LONDON - IFPI chairman andCEO Jay Berman has called for atough policy on music piracy which,according to the internationalmusic industry body, was worth anestimated $4.5 billion (euro 4.635billion) in 1998.

A year ago, IFPI's spokesperson for artists, Jean -MichelJarre, said in this magazine that piracy "existed beforeelectricity was invented" and will certainly continue "afterthe Internet has disappeared." But he added that,although music has always been a primary target forpirates, today's digital age demands proper enforcementand adequate protection for right owners.

IFPI figures released this week show that Jarre waspainfully right-piracy is a fact of life-and confirm thesheer scale of damage to the music industry

Billions are lost each year by the legitimate music busi-ness, only to be gained by a diverse underworld-from theone-man operation selling CDs copied on a CD -R player,to industrial operations linked to organised crime which

manufacture and distribute pirated CDs by the bucket -load on all continents.

The sale of illegal products has always been the con-ventional route for piracy to impact on legitimate sales.Yet what this year's IFPI statistics highlight is that newforms of piracy are growing at an alarming pace. CD -Rand Internet piracy, including the proliferation of infring-ing MP3 files, are fast becoming hot property for pirates.In fact, responding to digital piracy is probably the musicindustry's biggest challenge right now.

It is easy to argue that the musicindustry-i.e. the majors-arealready making such huge profitsthat a few little dents here andthere will not hurt. But whichindustry would tolerate 33% of itssales lining the pockets of thoserunning illegitimate businesses?

Piracy is a plague, and a firmplan of action is the only cure.

Garnett departs IFPI after 16 yearsby Adam White

LONDON - Nic Garnett, director gen-eral of the IFPI, is to leave the inter-national recording industry group inJuly after 16 years. His departure rep-resents the most significant change atIFPI since Jay Berman became chair-man and chief executive on January 1.

Garnett has been director generalfor seven years, and, until Berman'sappointment, he was the most seniorfull-time IFPI official. He has beeninvolved in all the group's majorpolicy initiatives of the '90s, and iscredited with a strong grasp ofintellectual property issues worldwide.

He comments: "My move gives Jaythe space he should have to imple-ment his vision of the organisation.

It's good timing for both sides, and I'mleaving on the very best of terms."

Garnett adds that he is still decidingfuture career opportunities, but expectsthat his next move will be "related to

the law, to the kind of things I've beendoing at IFPI, particularly in terms oftechnology." He will most probablymove into private legal practice.

Among accomplishments duringhis IFPI tenure, Garnett says he issatisfied with progress in the fightagainst piracy worldwide. "Not onlyhave we set up systems that a lot ofpeople are now copying, but we'vealso delivered results. I know piracyis still very much with us, but we'veactually cracked some very big prob-lems to date."

Berman says there is likely to be"some kind of reconfiguration" at IFPIexecutive level as a result of Garnett'sdeparture. The abolition of the direc-tor general post is thought to be one ofhis options.

More music at new -look Vivaby Ed Meza

COLOGNE German Music TV chan-nels Viva and Viva Zwei have axedseveral personality -driven shows in amove back towards more music andless talk.

Programmes such as the comedyshow Viva Family have been droppeddue to poor ratings, while music showslike Word Cup, Niteclub and BerlinHouse will now offer continuous musicwithout presenters. Viva Zwei is tolose two shows, Virus and Deep. Vivawill also not renew its contract withoutside production companyPanthertainment-which produceshiphop show Word Cup-in July.

Elmar Giglinger, head of program-

ming at Viva Zwei, maintains thatthe changes are not cost-cutting mea-sures. "We are simply trying to opti-mise our programming to better meetthe tastes of our viewers," he says. AViva spokesperson reiterates: "Vie-wers would rather see music pro-gramming than listen to chatty VJs."

According to Patricia Gebhardt,Viva's head of programming, theplanned changes will improve thechannel's format. Giglinger andGebhardt are currently working on anumber of new shows focusing onmusical genres including hiphop,R&B, house, techno and alternativerock. The new programmes are set topremiere at the August Tele fairin Dusseldorf.

TABACALERA BUYS INTO SPANISH RADIOBARCELONA - Tobacco companyTabacalera has confirmed its acqui-sition of 5% of Union Iberica deRadio (M&M, May 15), and is com-mitted to purchasing a further 16%of the company. Union Iberica deRadio owns the 16 -station news/talknetwork Radio Espana, as well asCHR station Cadena Top Radio.

ITALY SPEEDS UP SIAE REFORMMILAN - The Italian government has appointed a com-missioner to speed up reforms at Italy's authors rightssociety SIAE. Mauro Masi, a state bureaucrat responsiblefor copyright issues, has become the second commission-er in six years to be appointed to resolve disputes withinSIAE. SIAE is anticipating a deficit of euro 84.8 million inits budget for 2000.

MORE PRECIOUS METAL FOR METALLICALONDON - Metallica have scooped an IFPI PlatinumEurope award for their 1998 covers album Garage Inc. (Mer-cury). MANCHESTER MULTIPLEX AWARDEDLONDON - The Radio Authority (RA) has awarded theManchester local digital radio multiplex licence to the soleapplicant, CE Digital Ltd. The company-a joint venturebetween Capital Radio and EMAP Radio-was also award-ed the RNs local digital mutiplex licence for Birminghamlast month. CE Digital intends to broadcast the followingstations in Manchester: Key 103 (CHR); Magic (softAC/gold); Kiss (dance); Lite (MOR); Xfm (alt.rock); andAsian Sound (Asian). COPENHAGEN - Denmark'stwo biggest commercial radiooperations-the Radio 2/Uptown group and TheVoice-both gained listenersduring the first quarter of1999, according to official rat-ings figures from Gallup.

Both groupings were helpedby the addition of new frequen-cies in the reporting period, withThe Voice establishing an outlet

in Denmark's second largest cityAarhus, and Radio Uptownopening a new service coveringthe summer resort areas northof Copenhagen.

CHR chain The Voiceincreased its audience share to5.8%, compared with 4.5% inthe final quarter of 1998.National AC station Radio 2advanced to 2.2% from 1.8%,while CHR-formatted RadioUptown was up 0.3% at 1.0%.

of all Danish commercial broad-casters increased to 26.2%, com-pared with 25.4% in the previ-ous quarter. Also gaining in thecommercial sector was theRadio Jylland group of stations,whose share rose from 10.3% to10.7%.

Pulllic broadcaster Dan -marks Radio continues to takethe lion's share of radio listeningwith a 69% share. Its CHR sta-tion P3 held steady this quarterwith a 27.2% share of listening.

Hit Radio Antenne announce link -up

BERLIN - Cable music chan-nel VH-1 and Germany'sregional Hit Radio Antennegroup have revealed a joint co-operation pact which is set tobenefit both parties throughon -air cross promotion and thepooling of programmingresources.

VH-1 is currently received in50% of German television house-holds nationally, while the AC

formatted Hit Radio chain hasstations in the states of LowerSaxony, Saxony-Anhalt andSaxony, as well as neighbouringstates, and reaches more thansix million listeners.

VH-1 spokesperson AndreSchirmer describes Hit RadioAntenne as an "ideal" partnerfor the adult -oriented TV sta-tion, and reveals that a Mikeand the Mechanics concertscheduled to take place in Ham-burg on June 13 is set to be one

of the first events covered joint-ly by both broadcasters.

Funky Fela appeals to clubbersby Christian Lorenz

Bored with a diet of straight house and trancebeats, a growing number of European club-bers is rediscovering the funky Afro -beat ofthe late Nigerian bandleader Fela Kuti.

We are looking at a true pop phenomenonhere, with Fela's music steadily gaining recog-nition on the dance music scene over the pasttwelve months. The first crossover successcame with a US import 12 -inch called Tribute7b Fela (MAW Records) which, loosely basedon the Fela track Upside Down, became aEuropean club hit at the beginning of the year.The fact that the producers behind the recordare two of today's biggest trend-setters inhouse music-Kenny "Dope" Gonzalez and"Little" Louis Vega, a.k.a. Masters At Work-has undoubtedly speeded up the rediscoveryof Fela.

"Fela's audience has changed dramatical-ly," observes the artist's former manager RickyStein from his London office. "There wasalways a considerable number of [jazz andworld music oriented] Fela aficionados out

there, but over thepast year trendyyoung kids havestarted to discoverFela's music. DJsfrom New York toMarseille, fromLondon to Tokyo,mix Afro -beat withhouse and garage."

"We registerstrong interestfrom the club scene,especially in Japan,the US, Germany,Scandinavia andthe UK," confirms

Universal Music France head of internationalexploitation Eric Vanderpoorter, who coordi-nates the label's current worldwide Vela re-issue programme.

A first selection of Fela's most sought-afteralbums from the '70s and early '80s was madeavailable worldwide by Universal's Barclaylabel in March. Two boxes, containing sixvinyl albums each, were released in a limitededition of 5,000 sets on March 23. Both boxessold out within weeks.

"Some of this material was never avail-able in Europe before," says Vanderpoorter,explaining the heightened demand for thevinyl re -issues of the artist. "Some of it hasactually never appeared outside Nigeria atall." Out of an estimated 50 albums Felarecorded between 1970 and his death inAugust 1997, Barclay licensed 47 for theworld, with the rights reverting to Fela'sestate in 2011. Barclay plans a full re -issueof Fela's album catalogue, consisting of 12CDs, to be released on June 28.

All material has been digitally remas-tered from original master tapes by Steinand his business associate FrancisKertekian. "We spent eight years and$150,000 on the re -mastering," says Stein,who brokered the Barclay deal for Fela'sestate. "Francis and I managed Fela for 14years [from 1983]," adds Stein. "We neverdoubted that there would be a market forFela's music today. The whole club culturething is very much in tune with Fela's atti-tude towards music."

Fela's tight dancefloor jams such as Open& Close, Lady, Upside Down or NoGentleman, pre-empt current remix tech-niques by some 20 years with their short,repetitive figures and frequent percussionbreaks, and have a message to tell at thesame time.

Dance goes a little bit crazyby Marc Macs

Belgium has always been acreative country when itcomes to breaking commer-cial dance music, bothlocally and abroad.

The latest example areThe Poco Loco Gang, whosedebut single Poco Loco (BitMusic/CNR) cracked theBelgian Ultratop Top 5 sin-gles charts, climbing to sec-ond position in March.

The Poco Loco Gang areBelgian DJs Fred Vandermast and ReinierVanloo. Whilst working in clubs the duocontinued experimenting with variousmusical styles. "We had the unique oppor-tunity to test our material in front of clubaudiences before actually putting it downon record," explains Vandermast. "Thetrack Poco Loco was in fact written espe-cially for a new discotheque in Brusselswith that name."

Last month, Poco Loco charted inDenmark, Finland and Norway and beganto climb in France. In June the trackentered the Dutch Top 10, where it is stillin residence. Meanwhile, in Belgium, thefollow-up single Let's Go To The Party (BitMusic/CNR) went straight into the'Ultratop Top 5.

"We called it 'happy house'because we wanted to reactagainst the current trends indance which take themselvestoo seriously," says Vand-ermast. "The beats are OK, thesound is OK, but the tunes aretoo serious. Our music isinspired by the '70s feel of glit-ter and glam rock."

Poco Loco was released onvinyl 12 -inch first, and thor-oughly tested before the singlecame out on CD. "We had vir-tually no access to radio, and

local television was not too eager either,"recalls Vandermast. The single might havestiffed "save for Dutch music TV stationThe Music Factory, which had our video inhigh rotation," he adds.

On Let's Go To The Party, Vandermastand Vanloo directly target a mainstreamaudience by adding singer Saida. Themore pop -oriented approach has borneimmediate fruit, points out Vandermast,claiming that "radio picked up the songstraight away."

CNR parent company Arcade is com-mitted to pushing the Poco Loco Gang atan international level. To follow up the sin-gle success, Vandermast and Vanloo arecurrently recording their debut album attheir own Fast Creation studio.

PARTY TIMEMixing a '60s Blue Note feel with exhortations to"Parteeee," Time To Party by Grandmaster O.G. presentsSurfinghouse (DiscomatictBelgium) is a bright, easygoingnumber with an underlying deep house feel. Relying heav-ily on piano married to a simple bass figure and the chant-ed chorus, the track is simple, funky, very American sound-ing and highly effective. Wisely, it has a radio edit already.

MOVE YO' BODYHeading down towards the sorts of tempos which are par-ticularly welcome on a warm summer evening, The B000mTrack by Mellow Man (Club U Nite/Germany) is a verita-ble funk extravaganza. Vocals are intermittent and riffy,while the bass end is admirably syncopated. A slow grindfor a sweaty night, this one provides yet more evidence ofstrength in depth amongst the Peppermint Park posse.

ONE TO WATCHThe breakdown in M.L.B. Project's Watch It (Mo'Bizz/Holland) is the sort of "big moment" which is virtual-ly guaranteed to cause dancefloor meltdown. Starting offas a hummed bass sequence, the breakdown then developsinto a full -on "arms aloft and scream" moment. A jolly,bouncy tune and a softcore techno feel might indicate somecrossover potential.

YIPPY-Al-AAYAmong the current crop of musical cross-fertilisations,

Ned Sublette's latest effortfor UK -based Palm Pictures. The idea of mixing a full -onmerengue rhythm with the cowboy classic Ghost Riders InThe Sky might seem like a joke, but in fact a more apt sum-mation of the resulting tune would be "delightful novelty."The lyrics are indeed endearingly funny, but when thebrass section, arranged by Santiagan merengue superstarRamon Orlando, kicks in, the effect is electrifying.Underpinned by a strident but distinctly ethnic bass drum,this should charm DJs of all persuasions. An album, calledCowboy Rumba, is out this week.

CALLING CASSIUSHaving had their debut album 1999 acclaimed as one ofTHE records of the year, followed by modestcrossover success for Cassius 99, Cassius' lat-est single, Feeling For You (HBF/Justice/Virgin), is building into a more broad -basedcrossover success.

With more than 100,000 copies sold acrossEurope, plus 4,000 vinyl sales in the US,Feeling For You is making that all importantradio jump to A and B playlists in a clutch ofEuropean territories. "The UK was virtuallythe only country where we haven't crossed the track ontomainstream radio," says Virgin export manager RomainVivien, "The problem was that it came out at the same timeas new releases by Orbital, Chemical Brothers and otherbig names."

This has not been a problem elsewhere, however. InFrance the crucial three stations-NRJ, Fun andSkyrock-have all playlisted the track, and MCM is play-ing the video. In Holland TMF is playing the video between30-40 times a week, while Radio 538 has Feeling For Youon medium rotation.

It's now also gaining momentum in other key territo-ries such as Germany, Austria, Italy, Belgium,Switzerland, South Africa, Australia, Norway andSweden. Watch this space!

vival of the fittest is the harsh real-ity. There is little room for error,little space in retail bins, and fewwindows of opportunity for effec-tive promotion. Because jazz israrely, if ever, a priority in theglobal music market, the questionof priorities for the jazz musicindustry has become more urgentthan ever before.

For jazz radio, priority meansincreased airplay. For jazz labels,priority translates most directly asthe last phase of the long process ofproducing a record: making thosetough judgements on how best todivide marketing and promotionbudgets among several releases.The most common strategy is tofocus a larger part of limitedresources on one or two releases,which for a number of reasonsguarantee higher visibility. Thesereasons may include the alreadyestablished popularity of the artist,

The Radio dimensionHow do labels and radio stationsachieve the right balance betweenthe diverse elements involved inpresenting a perennially margin-alised music-such as jazz-to apublic inundated with competinggenres and formats, the majority ofwhich have higher visibility, moreaccess to the media and greaterfinancial means than those avail-able to purveyors of jazz?

Jazz radio in Europe is in manyways still in its infancy. There arefew dedicated stations, tentativeprogramming, unstable formatsand frequent personnel changes.Radio markets, perhaps more thanrecord markets, are volatile and-as far as jazz is concerned-mostlyuntried and poorly researched. Addthe element of competition frompublic stations, often with long-established jazz programmes, andthe format's fragile radio statusbecomes evident. Consequently,every station has developed its

Airplay longevi-ty is somethingwhich the U.K.'sJazz FM/ Man-chester head ofmusic Steve Quirkwould like to seeincreased. "In the US," heexplains, "tracks can be played forup to three months before beingdropped into low rotation. So analbum with three or four good[radio] tracks can last nearly ayear. Here, turnover is quite a bitquicker, but album longevity is apriority for us, to establish famil-iarity with both the tracks we playand the artists.

"The station," adds Quirk, "ismoving down the smooth jazzavenue during the day, though itstill covers the entire spectrum ofjazz." The A -list consists of some30-40 tracks which get aired 3 or 4times during a 24 -hour period. Thestation is in touch with both majorand independent labels on a regu-lar basis, and logs all calls from lis-teners as well. In May, a Jazz FMcompilation album, The Soul ofSmooth Jazz, reached the Top 40on the national album charts.

Mainstream successGermany's JazzRadio 101.9/Berlinhas slowly consolidated its posi-tion in the German capital with animpressive 8% of the city's radiomarket, according to programmedirector Julian Allitt. The stationhas slashed its talk content overthe last year, and is firm about itscommitment to melodic main-stream jazz. Says Allitt, who has acommercial radio background andwas a former MD at PiccadillyRadio, "I don't know anyone else

who has been as rigor-ous in their approachto making mainstreamjazz into a viable com-mercial format."

The station avoidsboth smooth jazz andAC, a risk which seemsto be paying off. Vocaltracks are seen as anaccessible pathwayinto jazz for new lis-teners, and are fea-tured up to 3 times anhour. The station alsohas a consultant in theU.S. to monitor releas-es there. "Jazz is a bigformat, bigger thanpeople realise. It'sbeautiful, clear,uncluttered musicthat's also intelligentand has got a much

bigger appeal than assumed,"Allitt asserts.

Labels need toursFrom the label perspective, airplayin Europe is a luxury. Priorityreleases can vary from territory toterritory depending on a number offactors, but for current artists tour-ing is the key, according to SonyMusic's European catalogue andjazz marketing manager TimFraser -Harding. The more support alabel can give priority artists thebetter. An example is the recent 10 -day 4 -city tour by Branford Marsalisto support his Requiem CD.

"That tour was specificallydesigned for radio and press inter-views to set up the forthcomingalbum," says Fraser -Harding."Then once it was released, it wasimportant to get him over for aproper tour. We have to ensurethat we're being adequately ser-viced by the artists to be able togive them the necessary exposure."

Working the catalogueCatalogue releases, especially injazz, are often also considered pri-orities. The Miles Davis box -setseries is a case in point. Sony isalready setting up the next instal-ment, The Complete Miles Davis &John Coltrane ColumbiaRecordings, though it is not dueuntil September. The set, whichincludes Kind Of Blue, consideredby many critics and fans to be the

Q: From whom did you learnmost about improvisation?A: I didn't learn improvising fromany one piano player, but fromlistening to Bill Evans, FatsWaller, Charlie Parker. I studiedwith Don Thompson and JimmyRowles. And working with othermusicians and asking lots ofquestions. I was improvising atthe same time as I was studyingclassical piano, [which was] adrier approach. Teaching is soimportant, and at the time I did-n't realise there were other waysto approach it.Q: What links do you seebetween jazz and theEuropean Classical tradition?A: I can't imagine one without theother. I wish I were moreschooled that way. I do listen to alot of opera-Debussy, Ravel.George Shearing is a perfectexample of a great jazz pianistwith classical influence.Q: Can you describe yourstyle? You once called it "min-imalist."

A: I like space. And beauty. I likeBill Evans and Ahmad Jamal. Iwas listening to Jimmy Rowlesplay a ballad recently, and hewasn't going crazy over it. Ifthat's minimalism then that'swhere I'm at right now. Single -note line improvising, beautifulmelody. I don't have to put every-thing I know into seven bars. What's involved in theprocess leading to the record-ing?A: Songs keep changing andevolving over the years. Thenthey come back to where theystarted, then they change again.It's amazing how a song that'swritten down can be treated in amillion different ways. It takesinput from others as well. But it'salways spontaneous. I'll write anarrangement in 50 seconds, butthat becomes a vehicle forchange. I like to play things dif-ferently from day to day. Thishappens on stage all the time. It's a pre-mium priced product and will becompeting with a number of othersimilar projects from other labels.We can't simply rely on the artists'iconic status."

Local spinPriority releases are tailored tolocal markets. Blue Note imprintMetro Blue issued Salif Keita's bowfor the label in Europe before theU.S. because he was touring here.Points out EMI/Blue Note U.K.product manager Wendy Day,"Tours definitely put an emphasison things. It can be a quiet time asfar as priority releases go, thensomeone comes over and that cre-ates new opportunites."

The summer festival season isusually seen as a boon for promo-tion of participating acts, but that'snot always the case. Day reflectsthat "the festival issue is unusual,because you obviously want artiststo come, but you don't always getthe same impact as if they weredoing a tour, because everybody'shere at once. This is especially true

with developing artists, who canget lost in the crowd."

Major artists are, of course,always priorities. "Someone likeCassandra Wilson speaks to differ-ent genres outside of jazz," explainsDay, "so we can advertise in moremainstream media." The singer'sTravelling Miles is just out.

Initiatives by local companiesare becoming more common. Anexample is a campaign undertakenby Marta Grech, jazz marketingmanager for Universal MusicSpain, called Joven Jazz Europeo(Young European Jazz). The cam-paign featuresextensive pressand radio promo-tion as well as con-certs, and aims todraw attention toVerve's growingroster of Europeanjazz artists whoare forging a vari-ety of styles.Included in the initiative are wellknown artists-such as BritishSaxophonist Courtney Pine, Ger-man organist Barbara Dennerlein,Austrian guitarist WolfgangMuthspiel, Dutch vocalist LauraFygi and Portuguese singer MariaJoao-as well as lesser -knownmusicians from across the conti-

nent who are pushing the frontiersof jazz by incorporating new tech-nology or regional musical ele-ments. Danish pianist Niels LanDoky performed a showcase at theMadrid branch of FNAC on April15 as part of the initiative. His self -titled debut for Verve featureshighly original takes on pop clas-sics by Peter Gabriel, Eric Clapton,Prince and Michael Jackson.

Indies under pressureIndependent jazz labels' approach tothe question of priority albums is, ofnecessity, complex. "For indepen-

dent jazz labels,"reports FrankHendricks, generalmanager of SiamRecords, "every act hasto be treated as a pri-ority, since the finan-cial resources arenowhere near whatthey are at a major.Also, the number of

acts on the roster will tend to befewer, so each release carries a muchgreater level of importance to thesurvival and success of the company.

"Regardless of the level of prior-ity and the- size of budget," addsHendricks, "the objective should beto use the budget efficiently, whereit counts the most, in creative

advertising and promotion whichwill bring the artist to the atten-tion of consumers. That means thatone has to look at traditional aswell as alternative ways of promo-tion and advertising, and makingdecisions by project. Moving fromthe major to the indie sector, onelearns to do more with less-avaluable skill."

Radio airplay cannot be depend-ed upon. Many artists attempt tofashion their music toward the diffi-cult goal of achieving all-importantradio exposure, but airtime is bothlimited and fickle, and trendschange quickly. ConcedesHendricks: "Previous radio airplaycan be helpful, but that is depen-dent on the reaction of the musicdirectors and DJs to the currentproject. For a jazz artist, a more`pop -oriented style' is a very minorfactor, and can even be a detriment.Trying to be pop can cause [theartist] to lose their fanbase withoutgaining any pop converts."

He concludes: "There is no onesingle factor in breaking an artist.Rather it takes a coordinatedseries of events-a good record, liveappearances, media response, anaccessible artist, good manage-ment, and creative marketing andpromotion campaigns, to make ithappen."

Funkin' Till 2000? Theysure are. Remarkablyfresh after they've beengoing for some 22 -oddyears without a break,Ronnie, Robert andCharlie Wilson-incidentally cousins offunk legendBootsy Collins-

still know how to ride a good rhythm. Theirbiggest hits date back to the '80s-think oftracks such as Oops Upside Your Head, BurnRubber, Beep A Freak and then some-but theGap Band have kept in touch with the sceneover the years. Snoop Dogg guests on the rather tastyScandalous, with the Wilsons effortlessly keeping upwith the West Coast rapper. The Wilsons, in fact, staycool throughout, delivering their smooth yet razorsharp harmonies on two-step numbers such asMessin' With My Flow, For The People and the '80s P -funk of Style & Grace. Two tracks go for a retro funkfeel, complete with brass section-Funkin' Till 2000Comz and Gotta Be Like This are good humouredparty numbers continuing the style for which the Gap

Band is best known. But Funkin' is by no means a"revive' album". Scandalous and Messin' show thatthe Gap Band could well find its niche in thecontemporary R&B market.

INNERZONE ORCHESTRAPROGRAMMEDTalkin' LoudInternational release date: August 2Innerzone Orchestra is the latest project of technopioneer Carl Craig. Programmed transcends theborders of dance music and crosses over into jazz andsoul. The standout track here is a beautiful, deadsimple cover version of The Stylistics' 1972 R&B hitPeople Make The World Go Round, which will also bethe first single off the album, slated for a Septemberrelease. A track such as Basic Math is pure jazz, whileCraig gets all funky on Timing and Galaxy. It's not allunder the sign of the groove, though. The Innerzone

Orchestra also takes us on a journey throughvast open soundscapes on tracks such asBlakula and Architecture. An updated versionof Craig's 1992 track Bug In The Bass Bin-arguably one of the key records whichinfluenced the nascent drum'n'bass scene backin the early days-makes it all the more clear

that Programmed is an organic piece of work by acomposer who's developed a highly unique, constantlyevolving style over the past 10 years. The MontreuxJazz Festival will introduce Innerzone Orchestra toaudiences outside the dance community on July 17. Alimited edition vinyl 10 -inch set of Programmed willbe available from July 5 onwards.

In a surprise move, Jamiroquai break the hege-mony of the Backstreet Boys in the EuropeanRadio Top 50.

Jamiroquai enjoy their first ever Europeanairplay number one with Canned Heat, afterpeaking no higher than number 3 with their for-mer hits Virtual Insanity in October 1996 andCosmic Girl in February 1997, all on Sony S2.They make the most of a dip in airplay sufferedby the Backstreet Boys' I Want It That Way,which slips to number 2. The Major Market Air-play section shows Jamiroquai won the battle inthe UK, France and Italy, and made substantialprogress in Germany. But it can't be long beforeMadonna's Beautiful Stranger (Maverick/WarnerBros.), this week's most added record at number5 with 17 new stations, becomes better known asthe occupier of the number one berth.

Highest new entry this week, at number 37, isthe R&B-flavoured If You Had My Love by actressand former Janet Jackson backing vocalist Jen-nifer Lopez (Work/Columbia). The song is nowemerging all across Europe and Jon Kristiansen,programme director and head of music at DanishCHR-outlet VLR/Vejle, was one of the first to A -listit. "It's a splendid summer tune, which will be ahit all over the world," he pronounced immediatelyafter one play-and without looking at the cover."I never play anything because of the looks [of theartist]," he laughs. Since January this year, whenVLR implemented the Selector system, they havemanaged to be on air 24 hours a day, whichpleases Kristiansen and also hooks night time lis-teners, who can relate even more to the station'sslogan "Staerkt Vanedannende," which roughlytranslates as "Strongly Addictive." Danish productcurrently enriching VLR's playlist includes thepoppy World Wide Web Girl by Gudrun (EMI),Graceland by pop/rock act Kashmir (Sony) andpop singer Andy Roda with Secret (Virgin). Youmight have noticed that there is no mention ofAqua-soundalikes here, since Kristiansen pointsout that "the Danish audience has been tired ofpop/dance for the last six months."

Other new en-tries this weekstart down atnumber 42, whereEnrique Iglesiasdances his way inwith the border -breaking summertune Bailamos(Universal). One

place lower, the UK and the alternative stationsacross Europe turn up the volume with PumpingOn The Stereo by Supergrass (Parlophone). At 45,Scandinavia nurtures Savage Garden's The Ani-mal Song (Columbia), which is already number 11in the airplay chart for that region. back over the 50% mark once more to50.3%, and commercial radio's totalshare down to 47.5%. The respectiveshares in the previous quarter were48.5% and 49.3%.

Justin Sampson, operations direc-tor at the Radio Advertising Bureau,suggested that the improved detec-tion of lighter listening is "beneficialto programme lead, rather than pro-gramming lead, stations." He specu-lated that the new system is better atrecording instances where a listenermay tune to a specific station just tohear one particular programme. This,he suggested, would be more likely tobenefit speech outlets such as theBBC's Radio 4 rather than formattedmusic stations which do not generallyrun specialist programmes.

However, Sampson emphasisedthat the commercial radio sector wasnot quibbling with the figures, andthat the stations fully support thenew RAJAR system. Rachel Fox,research and communications man-

ager for commercial radiotrade body CRCA, promisedthat "commercial radio willreact aggressively in bothprogramming and market-ing to the figures."

The new RAJAR system,which was unveiled earlierthis year (M&M, May 1),improves the briefing ofrespondents by moving fromhousehold to individualdiary placement, while thediary itself has been madesimpler and easier to usethrough respondents "pre-selecting" in advance thestations they normally listen to. This"pre -selection" is carried out in a face-to-face session with the RAJAR inter-viewer, using station prompt cards.

It had been speculated that youth -oriented music stations would per-haps do better under the new system,as "troublesome teenagers" are nowbriefed directly by a RAJAR inter -

In London, market -leader 95.8 Capital FM(CHR) fell from 15.5% to12.2% quarter -on -quar-ter, but sister stationCapital Gold (which hassubstantial speech ele-ments in the shape of its

sports coverage) moved up from 4.3%to 5.3%. Although its share was downslightly to 5.6%, EMAP's Soft ACMagic 105.4 retained its position asLondon's No.2 commercial station. At4.7%, Virgin's combined AM and FMrock services in London have nowovertaken AC station Heart 106.2,which slipped to 4.5%.

Vangarde hushed at SACEM AGMmiss any member. The move target-ed composer Daniel Vangarde, whowas responsible for disclosing docu-ments revealing SACEM's wartimeattitudes. Yet Vangarde's dismisalwas not on the agenda and was notproposed.

Vangarde planned to use theAGM to expound his case, but hisspeech -which had been given thego-ahead by the AGM -was inter-

The market for piratecassettes has been fairly stagnantover the past three years, accord-ing to IFPI statistics, but illegalaudio CD sales have grown by18%. IFPI claims that the explo-sion of production capacity foroptical disks is at the heart of bal-looning pirate activity.

An undisclosed number ofcivil suits taken against plants inAmerica, Europe, the Middle Eastand Asia resulted in settlementstotalling more than $20 million(euro 20.6 million).

During the AGM, SACEM's pres-ident/CEO Jean -Loup Tourniermentioned the question of the Jew-ish assets and its treatment by thepress. He said: "The accusations areslanderous. SACEM has recoveredmany documents and the MatteoliCommission can examine themsoon." He declined to make any fur-ther comment.

Meanwhile, another bone of con-tention at the AGM was a changein statutes forbidding authors, com-posers or publishers to directlyauthorise or prevent the public useor reproduction of their works. Thismeans, for instance, that composerscould not sue TV channels which

wrongfully use their works. Severalauthors and publishers stronglycontested the decision which givesSACEM greater control at theexpense of the direct right owners.

"Some right owners have start-ed legal action against broadcast-ers using the right to authorise orprevent. Yet this right is exclusive-ly granted to SACEM when youregister your work with them,"explains SACEM's general manag-er Thierry Desurmont. "This situa-tion can only weaken SACEM andtherefore right owners." The AGMeventually approved a revised, lessrestrictive version.

SACEM's annual report wasrubber-stamped by the AGMwhich also renewed one third ofthe society's board and elected anew president of the board, veter-an publisher Gerard Davoust,president of Editions Raoul Bre-ton, who replaces JacquesDemarny. Tournier also confirmedthat his successor would be diplo-mat Bernard Miyet, current Unit-ed Nations under-secretary gener-al for peacekeeping operations.Miyet will join Sacem in 2000 andwill succeed Tournier as presidentin February 2001.

Basyl De Groot, head of music atDutch CHR station Itadio 3 FM,first heard the song in the US: "Ibrought a copy back to Hollandwhich we initially played at night.We were so overwhelmed by theresponse, we put it on our daytimeplaylist. We are now consideringdoing a Dutch version with DJHenk Westbroek."

BBC Radio 1 DJ Chris Moylesrecalls: "Our head of music, JeffSmith, played the track to me, andwe thought the average punter

might not like it. We thought itwould need a lot of talking up, so I'vebanged on about it on air ever since.It's had a massive reaction since wefirst played it on April 1. Listenersinitially hated it, but, by the end ofthe first play, they thought it wasfantastic." He is adamant that "pub-lic interest finally forced the recordcompany to release it."

EMI is keen to catch the crest ofthe Sunscreen wave. Mike McNal-ly, EMI Records UK product man-ager, says: "We are trying to posi-tion Something For Everybody asthe summer album of 1999." Totranslate the success of Sunscreen

into album sales, McNally feels "itnow needs a second single so peo-ple don't think it's a one-trackalbum." The title of a follow-upsingle has not yet been confirmed.

The genesis of the song is alreadyan urban myth. Anton Monsted,head of A&R at Luhrmann's Baz-mark Music label, was working on anew version of Everybody's Freewith Luhrmann when they noticedan e-mail containing text by MarySchmich which resembled the per-fect lyric sheet.

French CHR/urban network Skyrock is filinga lawsuit against local Paris urban station AdoFM. Skyrock contends that Ado FM has beenclaiming on air that a number of rap titles havebeen "discovered" and aired exclusively on AdoFM, whereas Skyrock says it had already playedthe tracks in question before they appeared onAdo FM. Skyrock wants Ffr 1 million (euro152,450) in damages on the grounds of unfaircompetition, but the court case has already beenpostponed until September 3.

Following in the footsteps of GWR andCapital Radio, DMG Radio is set to becomethe latest UK radio group to network its AM ser-vice-from July 1, the company's soft AC brandThe Breeze, previously confined to the countyof Essex, will also be heard in Sussex and Surreyon a frequency previously occupied by AC/goldstation Fame 1521/Crawley.

Hotline hears that the producer of a charitysingle benefiting Kosovo refugees is less thanhappy after the release was banned from theAustrian singles charts. Roland Michael ofRojam Music claims that Last Stand by I -Land& Friends has been booted out of the charts bychart compilers Music Control. Michael says thesong, which had stood at number 19 on the previ-ous week's charts, was disqualified by MusicControl because a number of companies had pur-chased hundreds of copies of the CD to distributeas gifts to their customers. "We worked our buttsoff trying to support it, and then Music Controlsaid we had manipulated the charts," complainsMichael. The CD has already raised more thaneuro 28,000 for the refugees.
