TOWNSHIP OF WEST WINDSOR ORDINANCE AUTHORIZING THE ACQUISITION OF

A TEMPORARY CONSTRUCTION EASEMENT FROM ELISABETH LINDA LOUISE MIHAN

LOCATED AT BLOCK 5, LOT 39

WHEREAS, the Township of West Windsor has determined that it is necessary to acquire an easement on certain real property owned by ELISABETH LINDA LOUISE MIHAN (Seller) located at Block 5, Lot 39 (#43 Cranbury Road) in the Township of West Windsor, Mercer County, NJ for the purpose of constructing sidewalk improvements to be utilized for the purpose of public mobility; and

WHEREAS, the Seller is willing to grant such a Temporary Construction Easement; and

WHEREAS, the Township and Seller have agreed upon fair compensation for the easement; and

WHEREAS, the Local Lands and Buildings Law, N.J.S.A. 40A:12-1 et. seq., requires that an Ordinance be adopted permitting the Township to acquire the Temporary Construction Easement.

NOW, THEREFORE BE IT ORDAINED, by the Township Council of the Township of West Windsor, Mercer County, NJ as follows:

(1) The Township wishes to acquire a Temporary Construction Easement on certain real property owned by ELISABETH LINDA LOUISE MIHAN (Seller) located at Block 5, Lot 39 (#43 Cranbury Road) in the Township of West Windsor, Mercer County, NJ for the purpose of constructing sidewalk improvements to be utilized for the purpose of public mobility for the purchase price of One Thousand One Hundred Fifty Dollars ($1,150.00).

(2) The Mayor and Clerk are hereby authorized and directed to acquire and accept the Temporary Construction Easement from the Seller for the acquisition of said easement upon final passage, approval and publication of said ordinance according to law.

Section 2. This ordinance shall take effect twenty days after action or inaction by the Mayor as provided by law or an override of a mayoral veto by the Council, whichever is applicable; and upon publication according to law.

AN ORDINANCE AMENDING THE CODE OF THE TOWNSHIP OF WEST WINDSOR, CHAPTER 168, “TRAFFIC AND PARKING,”

ARTICLE VI, “PARKING AUTHORITY PROPERTY,” AND ARTICLE VII, “SCHEDULES”

WHEREAS, the West Windsor Parking Authority has recommended certain modifications to portions of Chapter 168, “Traffic and Parking,” that will improve the efficiency of parking enforcement in West Windsor Township; and

WHEREAS, with legal guidance from the Township Attorney, the Township Council has reviewed the suggested amendments, and deems it to be in the public interest to enact same.

BE IT ORDAINED by the Township Council of the Township of West Windsor, County of Mercer, State of New Jersey, as follows:

Section 1. Chapter 168 of the Code of the Township of West Windsor, “Traffic and Parking,” Article VI, “Parking Authority Property,” is amended in part to read as follows [deletions indicated with strikethrough, supplemental material indicated with underline]:

§168-38. Parking allowed in accordance with regulations. Lawful parking on premises owned, leased or operated by the Parking Authority of the Township of West Windsor shall be allowed in accordance with the regulations prescribed herein.

§ 168-39. General regulations.

A. Parking shall be permitted only in those areas designated for parking by appropriate lines identifying the spaces and/or within a designated space or stall. Parking shall be prohibited in all other areas.

B. Parking shall require either an unexpired permit, decal or other type of marking duly issued by the Parking Authority or payment of a daily fee as prescribed by the West Windsor Parking Authority through local ordinance.

§ 168-40. Definitions.

As used in this article, the following terms shall have the meanings indicated:

LICENSE PLATE RECOGNITION “LPR;” Scanning device used by authorized parking enforcement officers to read license plates on vehicles that are parked on premises owned and/or managed by the West Windsor Parking Authority. A database of information is created based on the information provided by parking customers when registering vehicles, and LPR allows

enforcement officers to quickly identify unauthorized and/or unregistered vehicles on these premises.

PERMIT PARKING The West Windsor Parking Authority has completely phased out window decals and is in the process of phasing out all mirror hang-tag permits. Instead, the WWPA will rely upon a customer’s registration of his or her vehicle, including license plate number and other identifiers. Parking enforcement officers shall use LPR scanning to determine whether cars parked in “permit parking only” areas are authorized and registered to do so. Any unexpired sticker, decal or any type of marking duly issued by the West Windsor Parking Authority.

SLOT BOX Any device installed or used for the collection of money for the regulation or privilege of parking in accordance with the provisions of this article. Each slot box installed or area of slot box installation may indicate the legal parking time established.

SLOT BOX AREA Any area, municipal lot, parking area, street or part of a street on or near which slot boxes are installed and in use.

SLOT BOX SPACE Any space within a slot box area where parking is controlled by use of a slot box.

§ 168-41. Permit Parking.

A. Permit parking area(s) established. There shall be various permit areas established by the West Windsor Parking Authority. These permit areas shall consist of the areas, streets or parts of streets and municipal parking lots described in the plan on file in the West Windsor Township Clerk’s Office, with the West Windsor Parking Authority and with the West Windsor Police and New Jersey Department of Transportation, which shall include all parking permit areas owned and/or managed by the West Windsor Parking Authority which are hereby made a part of this chapter and incorporated herein by reference; provided, however, where an emergency or temporary condition is declared by the Township, all rules and regulations set forth hereinafter shall be subject to such changes as shall be provided.

B. Operation and use; permit area. No person shall park a vehicle in any space in the areas established by this article unless:

1. a parking permit has been issued by the West Windsor Parking Authority for the designated vehicle whose designation shall be by motor vehicle registration and is kept on file with the West Windsor Parking Authority; or

2. the designated vehicle has been properly registered with the West Windsor Parking Authority such that the vehicle can be positively identified as

“permitted” or authorized to park in certain areas using LPR scanning.

C. Persons who are authorized to park in designated off-street parking facilities owned and/or managed by the West Windsor Parking Authority shall park “head-first” to allow for effective scanning and identification by the LPR technology. have the West Windsor Parking Authority parking permits prominently displayed on the rear-view mirror of the vehicle. Parking permits are not transferable to other motor vehicles unless authorized, in writing, by the West Windsor Parking Authority.

D. A person accepting parking privileges for a motor vehicle on property owned and/or managed by the West Windsor Parking Authority shall be subject to all rules, regulations, amendments and decisions issued or promulgated by the West Windsor Parking Authority and/or the Township of West Windsor. Parking on premises owned and/or managed by the West Windsor Parking Authority by an unauthorized or unregistered motor vehicle in violation of the rules and regulations or amendments hereunder shall be in violation of this article and shall be subject to fines and/or penalties promulgated by the West Windsor Parking Authority and/or the Township of West Windsor.

Section 2. Chapter 168 of the Code of the Township of West Windsor, “Traffic and Parking,” Article VI, “Parking Authority Property,” §168-42 “Slot box parking,” is deleted in its entirety and shall be designated “RESERVED.”

Section 3. Chapter 168 of the Code of the Township of West Windsor, “Traffic and Parking,” Article VI, “Parking Authority Property,” is amended in part to read as follows [deletions indicated with strikethrough, supplemental material indicated with underline]:

§168-43. Time limit parking.

The time limit on parking is 20 minutes, maximum, at Wallace Circle and Station Circle parking spaces.

Section 4. Chapter 168 of the Code of the Township of West Windsor, “Traffic and Parking,” Article VII, “Schedules,” is amended in part to read as follows [deletions indicated with strikethrough, supplemental material indicated with underline]:

§168-73. Schedule XVIII: Time Limit Parking.

In accordance with the provisions of §168-25, no person shall park a vehicle for longer than the time limit shown on any of the following described streets or parts of streets:

§168-75. Schedule XX: Taxi Stands.

Section 5. Repealer, Severability, and Effective Date.

A. Repealer. Any and all Ordinances inconsistent with the terms of this Ordinance are hereby repealed to the extent of any such inconsistencies.

B. Severability. In the event that any clause, section, paragraph or sentence of this Ordinance is deemed to be invalid or unenforceable for any reason, then the Township Council hereby declares its intent that the balance of the Ordinance not affected by said invalidity shall remain in full force and effect to the extent that it allows the Township to meet the goals of the Ordinance.

C. Effective Date. This Ordinance shall take effect upon proper passage in accordance with the law.

RESOLUTION

WHEREAS, Old Trenton Road (County Route 535), a secondary arterial road which runs through West Windsor, carries high volumes of traffic across several municipalities, and Edinburg Road (County Route 526), a principal collector road within West Windsor, carries traffic from the residential core of the municipality to arterial roadways, such as Old Trenton Road; and

WHEREAS, the signalized intersection of Old Trenton Road and Edinburg Road is an important hub serving traffic with both local and regional origins and destinations that frequently experiences backups during peak hour periods; and

WHEREAS, West Windsor Township and the County of Mercer recognize that, despite the completion of improvements to the intersection in 2013, further upgrades to the intersection would enhance its operation and aid in congestion relief; and

WHEREAS, West Windsor Township and the County of Mercer support completion and upgrading of regional roadways and their intersections to aid in improving local circulation and to achieve the transportation goals of the County’s and the Township’s roadway networks as opportunities present themselves; and

WHEREAS, the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1 et seq., permits local units of this State to enter into a contract with any other local unit for the joint provision within their combined jurisdictions of any service which any party to the Agreement is empowered to render within its own jurisdiction; and

WHEREAS, such Agreement is deemed to be mutually beneficial to both parties; and

WHEREAS, West Windsor Township and the County of Mercer have authorized and approved this Agreement by Resolution duly adopted pursuant to NJSA 40A:65-4 of the Uniform Shared Services and Consolidation Act.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of West Windsor Township, that the signing of the Shared Services Agreement by the Mayor and Clerk be and hereby is authorized.

RESOLUTION

WHEREAS, Mercer County has reviewed the function of their existing traffic signal at the intersection of Princeton-Hightstown Road (CR 571) with Clarksville Road (CR 638) and is recommending the addition of dedicated left turn lanes and left turn arrow phase for vehicles turning from CR571 onto CR638 in both directions as a means of improving the operation of the intersection; and

WHEREAS, the Township Engineer and the Police have reviewed the request with Mercer County Engineering staff and are recommending the addition of dedicated left turn lanes and a left turn arrow phase to the existing traffic signal operation; and

WHEREAS, Mercer County has requested the Township Council adopt a Resolution formally supporting the recommendation.

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Township Council of West Windsor Township, support and endorse an Ordinance by Mercer County to add dedicated left turn lanes and a left turn arrow phase to the traffic signal at the intersection of Princeton-Hightstown Road (CR 571) with Clarksville Road (CR 638).

WHEREAS, there is a need for Alternate Deputy Registrar’s of Vital Statistics for the smooth operation of the Vital Statistics Office; and

WHEREAS, Florence M. Saikey, Registrar under N.J.S.A. 26:8-17 has the ability to appoint Alternate Deputy Registrar’s when needed; and

WHEREAS, Ms. Saikey requests that Jill M. Swanson and Eileen Lang be appointed as Alternate Deputy Registrars for a term of three years to expire on June 26, 2020.

NOW, THEREFORE, BE IT RESOLVED that the Township Council of the Township of West Windsor consents to the appointments of Jill M. Swanson and Eileen Lang as Alternate Deputy Registrars of Vital Statistics for West Windsor Township.

A RESOLUTION APPOINTING THE EMERGENCY MANAGEMENT COORDINATOR AND DEPUTY EMERGENCY COORDINATOR FOR THE

TOWNSHIP OF WEST WINDSOR

WHEREAS, the State of New Jersey Office of Emergency Management requires that each municipality appoint a Emergency Management Coordinator and,

WHEREAS, the Manager of Fire & Emergency Services has been designated by the Mayor to serve as the Emergency Management Coordinator for the Township of West Windsor and,

WHEREAS, the Chief of Police, who serves as the deputy Director of Public Safety, has been designated by the Mayor to serve as the Deputy Emergency Management Coordinator and,

WHEREAS, it is the intention of the Township Council of the Township of West Windsor to comply with requirement set forth by the State of New Jersey Office of Emergency Management and to forward a resolution naming appointees to the Office for its records.

NOW THEREFORE, BE IT RESOLVED that the Township Council of the Township of West Windsor hereby appoints James Yates, Manager of Fire & Emergency Services, to serve as Emergency Management Coordinator and Robert Garofalo, Chief of Police, to serve as Deputy Emergency Management Coordinator effective July 1, 2017 for a period of three years; and

RESOLUTION

WHEREAS, the AEGLE LLC property (formerly known as the Azmy property), Parcel #38, identified as Block 15, Lot 3 is part of the West Windsor Township Open Space Acquisition Plan; and

WHEREAS, West Windsor Township has made application to the Mercer County Open Space Preservation Board for financial assistance under the Mercer County Municipal and Non-profit Assistance Program; and

WHEREAS, West Windsor Township has submitted an application in accordance with the Mercer County Open Space and Recreation Plan and has agreed to hold and use the premises in accordance with such plan; and

WHEREAS, the County has reviewed said application and has found it to be in conformance with the scope and intent of the Mercer County Open Space and Recreation Plan and has approved West Windsor’s request for funding; and

WHEREAS, in consideration of the award of funding ($450,000.00), and in accordance with the application heretofore filed, the County and West Windsor Township agree to perform in accordance with the terms and conditions set forth in this Agreement;

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of West Windsor, County of Mercer, State of New Jersey that the Mayor and Township Clerk are hereby authorized and directed to execute the Project Agreement in the form attached hereto.

RESOLUTION

WHEREAS, Haven House Inc. is a not-for-profit corporation incorporated in the State of New Jersey on May 17, 2013 by residents of the Township; and

WHEREAS, it has asked the Township to provide funding of up to $250,000.00 for the purchase of a single family house with at least four bedrooms in the Township for the purpose set forth below; and

WHEREAS, its mission is to provide a supportive home for very low-income adolescent mothers and expectant mothers who have limited or no family or other support network and their babies; and

WHEREAS, such home will be staffed 24/7 with the goal of providing a safe and stable home and allowing each girl to remain in school during her pregnancy, to have access to quality pre-natal and post-natal health care, and to learn how to take care of her baby and herself; and

WHEREAS, Haven House’s ultimate goal is to help adolescent mothers become independent, educated, and successful women and mothers and self-sufficient, productive members of society; and

WHEREAS, the girls and their babies may remain in the property in the house and receive the services indicated until they graduate from a secondary school or reach the age of twenty-four, whichever is later; and

WHEREAS, the Haven House program will provide a vital service to adolescents in need in West Windsor and throughout the region for whom limited services are available and can give them opportunities they very well might not otherwise have, to lead lives as educated, successful, and self-sufficient women who are productive members of society; and

WHEREAS, the Township will benefit not only by assisting in the realization of the Haven House program, with all the possibilities it offers, but, if approved by the court, will receive affordable housing credit for each bedroom, with the expectation that the house will contain four bedrooms, three for the adolescent mothers and their children and one for staff; and

WHEREAS, the Township will also receive credit towards satisfying its obligation that 13 percent of the affordable households in units constructed after July 1, 2008 be very low income households, a challenging requirement to meet; and

WHEREAS, for the foregoing reasons it is in the best interest of the Township to enter into the Agreement with Haven House, Inc. attached hereto, which includes a proviso that it becomes effective only if approved by the court.

NOW, THEREFORE, BE IT RESOLVED, by the Township Council of West Windsor Township that the Mayor and Clerk are hereby authorized and directed to execute the Township-Haven House Agreement.

RESOLUTION

WHEREAS, the City of Trenton, has established public health nurse case management services under the Child and Adolescent Program established in accordance with N.J.A.C. 8:51, Childhood Lead Poisoning, and seeks to expand its service to the jurisdictional coverage area of West Windsor Township Health Department; and

WHEREAS, West Windsor Health Department shares mutual interest and objectives with the City of Trenton, Child and Adolescent Program in the desire to reduce health disparities, increase health outcomes and improve the quality of life for lead-burdened children; and

WHEREAS, the City of Trenton and the West Windsor Township Health Department have mutually agreed upon the terms of the attached Memorandum of Understanding for Public Health Nurse Case Management Services for Childhood Lead;

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of West Windsor that the signing of the Memorandum of Understanding by the Mayor and Clerk be and hereby is authorized.

WHEREAS, the Township of West Windsor wishes to purchase cloud based mobile inspection data base to support uniform fire code inspections which will reduce the volume of paper forms purchased; and

WHEREAS, SHI International, 290 Davidson Ave., Somerset, NJ 08873 has been awarded New Jersey State Contract #89851 for the ProPhoenix software; and

WHEREAS, the cost of these purchases will not exceed $14,832.00 in the first year and $9,434.80 in the second if the Township chooses to renew; and

WHEREAS, sufficient funds are provided in the following Reserve Uniform Fire Code – Firefighter Training & Equipment Accounts as certified by the Chief Financial Officer:

Account #121431 – Uniform Fire Code Trust $7,000.00

Account #121432 – Firefighting Training & Equipment Trust $7,832.00

NOW, THEREFORE, BE IT RESOLVED, by the Township Council of West Windsor that the Business Administrator Marlena Schmid is hereby authorized to purchase, under New Jersey State Contract #89851 mobile inspection data base to support uniform fire code inspections from SHI International.

WHEREAS, the Township Engineer has reviewed the report from Alaimo Associates and recommends that the request for release of the performance guarantees be approved by the Township Council.
