For the past 25 years, the LSLC Forum for Shipping, Commercial Law & Dispute Resolution has placed before the shipping world the measures, developments and issues that really matter to maritime business.

In a constantly changing regulatory and commercial environment, the Forum has provided an unrivalled platform for informing, explaining and debating across an exceptionally wide spectrum of maritime, legal and commercial practice.

In 1994, the London Shipping Law Centre (the Forum), announced its arrival by highlighting the developments and theory arising from the Mareva Injunction. In September 2019, it focused on the implications of constructive total loss arising from The Renos.

In between these two events, there have been over 300 others, up to a dozen a year, run by the Forum, occasionally in partnership with other maritime bodies. These have included workshops, debates and special events but the predominant medium has been the seminar with interactive exchanges of views.

Presentations are given by three or four experts at the top of their game, including QCs,

barristers, arbitrators, solicitors, shipbrokers, mariners, ship managers, technical experts and representatives of public bodies.

The audiences, ranging from around 80 to over 150, are comprised of professionals in maritime-related fields from London, other parts of Britain and overseas. Many are already well versed in the subjects under discussion but are keen to learn more of recent and likely developments, sometimes in relation to their own immediate activities.

Proceedings are diligently orchestrated by the Chairman of the Forum and members of the Education & Events sub-committee and are usually chaired by present and former members of the judiciary, learned counsel or other members of the Forum’s Council. They provide context for the chosen topics, introduce the speakers and field questions and contributions from the floor. Some chairmen find these occasions suitable for airing their own views, perhaps laced with humour and even mischief, while ensuring there is much to be learned from the world of commercial practice.

Input from the floor has always been spirited, as attendees seek elucidation and make their own points.

When the formal agenda ends, generous hospitality is provided by the venues’ hosts, usually the Forum’s members, where speakers are hard pressed by persistent audience members wanting to know still more. Cumulative attendance at all these events has been well over 20,000.

In the course of a 25-year voyage, presenters have cast a net over causation and casualties, bunkers and bills of lading, tonnage tax and technology deployment, piracy and pollution, misrepresentation in contracts and mediation of disputes, documentation and dispute resolution, and a host of other concerns.

The most frequently visited ports of call have been the impact of regulations on shipping and ship safety, risk management, shipbuilding, insurance, arbitration, time and voyage charters, salvage, contracts’ construction and damages, collisions and new regulations. The ever growing raft of EU Directives and international conventions affecting shipping worldwide with their sometimes conflicting requirements have been steadily encountered.

The flagship events have been the Cadwallader debates. These have focused on civil law reform, pollution, eliminating ‘rust buckets’, criminalisation, collective responsibility for ship safety and the authority of masters, the roles of Flag States, Port States and Classification Societies, places of refuge for ships in distress, comparing ship and plane in respect of corporate social responsibility, terrorism, passenger ship disasters, and ship safety in relation to coherent IMO conventions and regulations. The particular requirements of the European Commission in the context of law making in international shipping have also loomed large in many of these debates.

The Forum has supported the activities of the Young Maritime Professionals group, set up by the Forum’s Chairman in 2011 and aimed at developing younger practitioners’ knowledge, skills and leadership, and at extending networking. They are meeting these objectives by organising their own educational and social events and have already spread their wings to Singapore and to Italy with similar activities. Within the next decade, these well nurtured young professionals will be the industry’s leaders.

“This 25-year celebration is a landmark event for our Forum which is essentially the industry’s

forum,” explains the Centre’s Founder and Chairman, Dr Aleka Sheppard. “It has achieved so much for education and business development within our industry throughout the period. Its success has been derived from the synergy created between maritime professionals, the valuable contributions made by our faculty participants, the invaluable support by the judiciary, and the continuing enthusiastic support from members and sponsors.

Dr. Sheppard concludes: “With such a track record of furthering education on both legal and commercial fronts, the Forum is particularly well placed to look ahead, providing an immediate platform for the biggest and broadest of questions to mark its quarter century:

Reflections & Perceptions

Lord Thomas of CwmgieddLord Thomas is one of the United Kingdom’s most distinguished jurists. He was born and brought up in Wales and graduated in law at Trinity Hall, Cambridge in 1969. He spent the next year as a Commonwealth Fellow at the University of Chicago Law School, graduating with a J.D. degree. He was called to the Bar (Gray’s Inn) and began practising commercial law at what is now Essex Court Chambers in 1972. He became a Queen’s Counsel in 1984 and was appointed a Recorder three years later. In 1992, he conducted the Department of Trade inquiry into the affairs of Mirror Group Newspapers and became a Bencher at Gray’s Inn. In 1996, he was appointed a High Court Judge and became a judge of the Commercial Court, being Judge in Charge in 2002-03. He became a Lord Justice of Appeal in 2003 and was Senior Presiding Judge of England and Wales for the next three years.

In 2008, Lord Thomas was appointed Vice-President of the Queen’s Bench Division and Deputy Head of Criminal Justice, succeeding to the Division’s Presidency three years later. In 2013, he was appointed Lord Chief Justice of England and Wales and served until 2017. He was created a life peer, as Lord Thomas of Cwmgiedd.

Lord Thomas has been heavily involved in the advancement and development of the law on a range of domestic and international fronts.

He helped found the European Network of Councils for the Judiciary and served as its President (2008-10). He is President of the Qatar International Court; Chairman of the Financial Markets Law Committee; First Vice President of the European Law Institute; Chairman of the Welsh Government Commission on Justice in Wales; President of ARIAS (UK); Past President of the British Insurance Law Association; a Vice-President of the British Maritime Law Association and Vice-President of the LSLC Business Forum. He is joint chair of a project with the American Law Institute on the data economy.

Lord Thomas is Chancellor of Aberystwyth University, an Honorary Fellow of Trinity Hall, Cambridge, the holder of Honorary Doctorates from four universities and a Fellow of the Learned Society of Wales. He has lectured on commercial, constitutional and other subjects around the world.

The Lord Thomas and Matheos Los will draw on their legal and commercial experience respectively to encompass the role of the LSLC in promoting understanding of maritime developments and issues.

Matheos Los has enjoyed a long career in Shipping, very much in an international vein and has taken a considerable interest in the issues affecting the industry.

Born in Chios in 1944, he went to Lower Canada College in Montreal and to Haileybury in England. He attended Neuchatel University, Switzerland, gaining his Licence en Droit in 1968.

After a year with a shipbroking office in New York and a spell of 4 months at sea, he returned to England to complete his LLM at University College, London in 1970.

The following year, he resumed his shipbroking career with C M Los (London) Ltd joining the board in 1974 where he served as a director for 35 years. “This period of service allowed me the opportunity to face almost every type of commercial problem that could arise across the ship broking spectrum, from revolution ashore (Iran) to revolt aboard (politically motivated crew refusals)”. He retired in 2009, when the London office business was transferred to the main Piraeus office.

Throughout his career, Matheos Los has been very active on various fronts in the wider maritime industry.

He was a member of the Greek Shipping Co-operation Committee in London for over 20 years. He served on the International Chamber of Shipping’s Insurance Committee for more than 25 years to 2015, during which time he helped establish closer bilateral links with underwriters both at Lloyd’s and abroad to discuss pressing shipping insurance issues.

He was a director of the West of England P&I Club (1980-2016) and the Hellenic Mutual War Risks Association (1982-2018), chairing the former from 2008 to 2016. This period saw the West of England’s S&P rating rise a notch to A-. He was very involved with the International Group of P&I Clubs in their successful efforts to counter the EU Competition Directorate’s challenge to the P&I clubs’ pooling and reinsurance arrangements for dealing with large claims.

He has been a long standing member and remains a keen supporter of the London Shipping Law Centre. Matheos Los seems well placed to consider at least a few of the lessons the industry has learned from its past - and how it might progress.
