RULES AND REGULATIONS

I. Rules and Regulations for the Government of Sewerage Utilities, adopted by the Public Service Commission of West Virginia, and now in effect, and all aanendments thereto and modifications thereof hereafter made by said Commission.

SCHEDULE I

(C) APPLICABILITY Applicable in Washington Lands and McLain's Run/WVU Extension area

(C) AVAILABILITY Available for general domestic and commercial service

(C) RATES (Customers with metered water supply) Customer Charge $5.24 per month Commodity Charge $4.78 per 1,000 gallons used per month

(C) MINIMUMCHARGE No bill will be rendered for less than $26.75 per month, which is the equivalent of 4,500 gallons of usage with a 5 / 8 meter.

(C) DELAYED PAYMENT PENALTY The above schedule is net. On all accounts not paid in full when due, ten percent (10%) will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to be collected only once for each bill where it is appropriate.

(C) TAPFEE The following charges are to be made whenever the utility installs a new tap to serve ai applicant.

A tap fee of $0 will be charged to customers applying for service before construction is completed adjacent to the customer's premises in connection with a certificate proceeding before the Commission. This pre-construction tap fee will be invalid after the completion of construction adjacent to the applicant's premises that is associated with a certificate proceeding.

AVAILABILITY Available for general domestic and commercial service

(C) RATES (Customers with metered water supply) Service Charge $23.24 per month Usage Charge $3.39 per 1,000 gallons used per month

(C) MINIMUh4CHARGE No bill will be rendered for less than $23.24 per month.

(C) FLAT RATE CHARGE (Customers with nonmetered water supply) Equivalent of 4,500 gallons of water usage plus the service charge- $38.50.

(C) Surcharge formula to be applied iii cases where surface drainage is connected to the utility's sewer system

APPLICABILITY Whenever the utility has discovered that a customer's roof drain, downspout, storm sewer or similar facilities conducting surface water have been connected to the utility's sewer system, and such customer has failed to take appropriate d o n , within h - t y (30) days of receipt of a demand by the utility in accordance with the Rules of the Public Service Commission, to eliminate such connection, a surcharge will be imposed upon the customer c a l c d d on the basis of the following formula:

The surcharge in dollars The average area under roof andor the area of any other water collection surface connected to the sanitary sewer, in square feet. The measured monthly raidall, in inches A conversion factor to change inches of rain x square feet of surface to !$ per 100 cubic feet. The District's approved rate per thousand gallom of metered water usage.

The utility shall not impose the surcharge unless and until the customer has been notified by certified mail, return receipt requested, or by hand delivery' that it has been established by smoke testing, dye testing, or onsite inspection that rain or surface water is being introduced into the sanitary sewer system at the customer's location, and that the customer has not acted within thirty (30) days &om receipt of such notice to divert the wafer f?om the sanitary sewer system.

Said surcharge shall be calculated and imposed for each month that said condition continues to exist. Failure to pay the surcharge andor correct the situation shall give rise to the possible termination of water service in accordance with the Rules of the Public Service Commission of West Virginia

WATER DISCONNECTIONIADMINISTRATIVE RECONNECTION FEES Whenever water service has been disconnected for non-payment of sewer bills in conjunction with a water service termination agreement with Marshall County Public Service District No. 1, a disconnection fee of $15.00 shall be charged; or in the event the delinquent sewer bill is collected by the water company7 an administrative fee of $15.00 shall be charged.

Whenever water service, which has been previously disconnected or otherwise withheld for non-payment of sewer bill in conjunction with a water service termination agreement with Marshall County Public Service District No. 1, is reconnected, a fee of $15.00 shall be charged.
