MARCH 16, 2020 CC MINUTES A regular meeting of the City Council of the City of Fort Calhoun, Nebraska, was held in open and public session at 7:00, on Monday, March 16, 2020 at the Fort Calhoun Council Chambers, in Fort Calhoun, Nebraska. Notice of the meeting was given in advance thereof by publication, said form of notice being a designated method for giving notice, an affidavit of publication being attached to these minutes. Advance notice of this meeting was also given to the Mayor and all Council Members. Availability of the agenda was Mayor Robinson publicly stated to all in attendance that a current copy of the Nebraska Open Meetings Act was available for review and indicated the location of such copy in the room where the meeting was being held. In accordance with Section 84-1412 sub section eight (8) of the Reissue Revised State Statutes of the State of Nebraska 1943, as amended, one copy of all reproducible written material to be discussed is available to the public at this meeting for examination and copying. The public hearing relating to ADOPTING AND INCORPORATING BY REFERENCE A REVISED ZONING ORDINANCE AND SUBDIVISION REGULATIONS FOR THE CITY OF FORT CALHOUN, NEBRASKA opened at 7:05 p.m. With no written or public comments, the public hearing closed at 7:05 p.m. Jim McNally with Municipal Code Services presented the final draft of the revised Fort Calhoun Municipal Code. Updates to the book are free for a year.

A regular meeting of the City Council of the City of Fort Calhoun, Nebraska, was held in open and public session at 7:00, on Monday, March 16, 2020 at the Fort Calhoun Council Chambers, in Fort Calhoun, Nebraska.

Notice of the meeting was given in advance thereof by publication, said form of notice being a designated method for giving notice, an affidavit of publication being attached to these minutes.

Advance notice of this meeting was also given to the Mayor and all Council Members. Availability of the agenda was Mayor Robinson publicly stated to all in attendance that a current copy of the Nebraska Open Meetings Act was available for review and indicated the location of such copy in the room where the meeting was being held.

In accordance with Section 84-1412 sub section eight (8) of the Reissue Revised State Statutes of the State of Nebraska 1943, as amended, one copy of all reproducible written material to be discussed is available to the public at this meeting for examination and copying.

Mayor Robinson stated persons wishing to address the Governing Body on an agenda item shall wait to be identified by the Presiding Officer; then, after stating their name and address for the record, may proceed to speak. No person, other than the Council and the person having the floor will be permitted to enter any discussion without the permission of the Presiding Officer. Member Prieksat made a motion seconded by member Lammers to approve the consent agenda, as presented. With members Schuler, Lammers, and Prieksat voting “Aye”, motion carried.

Jim McNally with Municipal Code Services presented the final draft of the revised Fort Calhoun Municipal Code. Updates

to the book are free for a year.

Member Prieksat made a motion to not take action on the Parking Lot License Agreement (Northern Hills Ventures

Redevelopment Project). Council explained that there were issues with the cost and waiving of certain fees. Member Lammers seconded the motion. With members Schuler, Lammers, and Prieksat voting “Aye”, motion carried.

Member Schuler made a motion seconded by member Lammers to approve the plans and specifications for the 2020 Adams Street Corridor Park Improvements Phase 2 and 3 Project and authorize JEO Consulting Group to work with the clerk to establish a bid date and advertise for the same. City Engineer, Lucas Billesbach, explained that project is split up into group A & B. Group A is the infrastructure associated with underground work and group B is the splash pad, shade shelter, and landscaping. Total project cost estimated at $675,000 (originally started at $550,000). The increase is due to most of the infrastructure that was not anticipated. The contract is laid out to bid group A & group B at the same time. Group A would be awarded and under construction this summer and group B would not be awarded until the end of July and start date would be in September. With members Prieksat, Schuler, and Lammers voting “Aye”, motion carried.

Member Prieksat made a motion seconded by member Schuler to award a construction contract to Western Engineering in the amount of $305,991.67 for Groups A, B, and C for the 2020 Asphalt Overlay Project. With members Lammers, Prieksat, and Schuler voting “Aye”, motion carried.

City Engineer gave an update on the 2020 Lift Station Flood Protection Improvements Project. The grant application is

in.

Member Schuler made a motion to introduce Ordinance 761 entitled:

AN ORDINANCE ADOPTING AND INCORPORATING BY REFERENCE A REVISED COMPREHENSIVE ZONING AND SUBDIVISION REGULATIONS FOR THE CITY OF FORT CALHOUN, NEBRASKA; REPEALING ORDINANCE NO. 687, ADOPTED FEBRUARY 18, 2013, AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.

Member Schuler moved that the statutory rule requiring an ordinance to be fully and distinctly read on three different days be suspended. Member Prieksat seconded the motion. With members Schuler, Lammers, and Prieksat voting “Aye”, motion carried.

Member Prieksat made a motion seconded by member Schuler to not approve Resolution 2020-3 – Traffic Control (15th Street). With members Lammers, Prieksat, and Schuler voting “Aye”, motion carried.

Member Prieksat made a motion to introduce Ordinance 762 entitled:

AN ORDINANCE OF THE CITY OF FORT CALHOUN, NEBRASKA, REVISING AND CODIFYING THE GENERAL ORDINANCES OF THE CITY AND REPEALING PRIOR ORDINANCES IN CONFLICT HEREWITH.

Member Prieksat moved that the statutory rule requiring an ordinance to be fully and distinctly read on three different days be suspended. Member Schuler seconded the motion. With members Schuler, Lammers, and Prieksat voting “Aye”, motion carried.

Member Prieksat introduced Resolution 2020-4 – Authorizing the revised Municipal Code Book to be printed and published and moved for its passage and adoption. Member Schuler seconded the motion. On roll call the following voted “Aye”: Lammers, Prieksat, and Schuler. The passage and adoption of said Resolution having been concurred by most of all members of the Council, the Mayor declared the Resolution adopted and, in the presence of the Council, signed and approved the Resolution and the Clerk attested the passage and approval of the same and affixed her signature thereto.

A true and complete copy of the said Resolution is as follows:

RESOLUTION NO. 2020-4

A RESOLUTION BY THE MAYOR AND CITY COUNCIL OF THE CITY OF FORT CALHOUN, NEBRASKA, DIRECTING THE CITY CLERK TO CAUSE ORDINANCE NO. 762 TO BE PRINTED AND PUBLSIHED IN BOOK FORM BY MUNICIPAL CODE SERVICES OF NELIGH, NEBRASKA. BE IT RESOLVED by the Mayor and City Council of the City of Fort Calhoun, Nebraska, that the City Clerk of said City be and she hereby is directed to cause Ordinance No. 762 of the City of Fort Calhoun, Nebraska, which was on this date duly passed by said City Council and approved by the Mayor of said City, to be printed and published in book form by Municipal Code Services of Neligh, Nebraska, within 30 days after this date, and that said printed ordinances be kept in the custody of the City Clerk. Council accepted the resignation of Terry Fitzgerald. Mayor Robinson announced a vacancy on the City Council, which will be advertised. Council discussed the 2020 Triple Crown Sports Agreement. Member Schuler made a motion to approve the agreement. With no second, the motion died. Maintenance Supervisor, Corban Helmandollar, discussed purchasing brine equipment using the proceeds from the sale of the truck. The truck sold by auction for $15,500. They are looking at purchasing a 450-gallon brine maker for $14,950 and using the rest of the proceeds for brine applicating equipment. Member Prieksat made a motion seconded by member Schuler to approve the purchase. With members Lammers, Prieksat, and Schuler voting “Aye”, motion carried. The Mayor announced the dates for the Annual Spring Clean-Up, providing Dumpster(s) at the City Shop: Saturday, April 4th through Sunday, April 26th.

Note, FCFD Fire Chief Dan Mallory will allow Open Burning with a BURN PERMIT during this time.

Mayor Robinson entertained a motion to add an agenda item for an Emergency Corona Virus Update. Member Prieksat made a motion, seconded by member Lammers. With members Schuler, Lammers, and Prieksat voting “Aye”, motion carried. -City offices will remain open to the public for the time being, but that could change anytime, depending on … -City parks and ball fields will remain open -There will be no unofficial City functions or meetings (Parks, Enhancement, or Planning Commission) -Will be looking into video conferencing for upcoming Council meetings

Following a motion and vote, Mayor Robinson declared the meeting adjourned at 8:09 p.m.

City of Fort Calhoun Parks Board

March 5, 2020 Meeting Minutes Roll Call: 1. Kris Richardson called the meeting to order at 7:08 pm. 2. Kris announced the Open Meeting Compliance act.

3. Roll Call: Board Members Jerry Barabas, Kris Richardson, Sara Ruthven and Bob Lammers all in attendance. Board Member James Totten absent. Members of the public: None.

4. Approval of February Meeting Minutes was moved by Bob. Seconded by Jerry. All in favor to approve.

Unfinished Business:

5. Multi-purpose Court Update.

a. The city received grading and concrete advise from JEO. The Board will continue planning the new court install.

New Business: 6. Schedule annual parks audit

a. Scheduled for April 2, 2020 at 5:45 starting at City Baseball fields b. Board members will individually do site observations on their own prior to the meeting.

This is Attachment A to Task Order No. 131216.28, Consisting of 7 pages

Project Description:

Construct improvements to protect the City’s main lift station and sanitary sewer conveyance system

against damages resulting from future flood events. The improvements include the following:

1. Construct a flood wall/berm around the perimeter of the lift station site providing flood

protection for the lift station, standby generator, two (2) sanitary manholes, and a

transformer on the electrical service for the lift station. The flood wall/berm will be

constructed to provide protection to the 500-year flood elevation. The flood wall/berm is

planned to be constructed of reinforced concrete on the south and east sides of the site and

is planned to be an earthen berm on the west and north sides of the site. The work also

includes modifications to site features such as relocation of the buried electrical service line

to avoid a conflict with the flood wall foundation and relocation of the existing chain link

security fence.

2. Raise the rim elevation to 1-foot above the 100-year flood elevation for all sanitary sewer

manholes located within the floodplain (4 total).

Basic Engineering Services (Lump Sum):

Project Management (All Phases):

1. Provide project management oversight over all facets and phases of the project. Project

management shall include the following services:

a. Coordination of design disciplines including facilitating communication and transfer

of documents between disciplines to minimize errors in the plans and specifications

as well as ensure a timely project design.

b. Provide timely and coordinated communication to and from the Owner for requests

for information, providing progress updates, scheduling meetings, and receiving and

providing feedback.

c. Provide oversight to ensure scope of services and schedule are met.

d. Work with disciplines to identify potential risks and how to mitigate those risks.

e. Review billed hours by design team and prepare invoice statements for Owner.

f. Provide timely and coordinated communication to and from the Contractor for

requests for information and to receive and provide feedback.

Preliminary Design Phase:

1. Project Initiation/Kick-off Meeting – Meet with the Owner to review project goals and

objectives. Review proposed scope of work and collect existing information necessary for

completion of the design.

2. Assist with procuring the services of a geotechnical engineer to conduct a geotechnical

investigation to obtain data on subsurface properties necessary for the design of the flood

protection wall/berm. The services of a geotechnical engineer would be paid for directly by

the City outside of this agreement.

3. Review flood wall access options to allow for at-grade entry/exit while the area is not

flooded. The selected access system shall allow for a quick and easy installation in the event

a flood event is anticipated.

4. Coordinate with Washington County on applicable requirements for any construction within

their Rights of Way.

5. 30% Design:

a. Prepare preliminary plan for the proposed flood wall/berm. It is expected that the

flood wall/berm will be constructed entirely on City property.

b. Prepare preliminary structural details for the flood wall and flood wall access

system.

c. Prepare preliminary details for raising rim elevations for sanitary manholes located

within the floodplain

d. Prepare a 30% plan set to include a title sheet, location map, civil plan sheets,

structural sheets, and details sheets to illustrate the work.

e. Prepare a 30% preliminary opinion of cost for the project.

f. Conduct an internal QA/QC review of the 30% plan set.

Final Design Phase:

1. 60% Design:

a. Revise 30% plan set as necessary following input from Owner, and internal QA/QC.

b. Revise details for the flood protection wall/berm.

c. Revise details for the flood access system.

d. Prepare details for all site modifications including site fencing.

e. Prepare details for the electrical service relocation, as necessary.

f. Revise standard details sheets for installation of the improvements.

g. Prepare a 60% plan set to include the revised sheets from the 30% plan set as well

as additional details created during the 60% design.

h. Conduct an internal QA/QC review of the 60% plan set.

2. 90% Design:

a. Revise 60% plan set as necessary following input from internal QA/QC.

b. Prepare final Specifications, including technical specifications related to the

materials and installation for the improvements.

c. Prepare forms for Contract Documents including the Invitation to Bid used for the

advertisement, Notice of Public Hearing, Bid Form, construction contracts between

Owner and Contractor(s), and necessary payment and performance bonds and

insurance requirements.

d. Incorporate appropriate FEMA/NEMA documents into the bidding documents.

e. Prepare a 90% plan and specification set to include revisions from 60% review and

final specifications.

f. Prepare a 90% engineer’s opinion of probable cost.

g. Conduct an internal QA/QC of the 90% plan and specification set.

h. Conduct a 90% review with the Owner and Owner’s attorney of the plans, opinion of

probable cost, technical specifications, bidding documents, and contract

documents.

3. Design Finalization Process:

a. Revised 90% plan and specification set as necessary following input from Owner,

Owner’s attorney, and internal QA/QC.

b. Prepare a final engineer’s opinion of probable cost.

c. Create final plan and specification set and sign and seal by an engineer registered in

the State of Nebraska.

Bidding and Negotiation Phase:

1. Obtain approval of plans and specifications and authorization to advertise for bids from

Owner and assist Owner with the development of an Invitation to Bid to be placed into

publication.

2. Furnish copies of plans, specifications, and contract documents of the project to prospective

bidders, material suppliers, and other interested parties upon their request upon receipt of

a non-refundable fee to be determined by Engineer.

3. Respond to inquiries from prospective bidders and prepare and issue any addenda required.

4. Assist the Owner at the bid opening consisting of one (1) meeting to ensure proper rules are

followed and adhered to during the process to ensure all requirements of State and Federal

law are fulfilled.

5. Tabulate and analyze construction bids and report on them to the Owner at one (1)

meeting. A written recommendation will be provided by the Engineer, along with any

supporting documentation to advise and assist the Owner in award of a construction

contract.

6. Prepare Contract Documents (Notice of Award, Construction Contract, Notice to Proceed)

for execution by Contractor and the Owner; provide cursory reviews of all insurance and

bonds submittals and present to the Owner’s legal and insurance counsel for approval; then

advise the Owner to proceed with execution of all documents.

7. Provide copies of all executed Contract Documents to the Owner and Contractor(s).

Construction Administration Phase: 1. Schedule and conduct a Pre-construction Conference, on site, consisting of one (1) meeting

prior to construction beginning. This conference (Pre-Con) will review the required

timelines set forth in the specifications, lines of communication, key contacts of those

involved, review any conflicts with utilities or schedules, review the schedule proposed by

the Contractor, review any requirements of the Contractor for locates and staking needs,

etc.

2. Review shop drawings (submittals) and related data supplied by the Contractor. This will

provide the Engineer and Owner the opportunity to review the materials and equipment

that will be supplied for the improvements prior to the Contractor securing and obtaining

them; which allows the Engineer to compare the selected materials and equipment with the

specifications to ensure compliance.

3. Provide interpretation of the plans and specifications, when necessary.

4. Review and process Contractor’s monthly payment applications and change orders (if

necessary) and provide to Owner for review and approval.

5. Schedule and conduct progress meetings on an as needed basis with Owner and Contractor

onsite.

6. Consult with and advise Owner during construction regarding all aspects of the project.

7. Conduct a final inspection of the project with the Contractor and Owner to ensure all

components of the project have been completed and are acceptable to all parties prior to

final payment. A list of items (also known as a Punch List) will be produced for the

Contractor to complete prior to the entire final payment being released.

8. Recommend to the Owner the acceptance of the project and complete the necessary

certificate. This recommendation will be based on the Engineer’s observation of

construction utilizing professional judgment and accepted tests to determine that the

Contractor has completed their contracts in substantial compliance with the plans,

specifications and contract documents.

9. Prepare a report of total project costs, as necessary.

Post Construction Phase:

1. Prepare Record Drawings to illustrate the final location of the water main and pit locations

should there be any modifications.

2. Submit project closeout documentation to FEMA/NEMA.

3. Conduct an 11 month on site review with Owner and contractor if necessary.

Topographic Survey & Construction Staking (Lump Sum):

Design Phase:

1. Complete preliminary field surveys:

a. Establish vertical and horizontal control on the State Plane coordinate system near

the project area(s).

b. Conduct a topographic survey of the lift station site and collect the location and

elevation of all sanitary manholes located within the floodplain.

c. Survey the locations of all physical features within the proposed site locations

(concrete, asphalt, gravel, rock, driveways, sidewalks, trees, utility poles, utility

locates, valves, manholes, signs, drainage structures, water features, terrain

profiles, etc.).

d. Locate the Rights of Way location along County Road 34.

e. Schedule utility location information and incorporate on preliminary plans (gas,

telephone, electric, water, sanitary sewer, communications, etc.).

f. Create an electronic drawing illustrating elevations, site features, and existing

utilities resulting from the surveys performed.

Construction Phase:

1. Provide baseline survey for horizontal and vertical controls for the proposed improvements,

to be referenced by both the Engineer and Contractor during the construction of the

project.

2. Provide construction staking of the proposed improvements; including corners for the

proposed flood protection berm/wall.

Permit Preparation (Lump Sum):

Design Phase:

1. Prepare Rights of Way permit for Washington County as necessary for any work within the

Right of Way. Owner shall be responsible for all applicable review and permitting fees.

2. Prepare Washington County Floodplain Development Permit for improvements located

within the floodplain. Owner shall be responsible for all applicable review and permitting

fees.

3. Prepare Nebraska Department of Environment and Energy (NDEE) construction permit.

Owner shall be responsible for all applicable review and permitting fees.

Post Construction Phase:

1. Prepare Elevation Certificate after construction of the improvements are complete to

validate compliance with local floodplain management ordinances.

2. Submit permit closeout documentation to all permitting agencies as necessary.

1. The Resident Project Representation (RPR) will be provided part-time during the entire

construction phase up to a total of 45 hours.

2. The RPR will assist the Engineer with the following tasks:

a. Review the progress schedules and schedule of values. b. Communicate with the Engineer regarding suggestions and recommendations made

by the Contractor. c. Conduct on-site observations of the Contractor’s work and report their progress to
