, radio static,water leaks, or wind noise.

Tires are warranted by their respectivemanufacturer as detailed in the applicabletire manufacturer’s warranty statements.Instructions for proper tire care and mainte-nance are contained in the Owner’s Manual.Should you experience difficulty in obtainingwarranty service from a tire manufacturer,your authorized MINI Dealer will assist youin resolving the difficulty.

Non-MINI Parts – While you may elect to usenon-genuine MINI parts for maintenance orrepair services, the MINI Division is notobligated to pay for repairs that include non-genuine MINI parts or for any damageresulting from the use of non-genuine parts.

MINI will not accept any liability for anyparts and accessories not approved bythe MINI Division of BMW NA.

This warranty shall be null and void if thevehicle identification number has beenaltered or cannot be read, if the odometerhas been replaced or altered and the truemileage cannot be determined, if thevehicle has been declared a total loss orsold for salvage purposes, or if the vehiclehas been used in any competitive event.

General

These warranties give you specific legalrights, and you may also have other rightswhich vary from state to state.

The MINI Division of BMW NA warrants thisoriginal vehicle against defects in materialsor workmanship which will result in rustperforation of the vehicle body for a period of12 years, without mileage limitation, com-mencing on the date of first retail sale, or thedate the vehicle is first placed in service as ademonstrator or company vehicle, which-ever is earlier.

To obtain service under this warranty, thevehicle must be brought, upon discovery ofany rust perforation, to the workshop of anyauthorized MINI Dealer. This MINI Dealerwill, without charge for parts or labor, eitherrepair or replace the defective part(s). Thedecision to repair or replace said part(s) issolely the prerogative of the MINI Division ofBMW NA. Parts for which replacements aremade become the property of the MINIDivision.

REQUIRED MAINTENANCE:

In order to keep this warranty in effect, thevehicle must be inspected at every MINIInspection I and II or at least every two years.

The Inspection/Maintenance consists of:

• Repairing any damages to undercoatingor paint due to stone chips, gravel erosion,scratches, or other external influences.

THIS INSPECTION/MAINTENANCE ISEXCLUDED FROM THE RUST PERFORA-TION LIMITED WARRANTY. ANY AREASREQUIRING PREVENTATIVE MAINTE-NANCE MUST BE REPAIRED, AND AREAT THE OWNER’S EXPENSE.

The MINI Division of BMW NA makes noother express warranty on this productexcept the new vehicle warranty or thewarranty as to the emission control system.

This warranty does not apply to thefollowing:

This limited warranty applies only to U.S.specification vehicles distributed by the MINIDivision of BMW NA.

In accordance with the defect warrantyprovisions of section 207(b) of the Clean AirAct, MINI warrants to the first retail pur-chaser, and each subsequent purchaser,that the passenger car: (a) was designed,built and equipped so as to conform, at thetime of sale, with all regulations of the U.S.Environmental Protection Agency applicableat the time of manufacture; and (b) is freefrom defects in materials and workmanshipwhich would cause it to fail to conform withapplicable regulations for a period of 2 yearsor 24,000 miles, whichever occurs first,except for specific emission control compo-nents (as listed on page 36), for which thewarranty period is 8 years or 80,000 miles,whichever occurs first.

This warranty begins on the date of firstretail sale, or the date the vehicle is firstplaced in service as a demonstrator orcompany vehicle, whichever is earlier.

Warranty claims must be made as soon asreasonably possible after a defect isdiscovered. To make a claim, the car mustbe brought to any authorized MINI Dealerduring normal business hours.

The MINI Dealer will, without charge forparts or labor (including diagnosis), eitherrepair or replace the defective part, if any.The decision whether to repair or replacesaid parts is solely the prerogative of theMINI Division of BMW NA and must beexpected to correct the failure of the war-ranted part. Parts for which replacementsare made become the property of the MINIDivision. In all cases, a reasonable timemust be allowed for warranty repairs to becompleted after the car is received by theMINI Dealer.

For assistance in determining which specificparts or components of your vehicle arecovered under this warranty, please contactyour MINI Dealer.

It is the owner’s responsibility to have allscheduled inspection and maintenanceservices performed (at the owner’s ex-pense), as prescribed in the maintenanceschedule for the MINI Emission ControlSystem. Service intervals are computed bythe onboard MINI service interval indicatorand displayed on the instrument panel. Theinstructions for proper maintenance and usecan be found in the Owner’s Manual. It isstrongly recommended that any replace-ment parts used for maintenance, repair orreplacement of emission control systems becertified MINI Service Parts or MINI Autho-rized Remanufactured Parts. Withoutinvalidating this warranty, the owner mayelect to have maintenance, repair orreplacement of the emission control systemsperformed by any automotive repair estab-lishment, or elect to use parts other thancertified MINI Service Parts. However, thecost of such service or parts will not becovered under this warranty, except inemergency situations. In an emergencysituation, where an authorized MINI Dealeror a warranty replacement part is notreasonably available (within 30 days),repairs may be performed at any availableservice establishment using any equivalentpart. The MINI Division of BMW NA willreimburse the owner for such emergencyrepairs (including labor, parts and diagnosisnot to exceed the MINI Division’s rates forlabor, parts, and diagnosis in said area) thatare covered under this warranty. Replacedparts and paid invoices must be presentedat an authorized MINI Dealer as a conditionof reimbursement for emergency repairs notperformed by an authorized MINI Dealer.

The use of replacement parts, which are notof equivalent quality, may impair the effec-tiveness of the emission control system. Ifother than certified MINI Service Parts orMINI Authorized Remanufactured Parts areused for maintenance, repair or replacementof components affecting emission control,

the owner should obtain assurances thatsuch parts are warranted by their manufac-turer to be equivalent to genuine MINI partsin performance and durability. The MINIDivision of BMW NA assumes no liabilityunder this warranty with respect to partsother than genuine MINI parts.

However, the use of non-MINI replacementparts or non-EPA certified parts does notinvalidate the warranty on other compo-nents, unless non-MINI parts or non-EPAcertified parts cause damage to warrantedparts.

What is not covered

This warranty does not cover malfunctionscaused by any of the following: accident,flood, misuse, improper adjustment, modifi-cation, alteration, tampering, disconnection,improper or inadequate maintenance, use ofleaded fuel or fuels containing more than10% ethanol, or other oxygenates with morethan 2.8% oxygen by weight (i.e., more than15% MTBE or more than 3% methanol plusan equivalent amount of co-solvent).

The replacement of maintenance parts, suchas spark plugs, filters and similar items usedin required maintenance services, the repairor replacement of maintenance partsbeyond the first required inspection/mainte-nance, or if the part has been replacedearlier for reasons other than it beingdefective.

The car or any part of the car unless a failurecauses the car to fail to conform to appli-cable emission regulations.

Any car on which the odometer has beenreplaced or altered and the true mileagecannot be determined.

The car, if the vehicle identification numberis altered or cannot be read, or if the car hasbeen declared a total loss or sold forsalvage purposes.

General

Some states do not allow limitations on howlong an implied warranty lasts, or theexclusion or limitation of incidental orconsequential damages, so the abovelimitations and exclusions may not apply toyou. Additionally, if you are a California,Maine, Massachusetts or Vermont residentand your vehicle is registered in that state,your vehicle is eligible for CaliforniaEmissions Warranty coverage.

These federal warranty provisions alsoapply to all vehicles sold in all U.S. statesand territories regardless of whether a statehas enacted state warranty provisions thatdiffer from the federal provisions.

In those states and jurisdictions that haveestablished periodic vehicle emissions tests toencourage proper vehicle maintenance andrequire the vehicle to pass an emissions testapproved by the U.S. Environmental ProtectionAgency and:

1. The passenger car was distributed by theMINI Division of BMW NA; and

2. The car has been maintained and oper-ated in accordance with the instructions forproper maintenance and use set forth inthe Owner’s Manual supplied with the car;and

3. The car fails to conform to the applicableemissions standards of the EPA as judgedby an EPA approved emissions test; and

4. The failure to conform results or will resultin the owner of the car having to bear apenalty or other sanction (including thedenial of the right to use the car) underlocal state or federal law if the non-conformity is not remedied within aspecified period of time.

Then, in accordance with the provisions ofsection 207(b) of the Clean Air Act, MINIDivision of BMW NA warrants that if the car iseligible for coverage under this warranty, anynon-conformities in the car, which cause it tofail an EPA-approved emissions test will,without charge for parts or labor (includingdiagnosis), be adjusted, repaired, or replaced,at the option of the MINI Division of BMW NA toproper specifications, in order to make the carcomply with applicable emissions standards.The decision to adjust, repair or replace partsis solely the prerogative of the MINI Divisionand must reasonably be expected to correctthe failure of the warranted part.

This limited warranty begins on the date of firstretail sale, or the date the vehicle is first placedin service as a demonstrator or companyvehicle, whichever is earlier. This limitedwarranty continues for a period of 2 years or

24,000 miles, whichever occurs first, except forspecific emissions control components (aslisted on Page 36), for which the warrantyperiod is 8 years or 80,000 miles whicheveroccurs first.

This limited warranty is made subject to theterms and conditions that apply to the Emis-sion Control System Warranty and the MININew Passenger Car Limited Warranty.

No claim under this warranty will be denied onthe basis of use of a properly installed EPAcertified emission part for maintenance andrepair.

A vehicle manufacturer may deny an emissionperformance warranty claim on the basis of anuncertified replacement part used in themaintenance or repair of a vehicle only if thevehicle manufacturer presents evidence thatthe uncertified replacement part is eitherdefective in materials or workmanship or notequivalent from an emission standpoint to theoriginal equipment part.

Maintenance, replacement, or repair ofemission control devices and systems maybe performed by any automotive repairestablishment or individual using anycertified part.

Immediately after the car has failed an EPAapproved emission short test, your claim canbe made at any authorized MINI Dealer. TheMINI Dealer will honor or deny your claimwithin the time period specified by local orstate laws (not to exceed 30 days), to avoidfurther penalties or sanctions. lf the claim isdenied, the MINI Dealer will notify you inwriting of the reason(s). The California Air Resources Board and theMINI Division of BMW NA are pleased toexplain the emission control system war-ranty on your 2005 vehicle. In California,new motor vehicles must be designed, built,and equipped to meet the State’s stringentanti-smog standards. The MINI Division ofBMW NA must warrant the emission controlsystem on your vehicle for the periods oftime listed below provided there has beenno abuse, neglect, or improper maintenanceto your vehicle.

Your emission control system may includeparts such as the fuel injection system, theignition system, catalytic converter, andengine computer. Also included may behoses, belts, connectors, and other emis-sion-related assemblies.

Where a warrantable condition exists, theMINI Division will repair your vehicle at nocost to you including diagnosis, parts andlabor.

Manufacturer’s Warranty Coverage:

– For 3 years or 50,000 miles, whicheveroccurs first:

1. If your vehicle fails a Smog Checkinspection, all necessary repairs andadjustments will be made by the MINIDivision to ensure that your vehiclepasses the inspection. This is youremission control system PERFORMANCEWARRANTY.

2. If any emission-related part on yourvehicle is defective, the part will berepaired or replaced by the MINI Division.This is your short-term emission controlsystem DEFECTS WARRANTY.

– For 7 years or 70,000 miles whicheveroccurs first:

Owner’s Warranty Responsibilities:

– As the vehicle owner, you are responsiblefor the performance of the requiredmaintenance listed in your Owner’sManual. The MINI Division recommendsthat you retain all receipts coveringmaintenance on your vehicle, but the MINIDivision cannot deny warranty solely forthe lack of receipts or for your failure toensure the performance of all scheduledmaintenance.

– You are responsible for presenting yourvehicle to an authorized MINI Dealer assoon as a problem exists. The warrantyrepairs should be completed in a reason-able amount of time, not to exceed 30days.

– As the vehicle owner, you should also beaware that the MINI Division may denyyour warranty coverage if your vehicle orpart has failed due to abuse, neglect,improper maintenance, or unapprovedmodifications.

This limited warranty applies to Californiacertified vehicles distributed by the MINIDivision of BMW NA registered and operatedprimarily in California.

The MINI Division of BMW NA warrants to theoriginal purchaser and each subsequentowner that the vehicle is:

(a) designed, built and equipped so as toconform with the applicable California AirResources Board emission standards.

(b) free from defects in materials and work-manship which cause any part that canaffect emissions to fail to conform withapplicable requirements or to fail aCalifornia Smog Check test or EPAapproved short test for a period of 3 yearsor 50,000 miles, whichever occurs first.

(c) free from defects in materials and work-manship in emission related parts, whichare contained in the California EmissionControl System Limited Warranty Parts Liston page 40, for a period of 7 years or70,000 miles, whichever occurs first.

This limited warranty begins on the date of firstretail sale, or the date the vehicle is first placedin service as a demonstrator or companyvehicle, whichever is earlier.

To obtain service under this warranty, thevehicle must be brought, upon failure of aSmog Check test or upon discovery of thedefect, to the workshop of any authorized MINIDealer, during normal business hours. TheMINI Dealer will honor or deny your claimwithin 30 days. If the claim is denied, the MINIDealer will notify you in writing of thereason(s). The MINI Dealer is required by lawto honor the claim if notice is not given to theowner within 30 days.

The MINI Dealer will, without charge for partsor labor (including diagnosis), either adjust,repair or replace the defective part and otherparts affected by the failure of the warranted

part, if any. If your vehicle failed the CaliforniaSmog Check test or an EPA approved shorttest, then the MINI Division will repair yourvehicle so that it will pass this test. Items thatrequire scheduled replacement are warrantedup to the replacement interval specified in theService section of this Statement. The MINIDivision may repair a part in lieu of replacing itwhen performing warranty repairs. Parts forwhich replacements are made become theproperty of the MINI Division. After 3 years or50,000 miles, and in accordance with para-graph (c) above, such repairs are limited to therepair or replacement of those parts identifiedin the California Emission Control SystemLimited Warranty List.

If your California registered vehicle is between7 and 8 years old and has been driven lessthan 80,000 miles, then your vehicle is eligiblefor additional warranty coverage under theFederal Emissions Warranty.

A repair performed as the result of a smogcheck test failure due to a defect in a part,which is warranted for 7 years/70,000 miles, iscovered.

In all cases, a reasonable time, not to exceed30 days, must be allowed for a warranty repairto be completed, after the car is received bythe MINI Dealer.

It is the owner’s responsibility to have allrequired maintenance services performed (atthe owner’s expense), as prescribed in themaintenance schedule for the MINI EmissionControl System. Service intervals are com-puted by the service interval indicator anddisplayed on the instrument panel.

However, the MINI Division will not deny yourwarranty repair claims solely because you donot have maintenance records or you did notperform the required maintenance unless theMINI Division demonstrates that such lack ofrequired maintenance is a direct cause of theemission control system failure. The instruc-tions for required maintenance and use canbe found in the Owner’s Manual and in theService section of this Statement.

It is strongly recommended that any replace-ment parts used for maintenance, repair orreplacement of emission control systems begenuine MINI Service Parts or MINI Autho-rized Remanufactured Parts. Withoutinvalidating this warranty, the owner may electto have maintenance, repair or replacement ofthe emission control systems performed byany automotive repair establishment, or electto use parts other than MINI AuthorizedRemanufactured or genuine MINI ServiceParts. However, the cost of such service orparts will not be covered under this warranty,except in emergency situations. In an emer-gency situation, where an authorized MINIDealer is not reasonably available or awarranty replacement part is not availablewithin 30 days, repairs may be performed atany available service establishment or by anyindividual using any replacement part.

A repair not completed within 30 daysconstitutes an emergency. The MINI Divisionof BMW NA will reimburse the owner for suchemergency repairs (including labor, parts anddiagnosis not to exceed MINI suggested retailprice for all warranted parts replaced andlabor charges based on the manufacturer’srecommended time allowance for thewarranty repair and the geographicallyappropriate hourly labor rate) that are coveredunder this warranty. Replaced parts and paidinvoices must be presented to an authorizedMINI Dealer as a condition of reimbursementfor emergency repairs not performed by anauthorized MINI Dealer.

The use of replacement parts, which are not ofequivalent quality, may impair the effective-ness of emission control systems. If other thangenuine MINI Service Parts or Authorized

Remanu-factured Parts are used for mainte-nance, repair or replacement of componentsaffecting emission control, the owner shouldobtain assurances that such parts are war-ranted by their manufacturer to be equivalentto genuine MINI parts in performance anddurability. The MINI Division of BMW NAassumes no liability under this warranty withrespect to parts other than genuine MINI parts.

However, the use of non-MINI replacementparts does not invalidate the warranty on othercomponents, unless non-MINI parts causedamage to warranted parts.

What is not covered

This limited warranty does not cover malfunc-tions caused by any of the following: accident,flood, misuse, modification, alteration,tampering, disconnection, improper orinadequate maintenance, except if performedby an authorized MINI Dealer doing warrantyrepair work, use of leaded fuel or fuel otherthan as specified in the Owner’s Manual.

The replacement of maintenance parts, suchas spark plugs, filters and similar items used inrequired maintenance services or the repair orreplacement of maintenance parts beyond thefirst replacement interval.

Any car on which the odometer has beenreplaced or altered and the true mileagecannot be determined.

The car, if the vehicle identification number isaltered or cannot be determined, or if the carhas been declared a total loss or sold forsalvage purposes.
