RES.#B84/10 - CANADA GREEN BUILDING COUNCIL GREATER TORONTO CHAPTERPartnership Agreement. Approval to enter into an agreement with the Greater Toronto Chapter of the Canada Green Building Council.

THAT Toronto and Region Conservation Authority (TRCA) enter into an agreement with the Greater Toronto Chapter of the Canada Green Building Council (CaGBC) to deliver the initiatives in accordance with the signed Memorandum of Understanding (MOU) with the Canada Green Building Council;

AND FURTHER THAT authorized Toronto and Region Conservation Authority (TRCA) officials be directed to take the action necessary to implement the agreement.

CARRIEDBACKGROUNDTRCA has worked closely with the Canada Green Building Council on several initiatives since the Council was first established in 2003. The Council's mission is to "lead and accelerate the transformation to high-performing, healthy green buildings, homes and communities throughout Canada." TRCA has provided ongoing support in their work towards this mission, which is well-aligned with TRCA's vision for The Living City.

In May 2004, the Authority first formalized this relationship by approving the establishment of a Memorandum of Understanding between TRCA and the Greater Toronto Chapter of the CaGBC. By entering into the MOU, TRCA agreed to work in partnership with the Chapter on various initiatives focused on increasing uptake of green building practices and promoting sustainable community development in the GTA. At Authority Meeting #3/10, held on April 30, 2010, Resolution #A54/10 was approved as follows:

THAT Toronto and Region Conservation Authority enter into a Memorandum of Understanding with the Canada Green Building Council.

RATIONALEAmong the various initiatives described in the MOU are several deliverables specific to the Greater Toronto Chapter. Current initiatives for which TRCA plans to work with the Chapter include:

Municipal Leaders Forum on Green Building and Municipal Leaders Working Group - development of online municipal green building case study repository;Commercial Building Energy Leadership Council - participate in developer/builder engagement including the efforts of the Toronto City Summit Alliance through its Greening Greater Toronto program;development and offering of green building training courses and workshops;Chapter membership engagement and growth;special events including a Chapter gala and Green Builder Recognition Award presentation;various initiatives in support of green careers;

Chapter meetings;Green Building Roadmap;development of various print and web-based communications;Green Building Training and Education Market Scan - development of a report;green building tours.

FINANCIAL DETAILSAs part of the agreement described, TRCA will provide financial support to the Greater Toronto Chapter of the CaGBC in the form of a $50,000 grant. These funds are available in accounts 415-89 and 129-81, provided by the City of Toronto and Region of Peel, respectively.

RES.#B85/10 - VULNERABLE SECTOR SCREENINGPolicy Update. Approval of the Vulnerable Sector Screening policy and receipt of procedures.

THAT the Toronto and Region Conservation Authority (TRCA) policy for Police Reference Checks be renamed Vulnerable Sector Screening and amended as outlined in Attachment 1.

AND FURTHER THAT the procedures for Vulnerable Sector Screening, as outlined in Attachment 2, be received.

CARRIEDBACKGROUNDAt Executive Committee Meeting #5/01, held on July 6, 2001, TRCA approved a policy on Police Reference Checks. The policy has been updated to include a change in title to Vulnerable Sector Screening. The policy has also been updated to include the definition of Vulnerable Sector as defined by the Criminal Records Act, to whom the policy applies, as well as the conditions and the procedures to be followed for those that require a Vulnerable Sector Screening.

RATIONALEThe purpose of the Vulnerable Sector Screening policy is to ensure that TRCA employees, volunteers, interns and vendors understand their roles and responsibilities as they relate to providing a safe environment for children and other vulnerable persons within its facilities and programming. Under the old Police Reference Check policy, staff applied for a police reference check and were issued a standard clearance letter. Now a vulnerable sector screening is a more extensive search of police records. The deeper search of databases is aimed at ensuring a potential employee or volunteer has no history of sexual or physical offences or other behaviour that would put the vulnerable sector at risk. A vulnerable sector screening search may provide the following information:

criminal record (adult and/or young offender, including summary offences);outstanding charges;findings of not guilty by reason of mental disorder;probation, prohibition and other judicial orders which are in effect;convictions/pending charges under Child and Family Services Act.

Also under the old policy, TRCA was able to use a third party to conduct the screenings, however revised rules by the RCMP no longer allow this. These changes and the procedures to follow to obtain a vulnerable sector screening are reflected in the policy and procedures in Attachment 1 and 2 respectively.

The revised policy and procedures also specifically outline which staff, volunteers, interns and vendors, depending on their job function, must have a vulnerable sector screening and the forms to complete.

FINANCIAL DETAILSAny new hire, volunteer, or intern will be responsible for the completion of the vulnerable sector screening and cost incurred before starting in the position. Any existing, returning or rehired staff required to complete a vulnerable sector screening will be reimbursed from their respective operating budgets. Staff will apply for the vulnerable sector screening in the location of their place of residence.

Costs are variable but expected to be minimal, and will be covered by operating budgets from individual divisions.

Attachment 1VULNERABLE SECTOR SCREENING POLICY & PROCEDURES

POLICY

Toronto and Region Conservation Authority (TRCA) is committed to providing a safe place for children and other vulnerable persons within its facilities and programming.

The Criminal Records Act defines vulnerable persons as:

“Persons who, because of their age, a disability or other circumstances, whether temporary permanent,

are in a position of dependence on others: orare otherwise at greater risk than the general population of being harmed by persons in a position of authority or trust relative to them.”

Examples - children under 18 years of age, persons with disabilities, seniors.

Accordingly, TRCA requires that any new hire, existing staff, volunteer or intern (paid/unpaid), aged 18 or older who will have direct, unsupervised contact or direct physical contact with vulnerable persons, will be required to have a Vulnerable Sector Screening (VSS) or have proof that the process has been initiated before beginning a position at TRCA.

A TRCA vendor who will have direct, unsupervised contact or direct physical contact with vulnerable persons, will be required to have a VSS or have proof that the process has been initiated before participating in an event at TRCA.

All contracts with TRCA preferred vendors will contain a clause stating that the vendor is required to complete a VSS, at the vendors cost, for all of their employees who will have direct, unsupervised contact or direct physical contact with vulnerable persons (e.g. face painting).

Any staff or volunteer under 18 years of age will be considered part of the vulnerable persons group.

There are procedures that implement this policy. The procedures include the process that is to be followed to obtain a vulnerable sector screening, the frequency of screening, the process for retention and access of such screenings, as well as the locations for applying for a screening.

VULNERABLE SECTOR SCREENING PROCEDURES

Vulnerable sector screening will be used only for the purpose of screening applicants who will have direct, unsupervised contact or direct physical contact with vulnerable persons.

Supervisors are required to expressly identify this requirement in the summary of functions on job postings. Vulnerable sector screening will not be required until after interviews are conducted. Candidates will be asked for a screening when they have been selected as the successful candidate. Employment at TRCA for positions having direct, unsupervised or direct physical contact with the vulnerable persons is contingent upon the applicant’s clearance of the vulnerable sector screening. If the vulnerable sector screening record suggests that they may be a threat to persons, especially vulnerable groups like children, at TRCA, they will be excluded from consideration.

Any new hire, volunteer, or intern will be responsible for the completion of the vulnerable sector screening and cost incurred before starting in the position.

Any existing, returning or rehired staff required to complete a vulnerable sector screening will be reimbursed from their respective operating budgets. Staff will apply for the vulnerable sector screening in the location of their place of residence.

Supervisors will monitor and ensure that anyone requiring a vulnerable sector screening will not start or perform their job duties until the clearance has been received or the process has been initiated.

Supervisors should consider that the vulnerable sector screening may take 2 – 3 weeks for processing and should include this in their hiring plan.

In the event the vulnerable sector screening results are not available on the hire day, the employee will submit a copy of the payment receipt indicating the process has been initiated and sign an offence declaration form. This will be included in their hiring or rehiring package.

For new employees, TRCA will accept a copy of a previously completed vulnerable sector screening dated within 12 months of the hiring date. The original must be reviewed by the Supervisor who will obtain a copy.

The vulnerable sector screening forms should be signed by the authorized TRCA representative, Supervisor, H.R and Safety. Supervisors may request in advance multiple signed forms to facilitate faster processing.

PROCEDURES FOR OBTAINING A VULNERABLE SECTOR SCREENING

Obtain the appropriate Vulnerable Sector Screening application for the location of 1.residence. For example - City of Toronto, York Region. See below for more location information.Complete the necessary information on the form and determine the appropriate pieces 2.of identification necessary to accompany the form.Attend one of the specified police locations in person to submit the application.3.Keep the receipt of payment for the application.4.When the vulnerable sector screening is received, send it to the attention of Human 5.Resources in a sealed envelope marked “Confidential”.

FREQUENCY OF SCREENING / DECLARATION

Vulnerable sector screening must be completed every three (3) years.

The TRCA Offence Declaration Form must be completed annually during intervening years.

PROCESS FOR SCREENING / DECLARATION FORM ACCESS AND RETENTION

Vulnerable sector screening results will be sent to the attention of Human Resources in a sealed envelope marked “Confidential” and it will be retained in the employee's personal file.

Vulnerable sector screening results for volunteers and interns will also be sent to the attention of Human Resources in a sealed envelope marked “Confidential” and it will be retained by Human Resources in a separate file

Vulnerable sector screening results from vendors will be sent to the attention of the Supervisor/Manager who has procured and entered into the agreement with the vendor. The VSS will be retained in an envelope marked “Confidential” and will form part of the vendor’s file.

Offence Declaration Forms should be sent to the attention of Human Resources in a sealed envelope marked “confidential” to be filed appropriately.

Vulnerable sector screening will be accessible on a need-to-know basis only. Only the CAO and Human Resources staff will have access to the screenings.

THAT the Toronto and Region Conservation Authority (TRCA) policy for Organ Donor Leave of the Ontario Employment Standards Act, as outlined in Attachment 1, be approved;

AND FURTHER THAT the procedures for Organ Donor Leave of the Ontario Employment Standards Act, as outlined in Attachment 2, be received.

CARRIEDBACKGROUNDOn June 26, 2009, the Ontario Employment Standards Act (ESA) was amended to include a new protected statutory leave for organ donors. As prescribed by the ESA, organ donor leave is unpaid, job protected leave of up to 13 weeks, for the purposes of undergoing surgery to donate all or part of certain organs to a person. In some cases, organ donor leave can be extended for an additional period of up to 13 weeks.

FINANCIAL DETAILSLimited budget impacts as TRCA would maintain the employees benefits, OMERS contribution and the employee would continue to accrue vacation.

Attachment 1ORGAN DONOR LEAVE POLICY

Organ donor leave is unpaid, job protected leave of up to 13 weeks, for the purposes of undergoing surgery to donate all or part of certain organs to a person. Upon return from organ donor leave, the employee is entitled to the same job the employee had before the leave began or a comparable job, if the employee's old job does not exist. In some cases, organ donor leave can be extended for an additional period of up to 13 weeks.

All employees, regardless of status are eligible for organ donor leave.

The employee must meet the following criteria to qualify for organ donor leave:

Have been employed for at least 13 weeks by TRCA;Undergoes surgery to donate all or part of the following organs to another person:

- kidney- liver- lung- pancreas- small bowel

Generally organ donation leave begins on the date of the surgery. It may begin on an earlier date, as specified in a certificate issued by a legally qualified medical practitioner.

Attachment 2PROCEDURES FOR ORGAN DONOR LEAVE

An employee who wishes to take organ donor leave must provide TRCA with at least two weeks’ written notice before beginning or extending leave, if possible. If this is not possible, the employee must provide written notice as soon as possible after beginning or extending the leave. However, if the employee does not provide notice to begin the leave, provided the employee meets the prerequisite criteria, the employee still has the right to take the leave.

TRCA may ask the employee to provide a medical certificate for the following reasons:

Confirming that the employee has undergone or will undergo surgery to donate an organ;

When the employee is to begin the leave if it is before the day of the organ donation surgery; and/or

To extend a leave for a period of time because the employee is not yet able to perform the duties of his or her position.

The employee must provide the certificate to the Human Resources as soon as possible after TRCA’s request.

CONTINUATION OF EMPLOYEE BENEFITS

TRCA employees continue to receive the benefit coverage by SunLife Financial while on organ donor leave.

TRCA employees on organ donor leave continue to accrue vacation and credit for length of service.

OMERS

While on organ donor leave, all contributions to OMERS cease. Once the employee returns to work, he/she will have until December 31

st

of the year following the year they return to work to make a decision as to whether or not they want to buy back all or a portion of that time. If the employee decides to buy back this service, within the required deadline, TRCA will match their contributions. If the employee decides to buy back the service at a later date, they will need to buy both their contributions and the TRCA’s. Upon return to work, Payroll will provide the employee with a letter outlining the buy back date and amount.

TEACHER’S PENSION PLAN

While on organ donor leave, the employee must decide before commencing leave if they will continue or not in the pension plan. If the employee decides to continue his/her contributions, they must give TRCA bi-weekly cheques and TRCA will remit the money to the Teacher’s Pension Plan on their behalf.

THAT the contract for Petticoat Creek Conservation Area Washroom Upgrade Project be awarded to Beta and Associates Inc. at a total cost not to exceed $120,000.00, plus 10% contingency, plus applicable taxes, it being the lowest bid meeting Toronto and Region Conservation Authority (TRCA) specifications;

THAT should staff be unable to achieve an acceptable contract with the above-mentioned contractor, staff be authorized to enter into and conclude contract negotiations with other contractors that submitted bids, beginning with the second lowest bidder meeting TRCA specifications;

AND FURTHER THAT authorized TRCA officials be directed to take the action necessary to implement the contract including obtaining any approvals and the signing and execution of documents.

CARRIEDBACKGROUNDAt Authority Meeting #6/09, held on July 24, 2009, Resolution #A121/09 for the redevelopment of Petticoat Creek Conservation Area pool was approved as follows:

THAT Toronto and Region Conservation Authority (TRCA) staff be directed to undertake the redevelopment of Petticoat Creek Conservation Area pool through the federal Recreational Infrastructure Canada (RInC) Program in Ontario and Ontario Recreation (REC) Program;

AND FURTHER THAT TRCA staff report to the Authority for additional approvals as required.

The Petticoat Creek Conservation Area Washrooms require significant upgrades and repairs in order to accommodate the new Petticoat Creek Aquatic Facility. Over the last few months staff worked closely with Kregg Fordyce Architects to prepare and refine detailed design and construction drawings required to move forward with the construction phase, Request for Quotation (RFQ) documentation and permit process. Key design features of the Petticoat Creek Conservation Area washrooms include:

a fully accessible washroom, shower and changeroom;additional showers and washroom accommodations; epoxy flooring; andgeneral upgrades and renovations.

RATIONALE Request for Quotation (RFQ) documentation for the Petticoat Creek Conservation Area Washroom Upgrade Project was publically advertised on July 7, 2010 and the following eight firms obtained tender documents and attended a mandatory site meeting:

RFQ's closed on Thursday, July 22, 2010 at 4:00 pm and were opened by Parks and Culture Staff (Brad Clubine, David Boccia, Kate Pankov and Mike Gionna) on Friday, July 23, 2010.

The following is a summary of the bids received:

FINANCIAL DETAILS Two thirds of the cost of the project will be from Canada RInC and Ontario REC programs. The remaining one third of the funds will be secured from future revenues produced by the operation of the aquatic centre. A request has been made for funding participation from the City of Pickering which, if successful, would reduce the funds required from future revenues.
