Welcome to Melbourne Law School: a vibrant place for learning, research and academic excellence.

The Melbourne Law Masters (MLM) is one of two, distinct, graduate teaching programs in the Law School. The Melbourne Juris Doctor (JD) offers entry to legal practice. The MLM provides postgraduate, specialised legal education of the highest quality. At the Law School we are very proud of the quality of our MLM program and its reputation in Australia and around the world. We work hard to make your experience in the MLM as enriching and useful to you as possible. My colleagues and I are always interested in ways that we could better meet your needs.

There are many opportunities available to you as a member of the Law School community. Every week we have seminars, public lectures and other activities that draw together people with similar intellectual interests. I encourage you to make the most of these opportunities and to enter fully into the life of the Law School. You should also explore the many forms of support that the Law School offers MLM students, including the services of the Legal Academic Skills Centre, the Law Library and the Careers Office.

MLM students constitute a talented, diverse and committed student body, drawn from all parts of Australia and all regions of the world. One of the many benefits of the MLM lies in the contacts made with other MLM students, many of which will last throughout your professional life. Who’sWhointheMelbourneLawMasters(MLM)

The following are the principal staff members with whom you are likely to have contact with as a MLM student. You are welcome to seek assistance and advice from any of them, as appropriate.

AssociateDeanThe Associate Dean (MLM) is a senior academic who is responsible directly to the Dean for the quality and success of the MLM. The present Associate Dean (MLM) is Professor Ian Ramsay who is also Director of Studies for the commercial law and corporations and securities law specialisations. He is located in room 0733 of the Law School.

DirectorsofStudiesEach specialist legal area in the MLM program is led by a Director of Studies who is a member of the academic staff of the Law School and an expert in the specialist field. The Directors of Studies are responsible for ensuring that their area of specialisation in the MLM remains at the cutting-edge of legal knowledge. The Directors of Studies also work as a team, as members of the MLM Committee, which is the principal advisory body to the Law School on all aspects of the MLM. Directors of Studies may provide advice and support to students within their specialist legal area. A list of the current Directors of Studies, with contact details, can be found on page 15.

TeachersinMLMsubjectsMany teachers in MLM subjects are members of the academic staff of the Law School. Others are drawn from practice, in Australia or elsewhere, and from major universities throughout the world. All teachers have an office in the Law School during the teaching period for their MLM subject. Students are welcome to contact teachers in relation to questions that arise in connection with the study of a particular subject. Contact details can be found on the relevant subject webpage or through the MLM Office.

MelbourneLawMastersOfficeThe MLM is managed by an office of nine professional staff, co-located with the MLM teaching facilities and common room on the sixth floor of the law building. The MLM office manages all aspects of the program including enrolment, the distribution of materials, the dissemination of assessment tasks and results, aspects of marketing and communications and management of the MLM website. The MLM office is also the first port of call for students who are encountering difficulties that affect their performance in the program or for student enquiries generally. The MLMSA holds monthly 'Open Houses' - an informal event for MLM students along with research colloquiums and other social events. GettingstartedintheMLMFor the purposes of getting started in the MLM and taking advantage of all that the Law School has to offer, MLM students fall into at least three distinct categories: Full-time MLM students, most of whom are international students, who complete eight subjects over a 12 month period and who are based in the Law School during that time Part-time MLM students based in Melbourne, most of whom are engaged in full-time employment and who complete eight subjects over two to four years Part-time MLM students based outside Melbourne, most of whom are engaged in full-time employment interstate and who complete eight subjects over about two to four years by commuting to Melbourne for the teaching period.

The Law School provides different orientation arrangements for each of these categories of students:

Full-time students attend a week-long orientation. During this period they: Meet the rest of the full-time student cohort Finalise subject choice and enrol Are introduced to Australian law and legal institutions and to the research and learning skills

necessary in the MLM Are briefed on the resources that the Law School has to offer and introduced to key personnel International students are given the opportunity to meet their mentor.

Part-time students based in Melbourne are offered a one day orientation prior to the start of each semester. This orientation program enables students to:

Meet other commencing student, and academic and professional staff; Gain insight into the research and learning skills necessary in the MLM; Identify the range of relevant resources available for students throughout their studies.

Part-time students based outside Melbourne are also welcome to attend the one day orientation, if they are able to do so. See the MLM website for session details. All Orientation PowerPoint slides and other distributed materials will be placed on the MLM website to assist students who are unable to attend. Queries about any aspect of the program are welcome, by phone or email to the MLM office.

In addition, we suggest that MLM students who are based interstate try to add an extra day when they visit Melbourne for their first subject in order to become personally acquainted with key services, including the Library and the Legal Academic Skills Centre. The MLM office would be pleased to make the necessary appointments for this purpose.

TakingtheMLMSubjectSelectionThe Melbourne Law Masters offers a wide range of subjects across all 23 specialist legal areas. Students must be guided by the requirements of the course in which they are enrolled in selecting subjects for the coming year. Please note that some subjects are offered on a once-only basis and many are offered only every second year. The range of MLM subjects is substantially renewed every year. There are around 30 new subjects offered in 2013.

The subject descriptions in the Prospectus and on the MLM website give full details about the teaching period, the type of assessment and the times at which assessment is due for each subject. These should be taken into account in choosing subjects and planning MLM study. For the purposes of planning, students also should note that materials for subjects taught intensively usually are available around four weeks before teaching begins. This enables students to read the materials in advance and to understand the format of the subject.

Full-time students should take particular care in subject selection to ensure that there is no clash between teaching periods or between a teaching period and assessment in another subject. More generally, students should ensure that their subjects are spaced in a way that will enable them to manage the assessment for each subject while preparing for the next. The MLM Office can assist with this. All full-time students are also interviewed by a member of the academic staff during orientation to review their subject selection for this purpose. Students are welcome to discuss subject choice again at any time during the year.

Part-time students are also welcome to seek advice on subject selection from the Associate Dean, a Director of Studies or the MLM Office. In choosing subjects, students should take particular care to ensure that both teaching and assessment are scheduled at times when they are able to devote adequate attention to them.

Changing subjects Please choose subjects as carefully as possible! While it is possible to change subjects at any time before teaching starts, last minute changes (within 4-6 six weeks before teaching begins) are discouraged. They may prevent other students being given a place in popular subjects and they complicate planning by both teachers and the MLM Office. Students who withdraw from a subject after having collected their subject materials, will be obliged to return them. We understand that all MLM students have busy lives that may require them to alter their subject selection from time to time and MLM procedures accommodate this. Timely notice is much appreciated, however.

TheteachingperiodMLM subjects typically take one of two formats:

Some are taught for two hours per week over a 12 week semester, generally in the early evening Most are taught intensively, for five hours per day over a five day period, often with a weekend

intervening

Irrespective of the teaching format, all class sizes are relatively small, generally with a maximum of 25-30 students. Classes are organised in seminar style format to encourage discussion and interaction. Students are expected to prepare for class and to participate in discussion of the materials set for each session.

Students should attend all classes; and there is a mandatory obligation to attend at least 75% of classes, in order to remain in the subject.

The teaching period for an MLM subject is likely to be exhilarating. The subject matter is new and thought-provoking and contact with the teacher and other students in such a propitious learning environment enhances the experience further. It is up to each student to take maximum advantage of the opportunities thus offered through advance preparation and participation in class.

All MLM subjects are evaluated by students, through an on-line evaluation process. The evaluations are extraordinarily useful to us in understanding the program and continuing to improve it. Students are notified by email when the evaluation is available for completion. Please be sure that to complete it when this happens: we will be most grateful!

AssessmentVarious forms of assessment are in use in the MLM. The most common are:

A take-home examination, generally over a three day period A research paper, generally of around 10,000 words A combination of the above

Guidance on what generally is required in relation to each of these forms of assessment will be provided during orientation and may also be obtained from the Legal Academic Skills Centre. Information about marking criteria is included in the materials for each subject and may be discussed further in class. Students with queries about assessment expectations in particular subjects, are welcome to raise them with the relevant teachers.

Take-home examinations are typically held about six weeks after teaching ends in an intensive subject. Research papers typically are due for submission about three months after intensive teaching ends. The assessment period will be closer to the end of the teaching period for subjects taught over a semester. Detailed assessment dates are stated in the description of each subject in the prospectus and on-line.

All work for assessment in the MLM must be submitted online using the University’s Learning Management System (LMS). Emailed and hardcopy submissions are not accepted. All work is checked for plagiarism, which amounts to academic misconduct and is severely penalised.

Students must submit work for assessment on the date and at the time prescribed. Extensions are possible only in exceptional circumstances, in the interests of fairness to all students. Any assessment submitted after the due date will incur marking penalties. Applications for an extension of assessment must be made by completing the Application for Extension form available on the MLM website and justifying the request.Applications are assessed by the Melbourne Law Masters office in line with MLM policy and are not the responsibility of teachers in the subject.

The marking standards in the MLM are rigorous. The highest grade is awarded only for excellent work. The MLM uses the same mark/grade correlation as the rest of the University, as follows:

H1 80%-100% H2A 75%-79% H2B 70%-74% H3 65%-69% P 50%-64% N 49% or less

Assessed work typically is marked and returned to students around six weeks after submission. Teachers are asked to give students comments on all assessed work, to enable them to understand the mark they have received and to learn effectively from the experience. Any assessed work that is given a fail grade is marked again by another examiner. Other work is not second-marked, but students are entitled to seek further explanation of their grades from the teacher in the subject.

Many research papers written for assessment in the MLM make a genuine contribution to understanding of a particular area of law. The Law School encourages students to seek publication of papers of this kind, thus adding to their own CV. The subject teacher or a Director of Studies will be pleased to advise on suitable journals and on revising research papers for this purpose. To ensure the publication contributes towards the Law School’s annual research record, a footnote should note that it was originally prepared for the purposes of the MLM.

SupportservicesLegalAcademicSkillsCentreThe Legal Academic Skills Centre provides academic skills support for all students in the Law School, including specialised skills support for MLM students. The centre is located on the third floor, in the Law Library, to the right of the information desk. It can provide assistance with:

Core academic skills including reading, research, legal analysis and problem solving, written and oral communication skills

Study support including strategies for effective study and time management and feedback on written work.

Two staff members are particularly important for this purpose, although MLM students will find all Library staff very helpful.

Dr Chantal Morton is Lecturer in Legal Writing and Academic Skills and can assist with queries about legal writing and argument and forms of assessment

Ms Natalie Wieland is Legal Research Skills Advisor and can assist with undertaking research for particular assessment tasks. Ms Wieland also has an assistant, Mr Tom Andrews, who can see students for research consultations on Thursdays.

Ms Wieland and Dr Morton will give introductory sessions on legal research and writing strategies during the full-time students’ orientation week. In addition, Dr Morton and Ms Wieland run a more detailed series of workshops on legal research and writing for MLM students in first and second semester. The schedule for the semester is on the MLM website and linked under Academic Skills Support. Attendance is voluntary. Students are encouraged to attend any sessions that they think will usefully supplement their existing skills.

Dr Morton also runs intensive evening workshops on writing legal research papers at least once each semester for MLM students who are unable to attend the weekly sessions. The dates and times will be circulated to all registered students when they are confirmed.

MLM students based interstate should also note that the Law Library hosts a ‘webinar’ seminar series, assisting with skills development on-line. The program for this series is published on the Law Library website.

LawLibraryThe Law Library is located on floors 3 – 5 of the Melbourne Law School. It has one of the best law collections in Australia covering a wide range of legal subject areas. The extensive collection of online databases, electronic journals and e books can be accessed anywhere in the world, 24/7. The Library has a number of research guides specific to MLM specialisations. The Law Library supports students through extended opening hours, study space exclusive to law students, discussion rooms, over 90 PCs and wireless internet.

MLM students are also part of the wider Law School community. Students are welcome and encouraged to take part in the rich program of events and activities that takes place in the Law School throughout the year, to the extent that they are interested and able to do so.

MLM students are an integral part of the vibrant intellectual community of Melbourne Law School. As one of the world’s leading law schools, Melbourne is host to a stream of visitors from all parts of the world who are influential in legal thinking and legal practice. During their time at the Law School, many of these visitors deliver seminars, public lectures and other exciting events.

MLM students are regularly informed of forthcoming news and events through Law School publications including the monthly MLM Newsletter and E-brief, the monthly e-newsletter published for the Melbourne Law School community. ResearchCentresandInstitutesIn addition to general Law School activities, MLM students are welcome to participate in the programs hosted by the Law School’s various research groups, generally described as centres or institutes.

Most research groups run seminars, conferences and other activities throughout the year. Participation in these enables MLM students to meet Melbourne scholars and centre visitors working in their own fields and to follow some of the latest legal developments of interest to them.

There is considerable synergy between the Law School’s research groups and the MLM specialisations. Most (although not all) specialisations have a parallel research group. In many cases, the Director of Studies of the MLM specialisation is also the Director of the research group.
