• Section 602 of the Oil and Gas Act states, “Except with respect to ordinances adopted pursuant to the Pennsylvania MPC, and… the Flood Plain Management Act, all local ordinanaces and enactments purporting to regulate oil and gas well operations regulated by this act are hereby superseded.”

The Basic Sequence for Facility Siting

1. Preliminary siting decisions by geology, rights, logistics, and purpose

2. Check for floodplains (local officials or http://www.msc.fema.gov)

3. If in floodplain consider moving facility!

4. If no viable alternative follow DCED permitting flowchart (handout)

5. Engage local and state officials

•Usually include detailed survey of hydraulic structures (bridges, culverts, etc.) and cross-sections, often have a floodway analysis performed, and have BFEs determined and shown on the maps.

Floodway:•The channel of a river or other watercourse and the adjacent land areas that must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more than a 1.0‘.

•Usually, this means 0.00’ increase for any proposed development

• Areas of 1% annual chance flood with average depths less than 1 foot or with drainage areas less than 1 square mile

DFIRM BASICS• Zone X (shaded): Areas of 0.2% annual chance flood (500-yr); areas of 1%

annual chance flood with average depths less than 1 foot or with drainage areas less than 1 square mile; and areas protected by levees from the 1% annual chance flood

• Zone X (unshaded): Areas determined to be outside the 0.2% chance floodplain

• Zone AH: Flood Depths of 1-3 feet (usually areas of ponding)

• Zone AO: Flood Depths of 1-3 feet (usually sheet flow on sloping terrain)

• Zone AR: Area of special flood hazard formerly protected from the 1% annual chance flood event by a flood control system (levee, etc.) that was subsequently decertified. Indicates that the former flood control system is being restored to provide protection from the 1% annual chance or greater flood.

• Zone A99: Area to be protected from the 1% annual chance flood event by a Federal flood protection system under construction; no BFEs determined
