Introduction

The law is the normative and institutional human behavior in society inspired by principles of justice, whose base are social relations that determine its content and character. In other words, are behaviors directed to the observance of rules governing social interaction and to settle international conflicts subjective.The final definition of positive law, but not its foundation, which is why lawyers, philosophers and legal scholars have proposed throughout history various alternative definitions, and different legal theories in the absence, to date, consensus about its validity. The study of the concept of law is done by one of its branches, the philosophy of law. However, the proposed definition initially gracefully solves the problem of "validity" of the basis of the law, to integrate the value held in its concept. The validity of the legal concepts and legal target are studied by legal theory.

Justice has been defined by history as the moral virtue that inclines to give everyone what belongs to him as his own. The object of this virtue is the right goal, what is due to another by force estarle linked in some natural or acquired legitimately titles. There are primary or fundamental rights which are essential requirement of human nature itself, derived from natural law but are not primary, others however, have reason to exist as the positive will of God or of man as God's representative. Man must use, referring to formal law and subjective. So also must respect these rights, provided the proper act of justice to give each one his own. Moreover, legal justice is understood as the means by which the state seeks the common good of all the inhabitants of a given territory, through the enactment of just and wise laws, and the establishment of a public authority can to promulgate and enforce, in this sense, the regency administration or as rough beginning, comes from citizens and is exercised on behalf of the Republic and by the authority of the law, through the organs that make the judiciary.
