Welcome

Dear Maine Conservationist,

Maine people ushered in new, pro-conservation leadership in the 2012 legislative elections while Governor LePage remained in the Blaine House. This dynamic led to mixed results for the protection of Maine’s environment during the first half of the 126th Legislative Session.

Over 80 bills were vetoed by Governor LePage, including one that would have protected pregnant women and children from toxic chemicals and another that would have allowed the state to prepare for the effects of climate change.

There were other measures that became law without the Governor’s signature, however, including a bill to restore passage for alewives at two dams on the St. Croix River; one to establish a recycling program for household paint sold in Maine; and a ban on BPA in infant formula and baby food.

Some important bills did not even make it to the Governor’s desk. This was the unfortunate situation for a bill to protect Maine people and wildlife from water pollution like arsenic, lead and mercury that results from open-pit sulfide mining. The Senate failed to pass “An Act To Amend the Maine Metallic Mineral Mining Act To Protect Water Quality,” despite bipartisan support and a sizable victory in the House.

How did your legislators vote in the tense political atmosphere of the 2013 Legislative Session? Did they take action to safeguard Maine’s air, land, water and public health? Or did they push for legislation that weakens protections and degrades our environment?

We know you look to MCV’s Environmental Scorecard for non-partisan, objective information. For over 25 years, we’ve publicly reported how each legislator voted on bills protecting Maine’s environment. In addition, we feature high and low points of the session and highlight examples of political courage on both sides of the aisle.

We give you the score—the rest is up to you. It is crucial that your legislators hear from you with praise or disappointment. Please take a moment to contact your elected officials. You can do this directly from our website at www.maineconservation.org.

Thank you for your support this session and for standing with us to protect Maine’s natural heritage. As we look toward another legislative session in January, you can count on MCV to keep score and make sure Maine’s environment remains a priority for generations to come.

With appreciation,

Alewives (LD 72) An Act To Open the St. Croix River to River HerringSponsored by Rep. Madonna Soctomah

The Legislature authorized reopening the St. Croix River to alewives representing a significant victory for wildlife habitat. Also known as river herring,

alewives are a critical food source for Maine lobster, many fish species, and a variety of birds and mammals. The fish passages were closed in 1995, restricting access to the alewives’ native spawning grounds and causing a dramatic population decline. The Marine Resources Committee voted unanimously in favor of the bill, setting the stage for easy passage in both the House and Senate. Thanks to the timely passage of this bill, alewives swam unrestricted up the river this year.

Wind-Power Siting (LD 385)An Act To Improve Wind Energy Development PermittingSponsored by Rep. Roberta Beavers

The Legislature directed the Department of Environmental Protection (DEP) to increase opportunities for public participation in deciding where new wind projects can be built. The DEP must now also evaluate the potential scenic and wildlife impacts of wind power. Additionally, the bill protects the habitat of Bicknell’s Thrush, a globally rare bird species found at very specific high elevations.

GMO Labeling (LD 718) An Act To Protect Maine Food Consumers’ Right To Know about Genetically Engineered Food and Seed StockSponsored by Rep. Lance Harvell

The House and Senate both passed the GMO labeling bill with overwhelming support, and Governor LePage has promised to sign it into law

in January 2014. The law will require food companies to label products that have been produced using Genetically Modified Organisms (GMOs). LD 718 will go into effect when 5 contiguous northeast states, including Maine, pass GMO labeling laws. Connecticut passed such a law this year. GMOs have significant environmental impacts on species diversity, unknown impacts regarding toxic chemicals in the food supply, and have increased pesticide use. The GMO labeling law will give important freedom of choice to food consumers in Maine and the northeast.

Climate Change (LD 825)Resolve, To Study Climate Change and Implement the Recommendations of the Department of Environmental Protection Report on Climate ChangeSponsored by Rep. William Noon

In 2009, the Legislature directed the DEP to build upon the Universtiy of Maine’s climate impact assessment by evaluating the options available to Maine people and businesses for adapting to the environmental effects of climate change. Under Governor LePage’s Administration however, the DEP ceased its study

Healthy Kids (LD 1181)An Act To Further Strengthen the Protection of Pregnant Women and Children from Toxic ChemicalsSponsored by Sen. Seth Goodall

Despite passage in the House by a wide margin and initial unanimous Senate passage, Governor LePage vetoed the Healthy Kids bill, and the Senate failed to override. LD 1181 would have required the disclosure of BPA use in food packaging by food manufacturers with more than a billion dollars in

annual sales. Disappointingly, the Senate did not debate the bill.

Open-Pit Mining (LD 1302) An Act To Amend the Maine Metallic Mineral Mining Act To Protect Water QualitySponsored by Rep. Jeff McCabe

Open-pit sulfide mining is one of the most polluting industries, releasing dangerous arsenic, lead, and mercury into the surrounding watershed. Until last year it was highly improbable that this type of mining would ever occur in Maine, but a bill passed in 2012 weakened the clean water protections that to apply these mines,

opening the door for their development in the state. LD 1302 would have strengthened water quality protections and ensured that Maine taxpayers are not left with clean-up costs once a mine is closed. The House passed the bill by a large margin, but the Senate failed to pass it by just one vote. The LePage Administration’s Department of Environmental Protection recently drafted rules that will govern future mining operations. In 2014, the Legislature will have final say over whether these proposed rules are adopted.

Paint Recycling (LD 1308) An Act To Establish a Stewardship Program for Architectural PaintSponsored by Sen. Thomas Saviello

The Legislature passed LD 1308, which establishes a recycling program for architectural (household) paint sold in Maine. Following the precedent set by Maine’s bottle bill, this bill enables consumers to return their unused paint to designated locations throughout the state for recycling and proper disposal.

Alewives  Committee chairs Sen. Johnson and Rep. Kumiega did an excellent job running the Marine Resources Committee, which voted unanimously in favor of opening the St. Croix to alewives (LD 72). Tribal Rep. Soctomah sponsored and championed the bill, speaking on the floor and even persuading three senators to change their votes to support it on final passage. Republican Reps. Parry and Weaver provided leadership in Committee. Governor LePage let the bill become law without his signature.

Open-Pit Mining Asst. House Majority Leader McCabe continued to be an environmental champion this year by sponsoring

the bill to strengthen water quality standards in Maine’s mining law (LD 1302). Sens. Johnson and Gratwick, and Reps. Welsh, Grant, Chapman, Harlow, Kruger, and Chipman were outspoken proponents of improving the law. Republican

bill co-sponsors Reps. Cotta, Dunphy, Espling, Maker, Malaby, and Sanderson contributed strong support; and Sen. Langley deserves credit for being the only Senate Republican to support the bill.

DISAPPOINTMENTS: Despite easy passage in the House, the Senate did not pass the bill. The Republican caucus (save Sen. Langley) and Democratic Sens. Cain, Dutremble, Patrick, Valentino, and Asst. Senate Majority Leader Jackson voted against the bill.

Healthy Kids Reps. Welsh, Grant, McGowan, Cooper and Sen. Gratwick energetically advocated for LD 1181, a BPA disclosure bill, in the Environment and Natural Resources Committee. Beyond the Committee, Reps. Devin, Dorney, Gideon, Graham, and Tipping-Spitz were staunch allies. House Speaker Eves prioritized the passage of the bill, contributing important support.

In the Appropriations Committee, Sens. Cain, Flood,

and Hill deserve thanks for shepherding an amendment to eliminate the fiscal impact. Commendation also goes to Sen. Flood: the sole Republican senator to vote to override the Governor’s veto.

DISAPPOINTMENTS: Sen. Saviello worked against the bill in Committee and sided with the Administration to oppose the bill. Lacking Sen. Saviello’s support, the Senate failed to override Governor LePage’s veto.

GMO Labeling Bill sponsors Rep. Harvell and Sen. Johnson provided passionate and tenacious championship for GMO labeling (LD 718). Their efforts were bolstered by Reps. Hickman, Jones, Kent, and Noon, members of the Agriculture, Conservation and Forestry (ACF) Committee. The four representatives who voted against the final bill on the House floor, Reps. Jones, Boland, Chipman, and Kent, did so only because they thought it did not go far enough.

Departmental Merger Rep. Kent was a hero in opposition to the merger of the Departments of Agriculture and Conservation (LD 837) which takes resources from conservation programs. He gave an impassioned floor speech, provided leadership, and asked probing questions in Committee. Asst. House Majority Leader McCabe and Rep. Carey were valuable allies, and Rep. Marean was instrumental in restoring the Land for Maine’s Future director position which had been eliminated from the budget of the merger bill.

EnergySen. Boyle sponsored and developed an energy efficiency bill (LD 1426) which was incorporated into a larger, omnibus energy bill (LD 1559) that passed both chambers and survived a veto. Within the Energy, Utilities, and Technology (EUT) Committee, Reps. Russell, Gideon, and Tipping-Spitz elevated

the dialogue about the omnibus bill, which has mixed environmental implications. Sen. Cleveland and Rep. Hobbins promoted keeping strong efficiency measures in the omnibus bill with support from House Minority Leader Fredette, Sen. Youngblood and Rep. Dunphy. Outside of the Committee, Senate President Alfond and House Speaker Eves championed energy efficiency policy.

Reps. Dorney and McGowan were also active voices pressing for energy efficiency and climate change legislation. Rep. Noon sponsored and led the passage of the Climate Adaptation bill (LD 825).

Rep. Beavers championed a successful bill (LD 385) that addresses the nuances of location decisions for new wind power projects. Rep. Welsh was a leader on other wind issues.

Energy, Utilities, and Technology Committee Chairs Sen. Patrick and Rep. Herbig, along with Rep. Graham ably attempted to restore the Maine Uniform Building and Energy code (LD 977).

On the Appropriations Committee, Chair Sen. Rotundo, and Reps. Carey and Keschl successfully halted attempts to take money from the Regional Greenhouse Gas Initiative and the Efficiency Maine Trust. House Minority Leader Fredette and Rep. Dunphy were also instrumental in this effort.

Habitat and WildlifeAsst. House Majority Leader McCabe championed protection of brook trout by opposing a bill to allow

live bait fishing in important brook trout ponds (LD 170). In Committee, Rep. Kusiak voted courageously, casting the only opposing vote among the Committee members present. Sens. Haskell, Saviello,

Cleveland, Lachowicz, Johnson, Tuttle, and Senate Majority Leader Goodall are lauded for voting to preserve trout habitat.

Sen. Haskell, with assistance from Reps. Shaw and Davis, championed a bill protecting loons from lead poisoning (LD 730).

Senate Majority Leader Goodall sponsored the successful bill to protect sand dunes (LD 1102).

Sen. Saviello helped defeat the vernal pool and significant wildlife rollback bills facing the Environment and Natural Resources (ENR) Committee (LD 674, 793). He

also led the charge on limiting motorized gold dredging (LD 1135) with significant help from bill sponsors Rep. Black and Sen. Boyle.

Sen. Boyle worked to prevent legislation that would have gutted Shoreland Zoning and the Natural Resources Protection Act (LD 470).

Other Noteworthy ActionsSens. Saviello and Boyle were critical in the passage of the paint recycling bill (LD 1308).

Rep. Black stood up to protect the Allagash Wilderness Waterway (LD 269). On the ACF Committee, he voted with Reps. Jones and Noon against the ten-member majority and delivered a powerful speech on the House floor.

Rep. Marean was a hero for opposing the Eagle Lake Sporting camp bill (LD 493) which would have sold public land for private gain. Asst. House Majority Leader McCabe also aided in the bill’s defeat.

In the Transportation Committee, Sens. Mazurek, Powers, and Peoples took the lead in defeating bills that threatened Maine’s billboard ban. Sen. Mazurek also played a key role in creating more transparency and increasing evaluation of East-West Highway proposals. Asst. House Majority Leader McCabe worked hard on the issue as well.

Rep. Priest assured that new regulatory “takings” bills, similar to those proposed in previous sessions, were soundly defeated by the Judiciary Committee.

A special farewell to Sen. Goodall, a champion for the protection of Maine’s environment during his five years in the Senate. We wish him the very best in his new position as Regional Administrator of the Small Business Administration.

Special recognition goes to Rep. Harvell for the most improved MCV score, followed closely by Reps. Marean and Black.
