1 MEMORANDUM OF UNDERSTANDING BETWEEN THE JOHN STARK SCHOOL BOARD AND THE JOHN STARK TEACHERS’ ASSOCIATION This Memorandum of Understanding is entered into by the John Stark Regional School Board and the John Stark Teachers’ Association. Hereinafter, the terms “Bargaining Unit Member or Teacherwill refer to any employee included in the collective bargaining agreement of the John Stark School Board and the John Stark Teachers’ Association noted above. WHEREAS, the “Board” and the “Association” wish to preserve the health and wellness of students, faculty and community members; and WHEREAS the transmission and adverse health effects of the novel coronavirus known as “COVID-19” are still being studied and information about the transmission and adverse health effects of COVID-19 will evolve rapidly, necessitating ongoing communication, collaboration, and rapid response to new information by the parties; and WHEREAS, the COVID pandemic will necessitate modification of “normal” working conditions in order to ensure the safety of employees, students and the community. NOW, THEREFORE, in consideration of the mutual covenants and promises set forth below, the parties agree that any plans to re-enter school during the 2021-2022 school year when COVID-19 concerns still exist include the following protocol and safety plans outlined herein: 1. With the exception of mask requirements, all procedures and protocols articulated in the John Stark COVID Response Plan will take the most updated NH-DHHS School Toolkit recommendations and JSTA input into consideration. 2. Mask wearing for members of the CBU will mirror masking requirements for students. 3. Any faculty member choosing to wear a mask or implement additional safety measures such as a plexi-glass divider shall not face any discrimination or consequences. 4. The District will coordinate with local health officials and follow appropriate protocols to ensure the health and safety of all who may have been exposed. Protocols shall comply with the most up to date NH DHHS guidance as well as local and state protocols. The Association President shall be notified as soon as possible of confirmed COVID-19 cases to the extent legally permitted. 5. The District will not subtract sick days from an employee’s sick days total for Covid-19 related illness or quarantine. 6. The District will provide substitutes to any teacher, and a teacher who is out for one or more blocks will not have to find their own coverage. Any coverage by another teacher will be voluntary. 7. Remote students will not be assigned to any teacher, as there will be no learn at home option.

8. In addition to those protections provided by NH RSA Chapter 275-E, the District shall not

harass, abuse, intimidate, discharge, threaten, or otherwise discriminate against any employee

regarding compensation, terms, conditions, location, or privileges of employment because the

employee in good faith reports or causes to be reported what they have reasonable cause to

believe are health and safety concerns or violations to the Association, fellow employees,

administration, the School Board, government agencies, the public, or the news media.

AUTHORITY

The parties agree that this Memorandum of Understanding shall set no precedent or past

practice and shall not be used in any proceedings except to enforce its terms.

The parties agree that this agreement does not replace the current collective bargaining

agreements which are still in full force and effect except as explicitly modified by this

MOU.

The parties agree to continue to work together, in good faith, to discuss and if necessary

modify this MOU as conditions necessitate. Neither party will unreasonably deny a request

to discuss proposed modifications to this MOU.

DURATION

The parties agree that this agreement is temporary and will only be in effect for the 2021-2022

school year or until the JSTA, Administration and SAU collaboratively determine the COVID-19

Pandemic to be finished, whichever comes sooner.

WHEREFORE, the “Boards” and the “Association” have caused this MEMORANDUM OF

UNDERSTANDING to be executed by their duly-authorized representatives this eighth day of

September, 2021.
