Foreword The Making Home Affordable (MHA) Servicer Reporting Requirements document is intended to provide servicers with a consolidated resource containing reporting guidance that supports the following aspects of the MHA Program:

NOTE: The reporting guidance contained herein is applicable to mortgage loans not owned by Fannie Mae and Freddie Mac (non-GSE loans). Furthermore, this reporting guidance is applicable to loans that are owned or guaranteed by Fannie Mae or Freddie Mac (GSE loans) to the extent the relevant guidance issued by Fannie Mae or Freddie Mac so requires. Accordingly, to the extent Fannie Mae or Freddie Mac is not participating in an MHA Program or an aspect of an MHA Program, the reporting guidance contained herein should be read accordingly. The MHA Servicer Reporting Requirements document will be updated periodically with new terms, policies and/or procedural changes as they are announced. Business Definitions

HAMP Reporting System: The technology application that processes loan modification data from participating HAMP servicers.

The HAMP Reporting Tool: The Web application where participating HAMP servicers submit loan modification data and view reports.

1. Home Affordable Modification Program (HAMP) Reporting Requirements

Introduction The Home Affordable Modification Program (HAMP) is designed to assist borrowers to avoid foreclosure by restructuring their mortgages

Servicer Registration Servicers are required to register to participate in HAMP using the HAMP registration form. Once the servicer is registered, the servicer will be allowed to modify both government-sponsored enterprise (GSE) and non-GSE first lien mortgage loans under GSE-HAMP or MHA-HAMP, respectively.

Servicers are also required to register with Lender Processing Services, Inc. (LPS) to have the ability to report periodic loan level data via the HAMP Reporting Tool. A first time user of the HAMP Reporting Tool should contact LPS at 1-866-939-4469 and select option 1, and then option 5 to register.

Cap Allocation Monitoring For a non-GSE servicer, the HAMP trial period loan setup will be rejected when submitted by an active non-GSE servicer that reaches its Program Participation Cap with the following error message: The transaction cannot be processed because the cap allocation for the HAMP Registration Number associated with the Servicer Number has been reached.

Reporting Servicers are required to report periodic loan-level data for all transactions related to HAMP using the HAMP Reporting Tool. HAMP has the following transaction types:

Servicers are able to submit these transactions through the file upload tab, as described in the Upload Files section of this document, or through user interface (UI) forms found in the HAMP Reporting Tool.

To access the HAMP Reporting Tool:

1. Log in to HMPadmin.com.

2. Click the HAMP Loan Reporting Tools & Documents link.

3. Select the HAMP Reporting Tool.

4. Enter the login name and password assigned to you after registering for the tool.

The home page has a list of tabs across the top of the HAMP Reporting Tool. The HAMP tab provides a drop-down menu of the required transaction forms for data reporting.

Trial Setup

Servicers must report the trial period loan setup data and the first trial period payment no later than the fourth business day of the month immediately following the trial period plan (TPP) effective date. The TPP effective date is determined based on when the TPP is sent to the borrower. If the TPP is transmitted to the borrower on or before the 15th of the month, the servicer should use the first day of the next month as the TPP effective date. If the TPP is transmitted to the borrower after the 15th of the month, the servicer may use either: (i) the first day of the month after next month as the TPP effective date; or (ii) the first day of the next month so long as the borrower consents to commencing the TPP earlier.

Scenario 1: Servicer sends the borrower’s TPP on May 10th. The servicer should use June 1st as the TPP effective date and must report the trial period loan setup data and the first trial period payment on or before the fourth business day of July.

Scenario 2A: Servicer sends the borrower’s TPP on May 20th. The servicer may use June 1st as the TPP effective date and must report the trial period loan setup data and the first trial period payment on or before the fourth business day of July.

Scenario 2B: Servicer sends the borrower’s TPP on May 20th. The servicer may use July 1st as the TPP effective date and must report the trial period loan setup data and the first trial period payment on or before the fourth business day of August.

NOTE: In scenario 2B, the borrower is required to make the contractual payment due in June in order to maintain their current (HMP7) status.

Borrowers in an active Chapter 13 bankruptcy who are determined to be eligible for HAMP may be converted to an official modification without completing a trial period as long as the borrower has been making payments in a bankruptcy plan for at least three months. Servicers must report a Trial Plan Type Code to indicate whether the loan will be modified as a standard HAMP TPP or a bankruptcy plan in lieu of a HAMP trial period. The allowable values include:

1 – Standard Trial

2 – Chapter 13 Bankruptcy

To report data at the start of a trial period:

1. Select the Trial Setup option from the HAMP drop-down menu.

2. Complete all the required fields, which are denoted by a red border.

3. Click Add Activity to submit the data.

Servicers can make corrections to the trial period loan setup record. Servicers need to resubmit complete loan setup data using the Submission Status = 1 – Trial. Corrections can be made at any time during the month.

Servicers can cancel a Trial Modification by submitting a loan setup record using Submission Status = 5 – Trial Cancellation. Trial Cancellations can be made at any time during the month.

NOTE: For a full set of Trial Set Up data attributes, their definitions, and the conditions under which each is required, refer to the HAMP Data Dictionary. (This file includes any new edits or changes due to release implementations.)

Trial Period Activity

Servicers are required to report payment activity during the HAMP trial period to substantiate the receipt of proceeds during the trial period. While the first trial period payment is reported at trial setup, servicers must report remaining trial payments no later than the fourth business day of the month following each trial period month.

NOTE: Trial Period Activity data cannot be reported if the Trial Plan Type Code is Chapter 13 Bankruptcy reported at Trial Setup.

To report trial period payments:

1. Select the Trial Period Activity option from the HAMP drop-down menu.

2. Complete all the required fields, which are denoted by a red border.

3. Click Add Activity to submit the data

When entering data, the following should be considered:

The Trial Payment Number must be greater than or equal to 2.

The Trial Payment Amount must be entered and must be greater than or equal to $0.

Official Modification

At the end of the trial period, if the borrower has satisfied the conditions for conversion from a trial period modification to an official modification, servicers must report the official loan setup data to establish the official

modification. This information must be reported no later than the fourth business day of the month in which the official modification is effective. The official modification effective date is the first day of the month following the month when the last trial period payment is due. However, if the borrower does not pay the final trial period payment by its due date but does pay it by the end of the final trial period month, the servicer may elect to establish as the modification effective date the first day of the second month following the final trial period month. The Modification Effective Date and the First Payment Due Date under the modified terms must be the same date. For example, if the official modification date is May 1st, then the first payment due date is also May 1st.

To report loan setup data for an Official HAMP Modification:

1. Select the Official Modification option from the HAMP drop-down menu.

2. Complete all the required fields, which are denoted by a red border.

3. Click Add Activity to submit the data.

Servicers can make corrections to the official modification loan setup data. Servicers need to resubmit complete loan setup data using the Submission Status = 6 – Official Correction. Corrections can be made during the first four business days of the month.

Servicers can cancel an official modification by submitting a loan setup record using Submission Status = 7 – Official Cancellation. Official cancellations can only be reported during the first four business days of the reporting cycle.

Servicers can report a bankruptcy plan in lieu of a HAMP trial period by selecting Trial Plan Type Code = 2 – Chapter 13 Bankruptcy.

Loan Activity

The Official Monthly Report (OMR) is used to report monthly payments. Reporting begins the first month after the official modification is effective. For example, if the official Modification Effective Date is May 1st, an OMR is due by June 4 for May activity, since the OMR is due by the fourth business day of each month. Servicers have until two business days prior to the monthly close to clear up any edits and have the final OMR reported to the HAMP Reporting Tool. The monthly close is on the 17th calendar day of each month or the first business day prior to the 17th, if the 17th of a particular month falls on a weekend or a holiday. Monthly reporting of the OMR directly affects borrower, servicer, and investor incentives. Servicers should ensure the accuracy of all data reported through OMRs. OMRs are due even if a payment was not received.

To report loan payments after the official modification:

Home Affordable Unemployment Program (UP) The Home Affordable Unemployment Program (UP) is a supplemental program to HAMP that provides assistance to qualified unemployed borrowers by granting a forbearance period which reduces or suspends their monthly mortgage payments. There is no additional registration required to participate in UP. UP is part of the First Lien Trial and Official Loan Setup transactions; therefore, loan-level data must be reported no later than the fourth business day of the month.

If an investor is participating in UP and such investor’s borrower is transitioning from UP to a HAMP trial period plan, the applicable servicer must choose between two Forbearance Plan Type Codes:

Principal Reduction Alternative (PRA) For non-GSE loans, servicers may be given additional flexibility to offer relief to borrowers whose homes are worth significantly less than the remaining amounts owed under their first lien mortgage loans. A servicer is required under applicable guidelines to evaluate the benefit of principal reduction for every HAMP-eligible loan with high negative equity.

PRA is part of the First Lien Trial and Official Loan Setup transactions; therefore loan-level data must be reported no later than the fourth business day of the month. There is no additional registration required to participate in PRA.

The Principal Reduction Alternative Code in the Trial Setup and Official Modification section of the HAMP Reporting Tool is a mandatory data attribute for non-GSE loans. If a servicer is required under applicable guidelines to offer PRA, such servicer must choose between options 2 and 3 below; otherwise option 1 signifies PRA was not offered.

The Housing Finance Agency Innovation Fund for the Hardest-Hit Housing Markets (HHF) The HHF includes funding for several states that have been hit the hardest by the housing crisis and economic downturn.

To indicate a borrower’s receipt of funds under the HHF program, servicers must include the Supplementary Assistance Code as part of the HAMP First Lien Trial and Official Loan Setup transactions. This loan-level data must be reported no later than the fourth business day of the month.

The Supplementary Assistance Code is a mandatory data attribute. The allowable values include:

Federally Declared Disaster (FDD) Guidance The FDD guidance in the MHA Handbook provides servicers of non-GSE loans with parameters for dealing with borrowers affected by a federally declared disaster. There is no additional registration required for non-GSE servicers following the FDD guidance. Implementation of the FDD guidance is part of the First Lien Trial and Official Loan Setup transactions; therefore, loan-level data must be reported no later than the fourth business day of the month.

To report an FDD forbearance plan, non-GSE servicers should select the Forbearance Plan Type Code - 2 Federally Declared Disaster. When a borrower qualifies for and participates in both an UP Forbearance Plan and a FDD Forbearance plan, the non-GSE servicer should select Forbearance Plan Type Code – 3 Unemployment and Federally Declared Disaster.

Reporting Transfer

A reporting transfer involves the reassignment of the servicing rights for a loan from one servicer to another. To initiate a reporting transfer for a HAMP trial or official modification, the servicer (transferor) must submit the required HAMP Reporting Transfers paperwork to the address provided. The HAMP Reporting Transfer paperwork is available on HMPadmin.com within the Servicer Documents section of the HAMP Programs menu.

The MHA Program Administrator will validate the reporting transfer request for completeness and, in the case of a non-GSE servicer, adjust the servicer’s cap allocation accordingly. Loans in trial or official modification will be processed by a HAMP Operations Analyst. The servicer will be notified once the transfer is completed.

Upload Files

Servicers can upload a file that contains multiple loans for each of the HAMP transaction types by using the Upload Files tab available in the HAMP Reporting Tool. The Upload Files functionality is especially recommended for large servicers that have high volumes of first lien loans.

Servicers can submit files in a compressed (ZIP) or uncompressed (XML or CSV) format. Compressed (ZIP) files, which may contain multiple files, should contain XML or pipe-delimited CSV files only. The file size must not exceed the 5MB size limit. The number of loans that can be contained in a 5MB file are:

The HAMP Reporting Tool validates each file, based on the LFN Number, to determine that the LFN Number in the file name matches the Submission Status. The validation will occur at the same level as the current Business Rule validation, which is at the loan level. If the Submission Status code and the Program Type provided do not match a valid value for the LFN file number uploaded, the loan will receive an error in the HAMP Reporting Tool response file report. The loan will not be transmitted to the HAMP Reporting System for processing. The loans that pass validation will continue to be processed.

File Structure Validation

HAMP loan-level transactions submitted via the UI or by uploading a file to the HAMP Reporting Tool will be validated for structure. If any data attribute within a file fails structural validation, then the entire file will be rejected and a structural validation error message will be provided. If the loan-level transactions pass the structural validation, the HAMP Reporting Tool will validate the transactions against a suite of business edits. Loan records that fail business rules validation will be rejected, and a business rule error message will be provided in the response file report.

Loan records that pass business rules validation will be transmitted to the HAMP Reporting System for processing. The HAMP Reporting System will edit and validate the input XML file. Edit warnings and failures

The Files Received report is composed of transactions submitted via the Upload Files functionality. This report provides a transaction processing status from both the HAMP Reporting Tool and the HAMP Reporting System for each submitted transaction, and includes a description of any warning or error messages (if applicable) that occurred for each individual transaction in the file. Transactions with errors must be corrected and resubmitted for processing to continue.

To access the Files Received report:

Web Data Submissions

The Web Data Submissions report lists the transactions that the servicer submitted via the Web forms submissions (manual entry). The report provides a transaction processing status from the HAMP Reporting System for each submitted transaction and includes a description of any warning or error messages that occurred for each individual transaction in the file. Transactions with errors must be corrected and resubmitted for processing to continue.

At 30 minute intervals, any transaction successfully entered via the Web site forms are bundled together and sent to the HAMP Reporting System for processing.

HAMP Incentive Payments

Servicers, borrowers and investors are eligible for incentive payments for official loan modifications in HAMP.

The HAMP Compensation Matrix provides details on the incentive amount, frequency, timing and conditions required. After the initial one-time set-up payments have been disbursed, servicers must submit an OMR on a monthly basis to ensure timely subsidy payments and accruals to the investor, borrower and servicer.

Program incentives are deposited on the 27th calendar day of each month or previous business day if the 27th falls on a weekend or a holiday in a particular month. The deposit is transferred via the Automated Clearing House (ACH) Network. Servicers must provide ACH banking instructions in Section 3 of the HAMP registration form for the account that will be used as the default account for the receipt of payments. Servicers are allowed to designate three additional accounts in Section 4 of the HAMP registration form to receive payments.

The HAMP Master Servicer Loan Reconciliation report provides trial loan setup, official modification loan setup and monthly accrual information. The report is available on the fourth business day after the monthly close of each reporting cycle and for the following 180 calendar days. The monthly close is the 17th calendar day or the previous business day prior to the 17th, if the 17th falls on a weekend or holiday. This reconciliation data is posted four business days after the end of a loan cycle (the 17th calendar day of the month) and is available for 180 calendar days, thereafter. Reports are differentiated with a Program Type.

2. Home Affordable Foreclosure Alternatives (HAFA) Reporting Requirements

Introduction The Home Affordable Foreclosure Alternatives (HAFA) Program provides foreclosure options to borrowers who may have:

met the eligibility criteria for HAMP but did not qualify for a HAMP trial period plan (TPP);

failed to complete a HAMP TPP;

missed at least two consecutive payments on an official modification; or

requested a short sale agreement (SSA) or a deed-in-lieu agreement (DIL).

Servicer Registration To participate in HAFA, a servicer must be registered as a HAMP-participating servicer using the HAMP registration form.

Servicers participating in HAFA are also required to register with Lender Processing Services, Inc. (LPS) to have the ability to report scheduled loan-level data via the HAMP Reporting Tool. A first time user of the HAMP Reporting Tool should contact LPS at 1-866-939-4469 and select option 1, and then option 5 to register.

Cap Allocation Monitoring If a HAFA transaction causes a non-GSE servicer to exceed its Program Participation Cap, the system shall reject the transaction with the following error message: The transaction cannot be processed because the cap allocation for the HAMP Registration Number associated with the Servicer Number has been reached.

Reporting Servicers participating in HAFA are required to report loan-level data to the HAMP Reporting Tool at key milestones. Each milestone is a separate data transmission and is listed as the following:

Notification – the SSA or a DIL is signed and executed by both servicer and borrower;

Short Sale/Deed-in-Lieu Loan Setup – the transfer of property ownership (closing of the SSA or acceptance of the DIL) is complete; and

Cancellation – when the SSA or DIL agreement expires or is terminated by the servicer.

Servicers will be able to submit these transactions through file upload, as described in the Upload Files section of this document, or through the user interface (UI) forms found in the HAMP Reporting Tool.

Short Sale/Deed-in-Lieu Notification

Servicers participating in HAFA must report notification loan-level data on or before the fourth business day of the month after a borrower and servicer have fully executed a signed agreement for an SSA or DIL. A HAFA notification must be submitted before a HAFA loan setup transaction can be processed. Servicers participating in HAFA must cancel an existing HAFA notification and resubmit a HAFA notification if the agreement termination date is exceeded and a new agreement has been signed. The new notification should be submitted using the original Agreement Issue Date and the new Agreement Expiration Date.

To process a HAFA notification, the servicer participating in HAFA must have either evaluated the borrower for HAMP or given the borrower the opportunity to be evaluated for HAMP. Therefore, one of the following corresponding records (matched by HAMP Registration Number, HAMP Servicer Number and Servicer Loan Number) must exist in the HAMP Reporting Tool:

A corresponding HAMP Additional Data Requirements data submission with an acceptable Trial Not Approved/Not Accepted Reason Code*;

A first lien TPP record that falls out of trial with an acceptable Trial Fallout Reason Code**; or

A first lien official modification that has not been paid off.

HAFA Cancellation

Servicers participating in HAFA must report a HAFA Cancellation loan-level data on or before the fourth business day of the month after the SSA or the DIL expires or when the SSA or DIL Agreement is terminated by the servicer.

A cancellation submission without a Cancellation Reason Code will not be accepted.

For an SSA or DIL cancellation, the servicer participating in HAFA should choose from one of the following Short Sale or Deed-in-Lieu Cancellation Reason Codes:

Agreement Expiration is used if the date specified in the “Termination of This Agreement” has been exceeded.

Agreement Termination is used for the other conditions listed in the “Termination of This Agreement” section.

Notification Cancellation is used when a notification setup was submitted in error; for HAMP Administrator purposes.

Servicing Transfer of a HAMP Loan is used to cancel a HAFA notification if the loan is being transferred to a new servicer. This cancellation is not used if the loan has already closed as an SSA or DIL and the loan setup has already been processed.

Pay Off of HAMP Loan is used if the first lien HAMP loan had been paid off due to other reasons not related to HAFA and prior to completion of an SSA or DIL.

For a Short Sale or Deed-in-Lieu Loan Setup cancellation, the servicer participating in HAFA should choose from one of the following Short Sale or Deed-in-Lieu Cancellation Reason Codes:

Loan Setup Cancellations used when a loan setup was submitted in error; for HAMP Administrator purposes.

Other is used only for HAMP Administrator purposes.

To report a HAFA cancellation:

1. Select the Cancellation option from the HAFA drop-down menu. The Submission Status must is set to Deed-in-Lieu Loan Setup.

2. Complete all the required fields, which are denoted by a red border. HAFA will utilize the same Active Program selection of First Lien.

The Housing Finance Agency Innovation Fund for the Hardest-Hit Housing Markets (HHF) The HHF currently includes funding for several states that have been hit the hardest by the housing crisis and economic downturn.

To indicate a borrower’s receipt of funds under the HHF program, servicers must include the Supplementary Assistance Code as part of the HAFA Notification and HAFA Loan Setup transactions. This loan-level data must be reported no later than the fourth business day of the month

The Supplementary Assistance Code is a mandatory data attribute that indicates if the borrower has received HHF. The allowable values include:

Reporting Transfer

If a servicing transfer occurs after an SSA or DIL has been executed and a HAFA notification reported for the associated loan, the existing HAFA notification must be cancelled and a new HAFA notification must be reported upon the transfer of servicing to the new servicer

Upload Files

Servicers can upload a file that contains multiple loans for each of the HAFA transaction types by using the Upload Files tab available in the HAMP Reporting Tool. The Upload Files functionality is especially recommended for large servicers that have high volumes of HAFA loans. HAFA file formats are available to assist servicers and can be found in the HAMP Loan Reporting Tools & Documents section of HMPadmin.com (login required).

The HAMP Reporting Tool validates each file, based on the LFN File Number, to determine that the LFN File Number in the file name matches the Submission Status. This validation occurs at the loan level, which is the same level as current Business Rule validation. When the Submission Status code and the Program Type provided do not match a valid value for the LFN File Number upload, the loan will receive an error in the HAMP Reporting Tool response file report. The loan will not be transmitted to the HAMP Reporting System for processing. The loans that pass validation will continue to be processed. See below for the validation criteria:

Short Sale Notification (LFN0900)

Servicers can submit a Short Sale Notification for a loan in the HAFA program (Program Type = HMP5 – Short Sale) using the HAFA XML with a Short Sale or Deed-in-Lieu Notification Submission (Submission Status = 8).

Deed-in-Lieu Notification (LFN0901)

Servicers can submit a Deed-in-Lieu Notification for a loan in the HAFA program (Program Type = HMP3 – Deed-in-Lieu) using the HAFA XML with a Short Sale or Deed-in-Lieu Notification Submission (Submission Status = 8).

Short Sale Loan Setup (LFN0902)

Servicers should submit the Short Sale Loan Setup using the HAFA XML with a Submission Status of 9 for Short Sale Loan Setup. The Program Type must be HMP5 – Short Sale to match the Submission Status for the transaction.

Deed-in-Lieu Loan Setup (LFN0903)

Servicers should submit the Deed-in-Lieu Loan Setup using the HAFA XML with a Submission Status of 10 for Deed-in-Lieu Loan Setup. The Program Type must be HMP3 – Deed-in-Lieu to match the Submission Status for the transaction.

Cancellation (LFN0905)

Servicers can submit a HAFA cancellation of existing HAFA notifications or HAFA loan setups using the HAFA Cancellation XML with a Submission Status of 11 and a Cancellation Reason code.

File Structure Validation

HAFA loan-level transactions submitted via the UI or by uploading a file to the HAMP Reporting Tool will be validated for structure. If any data attribute within a file fails structural validation, then the entire file will be rejected and a structural validation error message will be provided. If the loan-level transactions pass the structural validation, the HAMP Reporting Tool will validate the transactions against a suite of business edits. Loan records that fail business rules validation will be rejected, and a business rule error message will be provided in the response file report. Loan records that pass business rules validation will be transmitted to the HAMP Reporting System for processing. The HAMP Reporting System will edit and validate the input XML file. Edit warnings and failures will generate an XML response file that servicers can view and download from the Reports tab within the HAMP Reporting Tool.

Servicers will have the ability to view and download the response files reports via the Reports tab within the HAMP Reporting Tool.

Web Data Submissions

The Web Data Submissions report lists the transactions that the servicer submitted via the Web forms submissions (manual entry). The report provides a transaction processing status from the HAMP Reporting System for each submitted transaction and includes a description of any warning or error messages that occurred for each individual transaction in the file. Transactions with errors must be corrected and resubmitted for processing to continue.

At 30 minute intervals, any transaction successfully entered via the Web site forms are bundled together and sent to the HAMP Reporting System for processing.

HAFA Incentive Payments

Servicers, borrowers, and investors are eligible for incentive payments upon successful completion of an SSA or DIL in the HAFA program.

The HAMP Compensation Matrix provides details on the incentive amount, frequency, timing and conditions required.

Program incentives are deposited on the 27th calendar day of each month or previous business day if the 27th falls on a weekend or a holiday in a particular month. The deposit is transferred via the Automated Clearing House (ACH) Network. Servicers must provide ACH banking instructions in Section 3 of the HAMP registration form that will be used as the default account for the receipt of payments. Servicers are allowed to designate three additional accounts in Section 4 of the HAMP registration form to separate designated accounts for servicer, investor and borrower.

Viewing Reports

There are two reports currently available to the servicers for HAFA. Both are accessible through the HAMP Reporting Tool.

First Lien Cash Payment Summary

The First Lien Cash Payment Summary report provides loan-level compensation payment data for each reporting cycle. This report is available beginning the day before payments are deposited and 180 calendar days following the deposit.

An Incentive Type code will allow servicers to identify the program for which the incentive payment was made. There will be one row per loan per program incentive.

To view and download the Cash Payment Summary report: 1. Log in to the HAMP Reporting Tool.

3. Second Lien Modification Program (2MP) Reporting Requirements

Introduction The Second Lien Modification Program (2MP) seeks to lower payments on second lien mortgage loans. Under 2MP, when a borrower’s first lien is modified under HAMP, a participating 2MP servicer must offer to modify the borrower’s second lien by:

Modifying the borrower’s second lien mortgage;

Accepting a lump sum payment from Treasury in exchange for full extinguishment of the second lien; or

Accepting a lump sum payment from Treasury in exchange for a partial extinguishment and modify the remaining borrower’s second lien.

Servicer Registration Servicer participation in 2MP is optional; such servicers do not need to be the servicer of the related HAMP modified first lien loan or already be a participant in HAMP in order to participate in 2MP.

To participate in 2MP, servicers are required to execute a 2MP registration form.

NOTE: For a list of registration data attributes and their definitions, refer to the section entitled, “Second Lien – Registration Form” in the 2MP Data Dictionary.

Servicers are also required to register with Lender Processing Services, Inc. (LPS) to have the ability to submit 2MP-related transactions via the HAMP Reporting Tool and provide LPS with second lien loan data. LPS will notify the 2MP participating servicer if they identify a second lien match to a first lien modified under HAMP. A first time user of the HAMP Reporting Tool should contact LPS at 1-866-939-4469 and select option 1 and then option 5 to register.

Cap Allocation Monitoring If a 2MP transaction causes a non-GSE servicer to exceed its Program Participation Cap, the system shall reject the transaction with the following error message: The transaction cannot be processed because the cap allocation for the HAMP Registration Number associated with the servicer Number has been reached.

Reporting To enter 2MP-related transactions, the servicer must have a unique 2MP HAMP Servicer Number. As a result, servicers participating only in 2MP will receive both a HAMP Servicer Number and a HAMP Registration Number; existing HAMP first mortgage servicers will only receive a new 2MP HAMP Servicer Number.

Depending upon circumstances, a 2MP trial period is not required if the borrower is current on the existing second lien and the current contractual payment amount is equal to or greater than the monthly payment that will be due following the 2MP modification (unless a trial period is necessary to comply with applicable contractual obligations). Servicers cannot report a 2MP trial period setup and payment to the HAMP Reporting Tool.

Servicers participating in 2MP program are required to report scheduled loan-level 2MP-related transactions using the HAMP Reporting Tool for:

2MP official modifications

2MP partial extinguishment

2MP full extinguishment

Monthly activity reports (2OMR)

2MP cancellations

Servicers are able to submit these transactions through the file upload tab, as described in the Upload Files section of this document, or through user interface (UI) forms found in the HAMP Reporting Tool.

Servicers must report a 2MP official modification transaction no later than the fourth business day of the month in which the 2MP modification is effective. To modify a second lien, the servicer must follow a defined protocol

established by the applicable GSE, for GSE loans, or as explained in the MHA Handbook for non-GSE loans. As of June 3, 2010, for non-GSE loans, the calculations for 2MP forbearance and forgiveness have changed:

1. The forbearance percentage of the 2MP loan must not exceed the total of the first lien forbearance percentage plus the first lien forgiveness percentage if modification or extinguishment effective date is before June 3, 2010.

2. The 2MP forgiveness percentage must be greater than or equal to the first lien forgiveness percentage if modification or extinguishment effective date is on or after June 3, 2010.

3. The sum of the 2MP forbearance and forgiveness percentages must be greater than or equal to the first lien forgiveness and forbearance percentages.

Example 1:

First Lien Forbearance = 6%

First Lien Forgiveness = 4%

2MP Forbearance = 10%

2MP Forgiveness = 0%

NOTE: While the information provided in Example 1 shows that this scenario is allowed, a 2MP non-GSE loan with an official modification or extinguishment effective date on or after June 3, 2010 negates this because 2MP forgiveness percentages must be the same or greater than the first lien forgiveness.

Example 2:

First Lien Forbearance = 6%

First Lien Forgiveness = 4%

2MP Forbearance = 0%

2MP Forgiveness = 10%

NOTE: For a 2MP non-GSE loan with an official modification or extinguishment effective date on or after June 3, 2010, the sum of the 2MP forbearance and forgiveness percentages must be greater than or equal to the first lien forgiveness and forbearance percentages.

2MP Partial Extinguishment

A 2MP partial extinguishment allows servicers to extinguish a portion of the borrower’s second lien while modifying the balance under the terms and conditions of the 2MP official modification program. Servicers must report a 2MP partial extinguishment no later than the fourth business day of the month in which the second lien partial extinguishment is effective.

To report a 2MP partial extinguishment transaction:

1. Select the Partial Extinguishment option from the 2MP drop-down menu. The Program Type/Campaign ID defaults to HMP11 - Second Lien Partial Extinguishment. The Submission Status defaults to Partial Extinguishment.

2MP Full Extinguishment

As an alternative to modifying an eligible second lien, a servicer participating in 2MP may elect to fully extinguish a second lien. Servicers must report a 2MP full extinguishment no later than the fourth business day of the month in which the second lien extinguishment is effective.

To report a 2MP full extinguishment transaction:

1. Select the Extinguishment option from the 2MP drop-down menu. The Program Type/Campaign ID defaults to HMP10 - Extinguishment. The Submission Status defaults to Extinguishment.

2. Complete all the required fields, which are denoted by a red border.

3. Click Add Activity to submit the data.

2MP Official Monthly Reporting (2OMR)

With respect to each 2MP loan with an official modification, servicers participating in 2MP are required to provide a monthly activity report known as 2OMR to report monthly payments. Reporting begins the first month after the 2MP official modification is effective. For example, if the modification effective date is May 1st, a 2OMR is due in June for May activity. Servicers must report a 2OMR no later than the fourth business day of every month in which the second lien partial extinguishment is effective. Servicers have until two business days prior to the monthly close to resolve any edits and have the final 2OMR reported to the HAMP Reporting Tool. The monthly close is on the 17th calendar day of each month or the first business day prior to the 17th, if the 17th of a particular month falls on a weekend or a holiday. Monthly reporting of the 2OMR directly affects borrower, servicer, and investor incentives. Servicers should ensure the accuracy of all data reported through 2OMRs. 2OMRs are due even if a payment is not received.

If a 2MP official modification loses good standing the servicer participating in 2MP must continue to send 2OMRs so that the system can pay the investor subsidy, if appropriate.

To report a 2OMR:

1. Select the Official Monthly Reporting option from the 2MP drop-down menu.

2. Complete all the required fields, which are denoted by a red border.

3. Click Add Activity to submit the data.

2MP Cancellations

Servicers participating in 2MP will have the ability to cancel a second lien loan under a 2MP official modification; a 2MP partial extinguishment; or a 2MP full extinguishment. The submission status on the cancellation transaction must correspond to the original submission status of the loan, i.e., an official cancellation can only cancel an official modification; a full extinguishment cancellation can only cancel a full extinguishment modification and a partial extinguishment cancellation can only cancel a partial extinguishment modification.

To report 2MP cancellations:

1. Select the Cancel option from the 2MP drop-down menu.

2. Complete all the required fields, which are denoted by a red border.

Reporting Transfer

A reporting transfer involves the reassignment of the servicing rights for a loan from one servicer to another. To initiate a reporting transfer to a 2MP official modification, the servicer participating in 2MP (transferor) must submit the required HAMP Reporting Transfers paperwork to the address provided. The HAMP Reporting Transfers paperwork is available on HMPadmin.com within the Servicer Documents section of the HAMP Programs menu.

Once approved, the servicer (transferor) will perform a 2MP cancellation to the existing 2MP official modification. The new servicer (transferee) is responsible to resubmit a 2MP official modification loan setup transaction. Even though 2MP trials are not reported, 2MP trials for non-GSE loans should be included in the reporting transfer paperwork for Program Participation Cap allocation monitoring purposes.

Upload Files

Servicers can upload a file that contains multiple loans for each of the 2MP transaction types by using the Upload Files tab available in the HAMP Reporting Tool. The Upload Files functionality is especially recommended for large servicers that have high volumes of 2MP loans. 2MP file formats are available to assist servicers and can be found in the HAMP Loan Reporting Tools & Documents area of HMPadmin.com (login required).

Servicers can submit files in a compressed (ZIP) or uncompressed (XML or CSV) format. Compressed (ZIP) files, which may contain multiple files, should contain XML or pipe-delimited CSV files only. The file size must not exceed the 5MB size limit. The maximum number of loans that can be contained in a 5MB file are:

The HAMP Reporting Tool validates each file, based on the LFN Number, to determine that the LFN Number in the file name matches the Submission Status. The validation will occur at the same level as current Business Rule validation, which is at the loan level. When the Submission Status code and the Program Type provided do not match a valid value for the LFN file number uploaded, the loan will receive an error in the HAMP Reporting Tool response file report. The loan will not be transmitted to the HAMP Reporting System for processing. The loans that pass validation will continue to be processed.

File Structure Validation

2MP loan-level transactions submitted via the UI or by uploading a file to the HAMP Reporting Tool will be validated for structure. If any data attribute within a file fails structural validation, then the entire file will be rejected and a structural validation error message will be provided. If the loan-level transactions pass the schema validation, the HAMP Reporting Tool will validate the transactions against a suite of business edits. Loan records that fail business rules validation will be rejected, and a business rule error message will be provided in the response file report. Loan records that pass business rules validation will be transmitted to the HAMP Reporting System for processing. The HAMP Reporting System will edit and validate the input XML file. Edit warnings and failures will generate an XML response file that servicers can view and download from the Reports tab within the HAMP Reporting Tool.

Servicers will have the ability to view and download the HAMP Reporting Tool and the HAMP Reporting System response file reports via the Reports tab within the HAMP Reporting Tool.

Web Data Submissions

The Web Data Submissions report lists the transactions that the servicer submitted via the Web forms submissions (manual entry). The report provides a transaction processing status from Fannie Mae for each submitted transaction and includes a description of any warning or error messages that occurred for each individual transaction in the file. Transactions with errors must be corrected and resubmitted for processing to continue.

At 30 minute intervals, any transaction successfully entered via the Web site forms are bundled together and sent to Fannie Mae for processing.

2MP Incentive Payments

For second lien loans amended under 2MP, servicers, borrowers and investors are eligible for incentive payments in 2MP.

The HAMP Compensation Matrix provides details on the incentive amount, frequency, timing and conditions required. After the initial one-time set-up payments have been disbursed, servicers must submit a 2OMR on a monthly basis to ensure timely subsidy payments and accruals to the investor, borrower and servicer.

Program incentives are deposited on the 27th calendar day of each month or the previous business day if the 27th falls on a weekend or a holiday in a particular month. The deposit is transferred via the Automated Clearing House (ACH) Network. Servicers must provide ACH banking instructions in Section 3 of the HAMP registration form for the account that will be used as the default account for the receipt of payments. Servicers are allowed to select three additional accounts in Section 4 of the HAMP registration form to receive payments to separate, designated accounts for servicer, investor and borrower.

4. Treasury Federal Housing Administration – Home Affordable Modification Program (FHA-HAMP) Reporting Requirements

Introduction Treasury FHA-HAMP provides additional assistance to borrowers with FHA-insured loans who are unable to meet their monthly mortgage payment obligation.

Servicer Registration Servicers are required to register to participate in the Treasury FHA-HAMP using the Treasury FHA-HAMP registration form. Once the servicer officially becomes a Treasury FHA-HAMP-participating servicer, the servicer will be allowed to modify non-GSE FHA mortgage loans.

Servicers are also required to register with Lender Processing Services, Inc. (LPS) to have the ability to report periodic loan level data via the HAMP Reporting Tool. A first time user of the HAMP Reporting Tool should contact LPS at 1-866-939-4469 and select option 1, and then option 5 to register.

Cap Allocation Monitoring A Treasury FHA-HAMP trial period loan setup will be rejected when submitted by an a non-GSE servicer that reaches its Program Participation Cap with the following error message: The transaction cannot be processed because the cap allocation for the HAMP Registration Number associated with the Servicer Number has been reached.

Reporting The following reporting guidance regarding FHA-HAMP applies to non-GSE loans only.

Servicers participating in the Treasury FHA-HAMP are required to report periodic loan level data for all transactions related to the Treasury FHA-HAMP using the HAMP Reporting Tool. The Treasury FHA-HAMP program has the following transaction types:

FHA Trial Period Activity

Servicers will be required to report payment activity during the Treasury FHA-HAMP trial period to substantiate the receipt of proceeds during the trial modification period and to record modification details. Trial period payments/activities must be reported by the fourth business day of the month following each trial period month.

To report trial period payments (other than the first trial period payment):

1. Select the FHA Trial Period Activity option from the FHA drop-down menu.

2. Complete all the required fields, which are denoted by a red border.

3. Click Add Activity to submit the data.

The Housing Finance Agency Innovation Fund for the Hardest-Hit Housing Markets (HHF) The HHF currently includes funding for several states that have been hit the hardest by the housing crisis and economic downturn.

To indicate a borrower’s receipt of funds under HHF, servicers must include the Supplementary Assistance Code as part of the Treasury FHA-HAMP Trial and Official Loan Setup transactions. This loan-level data must be reported no later than the fourth business day of the month

The Supplementary Assistance Code is a mandatory data attribute to indicate if the borrower has received HHF funds. The allowable values include:

The Upload Files functionality is especially recommended for large servicers that have high volumes of Treasury-FHA HAMP loans. Treasury-FHA HAMP file formats are available to assist servicers and can be found in the HAMP Loan Reporting Tools & Documents section of HMPadmin.com (login required).

Servicers can submit files in a compressed (ZIP) or uncompressed (XML or CSV) format. Compressed (ZIP) files, which may contain multiple files, should contain XML or pipe-delimited CSV files only. The file size must not exceed the 5MB size limit. The maximum number of loans that can be contained in a 5MB file are:

Where part1 is the Servicer Login Name and part2 is the HAMP Servicer Number, part3 is the LFN File Number (described below), part4 is the Submission Date in YYYYMMDD format and part5 is the Other Identifying Information (optional), as shown:

LFN File Numbers are as follows:

FHA Trial Setup – LFN0300

FHA Trial Period Activity – LFN0301

FHA Official Modification – LFN0302

FHA Loan Activity – LFN0303

The HAMP Reporting Tool validates each file, based on the LFN File Number, to determine that the LFN File Number in the file name matches the Submission Status. The validation will occur at the same level as current Business Rule validation (which is at the loan level). When the Submission Status code and the Program Type provided do not match a valid value for the LFN File Number uploaded, the loan will receive an error in the HAMP Reporting Tool response file report. The loan will not be transmitted to the HAMP Reporting System for processing. The loans that pass validation will continue to be processed.

FHA Trial Setup (LFN0300)

Must be submitted with a Submission Status Code of 1 - Trial.

If not valid, then Error: The Submission Status Code for this loan is not valid for the LFN File Number used in the file name.

FHA Trial Period Activity (LFN0301)

A Submission Status Code is not required.

FHA Official Modification (LFN0302)

Must be submitted with a Submission Status Code of a 3 – Official.

If not valid, then Error: The Submission Status Code for this loan is not valid for the LFN File Number used in the file name.

FHA Loan Activity (LFN0303)

A Submission Status Code is not required.

FHA Cancel (LFN0305)

Must be submitted with a Submission Status Code of 5 – Trial Cancel or a Submission Status Code of 7 – Official Cancel.

As the only allowable Submission Codes values in the schema both relate to cancellations, an LFN file number error will not be generated, as with other submission file types. Instead, a schema error will be generated if the Submission Code for a cancellation is invalid.

File Structure Validation

Treasury FHA-HAMP loan-level transactions submitted via the UI or by uploading a file to the HAMP Reporting Tool will be validated against for structure. If any data attribute within a file fails structural validation, then the entire file will be rejected and a structural validation error message will be provided. If the loan-level transactions pass the structural validation, the HAMP Reporting Tool will validate the transactions against a suite of business edits. Loan records that fail business rules validation will be rejected, and a business rule error message will be provided in the response file report. Loan records that pass business rules validation will be transmitted to the HAMP Reporting System for processing. The HAMP Reporting System will edit and validate the input XML file. Edit warnings and failures will generate an XML response file that servicers can view and download from the Reports tab within the HAMP Reporting Tool.

This provides a transaction processing status from both the HAMP Reporting Tool and the HAMP Reporting System for each submitted transaction, and includes a description of any warning or error messages (if applicable) that occurred for each individual transaction in the file. Transactions with errors must be corrected and resubmitted for processing to continue.

To access the Files Received report:

Web Data Submissions

The Web Data Submissions report lists the transactions that the servicer submitted via the Web forms submissions (manual entry). The report provides a transaction processing status from the HAMP Reporting System for each submitted transaction and includes a description of any warning or error messages that occurred for each individual transaction in the file. Transactions with errors must be corrected and resubmitted for processing to continue.

At 30 minute intervals, any transaction successfully entered via the Web site forms are bundled together and sent to the HAMP Reporting System for processing.

Treasury FHA-HAMP Incentive Payments

Both borrowers and servicers are eligible for incentive payments in Treasury FHA-HAMP.

The HAMP Compensation Matrix provides details on the incentive amount, frequency, timing and conditions required.

Program incentives are deposited on the 27th calendar day of each month or previous business day if the 27th falls on a weekend or a holiday in a particular month. The deposit is transferred via the Automated Clearing House (ACH) Network. Servicers must provide ACH banking instructions in Section 3 of the HAMP form that will be used as the default account for the receipt of payments. Servicers are allowed to designate three additional accounts in Section 4 of the HAMP registration form to receive payments to separate designated accounts for servicer and borrower.

The Cash Payment Summary report provides loan-level compensation payment data for each reporting cycle and is available the day before payments are deposited and for the following 180 days. FHA-HAMP reports are differentiated with a Program Type HMP9 – FHA.

To view and download the First Lien Cash Payment Summary Report:

1. Log in to the HAMP Reporting Tool.

2. Select Reports tab.

The HAMP Master Servicer Loan Reconciliation report provides trial loan setup, official modification loan setup and monthly accrual information. The report is available on the fourth business day after the monthly close of each reporting cycle and for the following 180 calendar days. The monthly close is the 17th calendar day or the previous business day prior to the 17th, if the 17th falls on a weekend or holiday. Treasury FHA-HAMP reports are differentiated with a Program Type HMP9 – FHA.

To view and download the HAMP Master Servicer Loan Reconciliation report:
