    COVID-19 Pandemic Updates

    NPRI Reporting Deadline for 2019 Extended to July 31, 2020Owners and operators of facilities that meet the NPRI requirements must usually submittheir reports by June 1 every year. This year the reporting deadline is extended to July 31,2020. 

    Chemicals Management in Canada Phase I

    MEKO Code of Practice: Mandatory Risk Management Measures AheadAt the last PCWG meeting, Health Canada provided an update on the outcome of thePerformance Evaluation of the Code of Practice for MEKO which expired last year, 5 yearsafter its implementation. Industry was found to have NOT adopted the three elements ofthe Code. ECCC/Health Canada will publish a full performance measurement evaluationreport on its website. The Risk Management division now has to identify a mandatoryinstrument to mitigate risks. Members are encouraged to plan ahead for the imposition ofa significantly lower concentration limit for MEKO in their indoor consumer alkyd products(perhaps in the order of 0.1%) and for identifying alternative anti-skinning agents. PSSA Update:  FSAR and RM Approach for Coal Tars and Distillates StillScheduled for Publication in Fall 2020The FSAR and RM Approach for Coal Tars and Distillates have not been delayed by theCOVID-19 pandemic. The DSAR has proposed coal tars to be toxic for human health andthe environment. Coal tar-based pavement sealants were specifically targeted for healthrisks in the risk management scope. Following a S.71 information gathering done inDecember 2018, the government has now analyzed the results and will be ready to publishits recommendations this year. 

    Chemicals Management in Canada Phase III

    Final SNAc for Calcium 2-Ethylhexanoate: Publication Delayed to Fall2020/Winter 2021Members should note that as soon as the final SNAc is published for Calcium 2-Ethylhexanoate, any new activity in a consumer product to which the  Canada ConsumerProduct Safety Act applies, will be defined as exceeding a concentration of 0.1% by weightand at more than 10 Kg per year, except for a paint or another surface coating material thatdries to a solid film if the substance is present in the paint or surface coating material, in aconcentration that is less than or equal to 0.5% by weight (the quantity threshold of 10 Kg

  • is not applicable for paint or surface coating material). CPCA Comments on the DSAR of the Acyclic, Monocyclic, and BicyclicMonoterpenes Group (Turpentine and Turpentine Oil)CPCA provided extensive evidence to demonstrate the current lack of use and interestin  using turpentine and turpentine oil in Architectural paint and paint thinners/stripperssold for consumer consumption in Canada, and by extension, in industrial and automotivepaint. The total national Architectural alkyd paint volume represents only 5% of the totalArchitectural sales, meaning that the likelihood that the volume of paint thinners/brushcleaners that may contain these substances and that a consumer may use them isextremely low. Additionally, these products are certainly not used at the frequency thatECCC used for modeling exposure. CPCA recommended ECCC/HC not undertake aninformation gathering exercise that would encompass the Architectural paint and paint-allied sectors and to clearly target non-Architectural paint uses in the FSAR and Schedule I. 

    VOC Emissions & Air Quality 

    Status of the Proposed Amendment to the Architectural VOC RegulationsAt the last PCWG meeting ECCC informed CPCA members that it plans to publish aconsultation paper on the proposed amendment in the fall of 2020. CPCA offered to form aworking group and organize a teleconference should ECCC regulators have any specifictechnical feasibility or cost impact questions they would like to resolve prior to holding theconsultation. Following the consultation, government will work on drafting an amendmentto be published in Canada Gazette Part I, which will depend on the availability of legaldrafters as many other regulatory developments are experiencing delays. CPCA estimatesthat such an amendment may be published by mid or late 2021. 

    Workplace Health and Safety

    CIC Update on Consumer Products Education & Awareness CampaignCIC industry groups raised concerns that the process in developing these materials wasnot transparent and there were factual inaccuracies in the content. The concerns were in

    line with those of CPCA in its submission of March 6th. It was decided that the wayforward would be to re-convene the CIC sub-committee that developed these products andgive an opportunity to refine them prior to publication. 

    International Initiatives

    TiO2 Manufacturers Association to Pursue Legal Challenge of EUClassificationLast February, the European Union officially published the regulation to classify TiO2 as a

    suspected carcinogen by inhalation under EU Regulation (EC) No 1272/2008 onclassification, labeling and packaging (CLP) of substances and mixtures. The decision willbe enforceable on September 9, 2021 and members doing business in the EU must complywith the new labelling requirements after that date.  Nevertheless, the Titanium DioxideManufactures Association intends to bring a legal challenge of the EU TiO2 Classification

    before the EU General Court. ACA, CEPE, and BCF will join the challenge as intervenors. AJoint Statement in Intervention (main legal briefing) is due in January /February 2021. The

  • oral hearing is not expected until 2022. US EPA Published Its Draft Risk Assessment for Several ITAs(Isothiazolinones): BIT, BBIT, DCOIT, MIT/CMIT and OITACA is coordinating with ACC and the HCPA Preservation Stewardship Task Force indeveloping comments. CPCA will endorse these comments. ACA/ACC are gatheringadditional information on PPE, engineering controls and other risk mitigation strategiesused during formulation of paints and coatings. OIT: Inhalation and dermal exposure forboth occupational use (application of) and residential/consumer use (application of) ofpaint raised concerns (except for occupational brush/roller application for inhalationexposure).  BIT: There are residential handler inhalation concerns for airless sprayapplication of paint and trigger spray and wipe application of cleaners, for both, short andintermediate-term exposures. Dermal exposure for the airless spray application of paint,brush/roller application of paint and wipe application of cleaners is also of concern. ForCMIT/MIT: Residential handler and post-application exposures are not acceptable 1.9 dayafter painting, but not beyond. Occupational inhalation following the use of open pouringliquids, paint and cleaners, as well as for ecological aquatic risks also pose an issue.Comments are due by June 13.

    ECCC Minister Formally Acknowledges Industry ChallengesDuringPandemicECC assured CMC  and the  Business Council  of Canada  that it  will  continue to workon  protecting the  environment  while  recognizing  that Canadian businessesare  facing  extraordinary  circumstances  during the pandemic.  The Minister expectsregulated parties to act responsibly in order to minimize the effects and duration of anynon-compliance caused by the pandemic. However, while the Department's laws remain ineffect and cannot be waived, the ECCC Minister recently assured the Business Council that

To theextent possible, regulated parties should document the nature and dates of non-compliance. New Substances Notification Fees Payment Form for 2020-2021The new form reflects adjusted fees from April 1, 2020 to March 31, 2021. 

    Workplace Health & Safety & Supply Chain Management

    COVID- 19 Health Canada Interim Policy for Cleaning Products Used,Handled or Stored in WorkplacesIn light of the increase in demand for certain cleaning products regulated under theHazardous Products Act and Hazardous Products Regulations during the COVID-19pandemic, and the concerns heard from stakeholders, Health Canada has put in place aninterim policy to address potential shortages of cleaning products intended for use,handling or storage in a workplace in Canada. The policy is now available online via theHUB. 

    Post-Consumer Paint Recycling

    Consultation on the MHSW Program Wind Up Return of Surplus FundsTwo weeks following the June 25 approval, SO-Industry Stewardship OrganizationAgreements will be signed and lump sum payments anticipated to AMS & Product CareAssociation (PCA) for July 6-10, 2020. Fee reductions will then be applied to stewards’quarterly/monthly invoice or can also be dealt with by PCA by not billing companies for ayear. On May 19, CPCA met with SO and Product Care to work out a lump sum transfermodality. Contrarily to what was mentioned by SO during the consultation webinar, there isno need for members to pass on any funds to the consumers, as there is no way rebatingor returning money to stewards when there are no visible fees. ARMA’s Expanded Electronics Recycling Pilot ApprovedThrough a two-year $43 million pilot project, the government has approved the AlbertaRecycling Management Authority (ARMA) to use reserve funds to recycle up to 24,600tonnes of electronics products that were not previously accepted in the program. Reminder: Saskatchewan to Review all Stewardship Programs forEffectiveness and Efficiency in 2020-2021The review will aim to identify opportunities for improvement, including the potentialcreation of new stewardship programs. The first priority will be the program for householdpaper and packaging, with a review commencing in 2020-21. In Spring 2022,Saskatchewan will engage with stakeholders, including municipalities, private landfills,recycling organizations and businesses to develop a diversion program for non-residentialwaste.

  • EPA’s Updated Small Manufacturer Definition Will Apply to CDR ReportingPeriod Beginning June 1The updated definition states that a small manufacturer is an entity that has sales,combined with those of its parent company:

    under $120m (adjusted from the existing $40m), unless that company has a site thatproduced more than 100,000lbs of a particular substance; orunder $12m (versus the current $4m), irrespective of production volumes.

    Facilities that fall under the first standard can skip reporting on substances manufacturedor imported below the annual volume threshold. 

    Product Stewardship Washington State to Add Paints Under Safer Consumer Products ProgramWashington’s Department of Ecology has decided to add “paint” to their final list of priorityproducts for PCB contamination, which will include residential and commercial paints soldor used and possibly include factory applied coatings.  Certain pigments/colorantsincluding diarylide yellows, phlthalocyanine greens/blues and possibly some titaniumdioxides may contain low concentrations of inadvertent PCBs.  WDE must submit a finalproducts list to the Legislature on June 1.  

    Occupational Health and Safety EPA and CDC Released Updated Guidance on How to Properly Clean andDisinfect SpacesThe guidance provides instructions for workplaces and businesses.

The information will help refinethe scope of the proposal and analysis of the socio-economic impact of differentrestriction options. First ICCM5 Bureau First Teleconference Held on May 13The bureau discussed SAICM’s next steps, IP4 and ICCM5 timelines. China Revises its New Chemical Substance Management RulesMinistry of Ecology and Environment released Order 12 which will take effect on January 1,2021. The Order introduces substantial changes to the registration system for newchemical substances, and will likely have significant impacts on producers, importers,processors of the new chemical substances.
