What are your thoughts to men being able to claim FMLA for the birth of a newborn? Remember to give reasoning based on best practices of HR. Family and medical leave act is basically the law under which both women and men who need to take time from work for medical or family reasons, including to care for a sick family member, or to handle issues which arise from being pregnant, giving birth, and caring for a newborn. So as we have seen that Men are not the people who are needed for the pregnancy leave as they are not the one who is in need of proper treatment. But the FMLA also states that if you need to care for some one of your family you can have this leave while you are fulfilling its requirements of 12 months of job and your organization is above 50 employees. The FMLA also states that when you in need to care some of your family member who is sick, you can claim for that. It is all that is according to the rules and laws defined. In these concepts as my thoughts are concerned, a man with the new born baby can claim the family and medical leave if and only if there is no other family member is available there to care for her spouse. It should be guaranteed when there is no other one to care for the mother. It is because the most new mothers suffer post-pardum depression. They required proper care, love and affection at that time. Failing to do that, it might be dangerous for both baby and mother. This would disturb the life of the employee and it would lead him less efficient, more depressive and low productive. So keeping in all the fathers should also be guaranteed a family care leave. Similarly the main purpose of the FMLA is to allow employees time off from work to care for loved ones. Because a happy life produces good efficient employees that are ever been asset to the organizations. When a man has to work through the time of childbirth, he can be penalized for just taking off to be present during delivery. The time that he is away from his family to perform his job can affect his job performance. long paid leave from an employee.
