REZONING & SPECIAL USE PERMIT APPLICANT'S RESPONSE STANDARDS GOVERNING THE EXERCISE OF THE ZONING POWER
(A) Yes, approval of the Applications will permit a use that is suitable in view of the use and development of adjacent and nearby property. The proposed development is adjacent to high-intensity industrial uses and provides an appropriate transition through buffers to adjacent residential uses.
(B) No, approval of the Applications will not adversely affect the existing use or usability of any of the nearby properties.
(C) In light of the size, location, layout, topography, and nature features of the property and in conjunction with the nature of surrounding development, the Applicant submits that the subject Property does not have reasonable economic use as currently zoned and without the requested special use permits.
(D) No, approval of the Applications will not result in an excessive or burdensome use of the infrastructure systems. The Property is located on Ozora Road with convenient access to Loganville Highway (State Route 20) via Ozora Road and State Route 81 via Ozora Road/Ozora Church Road.
(E) Yes, approval of the Applications would permit a use that is in conformity with the policy and intent of the Gwinnett County Unified Plan. While the Property is within the Suburban Estate Character Area, the Property is also adjacent to a large industrial use which also serves as a community amenity. As communities grow, so does the need for services that allow for modern life.
(F) The Applicant submits that the character of surrounding development, the strong population growth of the County, and the proximity of the Property to major transportation corridors provide additional supporting grounds for approval of the Applications.

FOR REZONING AND SPECIAL USE PERMIT APPLICATIONS
Mahaffey Pickens Tucker, LLP submits this Letter of Intent and the attached Rezoning
and Special Use Permit Applications (the "Applications") on behalf of the property owner (the
"Applicant") relative to an approximately 51.616-acre property situated along Ozora Road
southeast of Tribble Mill Road (the "Property"). The Property is currently zoned R-100 and
contains two residential buildings with accessory structures. The Property is adjacent on two
sides to a large tract of land zoned M-2. This adjacent M-2 zoned land is the Vulcan Materials
Grayson Quarry. The Applicant is requesting to rezone the subject Property from R-100 to M-2
for light-industrial uses including an Automobile/Truck Storage Lot and Trucking and Hauling.
The Applicant is also requesting a special use permit for a Solid Waste Transfer Station.
The Property has apparently been zoned R-100 since 1970. The adjacent M-2 land has
also apparently been zoned M-2 since 1970 when Gwinnett County first adopted a zoning
ordinance. As depicted on the site plan submitted with the Application (the "Site Plan"), Lot 1,
Lot 2, and Lot 5 would contain future light industrial uses. As shown on the Site Plan, Lot 3
would contain the proposed transfer station which would receive household waste material and
then transfer such material to nearby disposal facilities. The Applicant is proposing to construct a
new office building with an associated parking lot on Lot 3 to manage operations and a larger

building to the south to accommodate the proposed use. Lot 3 would also include a proposed
concrete pad adjacent to the proposed transfer station building with an additional adjacent gravel
pad. The Applicant is proposing to utilize Lot 4 for the proposed Trucking and Hauling use.
There, the Applicant is proposing to construct an additional office building with associated
parking lot for on-site operations and management purposes as well as a gravel-surface truck and
equipment storage yard.
The subject Property is adjacent to both residential and heavy industrial uses. As shown
on the Site Plan, the proposed uses have been located as far away from adjacent residential
structures as possible and closest to the adjacent quarry. The Applicant is proposing a 100-foot
wide, natural undisturbed buffer where adjacent to residentially-zoned uses. In addition to this
proposed natural, undisturbed buffer, a stream cuts through the Property which brings with it 50-
foot buffers and 75-foot impervious setbacks on each side. Accordingly, the effective
buffer/setback width would be over 450 feet wide in spots.
