The Consent Appraisal Committee meeting of the Board was held on 09.02.2018. Following members of the Consent Appraisal Committee were

present:

The meeting thereafter deliberated on the fresh agenda items of 1st consent to operate [Book-let no 13] is placed before the committee and following

31.03.2020 Committee noted that renewal of consent to operate of

existing Coal Mine-1.5 MMTPA over a mining lease

area of 249.15 Ha. was approved in the CAC meeting

dated 27.08.2015. However, Consent was not issued due

to non-submission of consent fees.

Committee also noted that industry has obtained Consent

to establish vide consent dated 03.04.2011 for coal

mining activity of Underground mining over an mining

lease area of 661.65 ha for Coal Production- 2.0 MTPA

which was expired on 02.04.2016. Further, also noted

the reply of PP that EC validity period shall be counted

from the date of issuance of EC i.e. after 11.05.2015.

It is further noted that PP has provided Sedimentation

Tanks of size 45 X 25 X 10 mtrs and 40 X 10 X 1 mtrs,

Details of Air Pollution control arrangement is provided.

As decided in earlier CAC meeting, hearing to the WCL

authority was extended on 07.02.2018. They have also

made the presentation about compliance made before

CAC and based on the presentation made by WCL

authority they have agreed to comply the consent

conditions in time bound manner.

In view of above, It was decided to grant 1st Operate for

expansion with mining area for Coal production 0.5

MTPA on a mining area of 667.65 Ha. and its

amalgamation with existing consent of 1.5 MTPA

approved in earlier CAC by imposing following

BNH registration of hospital for 250 beds was

--- The committee noted that earlier the case was placed

before CAC meeting held on 08.08.2017. The case is

again resubmitted for seeking approval for part operate

for expansion and renewal. Committee deliberated the

issue in depth and made the following observations;

1. PP has applied for plain renewal of consent (Jetty

length of 331.5 mtrs) for handling capacity

13,50,000 MT/M. (i.e. 16.2 MTPA) .

2. PP has applied for first C to O for expansion for

length 395 mtrs with proportionate handling

capacity of 8,40,000 MT/M. (i.e.10.08 MTPA) (total

length 726.5 mtrs including existing Jetty length and

first phase expansion) for which C to E and EC

including CRZ Clearance already obtained.

3. The MoEF and CC has also accorded EC for Jetty

expansion project with length 1750 mtrs on

26.11.2015. 4. It is also noted from SRO remark that

the work of expansion for first phase of Jetty is

already completed and is ready to operate.

4. Committee also noted the reply received from

MMB, GoM that JSW Dharamtar Port had carried

out repairs of the Dilapidated Jetty structure of the

Jetty and integrated adjacent test pile which was

essential to prevent falling of debris in navigation

channel and also to avoid any eventualities of

accident. They have also stated that the cargo

handling operation is carried out by the company

from designated part of Jetty and restored part of the

Jetty is not use for operation.

5. Committee also noted the PP’s say that there is no

6. The Committee noted that the reply towards opinion

sort from MoEF, Govt. of India is not received till

7. Reminder letter to MoEF and to Env. Dep. GoM

dated 13.11.2017 has been sent. Reply still awaited.

In view of above, it was decided to keep the case in

abeyance for 1st Operate (Part) for expansion and

renewal of consent to operate till obtaining clarification

from Environment Department, Govt. of Maharashtra

and revert back to CAC.

31.01.2022 Committee noted that PP has obtained Environmental

Clearance from SEAC committee vide letter dated

20.11.2010 for total plot area 5,60,000 Sq. Mtrs. and

total BUA 12,13,345 Sq. Mtrs.

Committee also noted that PP has obtained consent to

establish dated 25.05.2015 for total plot area 5,60,000

Sq. Mtrs. and total construction BUA 6,72,341.66 Sq.

Mtrs. PP has also obtained 1st consent to operate (Part-I)

for total construction BUA 4,21,009 Sq. Mtrs.

In view of above, it was decided to grant 1st Consent to

Operate (Part -II) for Residential cum Commercial

Project of M/s. Pegasus Properties Pvt. Ltd,R-1/1, R-

1/2, R-1/3, R-1/4 Rajiv Gandhi Infotech Park-III,

Village- Man & Bhoir Wadi Mulshi on total plot

area 5,60,000 sqm and Construction BUA of

6,14,718.69 sq.m (out of TCBUA of 6,72,341.66 sq.m.

as per CtoE dated 25.05.2015) by imposing following

conditions:

1. PP shall submit affidavit in Board prescribed format

within 15 days regarding compliance of conditions

of Environmental Clearance (EC) and Consent to

Establish.

2. PP shall submit the affidavit within 15 days in the

prescribed format regarding the part of the built up

area/ building for which application for 1st Consent

to Operate (Part) is made and that the same is

included in the Environmental Clearance accorded.

3. Project Proponent shall extend/ submit the BG of

Rs. 25 lakhs towards O & M of pollution control

system.

4. PP shall achieve the treated domestic effluent

standard for the parameter BOD- 10 mg/lit.

5. The treated domestic effluent shall be 60% recycled

for secondary purposes such as toilet flushing, air

conditioning, cooling tower make up, firefighting

etc. and remaining shall be utilized on land for

gardening and connected to the sewerage system

provided by local body. Till the time of availability

of local body sewer system, applicant shall utilize

entire treated domestic effluent for Flushing,

Construction of remaining phase and on own land

for gardening.

6. PP shall revalidate EC before carrying out any

further remaining construction work.

7. PP shall submit Board Resolution from company

Board, towards discharging of sewage through the

cement pipes outside the premises into nearby nalla

same nalla meets to Gawarewadi-Mann Nalla thus

violated the provisions of Environmental Laws and

in future, they will not do such violations and BG of

Rs. 2 lakh towards submission of Board resolution

within one month of issue of consent.

8. PP shall not carryout construction activity beyond

the construction area mentioned in consent to

establish (6,72,341.66 Sq. mtrs.) and till

revalidation of EC.

Consent shall be granted after:

i. Submission of Certificate from Architect regarding

BUA completed for which they have applied for 1st

stating that industry complied with CtoE conditions and

also installed RO & MEE for achieving ZLD including

provision of online monitoring system. Also, noted that

CPCB has consented NOC for expansion.

In view of above, it was decided to grant Consent to 1st

Operate to manufacture of Crotonaldehyde -Di-Urea

(CDU) and Crotoresin by imposing following

conditions;

1. The consent is granted without prejudice of the orders

passed or being passed by the Hon’ble NGT.

2. This consent is issued in pursuance to the letter of

CPCB dated 11.08.2016.

Sugar unit- 1100 TCD (from 4900 TCD to 6000 TCD)

and Co-gen unit – 6 MW (from 15 MW to 21 MW.

Committee also noted that industry has achieved ZLD

by using treated effluent for on land for irrigation as

practice in other sugar industries. Board has also filed

case in district court Kolhapur due to excess crushing

carried out by industry in the season 2015-2016.

In view of above, it was decided to grant 1st consent to

operate for expansion by imposing following conditions.

Environmental Clearance vide letter dated 13.02.2017

and consent to operate for coal mining of 0.8 MTPA is

valid upto 31.03.2021. Also, obtained Consent to

Establish for 0.8 to 1.2 MTPA (i.e.0.4 MTPA) on

22.03.2017.

Earlier, the application of C to O for 0.4 MTPA (from

0.8 to 1.2 MTPA) was discussed in CAC meeting dated

08.08.2017 and SCN of refusal of consent and stop work

was issued as industry has failed to provide CAAQMS

as per existing consent condition. Thereafter, PP

submitted appeal towards Environment Department.

Now, PP submitted reply and informed that they will

provide CAAQMS as per existing consent condition by

operate in its CAC meeting dated 27.09.2017 due to

various non-compliances. It is also noted that PP has

obtained Environmental Clearance vide letter dated

17.05.2007.

Industry has submitted their reply and also received

verification report from concerned SRO dated

16.01.2018 and noted that now the industry has provided

adequate pollution control arrangement. JVS (treated

trade effluent) sample results are within consented

standards.

As decided in earlier CAC meeting, hearing to the WCL

authority was extended on 07.02.2018. They have also

made the presentation about compliance made before

CAC and based on the presentation made by WCL

authority they have agreed to comply the following

points in time bound manner.

Considering the assurance given by the industry and

verification report received from SRO, it was decided to

grant 1st Consent to Operate for Opencast Coal Mining

Activity of 0.8 MTPA capacity by imposing following

conditions.

1. PP shall provide dry deshelling / manual picking of

stray material arrangement by 31st August 2018 also

submit a plan for installation of Coal washery within

a month.

2. PP shall install CAAQMS arrangement by 31st May

2018.

3. PP shall install STP within 03 months period.

Committee noted that, PP has obtained amended

Commencement Certificate from Thane Municipal

Corporation including Occupancy Certificate for the

completed part. Also, noted that the construction activity

completed in NON CRZ Area, and Architect certificate

mentioning that construction is completed in accordance

with the approved CC and plan by the planning

authority. Also noted provision of pollution control

facilities including online monitoring system.

In view of above, it was decided to grant C to O(Part-I,

Part-II, Part-III & Part-IV) for construction for

residential cum commercial project as mentioned below

Therefore, it was decided to grant 1st Consent to

Operate (Part) by imposing following condition(s);

1. PP shall submit affidavit in Board’s prescribed

format within 15 days regarding compliance of

conditions of Environmental Clearance (EC) and

Consent to Establish.

2 PP shall submit the affidavit within 15 days in the

prescribed format regarding the part of the built up

area/ building for which application for 1st

Consent to Operate (Part) is made and that the

same is included in the Environmental

Clearance/CRZ Clearance accorded.

3. Project Proponent shall submit the BG of Rs. 25

lakhs towards O & M of pollution control system.

4. PP shall achieve the treated domestic effluent

standard for the parameter BOD- 10 mg/lit.

5. The treated effluent shall be 60% recycled for

secondary purposes such as toilet flushing, air

conditioning, cooling tower make up, firefighting

etc. and remaining shall be connected to the

sewerage system provided by local body.

6. PP shall not take further effective steps for

remaining BUA without obtaining revalidation of

consent to establish.

Consent shall be issued after:

i. Obtaining Certificate from Architect regarding

completion of construction of BUA for which they

have applied for 1st Consent to Operate (part).

ii. Installation of online monitoring system for the

parameters flow, BOD, TSS at the outlet of STP and

verification of SRO of the same

iii. Obtaining requisite additional consent fees.
