The application is made on the prevention of crime & disorder and public nuisance licensing objectives as it is the opinion of theMPS that the venue will operate as a late night bar/club. The current operating schedule is not deemed appropriate in reducing therisk to the licensing objectives.

Please provide as much information as possible to support the application: (please read guidance note 3)Mario’s Corner is a large two storey premises situated within the purpose built Leegate shopping centre. The shopping centre issurrounded by residential premises.The premises was granted a premises licence when it was trading as a restaurant. The operating schedule on the current licence issuitable for a restaurant providing Late Night Refreshment, however it is also authorised to provide Alcohol & RegulatedEntertainment into the early hours.

In 2013 the current Premises Licence holder Mr Dion Simpson took over the licence. The MPS visited the premises and identifiedthat it was now set up as a bar with a nightclub being set up in the basement of the premises.During the visit the MPS identified numerous risks to the licensing objectives as the operating schedule on the premises licencewas not suitable for such a venue.The layout attached to the licence had also changed from a restaurant to a club1bar, something that would have required anapplication to vary the licence.

During the meeting with the MPS, Mr Simpson explained that he had already been approached by several promoters who wantedto utilise the venue. It is common practise for promoters to look at venues with late night licences to operate in.The MPS provided numerous recommendations to Mr Simpson on how the venue should operate to ensure the licensingobjectives were upheld, however these were not included onto the operating schedule, so not enforceable.

Shortly after the meeting the MPS became aware that Mr Simpson had been evicted from the premises. The Premises Licence wasalso suspended in due course following non payment of the annual fee.The MPS have tried to make contact with Mr Simpson on several occasions without success and it is believed he no longer hasanything to do with the premises.

As far as the MPS are aware no licensable activities have taken place since December 2013 at the premises with the layout stillbeing a nightclub.

As the licence is only suspended any person can pay the outstanding fees to trade under the current licence.

In 2015 following interest from a local promoter/club owner the MPS arranged a meeting to discuss the plans. It was immediatelyobvious that the plans were to open a night club, with promoted events.Operating as a nightclub would require numerous conditions on a licence to reduce any risk to the licensing objectives,unfortunately they are not on the licence and it would be very difficult to impose such conditions immediately.This interest did not continue however numerous other enquires have been made into the premises and licence. All research intonames of those interested heavily link them to promoted events in London.

Due to the licence authorising Regulated Entertainment and Alcohol to 0300 and the fact it is only currently suspended, it isextremely tempting for a promoter or club owner to commence operations with very little financial outlay. As there are currentlyno enforceable conditions that would reduce the risk a nightclub/bar poses to the licensing objectives, this causes great concern.

If the venue does again wish to commence operations it would be the expectation of the MPS that conditions are added to theoperating schedule to reduce this risk.

Conditions which would prevent public nuisance would be required and would include: Noise reduction and dispersal policies

Conditions which would assist the prevention of crime and disorder would include: CCTV, Door supervisors and staff training.

Annex 1- Mandatory conditions

No supply of alcohol may be made at a time when no designated supervisorhas been specified in the licence or at a time when the designated premisessupervisor does not hold a personal licence or his or her licence has beensuspended.
