For Pricing, Royalty Rates and Transportation Information for December 1998, refer toAttachments 1, 2 and 3.

B. COMMUNICATION UPDATE

December 1998 Royalty Due Date

• Royalty clients are to remit the total amount payable shown on the March 1999 Statement ofAccount by March 31, 1999. If the amount payable includes accrued current period interest,the interest has only been accrued to the statement issue date. Clients must also include theadditional interest that has accrued since the statement issue date to the date of payment,using the per diem amount provided.

• The March 1999 Statement of Account shows your amount payable as of the Statement issuedate. It includes any outstanding balances from your previous statement, your December1998 Invoice amount and any applicable current period interest charges. It also identifiesrefunds resulting from overpayments.

• Current period interest will not be charged on current period charges for the productionmonth of December 1998 if it is paid in full by March 31, 1999.

• Current period interest will accrue on any overdue charges commencing the first day after thedue-date until it is paid in full.

Note: If the due date falls on a non-business day, payments will be accepted on the nextbusiness day.

January 1999 Owner Activity Statement (OAS) Due Date

The OAS for the production month of January 1999 is due in the Department office by March 15,1999.

NOTE:

• The OAS due date specified by the Department is the date by which the required OAS datamust be received in the Department.

• Keying services require sufficient time to process and transmit the data by the Department’sdue date. Each keying service will provide their cut-off date, if requested.

• For EDI clients, the receipt date is when Value-Added Network (e.g., GE) receives thetransmission.

• The importance of timely receipt of OAS data by your service provider and the Department iscritical to ensure accurate royalty calculation and prevention of Provisional Assessment.

Natural Gas Royalty Regulations (AR351/93) Proposed AmendmentsNew Penalty Rules

In the fall of 1997, Minister Steve West asked the natural gas industry to lead a review ofAlberta’s gas royalty system and make recommendations to improve business rules andprocesses. One such recommendation was a further review of the effectiveness of compliancepenalties introduced in January of 1998. A joint Industry-Department task force beganinvestigation and review in October, 1998.

As a result of this penalty review proposed amendments to Section 24 of the Natural Gas RoyaltyRegulations (AR351/93) introduced new penalty rules that have been implemented for alldocuments that are received on or after January 1, 1999. This review did seek and receive theadvice and input from Industry Royalty Clients, SEPAC and CAPPA organizations. The currentprocess was found to be administratively burdensome for both Industry and the Crown and it isagreed that in a number of situations the magnitude of the penalty is not commensurate with the“failure” to report.

AC2-V2 Filing

In preparation for the upcoming April 15, 1999 deadline for 1998 AC2’s, please note that theAC2-V2 form for 1997 and onwards is a mandatory two page form. The Department does notmake it a practice to pre-validate forms due to the large volume of AC2’s that are submitted everyyear. As AC2’s are received, they will be sent for processing and those without the requiredsecond page will reject. Please be aware that this is a valid form reject and could have possiblepenalty implications.

AC2-V2 Reporting for New Facilities

The Department has noted instances where AC2 documents for new facilities have been filedincorrectly. To clarify correct filing procedures for new facilities, please see the followingexcerpts from the Gas Royalty Principles and Procedures, pages 183G – 183I.

PART 2: CAPITAL COST ALLOWANCE CALCULATION (AMOUNTS MUST BE TO THE NEARESTDOLLAR), FROM PAGES 183G-183I.

ALLOWABLE CAPITAL COSTS

2.1 CUMULATIVE ALLOWABLE CAPITAL, JAN 1 OR — The cumulative allowable capital at thebeginning of the year is either:

· the cumulative allowable capital at December 31 of the previous year, brought forward from thesubmission for that year; or

· the allowable capital and allowable overhead on construction, in the case of a new facility.

If the Facility Cost Centre started or resumed operations other than on January 1, enter thedate of commencement or resumption in the space provided.

2.2 ALLOWABLE CAPITAL COST, JAN 1 OR — The allowable capital cost at the beginning ofthe year is either:

· the allowable capital cost at the December 31 of the previous year, brought forward from thesubmission for that year; or

· the allowable capital and allowable overhead on construction, in the case of a new facility.

If the Facility Cost Centre started or resumed operations other than on January 1, enter thestart or resume date in the space provided.

PART 3: CAPITAL ADDITIONS (AMOUNTS MUST BE TO THE NEAREST DOLLAR)

3.1 ADDITIONS/DISPOSITIONS/RETIREMENTS - A description of each allowable capital addition,disposition or retirement by significant category. Small additions should be grouped under theheading "miscellaneous."

If the AC2-V2 form is for a new facility, capital additions must indicate the descriptions of thecapital shown as Cumulative Capital, January 1, or in field 2.1, as well as additions,

dispositions, and retirements after the commencement of the operation. If the space provided isnot sufficient, attach a continuation page.

3.2 TYPE - For each item entered in field 3.1, identify the type of transaction as Addition (A),Disposition (D) or Retirement (R).

3.3 AMOUNT OF ADDITIONS/DISPOSITIONS/RETIREMENTS - Enter the actual cost of each CapitalAddition or net book value of each Disposition or Retirement described in field 3.1. (Capitaladditions are positive. Dispositions and Retirements are negative).

3.4 TOTAL - Enter the sum of all of the allowable costs entered in field 3.3, including the allowablecosts recorded on any attached schedule that may be required.

Confirmation of Receipt Forms

The Department of Energy encourages Industry to include a confirmation list along with thedocuments they are submitting to Gas Royalty Operations. The Department will confirm whatforms are received, and fax the confirmation list back to the client. By faxing the confirmation listback to the client, both Industry and the Department will be better able to track what forms arebeing submitted. The Department of Energy Confirmation of Receipt form is attached to thismonth’s Mineral Operation’s Information Bulletin for Industry’s use (please see Attachment 6).

November Provisional Assessment Charge

The net Provisional Assessment Charge for the November 1998 billing period was ($8,860,744).This includes $37,348,384 in first time provisional assessment and ($46,209,128) in reversals ofprovisional assessment for all production periods.

Update - Natural Gas Royalty Regulation (AR351/93) ProposedAmendments Corporate Average Price Re-Election - Terms and Conditions

Schedule 1, sections 5 (1), (2) and (3) and 7 (1)(b) and (2)(a) of the Natural Gas RoyaltyRegulation (AR351/93) are to be amended. The proposed amendments are to provide eligibleroyalty clients a one-time opportunity to establish status as a Corporate Average Price filer forpurposes of valuing the Crown royalty share of gas (natural gas, residue gas, and ethane). Thenecessary re-election advice via the VA1 (reference: Principles and Procedures page 139)had to be filed with the Department of Energy, Gas Royalty Operations by February 15,1999. No further consideration will be given to applications received after this date.

Reminder - 1998 AC4 Forms (Allowable Operating Costs)

Special Case Reconciliation Groups (Designated facilities and plant types) were dismantled forthe 1998 Unit Operating Cost Rate (UOCR) calculation. The Plant Type facilities tied to theSpecial Case Reconciliation Groups were transferred to their respective Plant Type Group andwere included in the calculation of the Group’s 1998 UOCR. AC4 forms are not required for the1998 production year (1999 UOCR calculation) for those facility cost centers at plant typefacilities, which were transferred from the Reconciliation Groups to the Plant Type Groups. AC4forms pertaining to the 1998 production year are required for the FCC’s tied to the 38 designatedfacilities. The due date for the AC4 form is March 31, 1999.

Operators may still file amended AC4 forms for the 1995, 1996, and 1997 production years forfacility cost centers which were tied to a Designated Facility before dismantling occurred. Pleasenote that 1995 & 1996 production years are operationally closed. Operators will need to followthe necessary procedures for filing documents for closed out years.

All AC4 forms which are system acceptable, and received by the due date, will be included in the1999 UOCR calculation. If AC4’s are not filed, no operating costs will be included in thecalculation of the 1999 UOCR.

Please refer to the attached Schedule A that lists the Designated Facilities for those facility costcentres for which 1998 AC4 forms are required.

Reminder - Close-Off for Operations

Operational Close-Out: Production Years 1996

As prescribed by the Natural Gas Royalty Regulation, 1994, royalty clients are required to fileaccurate and timely information within specified time frames for a production month orproduction year. Inherent in the business of gas production is the frequent adjustment andbalancing of reported volumes and distribution of costs. These adjustments result in retroactiveprocessing of Industry submitted royalty documents to accurately reflect volumetric ownershipand ensure appropriate distribution of costs. To contain the extent of retroactive processing and tofacilitate the completion of audits within the legislated time frames, an Operational Close-outprocess has been established. Normally two years after the end of a production year, thatproduction year is operationally closed. When a production year is operationally closed, theMineral Revenues Information System (MRIS) will reject any royalty document submitted for aclosed out production year after the established close-out dates, unless written authorization isgranted by the Department.

Facility Operators and Owners must ensure that correcting documents required to clearunreconciled volumetric discrepancies and to amend the distribution of costs for the closed outproduction year are submitted prior to the close-out dates. Facility Operators and Owners areencouraged to review the following reports produced by the Department to focus on facilities thatrequire immediate attention prior to close-out:

• Rejection Notices• Reconciliation Summary Report• Reconciliation Detail Letters• Annual Reports• Reconcile Statement of Account balances• Operating Cost Deduction at Facilities with No Capital Ownership or Custom Processing Fees• Custom Processing at Facilities with No Volumes

The close-out dates are as follows for the production year of 1996:

Note: There are only two secondary documents; the Reassignment of Volumes Set Up/Change(RMF2) and the Annual Capital Cost Allowance Reallocation (AC3). All others are primarydocuments.

Should circumstances warrant the amending of documents for a closed out year, a written requestmust be made which includes the following detailed information:

1. Specific reason for processing documents after operational close-out.2. List of document types being amended (e.g.: OAS, RMF2, AC2)3. Affected facilities and/ or stream ids (e.g.: Gas Plant code, facility cost centre code, well event)4. Concurrence from all affected parties (e.g.: Cascades on an OAS, RMF2's)5. Estimated dollar impact.6. Paper copies of the document(s) to be processed.Operators and Owners must ensure that submitted documents meet MRIS edit criteria.Documents that do not meet MRIS edit criteria will be rejected and the client will be notifiedby a rejection notice. Royalty documents that meet MRIS edit criteria will be processed and willbe subject, where applicable, to the following:

• Late Filing Penalties• Provisional Assessments• Recalculation of Royalty• Interest Calculations• Re-Calculation of Allowable Costs, including the Corporate Effective Royalty Rate (CERR).

Where applicable, results of the processed documents will be reflected in the Crown RoyaltyDetail Statement, Invoice, and Statement of Account.

Reminder - Year End Cost Recaptures

In preparation for the 1996 and 1997 production years' close-out processes, the Department hasbeen producing discrepancy notices for royalty clients on two reports:

1) Operating Cost Deducted at Facilities with No Capital Ownership or Custom ProcessingFees, which advises clients of operating costs that are subject to recapture.

2) Custom Processing at Facilities with No Volumes, which advises clients of customprocessing fees that will be disallowed.

Documents received after the operational close-out dates will not be processed without priorapproval. Consistent with the requirements outlined in Information Letter 97-25, any industryinitiated royalty recalculation requests for 1994 must have been submitted in writing to GasRoyalty Operations prior to December 31, 1998. Please note that Department approval to processdocuments for a closed-out year will not automatically prevent the year end cost recapture. Whenvalid documents are processed, the amount of recapture will either be eliminated or reversed.

The only additional forms that may still be submitted for 1996 are the Annual Capital CostAllowance Reallocation (AC3) and the Reassignment of Volumes Set / Up Change (RMF2).Both forms must be received by March 15, 1999. Late filing penalties are in effect and will becharged on original and amended RMF2 forms and original AC3 forms. On March 15, 1999 theDepartment will recapture operating cost deductions and disallow custom processing fee claimsbased on the remaining discrepancies for 1996 from the two reports. The year end cost recapturewill appear as an Annual Custom Processing Fee Adjustment on the January 1999 invoice.

Any forms submitted to resolve 1997 discrepancies will be subject to late filing penalties, whereapplicable. Contact Will Wong at (780) 415-0755 for additional information.

Operating Cost Deducted at Facilities with No Capital Ownership or Custom ProcessingFees - Consolidated Companies

Within a consolidation, facility volumes and costs may have been reported under different royaltyclients. For example, at a given facility, one royalty client is allocated the volumes and anotherroyalty client is allocated the costs. This results in discrepancies on the report, Operating CostDeducted at Facilities With No Capital Ownership or Custom Processing Fees. The impact is thatoperating costs will be recaptured at the year end close-out process.

In order to recognize the capital ownership of other royalty clients within the consolidation,consolidated companies may:

1) Amend the AC1/AC2 form to include the royalty client who is allocated volumes, or2) Reallocate capital to the royalty client via the AC3 form, or3) Request that the facility operator amend the OAS form allocating volumes to the

To take advantage of option 5, the consolidation's ‘Supra Client’ must submit a request in writingto the attention of Nancy Norman, Gas Royalty Operations. The following information mustaccompany the request for each production year:

• EUB facility ID• The existing consolidation owners (name and ID) identified on AC1, AC2 and AC3 forms for

that EUB facility• The other consolidation royalty clients that share ownership (name and ID) but are not

identified on AC1, AC2 and AC3 forms for that EUB facility

Upon approval, the Department will recognize the additional consolidation members as facilityowners and will prevent the recapture of operating costs at the EUB facility.

Operating Cost Deducted at Facilities with No Capital Ownership or Custom ProcessingFees – Multi-Processing Networks

In some complex systems, processing and OAS product allocation can occur at numerous EUBfacilities within the network. Situations have occurred where a FCC is tied to one facility (themain Network plant) but the OAS royalty volumes and operating costs are triggered at anotherEUB facility within the Network. In these cases, if there is no record of ownership (AC1, AC2 orAC3) or custom processing fees (AC5) at this additional facility, the Department will recaptureoperating costs previously allowed on these royalty volumes.In addition to normal means of correcting this situation (setting up a new FCC), this recapture canalso be avoided by amending the current AC1 to indicate the other EUB royalty trigger facility.Only one REPORTED EUB FACILITY CODE can be assigned to each FCC. If more arerequired, the FCC will have to be split into smaller components by amending the existing AC1forms as well as filing additional AC1 forms for any new FCCs. This reporting field (2.10) isincluded in the amended version of the AC1 FCC registry form which was published in theMarch 1998 Information Bulletin.

The REPORTED EUB FACILITY on the AC1 will be used to preserve the FCC owner’s existingoperating cost deduction entitlements as long as these deductions relate to production periodswithin the facility cost centre’s effective date range.Note: Gas Royalty Operations must receive all AC1 forms prior to year end close-out. AmendedAC1 forms are not subject to the late-filing penalties. New AC1 forms are subject to the late-filing penalties, unless they resolve a discrepancy on the report entitled, Operating Cost Deductedat Facilities with No Capital Ownership or Custom Processing Fees and are received prior to thedeferral deadline.

Weighted Average Aggregator OMAC

For Gas Corporate Average Price (CAP) filers, when determining the netback value, the weightedaverage OMAC – type charges may be deducted for sales to non-designated aggregators.

The Weighted Average Aggregator OMAC ($/GJ) for 1998 is 0.029. For further information, seesection 6.5.9 of the Principles and Procedures (Guidelines).

Complete Client Id Listing

Beginning in March, the Department will provide via the Internet a complete Client Id listing,which will include termination and effective dates as well as the status of all Business AssociateId’s. The list will be updated monthly. To request the Client Id listing to be mailed to you nextmonth, please contact the Client Services Help Desk at (780) 427-2962.
