MINUTE1. The Minute of Meeting of 23 August 2013 had been circulated.

DECISIONAPPROVED and signed by the Convener.

LICENCES ISSUED UNDER DELEGATED POWERS2. For Members’ information there had been circulated copies of a list of licences issued under

Delegated Powers for the period 14 August – 11 September 2013.

3. Members were concerned that St Ronan’s Primary School PTA had been granted anOccasional Licence for an event the nature of which was given as a return to School BBQ.The Legal and Licensing Services Manager explained that presently the Board’s LicensingPolicy does not require such applications to be referred to the Board for determination.However, the new draft Statement of Licensing Policy, which was presently out forconsultation, would deal with such events. Officers would also ensure that any furtherapplications, for such school events, would be referred to the Board for their consideration.The Education Department would also be informed of the Board’s concerns which they wouldbe requested to disseminate to schools.

DECISIONAGREED that future applications for child centred events in relation to schoolled events be referred to the Board for determination rather than dealt with underDelegated Powers.

LICENSING (SCOTLAND) ACT 2005:4. (a) Section 83: The Board considered a notification from Police Scotland in respect of Mr

Gareth Connolly, a Personal Licence holder who had been convicted of a relevantoffence:

There had been circulated copies of a letter dated 3 September 2013 from Police Scotland.Inspector Scott advised that Gareth Connolly had been convicted of a relevant offence atEdinburgh Sheriff Court on 14 August 2013.

5. The Licence holder had been cited to attend the hearing but was not present. The Legal andLicensing Services Manager informed the Board, that officers had been advised that MrConnolly had relocated and had only recently received the communication sent to himrequesting his attendance at the Licensing Board meeting. In the circumstances, it wasagreed to defer consideration of the matter until the next meeting of the Board, when MrConnolly would again be cited to attend.

DECISIONDEFERRED consideration of the matter until the next meeting of the Licensing Board.

URGENT BUSINESS6. Under Section 50B(4)(b) of the Local Government (Scotland) Act 1973, the Convener was of

the opinion that the item dealt with in the following paragraph should be considered at themeeting as a matter of urgency, in view of the need to keep Members informed.

NATIONAL LICENSING CONFERENCE7. The Convener reported on the recent Alcohol Focus National Licensing Conference which he

had attended in Glasgow. He reported that there were no radical changes planned for thenear future in policy. Issues around public health and community safety, particularly drinkingdens, had been highlighted. He reported that 76% of assaults were alcohol related, with adeath every 3 hours connected to alcohol.

8. Inspector Scott, who had also been present at the Conference, reported that the impact ofcheap alcohol and over provision had been the focus of the conference, Scottish Borders hadbeen highlighted as being at the forefront of alcohol related initiatives, e.g. alcohol dataprofiling and had received a Safer Communities Award for work on psychoactive substances.He added that if the police attended an address after receiving a complaint of a party beingheld, they would follow up with a letter to that address; often the parents had not been awarethat a party had been held in their absence.

9. In response to a question, the Legal and Licensing Services Manager confirmed that theBoard could make amendments to an existing Policy Statement but that it would be subject tothe standard 12 week consultation period. Members were reminded that any concerns theyhad relating to existing premises should be referred to the Licensing Standards Officer forinvestigation.
