MEMORANDCM OF PKDERSTANDING BETWEEN THE CHINA SCHOLARSHIP COUNCIL AND THE REGENTS OF THE UNIVERSITY OF CALlFORi'\'IA, OK BEHALF OF ITS LOS ANGELES CAMPUS, USA 1. Background In strong support of China's President Hu Jintao and American President Barack Obama, the China-U.S. High-level Consultation :\!echanism for People-to-People Exchanges was launched on May 5th. 2010. Chinese State Councillor Liu Yandong and C.S. State Secretary Hillary Clinton co-chair the mechanism. On behalf of their respective governments, Liu and Clinton have announced a package of exchange programs, in which 100.000 American students \\ill study in China in the coming four years, and ahout 10,000 Chinese postgraduates will go to the C.S. to undertake t;~eir PhD programs. In line with the implementation of the plan, the China Scholarship Council (hereafter CSC) and The Regents of the University d California, un behalf of its Los Angeles Campus (hereafter UCLA), actively respond to the call of the two countries and ;.1 accordance with guidelines of the China-C.S. High-level Consultation :\lechanism for People-to- People Exchang.::s, hereby agree to establish a collaborative arrangement called the CSC-UCLA. Joint Scholarship Program (Joint Scholarship Program) for the purposes of providing high quality research training to quali!led students and scholars from China \\ith the aim of developing research collaborations between CCLA and Chinese universities (sometimes referred to below as partner universities) that are mutually beneficial to both UCL-\ and the partner universities. UCL\ and CSC are sometimes referred to below as the Parties to this :\lemorandum of Understanding 2.     1. Background

  • 4. Entry Criteria

    i. Candidates to UCLA's Ph.D. programs must meet the normal selection criteria as established by UCLA for thegraduate program in question, including academic performance and satisfactory GRE and TOEFL scores.

    ii. Candidates for CSC funding should satisfy the selection criteria set out by CSC.

    5. Application and Selection Process for the UCLA-CSCJoint Scholarship Program

    I. Application process: Both Direct and CSST Candidates for Ph.D. programs must apply for admission to UCLAbefore the application deadline established by UCLA. Direct and CSST Candidates will be informed by CSSTand CSC that they should state in their application their commitment to apply for the CSC-UCLA JointScholarship Program.

    ii. Acceptance process: UCLA will evaluate and admit candidates according to its normal procedures, including an~valuation of the candidate's academic performance and English language proficiency, both written and spoken.By March 1st of each year, UCLA will have completed its review and will provide CSC and each selected studentwith a letter offering admissions to a specific UCLA Ph.D. program. In addition to the letter of admission, UCLAwill provide a letter describing the financial support the student is eligible to receive from UCLA and thefinancial support that the student may be eligible to receive if the student applies for and receives CSC funding.

    iii. Application for CSC funding: As part of the notification of acceptance into an academic doctoral program at• UCLA, UCLA will notify candidates that they may apply directly to CSC for funding through the standard

    application procedures (including online application and submission of paper documents) set out by CSC. Thecandidates will be advised that the deadline for applying to CSC for financial assistance is March 20th of eachyear.

    iv. CSC Evaluation: CSC will evaluate the candidates according to CSC requirements and priorities and provideUCLA with a final list of scholarship recipients by April 15, of each year. CSC will also be responsible forinforming the successful candidates of their award.

    v. Deadline for Acceptance: As part of notification of acceptance, UCLA will advise Direct and CSST Candidate thatcandidate must advise UCLA not later than May 1 regarding whether that candidate intends to enroll in theUCLA program, and also whether that candidate intends to accept the funding offer from CSC.

    vi. Conditions for Ongoing Enrollment and Financial Support: As a condition for continuing enrollment andreceiving ongoing financial support from UCLA, and also as a condition of receiving ongoing financial supportfrom CSC, students will be held to all UCLA requirements related to the degree program, including, withoutlimitation, standards for progress to degree.

    6. Funding

    i. For students matriculating into UCLA PhD degree programs without having participated in the CSST summerprogram:a. CSC •••ill provide living allowances (with a stipend of at least $1,600 per month), which includes the cost of

    student health insurance meeting minimum UCLA requirements, plus round trip airfare to the USA by themost economical route, and visa application fees.

    b. The funding for the living allowance will be provided by CSC for up to 48 months, under the condition ofcontinued good academic standing (as determined by UCLA) and the continued approval from CSC.

    c. Contingent on the student making continued satisfactory progress toward the degree, UCLA (the respectiveUCLA department) commits to providing each successful candidate with the following funding from school,departmental or faculty resources:i. Tuition, nonresident supplemental tuition, and student services fees;ii. Health insurance, chosen by UCLA.

    n. For students matriculating into UCLA PhD degree programs who completed the CSST summer programa. CSC will provide a scholarship to the student, which will provide the following funding:

    i. Tuition, non-resident supplemental tuition and student service fees for the first two years of study atUCLA,

    ii. One round trip airfare to Los Angeles by the most economical route,iii. Visa application and processing fees, and

  • IV. An annual living allowance, not less than $19,200 per year ($1,600 per month) for first two years ofstudy at UCLA.

  • 9. Joint Responsibilities and Best Endeavors

    Both CSC and UCLA commit to making every effort to ensure the success of this collaboration.

    CSC and UCLA will work with Chinese universities to encourage students to apply for the CSC/UCLA program. CSCwill work directly with Chinese universities to select candidates for the CSC/UCLA program. UCLA will select studentsfor admission to the graduate programs at UCLA. CSC and UCLA will actively promote cooperation across variousdisciplinary fields, encourage partnerships with relevant institutions, and develop innovative programs. UCLA willcontinue its current practice of developing collaborations with Chinese universities and Chinese institutions. Without

    limitation, this may include active involvement in the International Graduate Scholarship Fair conducted by CSC.

    10. Agreement Duration and Review

    This Memorandum of Understanding shall become effective for three years, commencing from the date of signatureby the last party signing below. This Memorandum of Understanding may be terminated by either party by giving theother party six months prior notice in writing. This Memorandum of Understanding will be reviewed during its thirdyear of operation. If both Parties concur in writing, it may be renewed for an additional three years. In the event theprogram is discontinued, students admitted under the program will continue to receive support at the levels and forthe time periods stipulated in the initial award letter.

    11. Additional Activity and Dispute Resolution

    This Memorandum of Understanding can be modified with the mutual consent of the both parties. Matters notincluded in the Memorandum of Understanding, but directly related to it, may be addressed by the mutual consentof the parties. Any such agreement must be appended to this Memorandum of Understanding and it will become validupon the date cf signing.

    Both parties commit to resolving any disputes on the terms of this Memorandum of Understanding by seekingfriendly, mutually acceptable resolutions.

    Both CSC and UCLA acknowledge and agree that, for the purpose of fulfilling their respective obligations pursuant tothis Memorandum, they will necessarily share information about academic standing and eligibility of their respectivestudents taking part in this Program. UCLA and CSC mutually agree that they will treat any such information in strictcompliance with their local law in that respect, in all ways as if it were the personal information of their own facultyand students.

    12. Use of Name

    Neither Party will use the name of the other, either expressly or by implication, in any publicity, solicitation oradvertisement without the written approval of the other Party; neither Party shall advertise or use any of each other'sfaculty names in any marketing materials without prior written consent.

    13. Indemnification

    i. Indemnification by CSC. CSC shall defend, indemnify and hold UCLA, its officers, employees and agentsharmless from and against any and all liability, loss, expense, (including reasonable attorneys' fees), or claimsfor injury or damages arising out of the performance of this Memorandum of Understanding, but only inproportion to and to the extent such liability, loss, expense, attorneys' fees or claims for injury or damages arecaused by or result from the negligent or wrongful acts or omissions of CSC, its faculty, officers, employees, oragentf.

    II. Indemnification by UCLA. UCLA shall defend, indemnify and hold CSC, its officers, employees and agentsharn.less from and against any and all liability, loss, expense (including reasonable attorneys' fees), or claims forinjury 0; damages arising out of the performance of this Memorandum of Understanding, but only in proportionto and to the extent such liability, loss, expense, attorneys' fees or claims for injury or damages are caused by orresult from the negligent or wrongful acts or omissions of UCLA, its faculty, officers, employees, or agents.

    iii. In the event of any litigrttion or other claims brought by third parties against UCLA, CSC or their employees orfaculty that relates to the Memorandum of Understanding, CSC and UCLA shall use their best efforts to assistone another in the defense of such litigation or claims, including promptly assisting one another in theinvestigation of any facts or the identification of any witnesses as may be needed for such defense.

  • This Memorandum of Understanding shall be written in English and in Chinese. Each version has two officiallyduplicated copies. Both the English version and the Chinese version are equally binding.
