It’s hard to believe 2011 is coming to a close. I want

to thank the Board of Directors for their support this

year. We did not accomplish everything I would

have liked to, but we are a work in progress and we

have a good foundation for the future of MPHCC. With

the help of our Board of Directors and our Executive

Director, we will continue to work hard to protect our

industry, provide benefits to our members and lobby

for our businesses. We look forward to increasing

membership and creating a bigger, stronger association.

We are fortunate enough to be a part of a great

association that has been around for 128 years. I’m

not sure about the details of what happened in the

first 103 years, but I have been around for the last 25.

There is one person who for the last 25 years has been

the backbone of this association. Anyone who has

questions about our industry knows who to call to find

the answers, our Executive Director, Diane Kastner.

Diane originally volunteered as the secretary for the

Maryland PHCC Apprenticeship Program when it began

in 1983. In 1986, Diane volunteered to work in the

MPHCC office to help the association until they could

hire a permanent Executive Director. Two and half years

later, we hired Diane!

The MPHCC Apprenticeship Program will be

celebrating their 24th graduating class next May. Since

it began, the program has developed and expanded

to include education programs including gas code

classes, plumbing code classes, backflow certification

and recertification and we have opened the NSPC Book

Store.

In 1998 Diane won the National Association

Executive Council’s highest award for Outstanding State

Executive. Diane is the editor of our quarterly Maryland

PHCC Contractor Magazine, winning 1st place from the

National Association Executive Council for outstanding

magazine in 2005 and 2007. She has coordinated many

events over the years including our State conventions,

picnics, trade shows, seminars, workshops, zone

meetings, membership meetings, dances, state

apprenticeship contest and hosting the National PHCC

apprenticeship contest and much more.

The development and growth of the association also

comes from the wealth of knowledge and experience

Diane has acquired over the years. Diane regularly

attends the Maryland State Board of Plumbing meetings

in order to learn about the issues affecting the plumbing

industry on the state level. She works with our lobbyist

and legislative chairman to review and introduce bills

to protect the plumbing and HVAC contractors and the

consumers. Diane keeps the lines of communication

open with county plumbing inspectors, attending

meetings and conventions when possible. She even

helped the inspectors create the Maryland Plumbing

Mechanical Inspectors Association. She works with our

suppliers, wholesalers and manufacturer representatives

throughout the region, giving us the opportunity to

network for the good of our industry. Diane has been a

member of the MPHCC Auxiliary for almost 30 years,

winning Maryland PHCC Auxiliary Woman of the Year in

1987 and National PHCC Auxiliary Woman of the Year

in 1988.

The successes of the Association comes with

personal sacrifices; long hours, working 6-7 days a

week, traveling to the schools 2-4 nights a week. The

most often asked question is, “How does she do it all?”

We’ll never know, but we are very grateful that she

has done it all for MPHCC. As her daughter I know

firsthand the hard work and dedication she has put into

this Association; this is not her job, it’s her passion. The

Maryland PHCC has come a long way over the last 128

years. We can thank Diane for the last 25.

It has been an honor serving as your President this

year and working alongside Diane. I wish the Board of

Directors, the incoming President and the members of Maryland PHCC much success in 2012!

This article is written just before the Maryland General

Assembly meets in Special Session on October

17, 2011 to discuss and vote in the Congressional

Redistricting map. This process occurs every 10

years after a decennial census, the last one taken in 2010.

The plan would radically redraw lines in Western Maryland

that basically runs from Carroll and Frederick counties all the

way to Allegany County, the farthest western point in the state.

It would transform the reliably conservative 6th District, held by

Republican Congressman Roscoe G. Bartlett, into a toss up

with the slightest edge to registered Democrats. This would be

done by dipping substantially into “blue” Montgomery County

all the way down into Rockville, Potomac and North Bethesda.

Of course, everyone can agree that those who shop at the

Montgomery Mall off 270 in Bethesda have lots in common with

the farmers and rural folk who live and work near and around

Deep Creek Lake. One legislator bluntly told me, “We don’t

draw lines to preserve Octogenarians.” This observation was

further validated by the Federal Election reports that show that

Congressman Bartlett, after 20 years in office, has raised only

$1,000 this quarter, making him an easy target for a Primary

challenge and weaker in the general. It would be hard to raise

the half-a-million or more in the next year to successfully defend

the seat. So many are saying, now is the time to make the

change because it appears he may not be running actively for

re-election.

So who are the likely successors? Most will come from

the state legislature. A major fundraiser and likely Republican

successor would have been former State Senator Alex Mooney

(R-Frederick) but he just lost his senate seat in the last election

to former Frederick Mayor Ron Young. Mooney is now the Chair

of the Republican Party. It is thought that Mooney could enter

and win a Primary, but is not as strong in the general because

of the added more liberal votes from Montgomery County.

Others who will give it a hard look would include Senator David

Brinkley (R-Frederick) and State Senator Joe Getty. Many feel

the strongest would be Senator Chris Shank (R-Washington)

who defeated incumbent Senator Don Munson handily in 2010.

He’s young, aggressive and has help leadership positions

the Legislature. The Democratic side looks like the new 6th

Congressional District is being specifically drawn for State

Senator Rob Garagiola (D-Montgomery) who is the current

Senate Majority Leader and resides in the Germantown area.

No other viable candidates have announced their interest and

are awaiting to see if Garagiola jumps in.

All these dynamics will become clearer after the maps are

voted on this coming week and as we head into the January

2012 legislative session.

Other issues on the horizon are jobs and public-private

spending on public works projects. There will be briefings on the

Governor’s controversial wind energy legislation, various county

concerns about the education funding law and the process for

raising tolls. Senate Finance Chairman Thomas M. Middleton

had scheduled a wind hearing for next week to discuss the

Governor’s proposal even before the special session was

announced. A recent poll said that Maryland residents would

favor paying $2 more per month in electric bills if it came from

wind farm energy rather than coal, nuclear or fossil fuels.

House Ways and Means Committee Chairwoman Sheila

Hixson will have her members review a portion of the state’s

education funding formula that has proved troublesome for some

counties in the last few years and may be subject to change

next year. At issue is a requirement that counties fund K-12

education at consistent levels so that higher state contributions

result in a net increase to the schools. Three counties have

fallen short, for reasons many lawmakers view as reasonable,

and waivers were granted.

Hixson’s panel will also examine recent state toll increases

with an eye toward changing the process of making hikes.

In another transportation related area, increases to the

state’s gasoline tax and vehicle registration and emissions

testing fees could be part of a plan to enhance the state’s

shrinking transportation fund.

The Blue Ribbon Commission on Maryland Transportation

Funding will vote later this month on a package of

recommendations that tentatively includes increasing the state’s

23.5 cents-per-gallon gas tax by 5 cents a year over the next

three years before tying increases to the rate of inflation.

Scheduled for a final vote is a recommendation to include

a 50 percent increase on vehicle registration fees that are set

at $50.50 and $76.50 based on type of vehicle, an increase

from 6 percent to 6.5 percent on the tax to title a vehicle, and a

doubling of the cost of a vehicle emissions test from $14 to $28.

The fund, which is used in part to supply local governments

with grant-type funding for road repairs, has all but dried up, and

commission members want to take funds generated by the taxes

and fees to reinstate that money to the locals.

In addition to searching for ways to raise the $800 million

needed to replenish the fund, commissioners also have made

policy recommendations to ensure that the money is not

directed away from transportation.

Earlier this month, they agreed that the state should close

loopholes that allow lawmakers to spend the money elsewhere

and eliminate free public transit rides for certain employees of

nonprofit agencies, a practice that the commission said costs

the state millions.

The commission dismissed options including increasing

the sales or property taxes to generate transportation money,

arguing that such taxes would put an unfair burden on the poor

and working class. Its final report is due to the State Legislature

and Governor Nov. 1.

It is a fascinating prelude to the 2012 Maryland Legislative

session to see whether the Big Elephant will be caged and the

Donkeys will have the run of the farm. Those who control the

locks to the gate know the answer.

Our nation’s history is filled with many great

examples of industry and government working

together to resolve society’s problems and issues –

while seeking opportunities for the “greater good.”

Our nation’s history is also filled with as many great examples of

legislatures and regulatory bodies trampling industry’s interests

in pursuit of what is believed to be for the “greater good.”

Are lawmakers’ and governments’ intentions well intended?

Perhaps…

Is the manner, at times, in which they seek their objectives

shortsighted? No doubt…

The truth is that full engagement from both sides – industry

and government (local, state, federal) alike, is the only way to

pursue for the “greater good.”

With all of this in mind, PHCC is providing expanded

grassroots services to its members. This includes monitoring

and tracking industry issues on a daily basis, and if need

be, mobilizing members to advance a piece of legislation or

regulation. Or, mobilizing members to stop (kill) a piece of

legislation or regulation in order to avoid a possible destructive

situation. This active participation is enhanced by constant

industry education for lawmakers and government. Education in

all its forms is the key to grassroots, and successful grassroots

campaigns can only occur if industry has fully educated

lawmakers and regulators.

It also crucial to continuously engage legislators and

government on the local, state, and national levels. Rest

assured that, on your behalf, PHCC is always educating,

always building relationships, always seeking opportunities

for engagement, and always studying pressure points in the

legislative and regulatory processes in order to protect and seek

opportunities for members.

PHCC sees much potential in these grassroots efforts for

this primary reason: the p-h-c industry is a natural grassroots

powerhouse and harnessing its strength and unleashing its

firepower is only a matter of structuring its ability to optimize

its potential. PHCC will continue to engage lawmakers and

regulators to educate them on the p-h-c industry, and when

needed, to use our structured grassroots network system so

that we can mobilize our collective voice in order to advance our

interests.

Issue update at a glance, as of mid-October…

• 3%WithholdingRepeal–HouseWays&Meanshasreported

outPHCC-supportedlegislationtorepealthe3%withholding

on government construction contracts. Starting Jan. 1, 2013,

all federal and state contracts for goods and services will be

subject to a 3 percent income tax withholding on each and

every payment over $10,000 to a contractor. The requirement

also applies to large local governments that make $100

million or more in annual expenditures for goods and

services. The full House is expected to vote on the bill soon.

PHCC’s grassroots focus is to overwhelmingly pass the

House version of the repeal, then move on to its grassroots

efforts in the Senate. PHCC National continues to work with

the Government Withholding Relief Coalition on repeal of

the3%withholding.PHCCPresidentKeithBienvenusent

a letter recently to House Ways & Means Committee Chair

DaveCamprequestingthecommitteemove3%withholding

repeal legislation to the House floor. “Congress should be

pursuing policies that encourage; not hamper, job creation

in the private sector,” Bienvenu stated. Unless repealed by

Jan.1,2013,the3%withholdingtaxwillgointoeffect.The

tax will mandate that federal, state, and local governments

withhold3%frompaymentsforgoodsandservices,not

only causing an unprecedented paperwork burden for the

government and companies who provide goods or services

to them, but forcing firms to

increase costs to offset the

impact of delayed payments and

disrupting businesses’ cash flows.

PHCC National is working very

closely with the U.S. Chamber

of Commerce on a massive

grassroots campaign to repeal the

tax.

• DeathTax–PHCCcontinues

to lobby in support and urge

Members of Congress to

cosponsor legislation to

permanently repeal the death

tax – 169 Members of the House

have signed onto the repeal.

PHCC National continues to work

with the Family Business Estate

Tax Coalition and the American

Family Business Institute to

repeal the death tax.

• LeadPaint–PHCCeffectively

lobbied the House Appropriations

Committee to approve an

amendment that would require the

Environmental Protection Agency

(EPA) to comply with its own

regulation regarding renovation

work in homes and buildings that

may contain lead-based paint

before placing more burdens on

renovation contractors.

• CareerandTechnicalEducation–

PHCC is working with the House

Congressional CTE Caucus to

help increase the number of

Members of the House serving

on the Caucus. As the number

of members on the caucus

increases, maintaining and

possibly increasing funding for

CTE programs will become more

likely.

• WorkforceGuidelines–PHCC

is currently working with officials

from the Department of Energy

working directly with the Office of Advocacy, U.S. Small

regulations impacting the p-h-c industry.

Business Occupations and Professions – Plumbers – Lead–Free Materials

FOR the purpose of prohibiting certain plumbing materials containing more than a certain amount of lead from being used in the installation or repair of plumbing intended to dispense water for human consumption; prohibiting the sale of certain plumbing materials containing more than a certain amount of lead; requiring the State Board of Plumbing to adopt certain regulations; defining certain terms; providing for a delayed effective date; and generally relating to the lead content of materials used in plumbing.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, That the Laws of Maryland read as follows:

Article – Business Occupations and Professions

12–101.

(H–1) “LEAD–FREE” MEANS:

(1)CONTAININGNOTMORETHAN0.2%LEADFORSOLDER AND FLUX;

(2) EXCEPT AS PROVIDED IN ITEM (3) OF THIS SUBSECTION, CONTAINING NOT MORE THAN:

(I) 4%LEADBYDRYWEIGHTFORPLUMBINGFITTINGS AND FIXTURES; OR

(II)8%LEADBYDRYWEIGHTFORPIPESANDPIPE FITTINGS; AND

(3) CONTAINING A PERCENTAGE OF LEAD FOR PLUMBING FITTINGS AND FIXTURES THAT IS IN COMPLIANCE WITH STANDARDS ESTABLISHED UNDER 42 U.S.C.A. § 300G–6(E) OF THE FEDERAL SAFE DRINKING WATER ACT; AND

(3) (4) CONTAINING NOT MORE THAN A WEIGHTED AVERAGELEADCONTENTOF0.25%FORTHEWETTED SURFACES OF A PIPE, PIPE FITTING, PLUMBING FITTING, OR FIXTURE INTENDED TO DISPENSE WATER FOR HUMAN CONSUMPTION THROUGH DRINKING OR COOKING.

(Q) “WEIGHTED AVERAGE LEAD CONTENT” MEANS A CALCULATION DETERMINED BY:

(1) IDENTIFYING EACH COMPONENT OF A PIPE, PIPE FITTING, PLUMBING FITTING, OR FIXTURE THAT WATER FLOWS THROUGH AND COMES INTO CONTACT WITH DURING NORMAL OPERATION;

(2) IDENTIFYING THE PERCENTAGE LEAD CONTENT OF EACH COMPONENT OF THE PIPE, PIPE FITTING, PLUMBING FITTING, OR FIXTURE;

(3) DETERMINING THE WETTED SURFACE AREA OF EACH COMPONENT OF THE PIPE, PIPE FITTING, PLUMBING FITTING, OR FIXTURE;

(4) DETERMINING THE PERCENT OF TOTAL WETTED SURFACE AREA OF THE PIPE, PIPE FITTING, PLUMBING FITTING, OR FIXTURE, REPRESENTED IN EACH COMPONENT;

(5) CALCULATING THE CONTRIBUTING PERCENT LEAD FOR EACH COMPONENT THAT COMES INTO CONTACT WITH WATER BY MULTIPLYING THE PERCENTAGE OF LEAD CONTENT OF THE COMPONENT BY THE PERCENT OF TOTAL WETTED SURFACE AREA REPRESENTED BY THE COMPONENT; AND

(6) CALCULATING THE SUM OF EACH CONTRIBUTING PERCENT LEAD VALUE DETERMINED FOR EACH COMPONENT UNDER ITEM (5) OF THIS SUBSECTION.

12–205.

(b) (1) The Board may adopt, as part of the State Plumbing Code, regulations to carry out the purposes of and to enforce §§ 12–605 and 12–606 of this title.

(2) The Board may adopt standards of the American National Standards Institute or any other nationally recognized organization.

(3) THE BOARD SHALL ADOPT, AS PART OF THE STATE PLUMBING CODE, REGULATIONS TO CARRY OUT THE PURPOSES OF AND TO ENFORCE §§ 12–605.1 AND 12–605.2 OF THIS TITLE.

12–605.

(a) (1) A person may not install a plumbing fixture or other device that does not meet the standards for approval as set out in the State Plumbing Code or any applicable local plumbing code.

12–605.1.

(A) IN THE INSTALLATION OR REPAIR OF PLUMBING INTENDED TO DISPENSE WATER FOR HUMAN CONSUMPTION, A PERSON SHALL USE ONLY PIPES, PIPE FITTINGS, PLUMBING FITTINGS, OR FIXTURES THAT ARE LEAD–FREE.

(B) IN THE INSTALLATION OR REPAIR OF PLUMBING INTENDED TO DISPENSE WATER FOR HUMAN CONSUMPTION, A PERSON SHALL USE ONLY SOLDER OR FLUX THAT IS LEAD–FREE.

12–605.2.

(A) A PERSON ENGAGED IN THE BUSINESS OF SELLING PLUMBING SUPPLIES IN THE STATE MAY NOT SELL PIPES, PIPE FITTINGS, PLUMBING FITTINGS, OR FIXTURES THAT WILL BE USED IN THE INSTALLATION OR REPAIR OF ANY PLUMBING THAT DISPENSES WATER FOR HUMAN CONSUMPTION, UNLESS THE PIPES, PIPE FITTINGS, PLUMBING FITTINGS, OR FIXTURES ARE LEAD–FREE.

(B) A PERSON ENGAGED IN THE BUSINESS OF SELLING PLUMBING SUPPLIES IN THE STATE MAY NOT SELL SOLDER OR FLUX THAT IS NOT LEAD–FREE UNLESS THE SOLDER OR FLUX BEARS A LABEL STATING THAT IT IS ILLEGAL TO USE THE SOLDER OR FLUX IN THE INSTALLATION OR REPAIR OF ANY PLUMBING THAT DISPENSES WATER FOR HUMAN CONSUMPTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect January 1, 2012.
