•v* '• It is apparent from the report of the Board that tJSDOF vas operating•under extreaely difficult conditions especially during the disengagementphase of the operations, which called for adherence to a rigid tineschedule in implementing the agaeeaent reached by Israel and Syria iaGeneva* As the report states, "work vas carried out under constantpressure relying on oral rather than written orders*.

In our opinion, the testimony supports the conclusion of the Boardthat "UHDOF FEQ (Forward Headquarters? vere aware that the road from

; Aarne to Pitulim Camp had not yet been cleared of mines". "She testimonyalso indicates that information to this effect vas passed by the Israeli

.J..V Liaison Officers to USDOF FHQ on 2k June* although, as you point out»there may have been some officers on the UEDOF staff vho vere not awareof that fact and assumed that the road had been fully cleared*

The testimony further indicates that information that the Aarae-Pitulis-•' Hoad vas not safe on account of mines vas relayed to the Austrian battalion

or at least to some of its officers. Indeed, UMDQP FHQ assumed, incorrectly,that another road running through Israeli-controlled territory would fee usedby the Austrian search party* The fact is that vital information about thecondition of the road did not reach members of the Austria battalion vhovere organizing the search pa ty, but there is nothing in the report of theBoard to indicate that the Austrian battalion alone vaa responsible for thefailure to channel that information to all concerned* This vas one of the w

"basic fflisunderstandings11 referred to in paragraph (B) of the Board ofInquiry findings.

The fcther "basic misunderstanding** concerns the exchange of messageson 2k June 1971* between the Austrian battalion and the UUDOF Chief EngineerOfficer concerning the condition of the Aarae-Pitulim Camp Hoad. It isevident that that exchange of messages lent itself to tragic misunderstand-ings and that in fact both messages vere misunderstood by their respective

~ recipients. I fully agree vith you in this connexion that there is no; basis for suggesting that the Austrian battalion alone vas responsible for :\,;'"those misunderstandings. '

In short, there occurred a combination of human errors by a number of>r ._ persons, all of whom vere working under great pressure in a genuine effort9'r-;;.";; x • to fulfil their important responsibilities in difficult circumstances. As

Further to my note MPP 3^0 of 15 October 197^, concerning the withdrawal of

the Panamanian contingent of UNEF in the Middle East, I have the honour to communicate

to you herewith a photocopy of the cable we have received on the subject from

Colonel Rodrigo Garcia Ramirez, Second-in-Command of the Guardia Nacional of Panama.

As you will be aware, the advance group of the Panamanian contingent proceeded

to the Middle East on 19 November 1973 and the main body of troops on 10 December of

that year. Since it is my Government's intention to withdraw its contingent from

the area after the completion of one year's service, I request you to issue the

appropriate instructions to ensure that the operations shall be brought to a happy

conclusion.

Government to terminate the participation of Panama in the United

before it adopted its resolution 362 (197 ) extending the mandate

of UNEF for a further period of six months.

for your Government's decision and I shall ask the Force Commander to

make the necessary arrangements, in consultation with the Panamanian

Declaration adopted on 12 September 197 "by the Co-ordinating Committeeof the Group of Non-Aligned Countries

At the meeting it held in New York on 12 September 197U, the Co-ordinatingCommittee of the non-aligned countries heard a statement on Quneitra by thePermanent Representative of Syria, Ambassador Haissam Kelani, The PermanentRepresentative of Syria drew attention to the fact that, during the term of theAgreement on Disengagement between Israeli and Syrian Forces signed in Genevaon 31 May 197 -, "the Israeli forces committed criminal acts as they withdrew fromthe Syrian territory they had been occupying by destroying Syrian villages , and inparticular the town of Quneitra and the village of Rafid, using for that purposeexplosives and bulldozers. He also submitted a report on the destruction andpillaging of buildings, sites and monuments of archaeological, cultural, religiousand historical interest' carried out by the Israeli occupation authorities in theliberated area of Syria.

The representatives of the non-aligned countries consider that these actsperpetrated by the Israeli forces, without any reason or justification, constitutea flagrant violation of international law, humanitarian principles, the valuesof civilization and the Geneva Convention relative to the Protection of CivilianPersons in Time of War of 12 August 19 9, as well as a total violation of theConvention for the Protection of Cultural Property in the Event of Armed Conflictadopted at The Hague, on Ik May 195 , and ratified by numerous parties, includingSyria and Israel.

Moreover, international law views the acts committed by Israel as war crimes.Under the terms of the Charter of the Nuremberg International Military Tribunal,wanton destruction of cities, towns or villages, or devastation not justified bymilitary necessity are considered to be war crimes.

The representatives of the non-aligned countriesa therefore, firmly condemnthe Israeli occupation authorities for these acts of barbarism, which are contraryto international law, international Conventions, and the values of civilization.

tembre 1974 a New York, le Comite de coordination des

pays non alignes a entendu une declaration du represen-

tant de la Syrie, 1'Ambassadeur Dr Haissam Kelani, sur

Kunei'tra. Le representant de la Syrie a souligne le fait

que, pendant 1'application de 1'accord de degagement des

forces israeliennes et syriennes,. signe a Geneve le 31 Mai

1974, les forces israeliennes, au moment ou elles se

retirerent du territoire syrien qu1elles occupaient, ont

commis des actes criminels de destruction de villages

syriens, et en particulier detruit la ville de Kuneitra

et le village de Rafid, en utilisant a" cette fin des

explosifs et des bulldozers. II a presente, eji outre, un

rapport sur la destruction -et le pillage des batiments,

des sites et des monuments archeologiques, culturels,

religieux et historiques , commis par les autorites d1occu-

pation israeliennes, dans la region libere'e de Syrie.

Les representants des pays non alignes corisiderent

que ces actes perpetres par les forces israeliennes, sans

aucune raison ni justification, constituent une violation

EXPLANATORY MEMORANDUM

1. The General Assembly has been continuously seized with the problem of Palestinesince April 19 7- In consequence of some of the early resolutions of the GeneralAssembly regarding this issue, a great number of Palestinians have been displacedand forced to endure the status of refugees, and the Palestinian people have beenprevented from exercising its inalienable rights, including the right toself-determination, in accordance with the Charter of the United Nations and therecognized norms of international law.

2. Nevertheless3 for more than 20 years, the question of Palestine as such andthe question of the status and fate of the people of Palestine as such have notappeared on the agenda of any session of the General Assembly, even though theAssembly and other organs of the United Nations have dealt with various aspects,ramifications or consequences of the Palestine problem throughout this period.

3. Since 19 -8, however, the General Assembly has recognized and reaffirmed theright of the Palestine refugees to repatriation and, since 1970, has recognizedand reaffirmed the inalienable rights of the people of Palestine, including itsright to self-determination. In addition, the international community outsidethe framework of the United Nations has, in recent years, recognized these rightsthrough various forums.

h. As the United Nations has borne since its inception an historic, political andjuridical responsibility regarding the problem of Palestine, it is, therefore,incumbent upon the General Assembly to consider the question of Palestine in itstrue nature and proper form, and to inscribe an item entitled "Question ofPalestine" as a separate item on the agenda of its twenty-ninth session.

Sir,

The resumption of Israeli bombing attacks on southern Lebanon, aimed

at civilian settlements and Palestine refugee camps, causing the death of

innocent civilians and of persons seeking legitimately to remain in their

homes, has profoundly disturbed us. These acts were committed in defiance

of fundamental human rights and the pertinent decisions of the entire

international community.

We, for our part, believe that such acts constitute a major threat

to peace and security not only in this region but also for the rest of the

vorld.

We unequivocally condemn these bombings aimed at innocent populations

and request that you once again draw the attention of the Members of the

United Nations to the consequences of such acts of State terrorism, which

do nothing whatsoever to help strengthen international security.

We remain convinced that a just and lasting solution in this region

can only be achieved by implementing the pertinent resolutions of the

General Assembly and the Security Council, and particularly resolution

2k2 of 22 November 1967, by recognizing the independence and territorial

integrity of all States in the region and by taking into consideration

the legitimate aspirations of the Palestinian people.

ment Arrangement that Your Excellency has sent us on

30 April 1974, we have the honour to inform you of the

common position of our Governments as follows:

In order to have a fair and equitable formula of

reimbursement we must adopt the principle of equal sum

per unit irrespective of the country of origin or the

rank of the troops.

After the discussions we had with the Acting Comp-

troller on 11 June, we strongly believe that this is the

best method to comply with the recommendation of the

General Assembly regarding "the possibility of standard-

izing cost and determining a ceiling after appropriate

consultations with the aim of reducing the wide discrep-

ancies".

Statement of the official spokesman of the Iraqi Government

The Government of the Republic of Iraq declares its acceptance of SecurityCouncil resolution 3^8 (197*0 9 adopted on 28 May 197 through the agreement ofall parties concerned and the members of the Security Council, and emphasizes itsreadiness to implement all its clauses with sincerity and goodwill in pursuanceof a principled attitude on the part of the Republic of Iraq, to abide by thefindings of the Security Council on the question of Iraq's complaint against Iran.

Although the above resolution does not cover all the dimensions of thequestion, the Government of the Republic of Iraq, in expression of its goodwilland positive spirit and in confirmation of its oft-declared preparedness tosolve all problems with our neighbour Iran through peaceful means, has acceptedthe resolution and supported it in conformity with its principled attitude inthis respect.

AUSTRIAN FEDERAL CHANCELLOR VISITS UNEF HEADQUARTERS

(The following was received from the Chief Information Officer ofUWEF in Cairo.)

The Federal Chancellor of Austria, Bruno Kreisky, paid a call today,11 March, to the headquarters of the United Nations Emergency Force (UNEF)on the outskirts of Cairo where he was greeted by the UNEF Commander, Lieut.Gen. Ensio Siilasvuo. This was announced by Rudolf Stajduhar, Chief InformationOfficer of UNEF at his press briefing today.

Accompanying the Austrian Chancellor was Ron Hayward, Secretary-General ofthe British Labour Party, and the Austrian ambassador in Cairo, Heinz Standenat.

During his talks with Chancellor Kreisky, the UNEF Commander summarizedthe process of disengagement and the overall situation of UNEF. He expressedgreat satisfaction with the performance of the Austrian battalion with UNEFand said the Austrians were doing an excellent job. Chancellor Kreiskycomplimented the successful mission of UNEF and the results it had achievedthus far.

The Federal Chancellor is currently visiting Egypt as the Head of theDelegation of the Socialist International, comprising leaders and secretariesof the socialist parties in Europe.

From the UNEF headquarters in Heliopolis (Cairo outskirt), the Chancellorleft by car for Ismailia where he will visit the Austrian battalion.

Mr. Stajduhar announced that the UNEF Commander thio morning had anappointment with the Permanent Representative of Panama to the United Nations,Aquilino Boyd, and the Panamanian charge d'affaires in Cairo, J.A.R. Batista.

Mr. Stajduhar recalled that the UNEF Commander, from time to time, was intouch with diplomatic representatives of the countries contributing troops toUNEF and with members of the Security Council.

In reply to a question, he said the strength of UNEP on 10 March stoodat 6,9 5 men.

Answering another question, he said he did not have information aboutthe arrival, of the Kenyan battalion.

Mr. Stajduhar stated that the two Peruvian soldiers seriously injured ina mine accident had remained in the same condition, while five other slightlyinjured Peruvian soldiers were doing well.

In reply to a question if there had been any incursions into the UNEFzone since the completion of the disengagement, Mr. Stajduhar answered thatsince the UNEF Zone had been established, there had been on several occasionsincursions into the Zone by soldiers and vehicles of the Israeli and EgyptianArmed Forces. Each case had been resolved and the soldiers returned to theirrespective areas voluntarily escorted by UNEF patrols.

The Secretary-General of the United Nations presents his

corapliaents to the Permanent Representative of Kenya to the

United Nations and has the honour to refer to his meeting of

11 January 197 with His Sscellency Dr. HJorge Mungai, Minister

for Foreign Affairs of Kenya, ia the course of which certain

financial aspects of the United Nations Emergency Force in the

Middle East (U3EF) were discussed.

la this conneaaon, it was explained at the Secretary-General's

Ejecting of 29 January 197 with the representatives of countries

contributing contingents to UUSP, that the competent services of

the Secretariat were giving serious and urgent consideration, in

consultation with the Governments concerned, to the question of

reimbursement of the extra and extraordinary costs incurred by

the participating governments. The object of these efforts is

to develop a reasonable and equitable system acceptable to fill the

Governments.

Preliminary discussions vith representatives of some troop

contributors have already taken place vith a viev to laying the

groundwork for a system of this kind, and further discussions with

the delegations concerned vill be tafcing place shortly. .-

The Secretary-General has asked the competent services of the

Secretariat to keep the Permanent Mission of Kenya, as well as the

Missions of other troop contributing countries, currently informed

of the progress of these studies and consultations. ,.

The Foreign Minister conveyed the wishes of President Kenyatta for allsuccess in the new year. He said the President recalled vith pleasure theSecretary-General's visit to Mombasa and Nairobi and hoped that it -would bepossible for the Secretary-General to visit Kenya again in the future.

The Foreign Minister said that Kenya was ready and willing to providea contingent of troops for the United Nations Emergency Force in the KiddleEast. He said that Kenya was prepared to send a battalion of six hundredtroops as suggested by the Secretary-General in his message to the President.However, there were tvo natters which required clarification at this stage:

1. What'proportion of the cost vould be borne by the United Tfationsin the transportation and naintenance of the battalion;

2. On vhat basis would Kenya be reimbursed with regard to'equipmentand transport used by the battalion while in the field.

The Foreign Minister wanted to know what were the reasons which allowed forthe nayr.ent by the United Nations of different rates to states providingcontingents. Ke understood that Swedish troops were receiving as much aseicht hundred dollars (3300) a month more while troops fron other countrieswere being paid less than one quarter of that amount. The Foreign Ministerexplained that while Kenya was prepared to provide a contingent, it couldonly be brought about by fresh recruitment since the existing standing armywas only sufficient to cone with the'internal defence needs of Kenya. SinceKenya would have to recruit an entire battalion to replace that to be sentto u"TZ?, he hoped that the United Nations would be able to bear the full costof that new unit.

The Secretary-General exnlained that the varying rates' paid to differentcontinents hadA established in the past but that it vras evident that thereshould be a new formula which would make the rates uniform. He said that

he was aware that some states had expressed concern on this natter but UIIE?was a departure from trie past nince it vas the first time that states frcnall five regions wero participating in a common .operation.

The Cecretary-leneral then invited Mr. Liu and Mr. De Lauro to jointhe r.eetin-3 in order to answer the questions posed by the Foreign Minister.Mr. Liu explained that there vas a Secretariat paper which outlined thecosts to be net by the United Nations and by the states concerned. Theprinciple was that a state would be reinbursed the extra cost incurredby sendin3 n. contingent out of its homeland by the United ".rations. Onthe question of enuinnent, Mr. Liu said that each contingent would. comewith its cvn transport and other equipment and that the United Nationswould reimburse the cost of usage which includes depreciation. For example,with regard to transport, the United ITations would meet the cost ofgasoline, spare parts, etc. There vas a formula for calculating depreciationon the capital cost of the transport which took account not only of thecondition of the vehicle at the tine of its entry into the area of operation,but also of the terrain on which it had been employed.

Mr. De Lauro confirmed that if a state was obliged to recruit armypersonnel in order to send a contingent abroad for service in the UnitedNations, that additional personnel would be considered as an extra costand the state concerned could be reimbursed accordingly. He explainedthat there had been precedents for this practice and cited the case ofSweden. He also confirmed what Mr. Liu had said regarding a formula whichallowed for a contributing state to receive a depreciation allowance onall transport and equipment used by the contingent in the field of operations,

The Foreign Minister said that he was quite satisfied with the infor-mationvhich he had received and said that his Government would now be ina position to complete arrangements for the dispatch of the Kenya battalionto the Middle East. He said that he would convey the information toPresident rlenyatta and that the exact date of departure would be conveyedto the Secretary-General in the near future. He added that on theinformation given,his Government would claim the pay allowances of theKenya contingent as s.n "extra and extraordinary cost". Furthermore, heexplained the intention of raising the question of the rates of reimburse-ment by the United Ilations at the next session of the General Assembly.

Mr. De Lauro remarked that the Federal Republic of Germany, which wasair-liftinp; the contingents from Ghana and Senegal, had confirmed that itwould also be able to provide transport nlanes for the Kenya contingent-about the 28th of January.

The Secretary-General asked the Foreign Minister to convey to PresidentKenyatta his warmest regards and best wishes for the future.
