DESCRIPTION

The state-based movement in support of sound money has spread quickly as Louisiana becomes the second state to eliminate taxes on gold. The Louisiana Senate passed by a vote of 25-10 H.B. 682, a bill which removes the sales tax on gold and silver currency and bullion. Existing law only exempts taxation for purchases of $1,000 and over. This gives lower and middle income citizens the ability to acquire hard money without a regressive sales tax burden. By removing taxes, it implicitly recognizes gold and silver coins as money.

AN ACT1

To amend and reenact R.S. 47:301(16)(b)(ii), relative to sales and use tax; to provide for2

definitions; to provide with respect to the definition of tangible personal property;3

to provide for the definition relating to gold, silver, or numismatic coins, or platinum,4

gold, or silver bullion; and to provide for related matters.5

Be it enacted by the Legislature of Louisiana:6

Section 1. R.S. 47:301(16)(b)(ii) is hereby amended and reenacted to read as7

follows: 8

§301. Definitions9

As used in this Chapter the following words, terms, and phrases have the10

meaning ascribed to them in this Section, unless the context clearly indicates a11

different meaning:12

Abstract: Removes the dollar value threshold for the sales and use tax exclusion for gold,silver, or numismatic coins, or platinum, gold, or silver bullion.

Present law provides definitions for purposes of state and local sales and use taxes.

Present law defines "tangible personal property", and in such definition excludes from thetax base gold, silver, or numismatic coins, or platinum, gold, or silver bullion having a totalvalue of $1,000 or more.

Proposed law changes present law by removing the dollar value threshold for the sales anduse tax exclusion for gold, silver, or numismatic coins, or platinum, gold, or silver bullion.
